Someone else in another thread suggested to me that I call the 800 # and inquire about my case. They had a simialr situation where their case had been touch, but no real updates. So, at her suggestion I called. Boy was I glad I did. My petition was approved last week on Friday. YEAH!!!

I find both parties here disturbing. She may have been looking for a sugar daddy - but he treated her like a #######.

I suppose marriage is whatever two people believe it to be - and however they choose to live out the kinds of promises they make when they sign the contract. But this kind of situation and story disturbs me greatly. Am I culturally insensitive? Overly romantic? Perhaps both. But there's a ton wrong with both of the parties here - that's the impression I get from the information the OP provides. And age has nothing to do with it.

And yeah, I'll say it - the thought of his application taking up space and time in front of mine and a lot of others makes me angry. This is a guy who is only close to loving this woman that he clearly doesn't trust anyway - and he has said he thinks she isn't as close to loving him. i have not posted often, but as a woman i feel the need to respond to your post.

unfortunately for you, i don't this woman really wants to be with you. i strongly advise that you get out of this situation before you are out more money & more heartache... the fact that she left 2 days earlier than planned says a lot about her. I'm quite sure you spent a lot of money going there to see how and this is how she treats you??? of course, she is going to call back & be nice. she realized that she might be throwing away her "meal ticket" to the US. The age difference also bothers me a lot. I absolutely do not mean any disrespect to you, but I am a 42 year old woman & I would NEVER think of dating a 61-year-old man. Does this woman have children?? Does she want children?? If she is acting this way now before she gets what she really wants, a visa, how in the world is she going to act when you bring her over here??? I understand that you want to be generous to her & give her money & buy her things, but you need to ask yourself would she want to be with you if you weren't doing those things.. I think you seriously need to evaluate this "relationship". take a step back and take a very, very good look. I do not know this woman, but judging from your post i honestly think she's an opportunist & she is in this for all the wrong reasons. I just want to interject that although I agree with the majority of your letter, I take some offense at the mention that it is impossible for a 40 something to love a 60 something. Ican and do love a 60 something and i am 40 something. He has nothing and neither do I except the great love and attraction for each other and many mutual interests too!!!!! Sorry, off the topic I know, but that is not a valid reason in and of itself. That said, I think he should run as far away from this woman as he can, and I feel quite certain he knows that!!!!

Ah now I see the mix up, They think HE is the German! That’s why they want your German birth record in English. Seriously though I've never heard of them asking for the beneficiary’s birth certificate in the K1 petition. Its normally asked for at the interview.

i used a white out on G325A because I wrote my fiance's mom birthday instead of a year 19XX i used 09XX
so i white out it, obviously it's understandable it's only a human error since there is no way she could of been born in the year 09XXXX

i am waiting for my NOA2 and i was hoping for no RFE and now you are scaring me :cry:



Not Trying to scare anyone just remember for future reference not to white out. An error like the one you described most likely would not be cause for rejection.

Just remember it is at the discretion of the adjudicating officer who reviews your case most of who are fairly sensible. ;-)

My fiancee had sent me signed G325 forms and I made a small spelling mistake while writing her fathers name on the forms...is it ok to use a white out etc? (since I dont have extra signed copies :( )


I'm a passport ecceptance agent and if we see whiteout on any application form they are rejected. The reason is that how do future adjucators know if the whiteout/changes were made before or after it was signed.

As with any government office you are dealing with people and they can be subjective in what they accept so it may or may not go through but I wouldn't chance it.

The normal procedure would be to draw a single line through the mistake and write the correct version near it. We want to be able to see what the mistake was as a method of fraud detection. In this situation I know its a PITA to get another signed copy and I'm not trying to stress you out but you don't want a RFE.

Why? Her signature is her signature.... If you look at mine you would have no idea what I wrote but it is how I sign everything.


Lol! I thought it was just me and my wife that grappled with this. She is also from Ukraine and made her "signature"...I looked at it and was like whoa...wth is that? I finally convinced her to sign one set of G325As the way she normally signs things, then had her do another version where she spelled out her entire name. It was sort of strange for her though...in her words it was "un-natural" to change the way she had always signed her name. After thinking about it for a while,. I ended up using the spelled out version. Besides, her original signature that she did had her old last name even though she took my name when we married.


I did the same thing with Susanna and brought both versions back home to file. I first asked a American/Ukrainian couple how they did it or which one to use and they told me to use the spelled out one or risk having troubles later on. She also told me to use her patriarchal name as the middle name even though I argued that it wasn't really her middle name that’s what they wanted to see. But as I posted all turned out well and the petition was approved no questions asked.

Hi everyone,
Just got all documents from my fiance in Ukraine. Ready to send I-129F out. Fiance`s signature looks like her last name, or initials, or combination. She says ukrainians do not do full name like americans. IT MATCHES HER PASSPORT SIGNATURE PERFECTLY. Anybody know anything about this??



Its better to have her sign her full name and even her Patriarchal name which will become her middle name in the USA. I believe it begins to matter more for SS number and other things later on. I agree with the poster that said she should sign as is recorded in her INLT passport (and not her propiska).

This is how we did it and had no problems. However, a good rule of thumb is to sign what best represents you, But if it bears little resemblance to her true name it could be questioned by the adjudicating officer.

Remember, she is coming to the US and things should be done in close accordance as not everyone handling the documents understands how things are done in Ukraine.

You do not have to arrive from the country of the issuing post. Many countries do not have direct flights to the US and you are required to travel to an intermediary city while enroute. When my fiancee comes, she could arrive in the US on a flight from Poland, England, Netherlands, or a host of other possibilities any of which we could stop and take a vacation in that city for a few days or few weeks while we are enroute....



Your wife being from Ukraine I believe needs a visa issued from that country in order to vacation there even if its en route to USA. The exception would be a country she could travel to without a visa such as Poland. So I don't know think she would be able to leave the airport in this situation.

Sounds like a good idea to me. If she never actually used the new one, there is probably no reason to keep it. I would also suggest she check with her local police office to find out the appropriate disposition of having two passports and then follow that advice.

If you can't lay hands on the original passport, then it is lost - whether its lost in your house our out in town square. So if you say 'no' to has your passport been lost or stolen, then you take your new passport -the one with an indication inside that it is a replacement - to the interview -- doesn't match up with your answer on the form.

Passports get lost all the time - it happens. If you're concerned about answering 'yes', then fwaguy's suggestion makes sense.

Or hey, say 'no' and then hope beyond hope that they don't realize it and think you've lied. Whatever - its your visa journey.


If you say NO and the passport clearly shows its a replacement then you're in trouble. Answer YES with an explaination like fwaguy said is the best answer in my opinion.

well since i live here in New York, pretty much there are many many phone cards that give you about 1 hr caling time to the dominican republic, and they are only 2 dollars, Now i have over 100 of these aved, and since i was reading the guides i saw that it stated that it wil be good to show calling receipts or etc, but i used these ards because they are affordable and convenient, should i do something, send them, copy it send or what.... thanks



I also use phone cards to call Ukraine but just so I have a record on my phone bill I use my long distance service about once a month for a half hour.

Congrats on teh engagement! My fiance and I were in the same situation and we decided on the K-1 and having a party over there after. Doing the wedding officially in the UK and then coming here with the K-3 also means doing 2 visa's (one here and one there) ie. more money and time. That is a concern for us, dont know if it is for you. The cival ceremony isnt bad here though, just go to the courthouse. Dont need to do lots of planning! I hate planning so I totally understand...

For your question 18 on teh I-129F you dont BOTH need to submit a statement each 3-4 pages long. They just want to know how you met. People seem to do 3-4 sentences up to 1 page. Feel free to submit all that but it probably wont all get read. Ours was 3 paragraphs and mainly included dates of meeting and visits

We are getting marry in June. I live in London, my fiance live in DC. We are assembling the package for submission. Anyone know how long does it take to apply to the USCIS and how long does it take to the US consular in London?

They JUST updated that form. I filed on Jan 26th and it came out a few days before that. There were lots of problems downloading it too. I just got lucky and could get it. My fiance went through Chicago once and didnt have any problems. Pretty typical. We've had more problems in Detroit.

To timsdaisy, I went to the UK and said to visit boyfriend. They asked how we met (him studying here) how long I'd be there and where I'd stay. He surprised me with a trip to Prague while we were there and we got engaged on that trip. On the way back through immigration I said fiance and said we'd just gotten engaged. She asked when I was leaving and said congrats and that was it. I had more problems when I said I was visiting friends to be honest!

Tell as much of the truth as is relevant. Answer questions honestly. Neither obfuscate information nor volunteer unrequested details. That's what a lawyer would tell someone on the stand. Do not lie. But it isn't your job to give a reason to be refused entry.


I'm in much the same situation as blspicer and msu17 (except we're already married.) We think he'll probably get in, but he's got to be prepared mentally for possibly getting turned back. (And financially prepared - it's unclear to me how easy the airline would make it for someone to just hop on the next plane back.)

Here on VJ, the consensus *seems* to be: don't lie, but don't offer any "extra" info; bring stuff to show some intent to return. We're thinking of buying me a plane ticket to fly back to France with him on the date he's scheduled to return. However, we're not sure I can really go at that time, so we'll probably get a refundable/exchangeable ticket. Those cost an arm and a leg, so our idea would be to "return" it -- still checking on if there are catches with getting refunded for a plane ticket -- does anyone know about this? Also, any opinions on whether such a ticket would just look like a ruse to official at the airport?

Some folks also suggested having your SO fly out of Ireland, as he can actually clear immigration in the airport there, before leaving. That way, if he's rejected, at least he's on the right side of the Pond. (We've actually decided not to go that route, but there are some threads about that here on VJ.)

Does anyone know how friendly/easy Chicago is as a POE?

Same situation here! Mine is coming in April. From what I've read on other posts, it is really up to the official when they go through immigration. Make sure that he has LOTS of evidence of his intent to return, ie letter from employer or similar, apartment lease, family there, bank accounts, school etc. Being from the UK, I think we have a bit of an easier time that those from other countries, and most people seem to get through just fine. However they DO NOT have to let him in, and from what I've read it can slow up the visa process. We decided to chance it, but it is a gamble.

I am going to file the Fiance Visa forms on February 14th. My fiance, who is english and on the visa waiver program, wants to come over for a visit in March and stay for about 2 months. Will this cause problems and will they even let him into the country. I've asked two different attorneys and i've received two different answers. He will return to England probably before the visa is accepted but I didn't want them to deny him entry in March after we've payed for the plane ticket. If anyone has any idea please let me know. Thanks.

If the marriage is not legal in Argentina and is only (hate to say the words, but please dont be offended!) for "show" ie religous reasons or for fam then I am pretty sure you can (please do more research on this though!). However if that is considered legal in Argentina, you can't get a K1 and would have to do the K3. Anything legally recognized in Argentina will mess you up. Not sure what to search under but I know there are other similar questions that have been asked before. Brouse around and see what you can find. Good luck on finally getting to be with your SO!!! Hope everything is as wonderful as can be!!!

Thats what we are doing too. Lookign to get married around then. I just went around, talked to all the people (cakes, photos, reception) and explained the situation. They are all being really flexible (since we are doing it on a weekday) and said to just give them a call when we know a date. Once the visa is in hand, I have my list of numbers ready to call so it will hopefully get pulled together ASAP after that :) Good luck!!! You should make that October date, at least we better get our interviews by then ;)

Yup, K1 if you guys are unmarried. My fiance is from the UK as well. We are having the wedding here and then after (prob December) we're going to do a reception over in the UK with a video of the ceremony so his family can see that. If you have a ceremony that isnt a legal marriage BEFORE the visa you may be ok, but please check on that. If you have a legal marriage in the UK while the K1 is processing, that's bad... 1st real (ie legal) ceremony has to be in the US for the K1

We had around 50-75 pages of evidence of meeting and a relationship. I included airline tickets and itineraries, reciept of ring and ATM reciept showing my fiance in my town. Submitted 4-5 emails, 7-8 pictures, evidence of us being at the same school at the same time and a few engagement cards. I really think you can cut down the 300 pages, and definitly eliminate the items without your names on them. That doesnt prove you were with your SO. Good luck on the app!!!

1. As stated, no problem. You have a 1-94 so you can fill that in and maybe give the date he's leaving (just a suggestion I heard from another poster)
2. USCIS, and both petitioner AND beneficiary send one
3. We are going to try it. My FI is coming beginning of April. In talking to people etc, the people getting sent back most of the time had good reasons to be sent back. They either had no evidence of any ties to their home country or had overstayed before. Bring LOTS of stuff, like a lease, letter from your job, if the non-USC has children, show that, any papers if you;re in school etc. I know on the London website it specifically states you ARE allowed to visit, just bring the evidence.

Kim and I are just starting to gather documents and filling forms for a K1 visa. We know it's going to be a long and tough but we are prepared for it. We were so glad to find this site which is such a gold mine of information. I have 3 questions though for which I couldn't find answers so here they are:
1- Is this a problem if we send the application while I (I'm french by the way...) am visiting her. I managed to take 3 weeks off and I'll be visiting her. We read that I should not try to visit her while the application is being processed as there's a risk of being denied to enter the US so we'd like to send it as soon as I land so the 3 weeks I'll be spending with her will be three less weeks of being apart.
2- In the letter of intent that I'm filing, what address should I put because I didn't get if I should put the USCIS address or the embassy's address. Do I have to put the USCIS address on the letter that the petitioner will send and put the embassy's address on the letter that I'd be sending to the embassy eventhough I didn't read that I should send any letter of intent to the embassy.
3- Has anyone tried to enter the US while the K1 application was being processed? What are the real risk except being denied and what are the chances of actually being denied. Ok for this last quesiton I might not have search the forum enough :)

Silly embassy!!! Though I guess it makes some sense. Anywho, again if it were me, I'd call the service center regarding the G-28 and see how long it takes to file etc. ALSO, perhaps have your fiance call the embassy to see if they can send you the forms or what has to be done to have them sent to him. I heard at least at the UK embassy they can resend the packet since things get lost in the mail every once in a while. If you do stay with the lawyer, make sure he gets you packet 3 as soon as it comes in.

There was no real negligence in your case, so you probably cant report him to the bar, but maybe the better business bureau? If nothing else, let the lawyer who recommended him know what a horrible job he did!
