Even if you didnt have the issue of visa fraud (silly intent...) I dont think it would wind up being any quicker. Not sure what Germany's interview timeline is, but I'm pretty sure its not a crazy long wait. You are going through Vermont, so assuming nothing goes wrong, lets say you get the approval in 3 weeks. 1-2 weeks for NVC and the mail. Lets say 3-4 months for the 2nd half of the process. You are looking at 4-5 months (assuming no complications). If you were to go the work visa route, she would need to find a job, interview, them to submit the paperwork etc. Just to find a job and get hired would probably take 4-5 months in itself! K-1 is the way to go

Welcome to VJ! You two are so lucky you could be together for such a long period, I'm jealous! Are you filing through Vermont or California? Filing in October (or around there) should work for an August wedding, but there are always possible complications you should be prepared for. Another option is filing now, moving here as soon as you get the visa and doing justice of the peace. Then having the big wedding without any worries regarding the visa (hopefully!). That is a fairly popular option around here.

You can visit during the Looooong wait BUT make sure to bring LOTS of evidence that you intend to return (work letter, student status, bank accounts etc.) The NOA packet one just holds a document stating your packet is recieved. I dont have the second one yet, so I dont know what comes in that other than a similar document stating you've been approved.

Welcome to VJ and congrats on the engagement. Yes she can mail off the petition while you are in the US. Read the timelines and processing time at the top of the screen, they give a good idea of how long things take. Where is she filing? Through Ca or Vt? Fill in your timeline so we can help a bit more :) The entire processing will take longer than 3 months and you will need to return to your home country for a medical, police check and the interview. Also they mail the instructions from the embassy to your home, so staying in the US once you've been approved will probably delay you getting the visa.

I believe she mentioned she was in graduate school. Speaking as someone also in grad school, you make it work. I will be oh 27 when I graduate... Its called student loans, savings and my fiance being the main support. I add my voice to the 1% however ;)

Also, even though you cannot support your fiance, you will be required to fill out an I-864 yourself. Might take some explaining if the addys are the same & you haven't filed in years. They might wonder how can you possibly support someone if you don't work, don't file taxes, aren't a student yet you are being supported, and NOT by a family member.


I am currently a student and have been since i was...4ish. lol


So are you graduating soon? Most college students have worked ast some point in their lives...and filed taxes.

How can you support someone if you are still in college? Even with a co-sponsor there are MANY red flags here. Be prepared to face them. Not to mention you 'lol'ing your own student statement - are you even mature enough to have 2 men?

That is what I did. Wrote a brief 2 sentances on how we met and then "see attachment". I then included 3 paragraphs, the first one stating how we met, the second and third stating the dates of visits after that. I then included the passport stamps for these, boarding passes, pics etc to show we actually did meet each time.

So what is the average wait time to get the approval, using a K1 Visa attorney? I was looking at the graphs and it looked like 4 months, but I see others 9 month long timelines...



This is going to depend on where you file through and the consulate. Vermont is super fast and approvals come through USUALLy within a month. Cali is slow, around 3 months (if your lucky) is standard there. Then embassy wait time is extremely variable. Look up timelines of those with similar consulates and service centers.

All the ties to the home country are only for if he visited. The whole purpose of the K-1 is to allow an immigrant to enter the US WITH the intent of marrying and staying, since without it would be a violation of immigration law (to stay that is). That is why you cant just wander across the border now and get married sans visa...

Thanks for that website it was helpful, a few questions for you....

1) Why is the K3 optional?
2)I see that it ranks Duration to entry of the U.S. between these options as shortest long longer etc, Do you have any idea what sort of time frame these equal, e.g. is longest 5 yrs or 1 yr or 7 months etc. Any ballpark figure would help.


1) There are several options for visa's once married. However you CAN'T use the K1 if you are already married. Head on over to K3 or Cr1 forums for opinions on which of the marriage visa's is best.

2) To the UK, through the Cali service center, I think we are running around 6-7 months from start to visa in hand for the K1 (as long as you dont get stuck anywhere in the process). That's assuming that you submit everything as soon as you can from the embassy etc. Check out the timelines for those in the Uk for each different type of visa.

For us, the decision came down to being apart. We knew for us, it would be more difficult to be apart as husband and wife than as an engaged couple.

I am currently at the start of the visa process e.g finding informtion and forms and I was wondering do many people use a lawyer to help their finance visa process. I have read the benefit being that they add credability to you being a couple and obviously keep track of your affairs. But in general are they more advantageous to have or not in the application process?

No you dont NEED a lawyer unless your case is not "usual". This process isnt excessively difficult if you have the time to learn about it. Most of us here dont get them, we are a "do it yourself" site. You are from the Uk, and they aren't especially suspicious of us, nor has anyone here mentioned (that I've seen) that lawyers add much credibility. They can't speed things up, and can hinder the process if they dont know what they are doing. If you do go with a lawyer, make sure to stay on top of the process anyways

Are they doing DCF again? Anywho, look into the tax situation, since you still need to file the I-134 with the K1. On the forms, I believe they say use the last address in the US you had. Which would be Ok, not the military base. Regarding the wedding, look into having it on a weekday. Most places dont book up for Thursday nights so you might be able to get what you want on very short notice.

I won't have a job when I first move to the USA - we are staying with my mom until we get established, which shouldn't take long. This means that I cannot file the proof of support for my spouse, which I think means we cannot file for DCF. I have also not filed US taxes in about 8 years - I was told that because my income was not US income that I did not need to until I return to the USA - also a factor in the DCF.

We probably will wind up having a very small ceremony when we get there. You are right, planning something like a wedding is hard when you aren't sure about the timeline. There are a few venues that I love, but without a date I cannot book one.

My fiance Pete is 41 and I will be 31 next month... altho we will be sending out our paperwork next month, our relationship has been ongoing for over 2 years. He's from the UK and I'm from the US....He's flown back and forth regularly, and I've taken a trip over as well. Thing is..I can't see them holding an age difference against someone..that would be discrimination. To the poster..you haven't anything to worry about... 6 years is nothing. Now I can see them delaying it over a 21 year old wanting to marry a 60 year old...out of possiblilities of fraud (and a gold digger) :jest: Otherwise...don't worry... Love isn't based on age.

I was audited by the Internal Revenue Service one time for taxes after my divorce..They wanted me to prove that my ex husband was indeed out of the house... needless to say, I faxed to them about 35 pages of proof which included written testimonials from family and friends, the letter from the post office showing mail addresses changed, a written letter from my landlord at the time, etc etc...needless to say... they never questioned me again..and sent my refund right away :jest: So, I kind of place the information needed with this petition in the same category... If they want proof...by golly, I'll send it...haha :P


I did however want to say thanks everyone for the support!! Pete and I have visited this site regularly for well over a year now.. getting information and just reading. I thank everyone for sharing their experiences and thoughts, not to mention...being genuine when it comes to helping one another out.

Lol.. Thanks for all the quick responses...

TimsDaisy-- yes, it was the G-325A...thanks for pointing that out! :) As far as supplemental information..I downloaded the I-129 from ucis.gov for the latest version. I used the Adobe Acrobat to fill in all information..so it fit pretty well. Pete signed the "older" copy of the G-325A that has the carbon copies attached to it (I made sure that the date on it was still ok to use) I downloaded mine again from uscis.gov and filled mine in...printing out all 4 pages and signed them all.

As far as pictures go... I figure I'd save my original pictures for the interview itself. I scanned all the pics I'm using or I had them on CD when developed. I just printed 6 photos on each sheet of paper with dates and text of what the picture was of below each one.

I suppose after a year and a half being engaged... we've finally set our wedding date for February 23rd here in Ohio, I just want to make 110% certain everything was ok..lol :P

:wacko: Ok.. I think I have everything assembled...and have checked it over dozens of times...and of course I keep finding something to add. I figure, if they want proof...I'LL GIVE IT TO 'EM! Pete and I did meet over the internet, and have been engaged now for a year and a half. We've had an ongoing relationship for two years. I followed the assembly instructions for the I-129 here on visa journey.... I'm just afraid I'm leaving something out...I don't want them to send it back saying they need more info or anything like that... SO, any input would be great from those of you who have already completed the process, or have already mailed yours in and have had it "touched."

Here's what I got:

-The Cover Letter
-I-129 Petition (completed and filled out by me)
-Declaration of How we met
-Fiance Letter of Intent (signed by me)**for both I used the guide on visa journey**
-Fiance Letter of Intent (signed by Pete)
-Phone bills from April 2005-2006 from Pete (England)
-Copies of all of Pete's plane ticket stubs/Itinerary/and passport pages
-copies of dated letters/postal stamped envelopes that I sent to Pete

Ok..where I'm worried at is..when Pete and I first started talking, we met off of a site I was able to access thru my mobile phone. We always inboxed there or sent text messages. I do not have that phone service anymore...and I'm horrible about keeping things...I burnt all my paperwork (phone bills basically) before I knew we would need them...not thinking our relationship was going to lead us where it has...finding soulmates in each other... I do have several bills from last year I am able to use.

For the G325, That's just the Biographical information on the both of you. Yes, both individuals have to fill out separate forms.

As far as the Fiance Letter Of Intent, It's just a statement that says you are free and eligible to marry your fiance after entering the United States within 90 days. As stated in the post above, If you go to FORMS, there are samples you can download for the Fiance Letter of Intent.. I used VJ's download and just changed it to fit my needs. Also there's all the information there you need when it comes to assembling the I129 packet if you are doubting what the lawyer has said. From reccommendations, it's best to be cautious of some immigration lawyers...have them checked out before you pay any fees to them.

You might have some trouble when you fill out the Affidavit of Support.
If your income is below the poverty level you will need to get a co-sponsor.

Just to make my question a little more clear. I have filled out the forms that come with medical bills to get the hospital to pay because they were big bills. I qualified because I had little to no income to cover them. I was recently in a car accident and I am going to try to get those paid because they were the sum of $4,540. I am just wondering if they look at that? (The visa people) It goes through the hospital and stuff so I am thinking no it's not even an issue. But I like to worry about all kinds of things. I am not getting government assitance or anything like that. Anyone?

Someone else in another thread suggested to me that I call the 800 # and inquire about my case. They had a simialr situation where their case had been touch, but no real updates. So, at her suggestion I called. Boy was I glad I did. My petition was approved last week on Friday. YEAH!!!
