My fiance and I signed our I-129F/325 documents on different dates. She signed hers while in Thailand, and she wrote in the date. Then, when I received these documents I signed and dated them. They documents are dates 3-4 days apart.

Also, my attorney who signed the documents signed on a different date as well. ????????????


Is this going to be a problem?

Is there some sort of requirement that the documents be signed by her and I on the same date?

Thanks fellas! So it wont matter about my attorney either? According to the papers, it shows he signed prior to my fiance and I. almost a month prior!

I've got an attorney handling all my paperworkd. He did not send me a cover letter to include with my package to send to the service center.

Is the cover letter really necessary?

My lawyer did include a document signed by him that states "Copies are exact photocopies....I understand the Consular can ask for original copies at any time." (or something like that)

So, do I need to type up a separate cover letter to include?

Well, it is coming up to 30 days now since NOA1.

I hope I pre-empted an RFE by submitting the correctly signed G325A for me with a covering letter marked with my receipt number and contact details.

HOWEVER - We have the wedding all arranged for the 28th July 2007 (booked it, packed it etc), and I really dont think now that it will all come through in time - it seems to me generally to take 90 days to the day for interviews etc which would put us inside of August.

SO - does anybody know if there is an effective way of contacting the consulate. Is it worth telling them this - I have evidence of all of the arrangements? Is there a chance of pulling forward the interview assuming all other things run smoothly?

Otherwise, would I have to leave the USA after the wedding and sit through another 6 months of isolation awaiting a spouses Visa?

I was wondering if the I-134 becomes a binding document after you are married or does the I-864 override it? Also how do you know it is non-binding?

I've kind of glanced through this thread, hoping to find some info about our particular situation. Phill just entered the country on the K-1 on May 2 with the hope of getting the temporary work permit when he entered thru JFK. The flight that we scheduled left London Heathrow with a stop over/connection in Shannon Ireland. The glitch happened when he got to Shannon. They told him he had to go thru US customs there! He didn't understand what was happening but didn't want to argue with them. He handed them the sealed envelope from the Embassy and they processed him and gave him the I-94 in his visa. When he asked about the work permit, they told him they don't give them. He was quite upset. So he just decided to get it sorted when he got to JFK. When he got to JFK they said they would have issued the permit but since he was already processed and didnt have the envelope from the Embassy anymore, they couldnt issue it.

What I need to know is: Can we submit the I-765 now? The lawyer we went thru, (who has been wonderful every step of the way) said that this must be done after the AOS is filed, which is after we are married. Phill wanted to be able to work and contribute to the cost of the wedding, among other things. I was confused by the lawyer's response because the instructions for the I-765 form say that someone with a K-1 is eligble to apply. Which is true? Can we apply now or do we need to just get married? I would like to be able to get this form sent in if it isnt a waste of time. I know there are many things that you have to put up with, but it just seems strange that a person who is getting married may not be able to work to earn money to contribute to the wedding. It greatly affects what type of wedding you can have.

Any information would be greatly apprieciated or just point me in the right direction for answers......

Hey there, so sorry to hear of your situation! I'm SO glad I found this before considering a lawyer. Check out what Huskerkiev said in this forum http://www.visajourn...h...c=56073&hl=

"Also keep in mind you need to keep your G-28 form (Entry as Atty or Lawyer) current if there have been any changes in this. Some of you have said you stopped using a certain atty, so you need to update this with CIS."

If it were me, I'd call the SC to check how long this takes etc and then change the G-28 ASAP. I would still think the embassy would send packet 3 to your fiance since the non-USC needs to sign everything etc. Why send a packet to the USA to be sent BACK to Germany? But it is the government, so who knows :) Good luck!

Okay, another question regarding firing my attorney: The NOA1 went to his address as opposed to mine. The NOA2 is currently in the mail, and I assume it is also being sent to his office since the first notice did. Does that mean that my fiance's packet 3 will also be sent from the embassy to my attorney? I've read a couple of posts where it seems like that happened. And I imagine that will add time. If I do fire my attorney now and if packet 3 will be sent to his office as opposed to my fiance's home in Germany, what will happen? Is it possible to get all that changed in time if I fire the attorney or am I better off just keeping him because it will complicate and lengthen our wait time?

I'm so frustrated. :( I wish I had never hired him in the first place.

Can my fiance apply for and use a tourist visa because she we won't get our K1 in time for our July wedding in Thailand. Meaning if and when I go over there to get married in July and we don't have our K1 visa yet...can she apply for the tourist visa in advance so that she can come back with me to America?



You can always apply for a toursit visa, but she probably wont get it with the K1 pending. When did you file the K1? Put up a timeline etc that would help! If you have a legal ceremony in the PI then the K1 is the incorrect visa for you, as someone said you need K3 or CR1. Even if you were to file the K1 now and didnt have an official ceremony in July, she would probably have her interview only a month or two after.

AugustJim, SO true!!! Oh well. Yes, you still need to show evidence though coming from a VWP country. Several people from the UK have told me they were questioned and asked to show the evidence and at least one was sent home (though I think he'd overstayed previously). There have been several posts previously about this, so search a bit and you may find some more info. Any which way, staying for a shorter period of time rather than a few months will look less suspicious. Also consider going back a week or so after NOA2 so your fiance will be home to get packet 3! Since you have been in his country, I'm guessing you may have not spent that much time apart (lucky you!) so feel free to ask if you need any tips on good ways to communicate long distance :)

Also for the period of unemployment, just write unemployed. So new job she has, unemployed, old job she quit etc. You need to write it on all 4 pages and sign all 4 pages. Since she needs to do that, might as well have her sign the letter of intent to make sure you dont get an RFE for that as well. Check out the guides, they have samples of all the forms filled out which I found really helpful. AND they saved me from my fiance asking 500 questions about the forms as well ;)

Not sure on the first part, BUT, you have to be in the US after the marriage. You file for advanced parole with the AOS application. That takes around 3 months I think to come in. To work in the US, you also apply for the EAD at time of AOS. Again, around 3 months and then you can legally work here. When you get your greencard, then you can also leave the US and work without AP or EAD. I know its frusterating, especially since you live so close to the border!!!

First of all it is in my nature to worry.
I posted yesterday and received an answer, I did call NVC and they told me my packet was sent to the US Consulate in Vancouver on the 23rd. OK that is good news....phew...
Now I am wondering when they tell you that you need a physician appt (I already have one scheduled for Apr 12, by the approved DR)...do I need the results before I fax my checklist in???
Also I've heard that I need originals and photocopies of BC, Divorce papers...and everything else. Well do the photocopies have to be notarized? do they have to have a stamp on them saying "certified copies? or anything like that??? I would hate to be at the Consulate and not have all my ducks in a row. It has been an incredibly long journey and I would love for the end to be in sight.
OK...one other thing. We are fortunate as we live on the border of each other. But, I work in Canada....now after we marry I have heard that I can not return to Canada for a certain period of time....why? What if I have a job there? Do I have to take a leave of absence? Or how can I apply to work in the USA? I enjoy working and I know I still need to contribute some $$$ to live on.
Now if anyone has any information I would certainly appreciate your help!!!

The reason the spot comes up positive is if you have been vaccinated against TB. Here in the US we dont do this, but I've noticed a lot of European countries do. Not sure if the PI does. If your friend isnt vaccinated against TB, then a skin test might be a good, quick way to check. No idea why they even bother giving the skin test to those vaccinated. Its SUPPOSED to come up positive if you are vaccinated... I'm making sure my SO hangs on to the x-ray so maybe we wont have to pay for more when his skin tests comes up positive in the future!!!

You might also try the University's international office. If they dont have one, try a larger University in your state. At Michigan State, we had an office specifically for international students and they were fairly knowledgable about different visas. They may not know anything about the K2, but they might know of an organization or indivdual that does. Its worth an e-mail or call at the least! Another place to look may be church groups or the like. Ie Russian Orthodox. You may find other individuals who have immigrated and may help with lawyers in your area.

explain to him that most of us wait 90 days or more before receiveing the NOA2 so he will just need to be patient and let the system work. It's not like morocco where you can give a little money and get something done. The good news is once you have the NOA2 morocco is pretty quick with the interview. Usually 4 weeks from the time Casa recieves it (or 6 weeks from the NOA2)

I know in Morocco there are lots of stories going around about how the visa process works (or how they think it works). Tell you fiance not to listen to these stories. It took us 5 1/2 months from mailing to visa being issued. This was going through California. Vermont works faster and barring any problems with security checks you will probably have everything in order in less time than we did! Good luck!


see 2 of his friends just got their visas and he is getting nervous about some things that were done on the visa like the fact on my g325a i didput an a# and i dont have one for his i didnt put my name or anything no the g325a but he is also anxius about the fact of seeing his friends again in america its hard but he doesnt get the fact that its giong to take time for this he is worried about that fact as i am not as much bc he does enough worrying for the both of us plus if i worry thats another min out of every day i cant afford how sad is that?

Also if you are set on getting married in Montreal, that might now work too well with the K1 and a September date. You cant get married before you enter the US on the K1. Everyone here usually recommends with the K1 not to plan anything until you have the visa in hand. You may be able to have an unofficial ceremony but make sure it isnt referred to as a wedding or him being your spouse.

Over on the UK board people have posted some reviews etc. Try searching for London embassy etc. Due to the age difference, I dont know if they will ask you a lot more questions than others. However, it seems like London is not too crazy with the interview questions, mainly where you met, how you met etc. Basic things. We havent been through that yet :( but those are examples of what I have read from other posters. Good luck!

I am just thinking about when I moved to the UK to live with my SO for 3 months. We had been apart for SO long, it was very odd to adjust to seeing each other every day. We fought a LOT every day for the first few weeks. I knew the language etc, but I felt really alone, scared and just wanted to go home. I almost packed my bags every day for the first 2 weeks. Eventually we got used to being around each other every day and had an absolute blast for the last 2 months. I REALLY didnt want to leave by then! I just think 2 weeks is not enough time to adjust from long distance to living together. Obviously if there is abuse of any sort etc. that is completely different. I just hope she doesnt decide to leave too early and change her mind down the line. Besides that, if she still is unhappy and needs to leave, I would have a very honest talk with the fiance and make sure he understands she IS leaving. If he still refuses, hopefully family and friends and charity can pitch in. Not sure on his legal responsibilities, though he definitly has a moral obligation to get her home if that is her true wish.

I use National City and they put the image of the check online (front and back) I dont get anything in the mail unless I request it. My NOA1 came around 10 days after I mailed it though, so I only waited a few days from the time the check was cashed till I got the NOA1

How do you trach your case number so quickly? I, too, sent a check, but I don't receive the photostat of my checks until 6 weeks later with my bank statement. Also, I never see the back of the check on this statement. (Where I believe the case number is posted)
