Same situation. I used my mother as a co-sponsor. Most of the students on here do that. I just had my interview and no problems. Plan on doing the same thing for AOS.

K-1 Fiance(e) Visa Process & ProceduresSlowing us down?

 All they are doing is having us mail directly to Cali if we would have filed at NCS or TSC. Right now we mail to NCS or TCS and they forward it to CSC. Nothing changes process-wise.

Some of the old TSC and NCS are going to be able to send to VSC directly too now if I remember what I read correctly *scratches head*

Ah, you're probably right. I did a cursory glance at it ;) Shhh, don't tell

So is the POE EAD stamp just a myth?

No, its real. They seem to only give it out (at least lately) through JFK. Some times you have to specifically request it as well when going through JFK.

Sit tight and wait. If they need more info they'll send you an RFE. It's the general wisdom on VJ not to send in anything unless specifically asked for it.

K-1 Fiance(e) Visa Process & ProceduresRFEs...how common are they?
Well if you forget to sign something, then they are very common!!! Sorry :) There's always a few every month on VJ, but the majority of us go through without them. It just depends on if you remembered to submit everything needed and if the person reviewing the app. wants to be picky. Ie, requesting the beneficiaries birth cert.

K-1 Fiance(e) Visa Process & ProceduresNeed help,someone please advise
I second Dev, you should have a read through the guides up at the top and they will help A LOT.

1. Usually K1 is faster, but check the current processign times up at the top
2. We showed passport stamps into the country, photos, receipts etc. to show we were in the same place at the same time. Just think what shows you were together.
3. Engaged means the normal US version of being engaged. Guy and girl agree to be married. That's it. That's why you sign an intent to marry letter.
4. REad the processign times at the top
5. I would say make your decison on which visa and file soon. Filing fees go up by a LOT on the 30th. So yes, file ASAP unless you can't move for a while.
6. Most people here don't use lawyers and while a consultation with one can be helpful, you probably won't need one unless you have a complicated case. Search for this and you'll find LOTs on it.

K-1 Fiance(e) Visa Process & Proceduresk-1 visa marry in japan first
My fiance and I didnt want to do the wedding party abroad before we have the visa thing. What we are doing is having him come on the K1, get married (you could just do a courthouse thing), file for AOS and get the AP then head back to the UK and have a big party. Dont know if that will work for the parents, but worth suggesting.

K-1 Fiance(e) Visa Process & ProceduresMy Fiances son
...just another little side note to add:

You will also more than likely have to obtain a written, notarized permission from the birth mother, if she is alive, as well if he plans on bringing the son over (if the child is a minor). I do know that in the United States, if a parent wants to move out of state, or even the country, they must have permission from the other parent...in order to avoid any claims against kidnapping....so I can't see where they wouldn't question a potential immigrant bringing a child into the country..without some questions regarding the other parent

K-1 Fiance(e) Visa Process & ProceduresCase moved from Nebraska to California????
Ok.. I'm confused. I live in Ohio..my service center is Nebraska...where I mailed the I-129F petition. We've received the NOA1 today, Saturday, April 21st!!! (yippee!!) .... But.. when I created my profile online at uscis.gov and checked the status...in which it was touched again yesterday, I found out it's been moved to California Service Center now....Is this common??? Or will this cause delays?? (as I know California is a little slower than Nebraska)?? I'm just confused about it :help:

K-1 Fiance(e) Visa Process & ProceduresAdditional Evidence
When I mailed out my I129F paperwork...I mailed out as much information as possible...the enitre packet was over 70 pages! The government would rather have too much than too little...unless it is irrelevant. As far as submitting your mothers boarding passes... It doesn't hurt to photocopy them and submit them... add a note to the side...stating this was when your mother went with you....make sure you submit all your boarding passes/passport info tho. Telephone bills, emails, screen prints, greeting cards, etc...those all prove an ongoing relationship..but is not the major proof of someone meeting. I did submit that information tho to build my case. As far as your pictures go...do not send the originals...scan them..then color copy on paper...that's what I did. Any pictures that shows you and your fiance together in the photo are good. Describe near the picture what is going on....to let them know ...the customs... it was not a wedding..but an engagement ceremony. I submitted photos of me with my fiance's family... It doesn't hurt your case...It can only help it.

K-1 Fiance(e) Visa Process & ProceduresIn need of serious help!!!
You seriously need to contact the United States Department of Customs and Immigration. If you have no interest anymore in wanting to be with her...and its obvious, sad but true, she's used you for a free pass into the United States.... She needs to be reported. You don't need an attorney...they will put out an all points bulletin on her. Just be honest with them and tell them that during the course of the K1 Visa, your relationship became shakey and you had changed your mind (which you ARE allowed to do)...let them know she came over on her own and you haven't a clue as to where she even is.... Do so ASAP...

K-1 Fiance(e) Visa Process & Proceduressending I-129 tomorrow- HELP!
I sent mine via the United States Postal Service..... My packet was over 70 pages..and to send it in 2-3 buisness days, it only cost me around 5 U.S. Dollars. I also had mine signature guaranteed, so the USCIS had to sign for it, and I went online to the US Postal Service's website (save the receipt they give you...that's your tracking number) I sent it out on a Thursday..they had it Monday...and I got my verifications via email. So, there's really no sense in paying UPS or FedEx's prices when the U.S. Postal Service works just as well...only cheaper.

K-1 Fiance(e) Visa Process & Procedurestime of being together when we apply
I don't think that so much matters. You just have to be able to prove an ongoing relationship, and from the sounds of it, you probably won't have any problems.

The ONLY thing I would be concerned about...being that you've already mailed off your I-129F.... and you said he was coming to the US in JULY... that may be a problem. Form other posts, and other questions, once the petition is filed... if the fiance tries to enter the country, he or she may be turned away at Customs..and will have to get another flight back at their own expense. It comes up in their computer files that he is applying for a K1 Visa. You may want to check into that further....or please someone here... add to this....

To back up what TimsDaisy is saying... The reason being is trick photography and photoshop.... It may prove that the two of you have met in person...but it does not substantiate an ongoing relationship. Telephone bills, letters, emails, screen prints of the two of you talking on web cam, birthday cards, and pictures all SUPPORT the relationship. The guaranteed evidence is the passport and airplane ticket stubs....also keep any receipts from items purchased in your fiance(e)s home country.

K-1 Fiance(e) Visa Process & ProceduresFiance' Coming Back to USA for visit
We are in the process of getting our k-1 visa. My fiance' was here (in the usa) from november 09, 2006 until February 1 2007 on the visa waiver program.

My mom is getting married on September 8th and I want him to come back for a couple of weeks for the wedding and wedding party and such.

I know he can come back but how do we going about doing this? Does he need a tourist visa this time? Or can he do the visa waiver? ALSO I know he needs ties to his home country. What should this be? Thanks sooo much!

K-1 Fiance(e) Visa Process & Proceduresworried sick about my K1 Visa:( any guidance anyone?
ok, so clearly the view here is to not use an attorney. I've just heard that it's near impossible to get the paperwork approved for a visa for a girl from Thailand. If my package was to get denied, it would only add more time because I'd have to redo the entire thing and resubmit it.

Plus, this attorney provides "coaching" for her interview...which I've been told can be pretty awful for Thai girls. Also, she used to be a "bargirl" which will have to be covered properly in the interview so as to avoid disapproval. Most girls in Thailand who work in a bar are considered to be prositutes immediately, and then denied US visa.

What do you guys think of this attorney's site/services? www.mythaifiancee.com

I've also got an attorney who is doing all the paperwork for me here and in Bangkok for my girl. He's got a 100% approval rate, so I'm really hoping here. I'm trying to do all I can to get my girl over here.

Welcome to the board J. If your attorney is advertising a 100% approval rate I am betting he/she is referring to petition approval and not visa approval. I'd ask what they're basing those percentages on.

It's actually a 100% VISA approval rate:)

K-1 Fiance(e) Visa Process & Proceduresworried sick about my K1 Visa:( any guidance anyone?
Sorry to be new to the board and just post all these questions, but I really just don't know where to turn.

I'm getting officially divorced to my American wife on this coming July 17th, 2007...at 11:00AM:) I cant wait:)
However, I'm scared to death that it might have some sort of negative impact on getting approved for my Thai fiance to get her K1 Visa. Will this have any bearing on approval? As far as financial support, I'm on active duty in the US Navy...so there will be no problem showing that I can provide for her financially...and I have absolutely NO criminal background.

Also, I'm only 23 years old (turning 24 on September 12). Will my young age work against me in this case? I'm hoping they dont view me as some young kid who doesn't know what he's doing, and then they dissaprove on those terms.

My USCIC is Nebraska...and it's showing that they are just processing cases from May of 2006. That's over a YEAR ago. So does this mean it takes them a YEAR to just process through my petition??? That seems like FOREVER.

I've also got an attorney who is doing all the paperwork for me here and in Bangkok for my girl. He's got a 100% approval rate, so I'm really hoping here. I'm trying to do all I can to get my girl over here.

What do you guys, the masters, think about my situation??

:) In advance, I really appreciate all your help.

K-1 Fiance(e) Visa Process & Proceduresfiling K1 petition day after my divorce is official?
I've read a couple different things about this so far from searching the forums...

I get divorced on July 17th, officially.

I was planning on dropping the petition to USCIS within a day or two after that. My divorce decree states that my wife and I have not "lived together or cohabitated" since October 1st, 2005. However, we will not be officially DIVORCED until July 17th.

My K1 petition for a fiance living in Thailand.

Is this going to draw up any fraud flags on my petition? Will they think this divorce is being done to get someone from a third world country into the US?

Is there anything extra I should include with my petition to help quiet any suspicion of fraud and move my petition forward for approval?

and finally...one more question...on my last trip to Thailand, I was stopped in customs and a State Department officer asked me about my trip. I told him it went to go see my girlfriend and that I was hoping to move her over to the US someday soon. At first, i said I'd get her a tourist visa, then marry her here if it all worked out. Then he informed me that was illegal and I would need a Fiance Visa. That was the end of the interaction mostly, but he seemed really shady. Is there anyway those guys can pull you up in there computers and make notes about you or anything? Might sound like a stupid question, but it's got me worried.

K-1 Fiance(e) Visa Process & Proceduresputting my past addresses on K1 petition

Put the Ohio address as current mailing address on the I-129F form, but on the G-325A fill in your past address on it.

They go by the address on the I-129F for where to send things like (NOA1,NOA2, and any RFE)

Great, thanks! One more question...since I currently live in New Orleans, LA...but I still use my address in Ohio for all my bills and everything...can I still list my current address as Ohio?

Also, I'll be moving to Washington DC in the middle of this entire VISA process. Will I need to do anything to let them know of my address change?
JCochranUSNMaleThailand2007-06-18 08:28:00
K-1 Fiance(e) Visa Process & Proceduresputting my past addresses on K1 petition
I joined the US Navy back in July of 2004. Since then, I moved to New Orleans, LA and lived in the barracks on the military base. Then, I was evacuated for Katrina to Dallas, TX and lived in an apartment that the Navy paid for. Now I live back in New Orleans, and I'm still living in base housing.

My actual mailing address that I use is still my address in Ohio (where I grew up, and where my mother currently lives). Do I need to only put my Ohio address on this form where is asks for all my past addresses? Will that be good enough?

I'm still a resident of Ohio, and I want all my mail to be sent to my Ohio address because the mail service is SOOOO terribly still here in New Orleans ever since Katrina.

K-1 Fiance(e) Visa Process & Proceduresa mis-spelling of my home city on forms...RFE/denial?
I had a lawyer draw up my paperwork in bangkok, have my fiance come into his office and sign them, then he fedex'd them to me here in America.

I just got them today...and there is ONE mistake;
my city I live in is "Marietta", but it was typed in "Marrietta" on all the forms. The zip code is still put in properly. Is this going to cause me to get an RFE or a denial? Will they ask me to redo all this?

Also, it has my signature date as 20JUN2007. However, my divorce wont be finalized until 17JUL2007. I'm not sending the paperwork until I get my divorce decree, but with the American Immigration service see that I signed the papers prior to my divorce and then deny me?

Thanks a lot for your help...I'm freaking out and stresssing about this since I just got the paperwork today....hopefully you guys will tell me its no big deal

K-1 Fiance(e) Visa Process & Proceduresa certification paper my lawyer included in K1 package

Not required, but helps give the paperwork a professional prepared appearance.

What do you mean by date conflict, it is understood that one form may have a different date than other items, most of the packages can be put together over a long period.

Example in our case, I-129F wa prepared on day, My G-325A, and my fiancee's G-325 had different dates, even letters of intent had different dates. The dates make no difference, just shows when the document was prepared and signed is all.

Thanks for the reply!

The only problem I'm concerned with, is that the date on this particular document is dated PRIOR to my divorce being completely official.

?????

K-1 Fiance(e) Visa Process & Proceduresa certification paper my lawyer included in K1 package
My lawyer included a paper that is signed by him in the papers (I129,etc) he just sent me from thailand. The papers states something like this:

"I certify that the following documents, photocopies, and pictures are accurate and real. I understand that original copies may be needed for the Consular and/or Embassy." OR SOMETHING ALONG THOSE LINES

This paper with my lawyer's signature was paperclipped to a picture of me and my fiance together. It's not an actual USCIS form or anything, just something written up in my lawyer's office.

Does this paper really have to be included when I send everything to the service center? Is it REQUIRED...or can I just put the picture of her and I together and that's it?

The only reason I don't want to incude it is because the date he signed it conflicts with other dates on the forms.

What do you guys think?

Thanks everyone!

K-1 Fiance(e) Visa Process & Proceduresusing white-out and 1-lining on the initial K1 package
can I cross it out and change it even if I'm changing the actual date that the papers were signed? See, we filled out the papers and signed them BEFORE my divorce was final. The signature date is 20JUN, but my divorce isnt final until 17JUL. I'm not sending the papers in before my divorce is final or anything like that though. I'll be including a certified copy of my divorce decree.

I've just been told that these signature dates cant be before my divorce is final.

I was just going to change the signature dates to make them a date AFTER my divorce is final.

Think I can still do just a pen change?

I was sent all my documnets in the mail yesterday. They were all filled out and translated by my attorney in bangkok and all have my fiance's signature.

However, the name of the city I live in was spelled incorrectly. it was spelled "Marrietta" instead of "Marietta"...still has correct zip code though. Can I just one-line and/or use white out this and write in the correct spelling or do I have to completely redo the form?

Also, some other info was slightly wrong...some of the dates. Can I one-line those and/or use and white and then write them in with black ink?

As always, thanks in advance everyone!

My fiance and I signed our I-129F/325 documents on different dates. She signed hers while in Thailand, and she wrote in the date. Then, when I received these documents I signed and dated them. They documents are dates 3-4 days apart.

Also, my attorney who signed the documents signed on a different date as well. ????????????

Is this going to be a problem?

Is there some sort of requirement that the documents be signed by her and I on the same date?

Thanks again everyone!
