I believe they say 40 days for the police cert in the UK. Assuming that he doesnt get the visa before the wedding date make sure he brings lots of evidence of ties back to the UK. You dont want him denied at entry because they think he's going to stay... But lets think positive and home the cert comes tomorrow and you get the interview in a few weeks! Sending positive vibes your way... :blink: that's my + vibe face :)

The bottom line is, if you get legally married before the interview, the K1 will be denied. If you happen to get married and don't tell them, then you will have some explaining to do with it comes to your AOS. They will require a marriage certificate and will see you were married before the Visa was issued. Do you really want to fight that battle? They may see it as you obtained a K1 visa Fraudulantly.

Wait for it.... or get married and file for a K3.



Ummm, ya... That's why we are all telling them NOT to get legally married. My post was simply saying if he comes for a NON-LEGAL ceremony, bring lots of ties back to the UK.

I have to let you know that it is VERY difficult for Brazilians to be granted tourist visas to the U.S. They have to show VERY strong ties to Brazil - proof that they will return to Brazil and not overstay their visa.
This can include a steady job, good salary, owning a home, proof they're in college, family, etc.
Even Brazilians who are middle class are often denied a visa because the consulate does not think they have strong enough ties to their home country.

In my opinion, I think it'd be better for you both if you went to Brazil. Your fiance will not be granted a fiance visa if you have not met in person within the last 2 years. That is one of the requirements for the visa (having met in person).

I lived in Brazil so everything I'm saying is from my experience. My fiance is Brazilian and we never thought about applying for a tourist visa because it is too hard to get.

I dont know what you mean you could go with her? You can have her sign the papers and get the pictures and evidence etc. while you are there. Saves waiting for the mail! Enjoy your trip. I totally understand what you mean about having her visit, dont you love how they want us to show we have a real relationship, but wont let her get a tourist visa and only give us 3 months to get married... Another idea (we were considering doing the caribean as well for a bit) would be file for the K1 etc. Meet your fiance in the bahamas once the K1 is approved and have a NON-LEGAL ceremony (not sure on the rules down there, so check) and make sure that immigration does not think you are legally married upon entry. After the NON-LEGAL ceremony, enter the US with your fiance on the K1 and then have a quick courthouse ceremony.

K1 is a FIANCE visa (ie NOT married). By entering on a K1 already being married, they violate the terms of the visa which regardless of WHAT they did or did not say at the interview is STILL VISA FRAUD!!! So they may not be lieing, but they are still committing fraud that way.

I applied for a visa for my fiancee in December 2006 with I29F. We have received an interview date for June 18 at the the U.S. embassy in Manila.

However, we were married in the Philippines on April 28, 2007. I would like to change this application from a FIANCEE visa to a SPOUSE visa.

It looks like SA has a fairly quick turnaround time at the embassy, so with no slow-downs, you might make it. HOWEVER, the universal advice here is DO NOT put any money down for a wedding that you cannot get back in full if you need to cancel (which happens fairly often unfortunately).

I disagree. Most people I've talked to have NOT used a lawyer. Your experience must be different from mine. Do you need a lawyer? No. Can you use one? Of course. What i would do in your case is read over everything Timsdaisy has pointed out several times (give yourself a week or two to let it all sink in) and then decide if you feel confident enough to do it on your own. Good luck!

Edit: If you do decide on a lawyer, MAKE 100% SURE they are experienced with family based petitions such as the K1. Too many horror stories of incompitent lawyers messing peoples cases up and causing months in delays.

Good afternoon all. I feel so blessed to have found this site. Already, I have learned a lot by just reading some of the posts. I have question. I noticed that most people here are filing the K-1 Visa without an attorney. Or, I should say no one mentions using an a lawyer. Has anyone been successful in filing this way. Next...can one of the senior members detail a list of lingo used in the timelines? For instance, what is NOIA? I see that a lot. It would be helpful because I am preparing my K-1 application for my Ghanaian fiance. Oh one more question...I just got back from Ghana and cannot bear going and leaving my fiance again. It was really tough. But, do you think we will have a better chance if I visited again?

To answer your questions NOA1 stands for Notice of apporval...that would be the I-129 NOA2 would be the I-130. As far as using a lawyer I don't think they can do anymore than you can at this stage. Just read all you can and educate yourself to the process. I don't know what you found when you were there but I found the american embassy was not very helpful. I therefore came back to the states and started the process in December 2005. We are currently waiting on an appointment date. Be prepared for a long wait and get your elected congressman and senator involved early on. That way if anything goes worng they will know about it. Good luck.


Ok, granted this is an old thread, but just to clarify, NOA1 does not = 129 and NOA2 = 130. NOA1 is when the service center recieves your package FOR the 129f (or I-130 I guess) and NOA2 is when they approve it unless I am completely misreading what you are saying (which I tend to do :) ). However K1 has nothing to do with I-130 in any case.

That is unusual. On 05/22, I was prompted at the USCIS website to change my password. Did this happen to you also? After I changed the password and logged into my account, I noticed I received the first touch after the NOA1 back in March. 1st touch on 05/22 and a 2nd touch on 05/23. But there's no update via e-mail. I'm guessing the same thing must've happened to me as some of you on this thread. We must've been approved also. But I don't have any confirmation of this yet.


Lets hope that's the case! This is getting ridiculous, not telling people! JEEEEEEEEZ :)

You have no idea whether you've received an RFE, or any NOA. You were touched. Period.

Oh for goodness sakes, relax! This happened to us and had I NOT called we still would not know we had been approved, almost one month AFTER our approval! And how is saying, "Hi I'm concerned we might have an RFE, could you give me any information?" a lie??? Especially when they aren't notifying anyone lately so you very well could have one. What the OP said is just semantics, give them a break

If you are worried, call. The worst they can say is the petitioner needs to call

Dear Members,
As some of you are aware my fiancee has decided to cancel our K1. I have no reasons other than that her family advised her not to, what about discrimination here, what if her daughter wanted to go back and questions about support of her family as she is the only peso maker in her household.
Is it in my best interest to notify CSC and the USE in Manila and make them aware of this? I am almost certain that I will be down this road again, but what about now. Would notifying them with her email attached saying that she does not want to pursue this K1 anymore help?
I need your helpful suggestions not judgement.

Are you 100% sure its over? If she changed her mind before the interview, would you take her back? If you're not 100% sure, I'd wait till after your visit at least. Good luck with whatever you decide

I guess we're doing it backwards as far as the weddings go. The religious ceremony in Germany will include all of P's family and quite a few of my friends and family. Even thoguh we'll be doing the "real" wedding in Seattle later. We didn't like the idea of splitting it, but there was no way his very large and very close family could all be in Seattle for the legal ceremony. This way, his family gets to be involved and we don't have to worry about timelines. If his visa isn't approved by the time we do the ceremony in Germany, it's not that big of a deal, because I can come home and we'll wait. If it is, then we haven't broken any laws because religious ceremonies in Germany aren't legal.

This won't work for all couples, but because of the logistical issues surrounding his family's presence, this seemed like the best route for us.

I think it's different for everyone. This isn't my first wedding and we aren't wealthy, so a huge affair isn't an option for us anyway....

:thumbs: Just an update for us as well... We are sending back packet 3 tomorrow and expecting an interview in the next month or two. So I've put money down for our cake, which we can't move and put $ down for the hall which we can move. Since we are doing it on a Thursday evening, everything is available and a lot less than on a weekend. All the people I really want at the wedding can make it on a weekday, so that is the perfect compromise for us.

I completely agree... Even if we had a "normal" relationship, we'd still be behind wanting to get married this summer. What we are doing is figuring out where we want it, the cake etc and explaining our situation to the vendors. So far everyone has been VERY understanding (especially since we are going to do it on a weekday). We have put money down on a hall, but they allow us to move the date to another free one anytime within a year and not loose any money. So we decided to reserve a date and change it if need be. Ask and see if any of the vendors would be willing to do that as well.

You become a US citizen when you are eligible (I think 3 years being a spouse of a US citizen, but I may be wrong), apply for it, fufill all the requirements and take the oath. Pretty sure the US doesnt take your other passport, but you'll have to check what your home country's policy is on taking a new citizenship.

One last question, if anybody has knowledge on this situation...

After we get married and send all the paperwork, and assuming everything goes well at the interview after all the paperwork is sent (months after), I understand I will get my greencard weeks or months after that. Now, how long after that will I be a "US Citizen"? Will I ever get a US Passport? Will I have to surrender my nicaraguan passport?
