I'm mailing my package tomorrow. My only copy of my divorce decree is my original copy with the certified stamp on it. Is this okay to send??

Also, it's two pages that are stapled together...but the 2nd page doesnt have the certified stamp on it. Only the 1st page. I was told this is no big deal by the courts because the 1st page has both me and my ex-wife's names on it...even though the judges stamp/signature is on the 2nd page.

Will this matter?

Also, my decree looks pretty raggedy because it was stapled and unstapled so many times and tossed around. Does that matter??

I included 8 pictures of me and my fiance. I did NOT write anything on the back of the pictures because I was told I only have to write my name on the back of my passport style photo.

One thing I'm worried about...my girl works on her family's farm in BuriRam. However, she doesn't exactly look like the typical "farm girl". She still has plenty of style and makes herself up VERY well. I've got pictures of her and I just lounging and dressed down, and I've also got pictures of her dressed up. Will they see these pictures where she is dressed up looking nice and say something isnt right?

I don't think that making corrections the way you described them will cause a rejection of your case nor a RFE..RFEs are Requests for Evidence, usually when they are missing something in your application or weren't completley satisfied with what you submitted as evidence for example your evidence of having met within the last two years.
Other than that correcting your fathers birthdate might have confused them so much that they need to see HIS birthcertificate, I don't see any RFEs coming your way for making correction.

Though I am wondering a little why you didn't just print out a new, corrected form on the computer? Might have saved you this headache now...



I only didn't print out a new one because my lawyer in Bangkok told me it wouldnt matter...of course, I wanted another opinion though from all my Vjers:) Plus, making a new one would mean my fiance would have to travel to Bangkok again (which she HATES) and I would have to wait for my lawyer to fedex me the paperwork again.

I think he means the biographic information forms. His fiancee would have had to sign them again if he had have printed off new forms.

I had to one-line the spelling of my city. I one-lined it on every page and wrote in the correct spelling, then initialed where I one-lined.

I had to one-line my fathers birthdate. It was only off by just TWO days because I was unsure as to his birthdate. Again, one-lined and initialed.

The signature dates dates were whited-out and new dates written in by hand. Again, these changes were initialed.

Everything else is completely in order. I'm on active duty in the Navy so I'm obviously not a felon and my background check should be easy...neither of my parents have had any legal troubles. My fiance has had no legal troubles.

That's only 3 minor changes made.

Now...will these be grounds to completely REJECT my application...or just cause a possible RFE? What would that RFE be requesting? Could the problem be solved by them just simply giving me a phone call? If this does cause an RFE...how much time does that add to the complete approval process?

Should it take about 3 months from NOA1 to NOA2?

So I'm sure a lot of us have heard MANY things and think different things about the new fees affecting the California process times.

I've heard that it will not have much affect at all, maybe only slowing the system by 2 weeks or so.

I'm going to continue this discussion here not to argue with you but purely to help you and some of the newer members understand this process.

Yes it's gruelingly slow, especially compared to most other business processes in the modern world. But believe it or not, it is much much faster than it used to be. It's much faster, even, than when I joined this site. I am not certain how old the timeline data is in the VJ database, but if it does go back a few years, check out overall processing time for nearly any type of petition and you will see the facts bear me out.

Prior to the K1 petition being developed, there was no way to bring a fiance here. The CR1 or IR1 were the only avenues (may have had another name then) and INS answered the call to speed up family unification by creating the K1 as a way to speed the process. Since that time, CR1 and IR1 moves along more quickly than it used to.

Also, the largest part of the 'speed' problem is a lack of modern technology and adequate personnel. You cry that it shouldn't be this way, but dollars pay for these things. DOS is completely funded by petition fees. No tax dollars flow into the system - the national debt doesn't prop it up. Because of lack of funds, much of the system remains paper based. Research about record retention of immigration documents and you will be deeply dismayed. A big fire in one facility could wipe out decades of documents with no way at all of retrieving that data.

I mention the security checks for a reason. The workload of the agency was multiplied vastly by the mandates after 9/11. Prior to that, the background of individuals seeking visas or applying to adjust status were randomly spot-checked. Now EVERY petitioner is checked. You are probably early in your petition stage to be crying foul about your particular case. Try being one of the 400,000 plus applicants for naturalization who are caught in a namecheck crunch with USCIS purely because USCIS has not had the funds to pay the FBI enough to put more agents onto background work.

As I said, I agree with you in principle. It takes time to gain a thorough knowledge of this system. When you understand a bit more fully how it operates, you will see how they are operating (in most cases) the best they can under the circumstances.


Hopefully the recent fee increases will help to alleviate the problem over time.


It better! It makes no sense for a service to go up in price by 175% and still perform the exact same (or worse) than it did before. I'm hoping and praying the fee increase will speed up the process, but im still expecting the 100-110 day waiting time for my NOA2.

I can see arguments for both sides of this...that it would increase, and could even decrease.

I paid by money order, but I have my receipt number already. I was also issued my NOA1 already. However I have NOT received my NOA1 in the mail yet. My NOA1 was issued on August 2nd, but still nothing in the mail.

I see that lots of people who filed before and after me have received their NOA1 in the mail.

I only see the regular "We have mailed a response detailing how we will process..." when I check the status on USCIS with my receipt number, which I'm told is the same as my NOA1.

I have not yet received anything in the mail at all though...is this bad that I'm one of the few who haved not received anything? Did USCIS lose my paperwork or anything? What should I do?

Bank statements,IRS transcripts,W-2, divorce papers etc. I am worried to send these documents with my soc.number on them and bank account numbers. I have heard horror stories about identity theft and it takes years and lots of $$$ to get it all strightened out. My Fiancee told me she has talked to some girls on a Russian forum that have gone through the interview there in Kiev and they told her they need originals there. Can someone please help me. My Fiancee has her interview set up on Sept. 26 in Kiev and she is worried that I did not get the NOA-2. I have the NOA-1 (I-797) notice of action that I received in March 23,2007. Then I received a letter from the NVC stating that they received an approved I-129F. Is this the NOA-2 ? There is our INS receipt number there,Case number for Kiev and a bar code. Is is pososable that the American Embassy could be ready for the interview and we did not receive the NOA-2 yet ? The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above 125% povertyline so I did not include any asset data.

If your income is sufficient, you can just skip all the asset portions of the form. Leave it blank.

If you need to use assets, they are just asking for the value of your listed property, minus any mortgage on the same property. No need to list outgoing cash flow or debts not connected directly to the listed asset.

I advise against it. Anything you list can be scrutinized. If they don't like your documentation, they can ask for something not immediately available and delay approval. For instance, maybe they'll ask for an appraisal of your home.

Hi everyone. Well I am just about done with getting all my documents ready to send to my fiancee in the Ukraine. I am a little confused about what documents need to be originals and or copies. I am looking at instructions for immirgrant/k visa applicants and there is a chart that says for example , Evidence of the relationship ( photos, letters,plane tickets) should be originals. Also for K-visa applicants . The American Fiance's tax returns,w-2's, pay stubs, should be originals and copies. What if this package I send gets lots. I would loose the original important documents. It makes a difference because the jerk lawyer that advised the USC to lie also probably didnt tell him about the IMBRA law. And for your info. there was only ONE previous approved petition and the reason most hire a lawyer is so they dont have to do "research" on their own. It doesnt make her guy a sneaky criminal as most have tagged him as.....it makes him lucky to have a gal who will find the facts so they can fire this idiot lawyer steering them in the wrong direction.

There's a forum on this site for IMBRA. From what I understand, which isnt a whole lot ;), its a thing meant to prevent US spouses who have a history of abuse etc from bringing a SO over here. My feeling is the question specifically asks: Question from petition 11, I-129F:"Have you ever filed for this or any other alien fiance(?) or husband/wife before?" and he has filed a petition, even though the marriage didnt occur, he should answer yes to this. It doesnt ask if you filed and then married, just did you file. He did, so yes! Good luck with your journey

Ya, I DEFINITLY know the feeling :) I have 2 close family members getting married the same time and I am so jealous they dont have all this to deal with!!! VJ is super as a support site!!! I see you're in the UK so you can get the police certificate started if you want. I cant remember the exact form to ask for, but you go in to the local station and they should be able to help you. They guestimate it takes 40 days for that to arrive and its good for a year. Also check on the embassy's website for the immunizations you need. I think its the MMR that takes 2 shots over a 2 month period, and with NHS its usually cheaper to get them done in the UK. Check out the UK forum, someone posted the paperwork that you get with packet 3. A lot of those you can find online, so take a look and familiarize youself with them. Not much to do till packet 3, but those few things will at least let you feel like you're doing something!!! FYI though, they dont have to get started until packet 3 though, so dont feel rushed! Hope to see ya in London in a few months ;)

We are planning a full floofy dress and church ceremony and reception, but we didn't plan anything (ok, i bought my wedding gown the day before) until he had his visa in hand. We're finding that other than some difficulties with the church (which are sorting themselves out), it's been easy to find a reception hall or a ballroom (we're having a smallish wedding, so that helps) for July.

I wouldn't put down a dime or make solid plans; there's a lot that will be up in the air and things can get delayed through no fault of your own. But if you're flexible on the date, remember that once you get the K-1, you have six months to use it, and that's enough time to plan parties.




Yeah, that's what we're doing too- Catholic wedding with mass, etc. I mentioned the idea of going through the courthouse at first (just to get the legalities out of the way) to my fiance and then planning the ceremony later. Unfortunately, he feels like this is a "cheat" at getting married and would rather wait until the church bit. I agree with him, but from where we currently stand I see no light at the end of the tunnel and will take what I can get. I know I'm not very far in the process (only being 6 weeks into it), but it's really doing my head in to wait around for someone else to tell me when I can get married. I'm sure this is a fairly common feeling around here.

I'm scheduled to put a deposit on a reception site next weekend- they've said they can move date around AS LONG as the original date can still be rebooked. I guess this is a chance to take... I'm sure I'll be stressing all week about whether or not it's worth it.

This website is really helpful- it's like a support club. It's nice to know there are other people going through the same frustrations.

Doll, you can still have the wedding in Aug/Sept if you are VERY flexible. Paul and I dont want to do the courthouse and then a ceremony so we are going to have a real wedding soon after he gets here. Look around at places and talk with all the vendors and explain your situation. I have found many are very understanding. We are going to do it on a Thursday, so no where is booked. I need to give them 2 weeks notice at the hall is all! Look for somewhere that is already nicely decorated so the florist wont have much to do on short notice. Thursday is great as well because you get lots of discounts (50% on my DJ!) So for us, Paul gets his visa, I call all the vendors with an actual date, he gets here and we get married! Just depends on what you want for the wedding but its another option. Just dont pay for any specific dates until he has the visa (or an interview date at the very least). Definitly send in the passport stamps for both of you. In additon to that and pics, we send in my SO's student visa paperwork, proof of where he lived and where I lived on campus and a little map to show how close they were :) I also sent in envelopes addressed to me at his residence when I lived with him this summer, e-mails to my mom from when I was abroad, pay slips to me delivered to his residence, payment of my wages into his account, tickets to a sporting event we attended together and time stamp dated photos. Good luck and be creative! What does he have to show for his obviously long period of time in the US? Bank stuff, rental agreements, church membership anything? Think of all the things you two did together and think of any paper trail that could have.

As an asside, I wonder how many "normal" couples could prove their relationship to USCIS? Hmmmmm :)

Exactly... Why pay to fill in the forms you can get for free? Online sites wont give you any more info than you'll get here. Also no way of filing (yourself, lawyer, online site) is going to be any faster, since its all teh same process, no shortcuts.


I guess what I mean by "filing online" is... finding a lawyers website or someone who does this thing for you, like this website: http://www.fianceevisas.net/



Just looking at that site, I wouldnt go with it. Everything on there is talking about the K1, whereas you want the K3. Not many people on here will know much about who's good to go with, since we are a "do-it-yourself" site for the most part.
