You should list the children as it is being asked. The 19 year will be eligible for a K-2. There is no penalty, to you or your fiancée, if the 19 year old does decide to remain in Russian Federation and does not accept the visa.

As far as the overstayed work visas, I don't see any question that asks, "Has any child of yours ever been to the U.S?" All questions are asked of your fiancée's situation. Maybe someone else knows differently about that issue.

I said this because we are all dealing with a very slow and very ####### government organization that handles thousands upon thousands of papers every day. My opinion is just putting everything in an envelope is risky. I believe it should be bond in some fashion to keep all the papers from your case from migrating to the case setting on top, under, or even around it. I would rather cautiously say, it may cause a little trouble than spout off the "feel good, no worries" "Oh, you'll be just fine!" What if something does get lost? There is a reason the USCIS has a post of "General Tips on Assembling Applications for Mailing". If someone takes the time to write, "We like it this way", I am sure going to listen! That is why I said something like that.

OK, let me clarify a little. She came to the US as a tourist, before I met her. I met her while she was here as a tourist. As far as I understand (I may be wrong), she can still leave and come back to the US until the current tourist visa expires. We're not talking about applying for a new visa yet.


Ya, she can come back for a VISIT, but since her intent upon entry this time would be to immigrate, that would be visa fraud. You need either a K1 or spousal visa if she were to leave and then re-enter with the intent to stay here. At the greencard interview, you could potentially run into problems with visa fraud were she to reenter on the tourist visa.

Discuss this with your lawyer before she leaves!!!

Option #1 (in no particular order), file K1, have a NON-LEGAL thing in the UK, move to the US and get legally married within 90 days.

Option #2, get married in the UK LEGALLY, file spousal visa (K3 or CR1)

Option #3, file K1, move to the US, get legally married, file for AP/greencard, once you get AP/greencard, go back to the UK for another ceremony.

We're doing option #3 :)

The requirement is meet in person in the last 2 years. If you have done this, then you are ok. You can prove that with plane tickets, passport stamps, hotel reciepts, credit card bills in each others home town etc. Evidence of a relationship isn't needed until the consulate stage, and most of us mainly have phone records, letters, e-mails etc.

Not sure on the age thing, BUT K1 is for fiance and K2 is for a child of that fiance. So you would only file K2 if the beneficiary has a child and that would piggyback the K1. If you want to be married first, then you file for K3 or CR1. They tend to take a bit longer than the fiance visa, however you MUST marry in the US under the K1.

Yes... You dont have an option. And I 2nd what Tracy said, its VERY risky to already have wedding plans if you havent even filed. We made plans when we got to the consulate stage, but so much can go wrong, its hard to plan so far out.
