Unless you have some very special circumstances, hiring an attorney does nothing but drain funds better spent on yourselves and your future together. An attorney stands in the same line we do, with no time savings what so ever. The paperwork is far from complicated if you can read and follow instructions. Have a question? There are tons of folks here that are in your same shoes.

Too many here have tossed hard earned money on overpriced useless attornies. Do not feed the lawyers. It only keeps them strong causing them to breed out of control and further weakening us.

The POE is just the name for the offical spot where the person crosses the border and activates their visa. It could be passport control at an airport or a crossng gate on a road betwen two countries. Of course, you decide that location!

Yes, everyone is different and books should not be judged by the cover. What shocked me was the quickness you moved from engaged to, "Oh what the fuk, NEXT!" In came off worse than buying a used car.

Let me share a bit of my story. In 2005, my fiancée changed her mind right before the interview. This was after an almost two year relationship. She flat out told me, "I can't do it." She even made the suggestion, "Maybe you should find different woman." But, rather than give up and holler NEXT! I examined the situation. I flew to her at my nearest convenience. I discovered a woman very frightened. Scared of such a big move and lacking needed support from her family. I found a woman very much in love with me but requiring more time to do this right. A woman that never meant those words, "Find another". A woman concerned I would not understand her life situation. I told her, it's okay. It will be all right. Rather than give up, I saw a challenge. I asked her to tell me how I could help. She only said, "TIME". After a year more, I decided to take a more aggressive approach. I chose to give up everything here and live with her in Russia. We used that period to be a true family and not the typical visiting tourist that many can only do. I lived with her like a Russian. I even managed to fool many who never suspected me as being an American. After another year, we both decided that life would be better in America than struggling to live in Russia. Thus, I returned and, began her paperwork for the second time. Now she completely looks forward to arriving here and has full support of her family. I gave everyone time to know me and witness our love at work. She has had too many men in her life that wanted too much too soon and gave up on her. She wants a man for life and another short term superficial individual. Fighting for her, if you will, was exactly what she wanted.

I don't know your exact situation and we are all different. For me, quitting was never an acceptable option.

With regard to Q1, your fiance obviously has an intent to immigrate, as all of our fiance's do. The whole point of filing a K1 is to enter the US legally with intent to immigrate. If they didnt want to move here to be with us, then we wouldn't be filing in the first place. Your son shouldn't have any bearing on the case, except at the consulate stage, he might be good evidence of a real relationship wink.gif

Looking at your timeline and based on averages of others on VJ, your adjudication date is still a few days away. You can call USCIS, but they wont tell you anything new and its WAY too early to call your congressman. Just hold tight for a few more weeks and then worry. Good luck!

Definitly check on the validity of the 2. In the UK, the police cert is good for a year, but in other countries I know that it is valid for much less time. Also check how long it takes to get the Japanese police cert. We waited until he had the NOA2 to file for the medical and police cert. so that we didnt run into any problems with them expiring.

Your situation is very similar to what my now husband and I faced a year ago. I too am in medical school and he came over from the US. Anywho, we just used my mother as a cosponsor and have had no problems in filing the K1 or AOS. You can leave the UK for your trip and can even visit the US, though bring evidence that you are returning home. You just want to make sure you are home when the embassy sends you documents (after you get your NOA2). Just as an aside, it will take some time for you to be allowed to work in the US. JFK airport (last time I heard) gave out a stamp that allowed you to work on the K1 for 90 days. When you file for AOS, you also can file for a temp. work permit that usually takes around 3 months to get. We did manage to have the big fancy wedding on the K1 (rather than a civil ceremony and large wedding later) by planning at the last minute. Since we were fairly confident we wouldnt be denied or have name check issues, we started planning when we got the interview date. This is a BIG risk though, because if you dont get the visa by the time the wedding roles around, you are SOL. Regarding how long it takes to get the K1, we got it 5 months after filing, but we filed Feb 07, and so it only took us 3 months to get our NOA2. Its now taking a lot longer to get this, so check the timelines at the top of the page to check others with similar situations to see how long others are taking. Good luck to you both!

For me, I planned a date we would see each other etc. I needed some light at the end of the tunnel. I also just kept telling myself it was either this or be without him, and I'd rather talk to him for 2 hours a day than not have him at all... It's hard, but looking back, it was only a blip in our relationship, something that made us know each other better than most engaged couples. You'll get through it and hopefully have a stronger relationship for it. Good luck

There's no official time limit on filing. If you wife wants to work sooner, rather than later and would like to leave the US, I'd file AOS (along with EAD and AP) as soon as you can. We filed end of Sept. and got both AP and EAD 2 months later. My husband just started his first US job! Good luck and congrats to you both!

There are those one here who did have the 2 year residency requirement and had to wait, but there are certainly LOTS of J-1 ppl who file K-1's.

Not quite true. You DO need to meet and prove that you have met when you file the I-129f or it will be an automatic denial (barring a few circumstances that almost never are accepted). At the final stage of K1, the embassy stage, you are correct in that they will ask for evidence of the relationship. Evidence of meeting in the last 2 years at initial filing, evidence of relationship at the embassy.

That is something to think about... I felt like I was going to die worrying about the K1 and planning the wedding, plus some other stressful things I had going on at the time. Both immigration and wedding planning are stressful, so keep in mind that you might feel like having a nervous breakdown every day for several months wink.gif
