IR-1 / CR-1 Spouse Visa Process & ProceduresTouches....?
normal touches do not prompt an e-mail to be sent out. Like Ilya stated, if there is a change in status, like and RFE or an approval, that is when an e-mail is sent out. Other than that, they can touch your case everyday and not change the status and there will be no e-mail sent out.

If you entered the country on a K-3 visa, you have to adjust your status here in the United States. Since the K-3 was approved, there is no reason to call NVC, you are already in the country. Once you adjust your status here in the US, that is when they will either give you the CR-1 visa or the IR-1 visa depending on how long you have been married.

Not correct. If they want to travel back for a CR1 interview instead of adjusting status they may do so. First they'll have to determine whether their case was ever forwarded to NVC. If they've heard nothing by now, it probably wasn't, in which case they would need to file an I-824 to get the I-130 sent to NVC. Might not be worth it and few do it but it is definitely an option.

Since the petitions went through CSC in the spring of 2007, I suspect the I-130 was held per the policy at that time.

I did not know that was a possibility. but good to know for future purposes

I am a january filer from CSC with no approval in sight. I don't understand why VSC has not moved it's date in like 4 months. It is not right. I still get the pre-packaged answer: "until they have passed your date, we cannot take any action"

no approval yet. I got to submit my evidence for the expedite and they told me that by next week I should know whether or not the expedite was granted. Then they will approve the petition. I am leaving to see my husband on Wednesday July 9th, so hopefully when I get back there will be an approval notice!

IR-1 / CR-1 Spouse Visa Process & ProceduresGoing to another interview...
So after a month of waiting, I have another appointment at the Cincinnati office tomorrow morning. Does anyone have any suggestions on what I should bring? THe interview resulted from asking for an expedite on my case. CSC transfered my case to Cincinnati. I have no idea what I should bring. Information regarding my expedite request, information regarding our relationship or both. Any suggestions would be helpful.
Thanks

I think as long as your sis provides the required info, you should be ok. If she is receiving income, then it will be included. If she has plans to return to work, maybe her boss can write a letter stating the day she anticipates to return to work and what her hourly wage is along with how many hours a week she works. May, just a suggestion, they can add how long she has been employed there so they can see job stability.

Thank you Sarah for the support! It means a lot! dancin5hr.gif I am going to try and call the other Senator on Monday. I work at a bank, so yesterday was really busy and did not leave me much time to call all the people I wanted to. (Yes I know, I am misusing work time) hehehe My coworkers know my situation so they understand if I need to take 30 minutes to call someone. I really hope something gets done quickly. It seems to undermine the whole reason for an expedite.

What a crock of #######!!! pardon my French.
Hopefully your file won't have left the service center yet ..... that is a big possibility.
And it shouldn't take month ....
As you've made contact with the Senator, how about pushing for the expedite ?????
Send them a nice wad of documents .... pictures .... newspaper clippings ..... stuff on how your Husband is living (Google is your friend) .... court papers ..... and that letter from your lawyer stating you need an expedite.

I have already requested an expedite with all required documentation. The response to that was to send it to the local office. I have NO idea ####### is going on and I cannot get anyone to tell me. The woman from the Senators office told me there was nothing that we can do until at least 3 weeks from now. And that is to make sure it got back to CSC. I appreciate your good thoughts, I am just feeling very bitter right now. I should have left it alone and I would be getting approved soon, but now I have pushed myself out another month.

IR-1 / CR-1 Spouse Visa Process & Procedures~ EXPEDITE TIPS ~
I am going to cry. I called my Senators office to find out why my petition was sent to Cincinnati and she told me that she contacted that office and they told her that since my husband is not in the US, that there is no need to conduct the interview, so once my file is received in Cincinnati, they will send it right back to California. So I requested an expedite and now it is taking at least another month before my case is right back where it was. I called USCIS and told them that is was their error and she told me there was nothing she could do. So I am royally screwed and there is nothing I can do about it.

The first email is about your expedite.. it simply states your case is being sent to your local office for standard review and your local office will be contacting you.
The second email from your local office says that your case is undergoing "standard review" and they will contact you with an appointment for interview if one is needed.
Maybe it has to do with the reason used for you expedite? I'm guessing here, as I've not seen this b4. blink.gif The good word is IF an interview is needed.. so they are just clarifying something it seems.

I honestly have no idea. If it was for the expedite request, what is the purpose of sending somewhere else and then having to wait for an interview. It seems to nullify the point of an expedite... But then again USCIS does not have to make sense. We pay them to have our spouses here with us and then just for fun, they like to toy around with us.

When I called, the guy told me that it sounded like they approved the expedite and they were sending my case to Cincinnati for an interview to be adjudicated. It says in the e-mail that it is normal, but I have never heard of this. I told him that my husband is in Mexico, so it would only be me. He really did not know what to say because there was no further info in the system than what they sent me...

Well done Nicole .... now, are you able to collate the paperwork to back up your request?
I remember your situation with your sister and of all people, you deserve it.

Now you've got some renewed energy, can you collate your paperwork and write up a letter to explain your situation?
Phone requests for expedite rarely give a good outcome, so I want you to prepare just incase ..... God I hope they give it to you, I really do.
If you prepare now, at least the paperwork will be together ready to send to a Senator/Congressman if the outcome is not positive.

I'm praying for you
Sarah x

I told the lady that I have all the documentation needed to back up my statements and asked if I needed to send them anywhere. She told me that they do not need them at this time, but if they want to see it, they will ask me for the documentation. I told her about the death of my sister and that there is a murder investigation going on. The man who killed her was released from prison in November, where he served 7 years for murdering his uncle. I told her about the family battle that is breaking out, like the 7 court hearings that I am required to go to in order to determine who will be the executor of her estate (she was 20, so there was no will naming the executor) and I told her that my husband and I had been together for 5 years and that he knew my sister well, and it hurt him very deeply that he was not able to pay his last respects to my sister.

I also told her about the information I pulled off a Mexican government website that shows the city that my husband lives in, only 50% have running water and 0% have drainage. Which means there is no toilets or showers, so the rate of disease is very high. I told her that I spent a week there, and you have to go do your business behind the house, or by a tree. I used the humanitarian and emergent situtation cause for my expedite request.
