because he may want to know the consequences of this before he makes a decision. Like I said, it is just in case. And most lawyers do free initial consultations. That way he can get all the information upfront. It is not a confusing thing to be prepared.

The only and ONLY reason a lawyer should get involved is due to the prenup which is NOT an immigration issue, he is asking if he can nullify that as well. There is no immigration lawyer needed in this case as he is canceling the petition out, meaning, to cancel, no one just shows up for the interview, or you can contact USCIS to let them know.
But no, an immigration lawyer is not needed. They dont even need an immigration lawyer to get an annullment.

I have done this... I have previously cancelled an I-129F!


And even had you not gone thru a petition cancellation before, your advice is no less correct than someone who has done it before.


If you had bothered to read the rest of my post or the one before that, I stated that an immigration attorney would be a good idea IF THEY INTEND TO FILE OTHER PETITONS IN THE FUTURE.

There's really not much you can do but wait at this point.

My wife would have been unable to join me in the US during the visa process and I chose, for the good of my family, to stay in the US and work. Nobody forced us to live apart. We chose that and both knew that would be the circumstances at the time we decided to marry foreigners.


Sorry, if my words were too strong. I am just very sad and depressed. I don't understand why you thought I might have chosen simply to remain in the USA for my own reasons. I met my husband in a graduate school in the USA, fell in true love for the first time in my life, and got married there after my graduation. I could have stayed legally on OPT to search for a job, if I wanted to stay. But I didn't. I have lots of things I don't want to leave behind in my country. I wouldn't choose to go to America if my husband was not there.

Yes. I KNEW that I had to be away from my husband for a while, waiting for the visa processed, but I didn't expect it would be this long. It's just too painful. My husband and I spent almost everyday together for the two years of dating. Although we've talked to each other on the phone almost everyday for the last two years, it's not enough. I want to be with him, able to hug and kiss him. So I just try to find a way to expedite this process, if there is.



I was not being mean or malicious towards you or your wording. I totally sympathize with you. My husband and I have been apart for almost 7 months. I am going to see him next week. So I understand your situation. The waiting is tough, I think the waiting is actually the hardest part in this process.

What was approved was your I-129F petition for spouse. K3 is a visa. The two petitions were approved together by the same person at the same time. The emails arrived 30 minutes apart.

I am confused. I requested an expedite on my case on May 27th. on the 28th they sent me an e-mail that had all the infor for the expedite and the 2nd e-mail was an update on my case saying that they transfered my case to the local field office for a standard interview. I have not been approved yet and my husband is in Mexico. So what is this interview for? What does this mean? Is this a bigger issue than and RFE? We have been together 5 years. I sent in tons of pictures of us together plus a video that is from the WB from when I proposed to him on National TV. So I am not sure if this interview thing is good or bad. Does anyone have any idea?

Hey JennieLee,

Welcome to the club! When someone has the word "Touched" or "Touch" it means that there was an update on their case. When you go to www.USCIS.gov you can sign up to see your case online. You have to actally sign up using a user name and password in order to see the Touch. When you siign up and then sign on, there will be your "Portfolio" You can add cases to your Portfolio by using the receipt number. Then where it says last updated it will have the last date that there was any type of action on your case. That is what we all refer to as a "touch"

Befor my wife got here I tried to add her to my account and my bank (small credit union) would not allow me. That is not true. Banks are allowed to open an account for someone without a SSN as long as they have a document from their home country such as a passport, drivers license or other picture ID's. If it were illegal, there would not be a federal paper allowing us to do this.
