I filled mine out myself, there is a lot of useful information on this forum to help guide you through the paperwork. Unless there is complications with your case, like divorces, deportations or anything like that, there is no need for an attorney for the first portion. But that is entirely up to you, whether or not you feel comfortable doing it or if you want someone with experience to do it. But research your attorney thoughly... you don't want to pay someone thousands of dollars and they have no clue what they are talking about.

For those who think that your job shouldn't be part of consideration for expedite ..... there's a ton of people on here with jobs that cannot be affected by outside and abnormal stresses .... i.e. immigration delays.

As far as flooding the system with expedites .... not everyone works for or with the government. And those who apply would be prudent to back their requests up with other expedite criteria too.

Your finances, if dire, should definately be added to the mix .... especially prior to receiving the $4000.

Depression and missing your spouse is not part of the deal .... if however, you could make mistake when it comes to US Government weapons because the stress of these delays are getting to you .... then you have a valid reason to apply for the expedite.
Always use a strongly written letter from your boss on government headed paper .... the higher up the chain the boss is, the better.

Um, no. Expedites only happen for active members of the military and certain others that are not represented in this case. Be sure to have positive topic knowledge, before you make broad statements of fact on immigration.


Um No, expedites don't only happen for those in the military. Read up on expedite criteria on the USCIS website before you make statements you can't back up.

Ninja, you are through California and they have posted November 17, 2007 as their current processing times. Thus you are out of processing times. You could use USCIS error as an expedite request. That is my opinion though, it is up to you.

It will be backlash though once you go to the visa interview at the consulate, they will do the name search then, so once you think you can get your spouse home... NOPE... I think the 180 days thing is what they had hoped to achieve, but it is no where in sight at this point. You can request an expedite, but they have to meet the criteria requested. You can find a list of acceptable reasons to file an expedite on the USCIS website.

You can notify the embassy of you address change when you go for your interview. You can ignore the notices from NVC until you are done with the appointment for the K-3. If te K-3 visa falls through, then you can use the CR1 visa appointment for another shot at the visa. NVC holds cases for a year then they put it in the "dead" files. You can notify NVC in writing or by phone that you no longer wish to pursue the CR1 so they can put it aside now. It is up to you how you want to proceed.

It would be the CR-1, it is not taking too much longer than the K-3. With the K-3, you have to adjust status in the US and the immigrant cannot work or get any drivers license or other documentation until the status change is complete. The CR-1 gives the immigrant rights to work and get other documentation from the time they come in the US. But 2 years after the CR-11 is issued, you have to apply to remove the conditions of the green card.

Yeah It would be CR-1 if you have been married for less than 2 years at the time the visa is issued. It will be an IR-1 if you have been married for more than two years at that time

NVC will keep pending petitons active for one year before they toss them in the "dead" files. You can notify them by e-mail that you are no longer pursing the IR-1/CR-1 but instead pursuing the K-3 visa. Or you can keep it active just in case...

No, I have not done anything yet, just because I am not outside the processing times. They will tell me to wait anyways. I know what you mean about missing your spouse. I am going on July 9th to see my husband in Mexico for 2 and a half weeks. How sad is this. I get to see my husband for 2 and a half weeks out of the entire year. I don't know how military spouses do it. I commend them because this is just torture. I love my husband so much and there has been a lot in my life that I wish he were here for. My sister was murdered on Easter this year and it has been very difficult to do without him. Not to mention the fact that he did not have the opportunity to be at her funeral to say goodbye. It made me realize that if something were to happen to me, God forbid, what would happen, he would not be allowed to come and see me and would not know how I am. And he is working as a cop in Mexico, so if something weere to happen to him, God Forbid, I would not be able to make it there no sooner than 2 or 3 weeks. It makes me very angry with this whole process.

No, no, no, no, no. Do not tell NVC to cancel the I-130 petition. Never do that. You can ignore them and do nothing or you can notify them you're pursuing the I-129F path and ask them to return the petition to the National Records Center but never cancel or withdraw a petition for a loved one if you want them to come to the USA.

The K3 route will be faster but if NVC actually receives the I-130, you do have the option of pursuing both through to an interview. If the I-130 arrived in Cairo even a day before the K3 interview, he can interview for a CR1 visa instead. This is a long shot though and if it doesn't work, you've waisted nearly $500.


Ultimately the decision is theirs. We may know not to have NVC cancel, but it is their decision which is why I gave them all the facts, not just my opinon.
