IR-1 / CR-1 Spouse Visa Process & ProceduresHelp With I-130
QUOTE (Marie87 @ May 22 2008, 08:16 AM) <{POST_SNAPBACK}>
Hi everyone...I need some help filling out the I-130 form...

For item #13 - I was born in Jamaica but my father was a US citizen at my time of birth, granting me automatic US citizenship. I do not have a naturalization number or a certificate of citizenship...what should I put on the form?

For item #15 - I just got a new job but have not started as yet. Should I still put down the information as my present employer or should I put unemployed?

TIA,

Marie star_smile.gif

#13- You are a US Citizen, so all you would need would be your birth certificate, social security card, and a copy of the biographic page in the passport.

#15- I would put the information of the new job and put the day you will be starting there.

Hope this helps

you can submit the tax returns and you can provide the past six months of paystubs and a letter from the employer stating the amount per hour your husband makes, plus the annual salary. That way you can prove that although he made less than the minimum last year, this year he will surpass the requirement. I don't think sendng the past tax returns will hinder you, they just want to see that there is steady income and that your husband will be able to support you. It is up to your husband on if he wants to obtain a joint sponser.

you can submit the I-129F at anytime during the process, but the problem some people are running into is that the I-130 gets approved first and the I-129F gets disregarded, so it becomes a wasteof time for you and for USCIS. But it is up to you.

Hi,

I sent in my I-130 on February 8 to the CSC and still haven't gotten an NOA1 yet...is that normal or should I be on the phone harassing people? I keep looking at the "processing times" on the USCIS website and they're "processing" (whatever that means) petitions sent by August 19, so I was assuming that I had a long time to wait but looking at everyone else's info, it seems like everyone in the world has gotten their NOA1 except me. I'm divorced, so does that have anything to do with it? And I'm living abroad (with my husband) is that what's taking so long? If anyone has any input let me know. blink.gif

April

The "processing" times mean that they have already issued you a receipt and they are working on the approval for the case. I would call the 1800 number for USCIS and ask them about your receipt. They do sometimes send the receipt to the wrong address and sometimes don't issue it at all. So I would call to verify that they got it. Or you can make an info pass appointment at your local immigration office.

hello everybody out there!!!! is it mandatory for us to bring our medical records during medical????

If you had any major medical problems in your past, I think it's a good idea to bring any records you can dig. The problem I think you are referring to was someone who had something major in her background and when asked about the records, the hospital no longer had them.

This brings a question to my mind now, is there a list of immunizations my husband should have prior?

There is a list on the State Department website... I think it is www.travel.state.gov and click on the visa link and there is all the info you need, including a list of the most common vaccinations
NicoleX08FemaleMexico2008-05-22 10:02:00
IR-1 / CR-1 Spouse Visa Process & Proceduresis it mandatory?
You have to go to the medical exam in the country you are going to go to the interview. The officer at the consulate will ask for those records to show that you are up to date on all the shots required to enter the United States. If you have had the shots required, you can take it to the medical exam so you are not vaccinated again. But they do require the results of the medical exam during your visa interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat happens after I-130
You can file an I-129F with your I-130, this is called the K-3 Visa, it would get your wife here sooner, but she will have to Adjust Status in the United States after she gets here. A lot of filers here have gone that route. You can also request an expedite of your case because of the deployment. I cannot say if you would get approved or not, but you can go that route.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat happens after I-130
Hi Maximus, and welcome.

The I-130 is just the first step in the process to bringing your spouse to the US. The first step is the I-130, and currently those are taking anywhere from 5 to 12 months to process. Once it has been approved, then it will be sent to the National Visa Center, also known as NVC. There you and your spouse will be required to fill out more paperwork and information in order to process the visa application. Once the NVC has completed the case, it will be sent to the consulate in the country the spouse is from, so Thailand in your case. There the case will wait for an available appointment, typically within 6 months, depending on the volume. Your wife will be required to attend the interview. If she has ever been in the US illegally or has any issues that may disqualify her from entering the US, she will be denied, do not worry though because there is a waiver that she can fill out and turn in.
There is a wealth of valuable information on this website. Look under the "Guides" and "Wiki" portion of the website and you will find TONS of information.

They are not doing much anyways, and if they can read these posts and other people have access to view them, it may spark attention to the subject. Who knows it could go either way. I just pray that someone important is paying attention...

I am not an expert in that category, I am hoping that one of the more knowledgeable members will join in here. I would say she could try to extend the work visa, but I do not know how that works

IR-1 / CR-1 Spouse Visa Process & ProceduresQUESTION...
She came here legally, so she is ok. The only issue will be the overstay of her visa if she does not leave before it expires. As of now, once the I-130 is approved, she can adjust status in the US. If she overstays, she will have to file an I-601 for illegal presence in the US. It makes the case a little more difficult. I hope this helps a little

Sarah is Approved!!!!
Just got notice about 1.5 hours ago.

The process of adjudicating my case was started this morning about 10am Vermont time ... the date was changed on the USCIS website and my Senator's office has been updating us by email via Vermont today.

This was an expedite under the criteria of National Interest backed up with Financial Hardship, Humanitarian, a US Army Commander and a kick ####### Senator.

I'm a bit happy at the moment, so I will post the details of the expedite later in a hope that it will help others too.

Right now I just want to hug the Colonel and especially the Senator .... the man whose team made this happen!

Expedites are not impossible

.... I also want to thank a certain person on this website who truly pi**ed me off last week as without her I wouldn't have had the fire up my ####### to pull the paperwork together so quickly ... and involve every Tom, ####### and his dog in my case to get it approved.

Not ALL of us... I am still in Limbo... LOL

When your last updated date has changed on the USCIS website, it means you have had a touch.

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Case received and pending.

On January 18, 2008,

So other than that it's never been touched?

meaning NOA2 is no where on the horizon because they've never even picked the mutha up.

Do you sign in with a user name and password? Or do you just enter the case number? In order to see the last updated part that we are talking about, you have to sign up using a uername and password. It will show your portfolio where you can add case numbers to it. Once you add the case number it will show up in your portfolio and you will see at the top of the portfolio "Case number" "Last Updated" etc... When you look at the last updated part of the portfolio it will have a date, like mine surrently says 5/19/2008... So last Monday they did something with my case, what they did I have no idea because it still says pending when I click on the case number.

well, i did speak to someone nice actually. she said my date was february, i said november. she asked me to read the date on my noa1 and i did. she said, oh,you are out of our processing time. it seemed like she was changing something on the computer. then she said, well, we can't do anything until 30 days outside of processing. please call back in two weeks if you don't hear anything.

i can't say the result is great, but better than i expected. at least i know i don't actually have to live with a february date.

thanks everyone!

It is not the greatest news, but at least they did input the fact you are outside the processing times. I would def. keep an eye on it, I have a feeling an approval is coming very soon!

IR-1 / CR-1 Spouse Visa Process & ProceduresCASHERS CHEQUE OR MONEY ORDER DRAWN ON US BANK ??
I work at a bank, so I may have a few suggestions. First, Do you have someone in the US that you can wire money to and they can buy the money order for you? Like a parent, sibling or a friend. That could be one option. You could also find the US consulate in Inia and ask them if they sell money orders or cashiers checks in US funds. Or you could go to a money exchange place. They buy and sell foriegn money, they could sell the money orders too. Those are a few of the options you have.

Good luck with the expedite. Depending on your situation, USCIS may request the evidence for the expedite, or they might not. Going with the Senators office may work, but it may be a moot situation since you have alreaady requested an expedite on your own. But either way, Good Luck!
