yes, the USC can be appointed to be the agent. When NVC receives the case, they will assign the case number and they will send out the Choice of Agent form, known as the DS-3032. The Beneficiary can assign the USC to be the agent and receive all forms from the point forward. You can have this form filled out already with the beneficiary's signature and sent it out once the NVC line states that it has been mailed out.

seriously bad for relationship. My wifey and I find ourselves so frustrated at times. We are imploding and exploting all at the same time. Sad ....my bro, who is also a US itizen, got married 3 years ago in Pakistan, and brought his wife here on I-130 in only 10 months. I am now into 11th month with only a stooopid receipt.... That made me laugh! I am so sorry that you all have been waiting so long. It is not fair that we as spouses are trying the best we can to make our spouses legal and no one says a word edgewise, but if our spouses came over illegally, that shoud get tons of media, senators, congressmen and presidential candidates interested. It bugs me to no end how hypocritical we as a country are. We don't want illegal immigrants, but we don't want the legal ones either...

In Ohio, all I had to do was get on the internet and make a request for assistance. Then they sent me a letter saying that I needed to fill out and sign an official request and write a letter about my situation and everything pertaining to my case, including case number and a copy of my NOA-1. They then did an inquiry to USCIS and told me that I can request an expedite and send in evidence as to why I am requesting it. Then I send it directly to the Senator and they pass it to USCIS.

All this was within 2 weeks. I just have not had a moment to put together a convincing letter at the moment, at the time my sister was killed and it has been downhill since. I am trying to get it together enough to send to the Senator though.

I hope this helps at least a little.

My thoughts would be depending on the day she has to go back to Japan. If the baby is born in the US, she is an American and there will be no need for any further action. But if you and your wife are in Japan at the time, you could go to the US embassy in Japan and get your child an American birth certificate (because it will most likely be in Japanese) and get a passport for her. (My coworker had to do this in Germany, but it was 5 years ago.)

I feel the same way. I am not sure if the I-129f filers went down drastically and there are different immigration officers handling those cases or not. That would explain why those are getting done in record speeds. But those of us who decided to stick with the CR-1/IR-1 visas are being left out to dry. Immigration does not make sense in the slightest. I am truely happy for those that have been approved, it is not their fault, but there is always a sick feeling in my stomach when I know that it may be up to 8 months or more before my petition is completed. I am in month 4....

I was under the impression that if you are going to a consulate in a country that the documents are from, you do not need to have them translated. You can do it as a formality though, but I do not think it is necessary.

Since both were approved, you will most likely be forced to go the K-3 route anyways, so you don't have to worry about that too much. But you still need to contact NVC because if you don't they will send it to the local office and not the foreign consulate.

Yes, I got the message too.
I am going to proceed with both CR1 + K3, but we will hold on to CR1 and not send back any documents until few months later when the K3 physical file arrives in China. This is so that if my husband fails K3 interview, we know he still have another chance for CR1. I know this means we will be spending more $$, but getting the visa for him is more important. How about you?

Uscis is saying that since both are approved I-129F is cancelled and I-130 is oly valid.... NVC says that it's the I-129F being sent to the embassy and I-130 is being held for future adjustment of status.... The embassy is saying we can choose which to pursue and I don't understand anything anymore sad.gif

So please for my sanity... look and write here what's written on your I-130 NOA2... please


I would call and verify that with USCIS so that they will send it to NVC instead of you local office. It sounds like a box was checked wrong. That will be a big issue if it is not corrected

Not true... if you have a valid social but file jointly with a person without a vaild social (ITIN) then you and the other person are ineligible. No Stimulus package...

If you have already received your rebate, you would have to call the IRS about that, You will probably be able to request an ITIN for her, but probably not be able to ammend your tax return.

What she needs is an ITIN number, you can request one through the IRS. The only bad thing that I see with ammending this year is that you will not qualify for the tax stimulus rebate because anyone who files single or jointly with a person with an ITIN is diqualified from receiving it. If that is not an issue for you, I would go ahead and do an ammended return and request and ITIN for your wife.

Well since you filed in January, I don't think they will take you seriously at this point. THey are still processing petitions from August 2007. They will tell you to go to the website and look at the posted processing dates and tell you not to call back until you have passed those dates by 30 days... I don't want to sound negative, but that is the reality of it right now.

The gap between CSC K-3 filers and IR-1/CR-1 filers is still growing. I filed my stand alone I-130 in January, I don't get why mine would be skipped over someone who filed in March, but then again, there is not any type of system they go by. None of it makes sense.

#13- You are a US Citizen, so all you would need would be your birth certificate, social security card, and a copy of the biographic page in the passport.

#15- I would put the information of the new job and put the day you will be starting there.
