I don't know, I think the forms are fairly cut and dry and don't require any proofs to approve. You'd probably confuse the form-checker's little minds and would be lucky if they end up in the file :P

But, as always, I doubt it could do harm.

or do i need to send my birth certificate, police certificate, proof of engagement , evidence of financial support along with forms now?? or i take them with me to the interview, because on the form DS-156 they said: THE FOLLOWING DOCUMENTS MUST BE ATTACHED IN ORDER TO APPLY FOR A FIANCE VISA
so is that mean attach them to the DS-156 and send them right away or take em with me to the interview??


From everything I have heard from other London filers, just the forms for now. They have a station at the interview where you show the required documents. Why don't they change the form to reflect this? Couldn't say, except that they are standardized and different embassies want different things. If you want to send them in, okay I suppose, but you'll likely have to go through more work at the interview having them locate something.

and they also that AN APPOINTMENT FOR YOUR VISA INTERVIEW WILL NOT BE SCHEDULED UNLESS WE RECEIVED THE RESULTS OF YOUR MEDICAL EXAMINATION

Send the forms if you want, but they process them separately. The forms will sit on the desk until they get your medical I believe. They process this first, because why should they bother doing the work for someone who may be rejected at the medical, you know? Schedule your medical now (they do it one week in advance), send the forms if you like. You don't GET anything from the doctor to give to the embassy (maybe vaccination record sheet for later), in case you're wondering. They send the forms to the embassy in LND 4 business days or fewer after the medical occurs. At that point, your forms will begin to be processed. Don't panic!! It's all confusing :) We got our medical on a monday, sent the forms wednesday, but that was just our experience (we had scheduled the medical right after receiving NVC number). Oh and I would suggest some tracking number for sending your forms, LND seems to be very prone to the "we never received/lost your packet." Good luck!!

K-1 visa need to speak to an operator not the autoline.

You should of already had the embassy case number from the NVC and your case should of been already sent off and likely at the embassy by now or almost there.

Call NVC get the case number then call DOS and ask if its reached the embassy.

Our 129F was approved on 05 July, and as of 07 August we still get the message "there is no record of your case number" when we call the NVC processing center. Is the automated system accurate, or should I call and get a live operator? Is it typical to take more than 30 days to get a case number with the NVC?

One last question - what exactly does the NVC do? Are they charged with the background work, or is all that done when the application packet is sent in with the original 129F?

  My step-daughter has recently received her 2-year green card (hooray!). She is currently 18 - will there be any difference in the way we need to do her ROC when the time comes? I am not clear on when the minors LPR status "parts" with the mother in the case of a K-1/K-2 pair. Any clarity is appreciated.

  My wife and step-daughters arrived here on K-1/K-2 visas. We have done everything required and now everyone has their 2-year green card. When it comes time to "remove conditions" each of the girls will be older than 18.

 

  In the K-1/K-2 visa process I know the K-2 statuses are "linked" to the K-1 status. Now that they all have their green cards, are they each responsible for their own fates from here on out? And if we will be processing ROC papers for each of them, how will the girls establish they have been here in a bona fide way? Just curious about the linkage, collecting paperwork, etc. Thanks in advance for any insight in to this.

Removing Conditions on Residency General DiscussionTime to file for ROC - I have some worries/sleepless nights

  While I have not filed ROC yet, here is my thought: Stop worrying and file what you have. You seem to have a complete and honest story and you are able to tell it well. Just complete the process as best you can... it seems unlikely they will not grant you ROC after all this time and work. You might need to answer more questions than normal; it might take more time than you prefer; and some of the process might be confusing. But in the end, you will get through it. If there is nothing to hide, then there is nothing to hide. Relax, get some sleep, and provide a complete, honest disclosure of your situation and I bet it all works out in the end!

My wife came in as a K-1 with her two daughters on K-2 visas. They received AOS and 2-year green cards. The anniversary of their green card status (for ROC) will be March of 2015. The daughters are now 18 and 19 (and will be 18 and 20 in March).

 

Their mother wants to get a divorce from me, move back to her home country, and continue her life alone there. Will her daughters - now over 18 - be able to remain in the US and apply for ROC?

  Thanks for pointing me to the I-131. I have reviewed the instructions and it does apply to Conditional as well as LPR - so there should be no problem there. As for the other questions asked:

 

1) I don't know how long she will be out of the country - she will be caring for minor children in school, so more time out than here. She will come back and forth to the US throughout the time but we don't have any way of knowing the cumulative time in the US v. out of the US.

 

2) She will be able to be back here for any ROC interviews, meetings, etc - as long as we can plan them, the travel is not a problem.Maybe when she has ROC, we will need to renew the 131 at the same time?

 

  Is the I-131 good for the entire 2 years, regardless of re-entries? I expect that she will be "back and forth" during the time so I want to be certain the 131 maintains is validity past a single re-entry. I believe so but hope someone can confirm this fact.

  My wife needs to spend extended time in her home country caring for minor children and an elderly mother. My wife currently has her 2-year green card and we are on track for ROC in May/June of 2015. 

 

  What is the process for filing with the US government for her to have permission to (potentially) exceed the rule for time spent out of the country? We don't intend for her to forfeit her GC status... so can anyone enlighten me on the guideline?

My fiancee has one tattoo (small on her hip) and while it was not a big deal in the medical exam, the embassy required her to allow them to take a photo. We were told the embassy must take photos of all tattoos - but they asked first if they could be photographed while she was clothed. If you need to be nude, they must make other arrangements to get the photos.

Today we received an email from the US Embassy in Tegucigalpa informing us we have been approved for our K-1 visa! My fiancee and her daughters are approved. With the holiday schedule we will travel to the embassy on the 9th of January and they will take the passports. They told us the passports with visas would be ready for pickup the following afternoon after 3.

Our timeline is up-to-date, but I filed the first papers in March of 2011 and received notice today, 28 December. So if you are working your way through the process in Honduras, just be patient. It will happen for you too!

After my fiancee has her K-1 approved, we will goto the US and immediately (like the week we arrive) get married and send in the next stage of paperwork. But I want to know about her restrictions (if any) about traveling back and forth from the US and Honduras. I think the K-1 is a single-entry VISA, but family situations require us to go back to Honduras for a while soon after we marry (within a couple weeks). Will she be able to travel back and forth after we are married? Are there additional forms we need to complete in order for her to be able to come and go between the US and Honduras? She will not be working in either country - but she is the primary caregiver for her three year old nephew and we can not be away from Honduras for any longer than required.

In the information published, it says that one the K-1 is issued at the embassy it is "generally" good for up to 6 month for travel to the US. Does this time vary by embassy? This is no big deal... but I am curious - will I be allowed to be in the interview with them? I will go to Honduras for the appointment (or I will already be living there for the winter), but I am not sure if I will be allowed "in the room." And I am certain the girls will ask me for information! What is the process?

Same fees. Same medical. For the most part, same forms and documentation. Many consulates also want to see additional evidence that the applicant is the biological parent, such as photos of parent and child over the years, school records, etc. It depends on how reliable birth certificates are in that country. In some countries it's pretty easy to get falsified documents by paying off a government official. She'll probably also need a quit claim, signed and notarized by the children's father, that gives his permission for the children to immigrate permanently to the US.

The consulate should provide specific instructions, but usually very young children don't need to attend the interview.

In my business I do not get a W-2... I get a K-1. Since our business is a partnership, we do not get W-2 forms. However, our distributions from the partnership are shown on a K-1 (the tax form, not the visa forms). Will the K-1 substitute as income evidence in lieu of a W-2? In addition, in 2010 our business reported a loss, so this loss flowed through to my 1040. Will this affect my ability to meet the 125% test? We do not and will not be a public charge, but our business tax structure does not follow the typical "1040, W-2" format. Will the embassy personnel understand all of this? Our accounting firm will prepare a letter of employment and statement of my income, but I am concerned about how all of this will be viewed as part of the means testing for the visa. Any help would be appreciated. Even better - someone with experience as a business owner in this situation would be very helpful!

My finance and I are awaiting her interview... we are through all of the preliminary stuff. But circumstances with her family are making it highly unlikely that she can leave Honduras in the next year or so. As rotten as this is - I understand. So here is my question...

Should we delay the K-1 somehow? Can we switch from the K-1 process, get married in Honduras, and then restart her paperwork to get her and the kids here? I can travel back and forth, so while this is difficult, we can delay. But we are mid-stream in the K-1 process. Any suggestions? I do not want to do something that causes problems later. Frankly, if it takes more time and we just get married in Honduras, that is probably OK.

We have now successfully been granted a K-1 visa for my fiancee and her two daughters have K-2 status as part of the process. They are both under the age of 18 and their birth father is deceased. We have not yet gone to the US, but while researching all of the things we need to do when we get there, I was faced with this question: Am I a "legal guardian" of the minors when they are in the U.S.? I do not plan to adopt them (they are 17 and 15 - soon to be emancipated), but we will need to sign documents in the U.S. where we are to list the legal guardians. What is the process here? School forms, medical forms, and driver's licenses come to mind, and I am sure there will be more forms to sign. Thanks in advance for any enlightenment!

If your concern is future travel, on the plus side, several countries allow visa-free entry by US Green Card holders using the passports of their country where they would normally be required to have a visa. Others will still require a visa but are more likely to grant one to someone with a US GC than they may otherwise be. But, yes, they will need to become citizens (3 years minimum US residency, post-AOS) before becoming eligible to receive a US passport.



Thanks - I do travel frequently so I will be learning more about this situation in the future! I have trips to China and Japan in the wings now, and who knows what else will pop up. I guess we Americans become incredibly spoiled by being able to buy a ticket to just about any place on earth!

Please understand - this is critical - that your wife will not become a US Citizen when she marries you. Once you get married and apply to change her status she will become a Permanent Resident. Then 3 years after her permanent residency was approved she can apply to be a US Citizen. This is important to understand because if she falsely claims to be a US Citizen because she married you, she can be deported and given a lifetime ban from the US.


Thanks for the warning. We are aware of the distinction, but we will be doubly-certain to consider the exact wording of any forms we complete and sign!

  As long as the father permits it, you will not have any problems. If you look at our timeline, we just completed the entire process (K-1, K-2, finally green card!) for my wife and two step-daughters from Honduras. Just follow all the paperwork and it should flow right through.

 

  One thing we learned - if your daughters are older than 16, they need the police background search for the K1/K-2 process. You can email me if you have any specific questions and I am happy to share our experiences here. My step-daughters are now 18 and 17 - they were 15 and 14 when we started this process!

also, i was wondering what the deal is with the vaccinations. on the us embassy site it says K1 visa applicants do not need the full list of vaccinations at the medical. i understand these will be needed in time for the AOS once the visa has been approved. I am currently in the USA and we received our NVC documents this week. I am going home on August 2nd and wanted to book my medical for August 3rd since i will be in London anyway. I have a feeling im going to need a top up on my tetanus and MMR injections. I was wondering if i could go to the interview without these top ups and get them done afterwards on the NHS if the vaccination guidelines arent required until the AOS phase. thanks

Yes that is accurate, you won't need them until AOS occurs.

The wait for the interview is unbearable. We sent our packet 3 on august 6th and it never made it to the embassy for whatever reason. I had my medical on august 12th and it was logged on the 15th. Resent packet 3 on the 24th and now just sat around waiting. DOS have said both have been received and are still being processed. In the packet 3 we had included our provisional wedding date of september 28th but I am pretty much certain that wont be happening. Im hoping for my interview letter this week but im really at the end of my tether with this whole process. Its awful!


I hope for the best for you, it must be this week! Unfortunately there were the two holidays (last monday: British and this monday: American) which might be slowing things down. Unfortunately I think that wedding date will not happen, but maybe they are holding off giving you a date in the hopes that someone will cancel their interview? I don't think there are slots available before October, but I have heard people calling and looking for cancellations to take someone's spot. I would never cancel my interview (the holy grail), but there must be some people who do because you can see it in the history of this forum! I wish you luck!

Wedding plans... a mess :) We're just doing a super minimal thing with parents etc., but it still gets complicated, especially doing it alone! I can't imagine trying to plan anything with all those variables and time constraints, so I'm glad he and I both feel this way. I guess you do have 90 days, but that's not long to plan something like that if you want what has become the "typical american wedding."

So yeah, everything has it's complications with our relationship, but after this process, I'll have the patience of a saint :lol: I just cannot wait to be with him and I don't care how it happens. As for the planning, I think we've both put more effort into planning the honeymoon than the wedding, and I'm certainly looking forward to that!! :P




Haha I was trying to see your timeline there and I see you got your medical the same time my fiance did- smack in the middle of the riots. I was really worried about him as he lived in one of the impacted areas, but he still went of course. Then we tried to send the packet 3 and all the post offices were closed! Good grief!! Anyway, you haven't had any news? If so, that is awful!! And, bonus, monday is a holiday. I hope something happens for you because I know how it feels to wait. I am so grateful for my date, and I hope you get yours next week!
