Sorry to be away from the forums for such a long time, I just wanted to let everyone know my husband was approved on the 10th for his CR1. I have this sick feeling deep in my stomach. This whole process is stressing me out. I can't do a dang thing to move it along.. I can't concentrate. I feel so horrible about all of this.

Ugh, I wish I could approve your i-130 for you! Don't lose hope! Its all we have in the stupid roller coaster... that's all it is, an emotional roller coaster. You wait and wait for the NOA2 and then you wait for it to arrive at NVC, then wait more for case number! Luckily NVC is sooo much faster than USCIS but its still a waiting game. Its completely unfair that your husband cannot visit! Its ridiculous! He should be able to at least visit if he can show ties to back home, but I guess then still there is the cost factor. It certainly isn't easy being in a long distance relationship, and I feel for everyone that is doing it. Its been hard, but I can only imagine how amazing it will be once we're together. At our wedding we had long distance relationship quotes on every table, I'm going to leave some in hopes that maybe it will at least get a smile.... Crossing everything for you!

Ok...sooo I got tier 2, he said my case is still at NBC, he said to wait between 90 and 120 days to get an approval. I asked him if it was going to get transfered, and he said it USUALLY is, but it is not set in stone, he said the case could be adjudicated anywhere in the country. Then he said, now I need to go answer other phone calls, do you have any other questions? And I said, no I am just asking you this information and re-stating the info to get all my facts straight. I paid the 400+ dlls and that was cashed right away, so I feel I should at least receive some answers, since your national goal is 5 months and you are telling me to wait 9 months. I said I should at least be informed as what is happening with my information. I said that would be it, and said thank you. ...How about that? Our tax dollars working at its best....(sarcastic)ranting33va.gifClockWatch2.gifcray5ol.gif

I just had the most disheartening moment.  cray5ol.gif So, I go out to get my mail and there is an envelope from USCIS.  My heart starts racing in excitement...just to finally be hearing something, anything.  I rip open the envelope.  The letter is dated September 12, 2013.  I begin reading and it says on 05/06/13 you contacted us about your case.  I'm thinking to myself, I did???  I don't remember that.  I go on to read that I had notified them because they spelled my name incorrectly on the I-797.  Seriously???  I notified them the beginning of May and they are just now getting around to updating my name and sending me a confirmation.  Wow, that only took 4 months to correct my name.  I was chatting with my hubby when I got the mail, we were both so excited that I received something from the USCIS.  It was so disheartening to have to tell him that it was just a confirmation that they fixed the spelling for my name that I requested 4 months ago.   UGGHHH....this waiting is crazy.

 

The exact same thing happened to me. I contacted them early may regarding a typo, and I didnt hear from them untill last thursday. I am waiting for the paper copy in the mail. I have a priority date of april 29th, and still no NOA 2... :(

On the day the adoption became final, your stepdaughter would likely become a US citizen under the Child Citizenship Act (2000) if she was under 18 on that day.

See this is what confuses me of the CCA, it only states adoption of orphans and makes me think that in the best interest of my daughter (immigration wise) would be to wait until her mom becomes a USC. My daughter is 13 and my wife would be come eligible to file for USC in Feb of 2016 so she would be 15 by then. 

 

With all the legal issues being so expensive I wanted to see if I could do it my self, yes this is important for the whole family, but as I am the head of the house hold I must also look out for her other necessitates and well budget can only stretch so much. This is what made me wonder if anyone has been in this situation where they adopted their Permanent Resident stepchild, and if it affected their immigration status? 

 

Section 320: Automatic Acquisition of U.S. Citizenship for Children Born Outside of the United States and Residing Permanently in the United States

The child must meet the following requirements:

  • Have at least one U.S. citizen parent by birth or naturalization;
  • Be under 18 years of age;
  • Live in the legal and physical custody of the U.S. citizen parent;
  • Be admitted as an immigrant for lawful permanent residence; and

If the child is an orphan, the adoption must be final. If the adoption must be finalized in the United States, citizenship is acquired when the adoption is finalized.

Hi All, 

 

My oldest daughter who became a PR along with my wife on May 2013 has asked if I could adopt her so that she can bear my last name, which both my wife and youngest daughter have. In the spirit of DIY I have done a lot of research on the subject, but I keep coming up unclear with what an adoption will do for her immigration status. As I mentioned earlier she is already a PR and would derive citizenship from my wife after she becomes a citizen herself (if all goes well by May/June 2016.)  To clarify I am a USC. 

 

If anyone has previous experiences in the same situation as I am in, I would love some feedback on the following questions: 

 

After adoption would my daughter derive citizenship from me? 

 

Adoption says she would get a new birth certificate, would this certificate cause any issues with citizenship derivation from my wife if she cannot derive it from me? 

 

Is the adoption of my daughter now that she is a PR a good idea or should I wait until she becomes a citizen?

To be honest with you, there is not much what you can do but to wait for the decision. You don't know what USCIS is looking for. All you can do is to call the USCIS and make infor pass appointment to extent staying legally in the State.

When is the interview? and how did it go?

 

 

Hi I have known my wife for over 10 years, after the first 2 years of us dating we broke up for 3 years where I got married and filled for benefits with a different women, our marriage didnt work out and we filed for a divorce. (all this time I was out of status)I then met my girlfriend again (current wife), we started dating again and got engaaged in 2005 and then married in 2011. we have a solid marriage and things are good. 4 month after we got married we had a bad argument in the public and someone called the police and I was arrested for domictic violance,  the charged were never filled with the DA since there wasnt any evidence  that could support the false claim of violance.

 

our first Immigration interview went very smooth, I got my conditional GC and I filled for the I751 2 months ago and was suprised to see how fast I recieved a letter for interview from te USCIS (2 months wait only), they are asking for us to come n for an interview.

 

I am really worried as I understand less than 10% of all cases are being called for an interview. I have all documents that shows there was no charges from the DA which i will obviously bring.

 

The documents I already submitted was:

 

2 affidavids of friends

all required forms

copy of utility bills

copy of insurance

copy of health insurance

copy of join checking/savings

copy of joint car loan

copy of joint po box

copy of housing lease

pictures of anniversaries, gatherings, b-days vacations and so on

we have NO kids.

 

so why this interview? should I be worried? any good advise? I have spoken to the original attorney who helped filling for the initial process (we did the 751 our selves), and he wants $3000 to help us with the interview.

 

I apprecite any help.

Over a year later and we're still waiting!!!

We got called in for a second interview September 22. Thankfully this time it wasn't a Stokes interview but the man conducting the interview HAD NO RECORD OF OUR ORIGINAL INTERVIEW >:[ The interviewer was a lot nicer this time. He seemed more confused than us as to what was going on though. He even told us that they had sent people to our home. Husband works full time and is in grad school so he's gone from 7 am to 10 pm. I'm in school full time and watch my nieces in the evening so that she can go to school as well so I don't get home until around the same time. On the weekends we normally go to visit my parents on the weekends. When they came by we weren't home both times. They asked our neighbors if they recognized a picture of us and they said they recognized my husband and not me. They showed them a picture of me when I was 20 (I don't look nearly the same) and I'm completely bald now due to alopecia so of course they said they don't recognize me. That got us flagged as fraud which caused them to schedule this second interview.

Once again we came armed with binders of evidence and this time we made sure that he looked at all of our photo albums. I've been to China to meet his family and he's always around mine. That's a lot of work and money if we were a "sham marriage" The interviewer said he had no doubt of our authenticity (we've been married 4 and a half years now) but once again, they did not have our complete case file on site. I think they must have lost it somewhere and wont do anything about it. It's going on 60 day since the third interview and its still set as pending. I really don't know what to do at this point other than writing our congressperson

I am looking for some advice. My husband is moving to San Diego mid-August to begin university. I am following him in January. Normally we file in the VSC b/c we live in Philly, but since he will need to do a biometrics apt I guess we need to quickly do a change of address form AR-11 with USCIS and file with the CSC so that he can attend the biometrics apt in CA...right? We need to file in September. Thanks for your help.

Also, on the I-751, my address will be different than his. Do you think that will be an issue? We have lived at the same address since we were married up until now...and since he's beginning school in CA and I'm finishing school in PA it isn't too odd.

It feels like forever since we've had to do any immigration paperwork and I forgot how crazy the fees are....$545!!! Outrageous!
