you can have the children follow to join after he is here, but you have to list their names on the I-129F even if they're not coming with him now, because they will use this letter to get their medical exams and vaccines whenever you're ready to file for them to come within a year of the K1 visa being issued. Firstly, thank to both of your for your comments. They are both very detailed and full of very helpful insight. I have a few followups:

I am not super worried about her having trouble coming in again as she uses her Spanish passport when she enters the US. I also checked with the embassy here if the whole idea was ok and they said it was fine as long as she doesn't violate her tourist visa (by staying). I know they do not have the final say but we just recently went to the US and we had no problems.

Does anyone have an idea of how long this process will take now? Once we get our NOA2 how long does it take to get scheduled for an interview and all of that?

I recently got married to my wife in Argentina. She is from Argentina, and we were married here. We are planning on living in the US and as such have started the application process.

From what I have read it looks like the best way to go is the I-130 form, and then get a K3 to bring her to the States to hang out.

I am looking for general advice here on the best way to go. She already has a tourist visa in her Spanish Passport (duel citizen) so she can enter when she needs. We need to go to the US this summer for 3 months for my work so we will likely just be going on her tourist visa and then leaving to return here afterwards. What would be the best way to go in my situation?

Side Questions:

When submitting I-130 I am using a copy of my passport since I do not have my birth certificate on hand here in Argentina. Do I need only the first page or all of the pages photocopied?
Is there any advantage to have her apply as being Spanish instead of being Argentine?

have thesame situation i was interviewed july 11 (thursday) everything went well.then they gave me  221(g) form also want me to submit nbi with a.k.a in my bc correction. sent it friday (july 12). embassy received monday,..tuesday  check status still administrative processing,today husband called the embassy they said they will start processing it five days after they received the paper(nbi).im still waiting to what would be the outcome.maybe they just need it to complete the process..

 

oh really, I hope it goes well for you guys :). did they kept your passport too? I hope you keep me updated on your status...thank you

HI there my fiancee just went through her interview. The interview went fine but she was unable to find out if shes approve or not base on a document they needed..she  was issue a 221g for nbi clearance for aka on her birth certificate name correction. They kepty her passport..is that a good sign? .Anyhow we  sent the nbi clearance in and it was promptly recieve by the immigrattion unit in Manila us embassy through 2 go courier..I wonder if anyone have the same issue or was in the same situation? and how long does it take for them to process her visa? do i have anything to worry about?  thank you

Hey guys,

 

So my American fiance sent our application to the Dallas Lockbox 4 weeks ago (on the 18th September I believe). He didn't have it tracked in the mail (yep, I'm super pissed about this), but it obviously got there because his cheque has been cashed already. But we (well, he) still hasn't recieved the NOA1 - it's been four weeks.

 

Is it time to panic yet? Is there any way to contact anyone to make sure they did actually recieve it? Please help! I'm freaking out.

Hey guys,

 

So I recieved my K1 visa (stuck inside my passport) in the post today and ... I accidentally opened the sealed envelope. PLEASE don't tell me I'm stupid because I've spent all afternoon beating myself up over it. 

 

Anyway, the question is: what do I do now?! Do I send my passport/visa + the sealed (well, now un-sealed) packet to the embassy with a letter ASAP? Or do I wait for a response from the embassy (I sent a query about this via their contact form). 

 

Any thoughts/advice/guidance would be so appreciated! I am due to fly to the US in 6 weeks so whatever I do, it needs to be the right thing and it needs to happen as quickly as possible.

I was just wondering. maybe we could all do something to make them work faster on our cases. it seems like they've done nothing the whole december and they were just sitting on out cases giving us the run around. Maybe if we could all blow up their phones everyday then they would start working on the cases filed in July. I saw cases filed in August that were already approved by December, and if they are working on first come first serve basis then that just aint right! :bonk:

For whatever it's worth, we have issued two service requests (late December and early January) and have not heard anything back from them yet. Your above response appears to be generic one if you ask me. Note that we have an Immigration Lawyer and he issued the first service request; I issued the second on myself. If we hear something I will update you all. I really doubt that they will go too much long on the July Filers, especially another 120 days. Let's just keep our heads up and hope from sore more momentum soon at the CSC... :whistle:



my fiance said he had made like 6 service requests already since September. haha. I guess the only thing that's gonna make them work on our case is if we keep calling them that way they will remember that they have work to do. I've seen cases filed in early August that has already been approved and it sucks coz they said they work on first come first serve basis. But its good to see some July cases being approved already. I just hope we don't have to wait 4 months more. Our NOA2 is coming soon I can feel it. *goodvibes good luck on yours too. :star:

We filed our K1 application on July 15th. I think it was the 24th of July when we got the NOA1. It has been almost 6 months now and still no NOA2. Based from my readings on VJ the delay is caused by Obama's Dream ACT. It is really frustrating for me and my fiance to hear this news not to mention that he might get deployed to Afghanistan next month. We called USCIS on January 3rd and we just got a reply today saying :

"We are experiencing a longer processing period than what is currently reflected on our national website. Your I-129F, Petition for Alien fiancé, is pending review. We recognize your interest in a final determination on your pending petition. The California Service Center is committed to processing this workload, and will be making every effort to finish reviewing your case as soon as available under our resource constraints. If your Form I-129F remains pending 120 days or more from the date of this response, you may call the National Customer Service Center.."

meaning we need to wait 4 months more. Does anybody here knows anything that we can do to speed up the process? Please. We are willing to do everything just to be together soonest.

OMG OMG OMG!!!! USCIS just called my fiance for an RFE!!! yes, it's an RFE but that makes me very happy coz now i know that they are already working on our case. that's way better than waiting for over six months without anything from them. all she wants is for my fiance to fax her his G235a form coz he forgot to sign it. I was told the same thing. So I guess it's a standard reply they have. Last night I tried filing an e-request and it said that an inquiry was already made and i have to wait for 30 days until i can file an e-request again. so 120 days or 30 days I'd like to call after whichever is earlier. haha. I really hope we all hear from them soon coz all this waiting is so frustrating.

If you already have an account, sign in. If not, sign up for one. Then, click on your receipt number and change the number by one going up or down. If this petition is the same kind as yours (K-1), then copy the receipt number, and go back to your portfolio. Click 'add a case to your portfolio'. Do this for all the cases you find until the next number you enter is a different type of petition. This is how I found my group. I hope that helps and that you receive you long awaited NOA2 soon!

its very upsetting to find out that cases filed before ours have been already approved on December of last year. :crying: We filed the K1 on July 15 got the NOA1 through email a couple days later. However the hard copy of the NOA1 was returned by the post office. We called USCIS and they sent it again and it was received around 1st week of September. Up until now we haven't received our NOA2 yet. We filled a service request on Jan 3rd and heard from USCIS today asking us to wait for 120 days before calling them again to inquire on our case. It's really very frustrating for us coz my fiance might get deployed to Afghanistan next month, which i really pray not to happen. :( DOes anybody here have any suggestion on what we should do to somehow speed up the process of getting the NOA2???

Once case is completed at the NVC, they will contact the USEM and set an interview for the applicant. My case completed Jan 29 and they emailed me Feb 2 to inform that my visa interview has been scheduled on March 6. February is fully booked already. Blessings on your journey.



is it the same for k1? coz from what i have read for K1 visa, you have to pay at BPI first before you could set an interview with USEM coz they will need the receipt of payment.

1040 is the tax return. W2s show what a person made and how much taxes, social security, etc were taken out of an individual's pay, 1040 is what gets filed after the end of the year to determine if you get money back from taxes or if you owe money in taxes.

I already have my case number since Dec.11. But as I already mentioned, I can't still proceed because I am still waiting for my son's passport. It was bad, I procrastinated in applying his.I should have done it early this year :-( Coz i really could not do it until this december because I had hard time walking that i used crutches for months because of accident i encountered. My fiance and I just keep on praying on God's perfect timing :-) thanks again :-)

hi guys..me and my fiance are a little worried about the validity or expiration of our application regarding the priority date and the interview date. we are trying to complete for now the requirements needed for the interview but the problem is the 4 months validity that they say of our application and it is going to expire this march but we cant do the interview this march yet and as ive looked through the available dates for interview only one date appears which is march 11. the question is that will the embassy automatically extend the validity of our application?
