"On November 23, 2010, a USCIS office received this case from the State Department with a request that we review it." This is the part that doesn't make sense to me. At this stage of the process, USCIS should not be getting anything from the State Department. Guess we will have to wait and see if others get the same message for approvals. Good luck to all of us.

I had a very nice surprise waiting in my mailbox today......I-797C APPROVAL NOTICE!!! My case on the USCIS website still says "initial review". The letter was from the Texas Service Center. The Notice Date is November 23, 2010........wonder why I got touched on the 24th and 26th? Now on to the NVC stage. Thank God, and hoping all June and July filers receive their approvals THIS WEEK!!!

If you name contains any letters other than Roman Letters (a,b,c.........etc) then you would write your name in your "native alphabet".

Persons who will accompany you means who will immigrate with you. If your sponsor and/or U.S. Citizen children (if any) are "on the same plane" with you; they do NOT count. For example, if you are flying with your sponsor and a U.S. citizen child, you would put NONE for 31a.

Start getting ready NOW for the NVC stage. Once you receive your NOA2, and your case gets to the NVC, you will find it moves quickly from there. You will kick yourself later if you don't get all the NVC documents together NOW.

Once you have your NVC case number, its ok to send the DS 3032, no need to wait for anything from NVC first.


I second that! DO NOT WAIT for snail mail from NVC. Once you have your case #, you can send in your DS-3032. Use the email template. Get your Invoice I.D. # from the human. Then you can log on to the payment portal and pay your AOS and IV fees. Once the fees are marked PAID, you can print the bar-coded Document Cover Sheet(s), and send in your AOS and your IV packages. Things can move very quickly at NVC. It all depends on how fast you want them to move. Once you have submitted your AOS and IV packages, SIF and CC could be within a few days depending on whether or not you receive RFE(s). Send your AOS and IV via certified mail (return receipt requested). GOOD LUCK!!!

Thousands of I-130 petitions were mishandled by TSC, due to "unforeseen circumstances". My I-130 was approved on 11/23, but did not reach the NVC for 80 days!! Hang in there until the end of this month. USCIS is trying to clean up their mess by the end of February (according to their press release).

This is the first step in a long journey. You will be fine as long as your husband submitted all the required documents. Even IF something is missing, USCIS will let you know, and your husband can send in what they request. Don't spend your time worrying about WHAT IF! Take the time NOW to start preparing for the next stage - NVC. Above all, read the guides, and you will be prepared for a smoother journey. You will have ups and downs all throughout this process, but KEEP BUSY with upcoming paperwork you are going to need. A lot of people here on VJ will help you if you run into a snag.

I am struggling here a little. Is it 150 or 180 and is it a goal or a law? Are there 150 or 180 days of processing or just dust collecting? What is 11 months? And what USCIS average is 20.08 months? If it really takes that long, I think I would rather just sellout a move to Venezuela. Are all of these numbers and statements about goals and laws just venting driven by a very frustrating process operated by seemingly incompetent government employees?

And while I am on a roll here, the whole USCIS thing is scary. Lost paper work, conflicting answers, astounding ignorance and punitive processes all from USCIS. How is it possible that an RFE can be generated asking for documents that are already in the possession of USCIS? How do I know that the documents I sent to USCIS will be in the folder that an adjudication officer looks at? How do I know that someone is not going to have a bad day and just drop my entire package into the circular file. How do I know that USCIS ever sent me anything. If a piece of paper is lost, why does it cost so much to replace it? Why should I have to just hope and pray that the person who looks at my file is having a good day, is competent, has everything I submitted and will not get distracted or just plain check the wrong box.

In case you are wondering what "venting driven by a very frustrating process" looks like, just read again.

I would go with what is on your birth certificate. Both my U.S. Citizen daughters have two first names. That was not my intention, but when the Philippine birth certificates were registered NSO listed their first and middle names as their first name, then my wife's maiden name, and then my last name. So, that is what is on their U.S. Passports, Social Security cards, Philippine Passports, etc.......SO, I would suggest being consistent with what is on your birth certificate.

Question: has anyone ever asked the Embassy for help in expediting a K-1 application from the start? My finace is in the Philippines, in a very poor purok, nowhere near an urban section or town. To get to her village, you have to cross a river on a raft. I emailed the embassy requesting help while I am finishing my paperwork to file this week. I am in hte process of writing the cover letter now requesting expedition based on humanitarian, and extreme emergent situations. I am also planning on contacting my senators/state representatives requesting assistance. I thought I knew poverty until I saw the village. The village made a campground look good. It was very much off the beaten path for anyone but pinoys.

Hello everyone. I'm in the process of sending my I-129F package and i'm on the last leg of finishing the package. My question is, I'm a dual citizen. I'm a filipino Citizen and an American Citizen. I was born here in the United States but since i went to school over there in the Philippines, i became a dual citizen. Will this by any way affect my petition? I'm basically using my American Citizenship all the time but i do have a philippine passport. And i have about 3 stamps on my philippine passport. should i include that in my proof of being together or will it just jeopordize my filing? All i have is my philippine passport and nothing else to support my dual citizenship. (i don't have the certificate of naturalization because it was lost in a flood.) Thanks.


If you were born in the U.S., then you are a U.S. citizen. Your U.S. birth certificate is all you need. You can obtain a certified copy of the birth certificate from the vital statistics bureau in the State where you were born.

Not sure about the K1, but when my wife went to her interview in Manila, she did NOT have to provide any paperwork to the Embassy. She took a suitcase full of certified copies and supporting evidence, but did not have to show any of it. The Embassy had all the originals I supplied to the NVC (even her 2x2 pictures). This was a complete shock to me, as even the Embassy website says to have originals, certified copies, etc at the interview. She was asked to show a few photos of us together along with our kids. Other than that the CO had what I had supplied to USCIS and NVC. That is what happened in our case. I still think it is better to bring all your paperwork to the interview. Better safe than sorry. I should add we are applying for a K1 visa, my fiance has possible tb, the interview is next week, and the results won't be back for 4 weeks. What on earth should we do? Is there a form saying that we choose to treat it in the states? Could this result in a possible denial? Please help help help


I don't think it will be denied, but IF he is positive for TB, the visa will more than likely be delayed until such time he has completed treatment in his home country. I don't think he will be admitted to the U.S. with active TB. My wife's 2 month sputum culture was negative, and she was given a waiver, but had to report to the local health department here in the States for follow-up testing. It did not hold up the processing of her green card though.

I have received the reciept(NOA1)from the VSC and it of course lists my fiance's name and date of birth,
but under COUNTRY OF BIRTH it says UNKNOWN,... IS THIS NORMAL OR DO I NEED TO CONTACT THEM TO CORRECT THIS?
Surely I did not leave this out on her G325A.
