Ours was transferred from the CSC to the TSC in November and I received noticed on December 27 (almost 4 months to the day from NOA 1 as expected) that we were approved. Yours should be coming shortly. I don't believe you'd now have to wait another 4-5 months for them to finish reviewing. Hope this helps!


Mine was also transferred from CSC, and approved by TSC in 119 days (11/23/2010), BUT still has not been transferred to NVC. Keep us informed if you get a case #

36,000 cases transferred from CSC to TSC for adjudication!!! I can't believe only we here on VJ are experiencing the same problem. It has to be a systemic problem at TSC. All July filers are over the advertised 5 month processing time-frame, and are approaching 6 months. This is USCIS error. Individual complaints go in one ear and out the other at USCIS. We need a class-action letter (or something). We probably represent all 50 States (or close to it). Does anyone have any idea how we could bring this to the attention of the media, acting as one voice? I would be willing to sign a petition or letter requesting an investigation of the incompetence of USCIS in our cases. Comments?? Suggestions??

Saying you're approved, then sending you that letter was almost the same as winning the lottery and losing the ticket. Congrats!! Like others have said, I sure hope this approval signals the breaking of the log-jam at TSC. Hoping to see many more approvals this coming week, so we all can be together at NVC. Hope us June/July/August filers can stay in touch, and help one another through the NVC and Consular stages. Although our spouses are from different countries, I feel a bond with all you guys. This has been a roller-coaster of a ride so far, but I feel things will start picking up for us now. I have faith that we will all be reunited with our families within the next 3 or 4 months.

Just got off the phone with USCIS NCSC. Escalated to a service representative per my request. Told her my story, she looked up my petition number, and told me that there was nothing new to report. She did say that I could expect my case to be completed and sent to NVC within 2 weeks. Nice to hear, but not holding my breath.

Also, as I was browsing another website, it appears that VJ members who were transferred to TSC are not the only ones having problems getting their cases adjudicated and/or forwarded to NVC.

I don't really know what to think. Maybe NVC is so backlogged with TPS, etc, petitions/applications, USCIS is holding on to petitions to allow NVC to clear some of their backlog. Does anyone know if any of the other approvals from other Service Centers have been forwarded to NVC, or is it just the petitions being adjudicated at TSC?

When I received my NOA2 from TSC (dated 23 Nov), I waited 1 week before I called NVC to find out my case #. Until now NVC still does not have my file. There are several of us in the same boat. I put in a service request to USCIS about 3 weeks ago to find out where my petition was. I received a letter from USCIS (TSC) dated 23 December, that stated: "Your application was ordered approved in November; however, the processing is not complete. The application has not been transferred to the National Visa Center, and the approval letter has not been sent. A request has been made to the adjudicating officer to complete the processing of this application". The letter was signed by "Officer XMO217 USCIS". So, 13 days later, I am still waiting for the adjudicating officer to "complete the processing of my application". NOTE: For some of the sticklers who read this forum, TSC used the word "application" in the letter I received vice "petition".

He is probably working in his cubical with a dunce cap on his head.

We need to do a lot of research on the Law that created the K3 non-immigrant visa. As far as I know the Legal Immigration Family Equity (LIFE) act that was signed into law by President Clinton on 21 December 2000 has not been repealed. I could be wrong though.

Celldoc: My background is in Electronic Engineering Technology (for Honeywell and John Fluke Instrumentation). I am an analytical type person and most call me a perfectionist. No, I don't have any formal training in law (it makes me sick to my stomach when I see what is going on in the courts in this country). But I have had several friends who are lawyers and I like to keep track of what is going on especially in the legislative branch of our government. I filed the I-130 (NOA1 is August 6) and then filed the K3 (NOA1 is August 30). I think that my appeal in January to my Senator and/or representative will be more along legal lines of what they (the USCIS) have done and are doing. We will see what happens.
It would be interesting if we could find someone in the media to take up our cause. Does anyone have an inside track on anyone in the media that would be interested?


After Congress sends a Bill to the President, and He signs the Bill into law; that's where the problems begin. The BUREAUCRATS take over. They implement the laws according to how THEY interpret them. Bill, I think you are on the right track. USCIS and NVC are stacked with career bureaucrats. Administrations come and go while their jobs are secure from year to year. Talk to you attorney friends. Perhaps a law suit filed (class action??) against DHS (USCIS) and/or DOS (NVC) would at least get someone's attention. Just a thought..... Also, I believe national media attention is key in exposing the incompetence of USCIS/NVC. We have members right here on VJ that represent all 50 States. As for me, no matter what happens to my case, I will never forget the insensitivity and bureaucratic bungling of our collective cases by USCIS and NVC.

Would it be a bad idea to now file for the k-3? This waiting period is ridiculous and is really pissing me off! I have two small children who need their father. What happened to family unity? This whole process is so unfair. They should make it so that spouses of American citizens can get to the U.S A LOT quicker.


AGREED!! My two USC daughters are still with their Mother (my wife) in the Philippines, and they don't understand WHY their mother can't come NOW!! My older daughter is exhibiting signs of depression coupled with disobedience to her Mother. (She is 12.......13 on Feb 14). I try to console them via Skype every day, and let them know we will all be together soon. My wife keeps telling me to be patient, but that has never been a virtue of mine.

I am curious...After the switch to TSC, were you one of the people who had the status change notice that your petition was further transferred to a "USCIS Office"?

When my petition was transferred from CSC to TSC, I then received an email stating that my case had been transferred to a USCIS office for processing. When I received my NOA2, it came from TSC. Looks like it never left TSC. Just hanging on til the first of the year. I will give it some more time........don't know how much longer I can wait before I blow my top!! Wouldn't be the "smart" thing to do though. Anyway, God Bless Us ALL. May we all have a VERY Happy New Year as we are re-united with our families.

Has anyone had 30 days pass since their service request was initiated? I'm just curious. And caffeinated.


I called NCSC last week, and a representative took all my info, and said that he would send an email to the adjudicator who handled my case at TSC. He told me to expect either an email, phone call or letter NLT 6 January, as to where my paperwork is located. He did say that my NOA2 was genuine, and that it should have already been received by NSC. I also sent an email to NVC (with a scanned attachment of my NOA2) on 12/15. I guess these were "service requests". I have not heard anything as yet. I am tired of USCIS and NVC pointing fingers at one another. Dumb and Dumber ride again!! My New Year's Resolution is to expose the bureaucratic incompetence exhibited by USCIS and NVC. Even if I got my case number today (which I won't), and if the rest of my journey only took a couple of months (which it won't), I am dedicated to getting to bottom of WHY we, as U.S. Citizens, have to endure this inefficiency in order to be "re-united with our families".

All I can say for now is I completely echo your sentiments. In what little free time I have, I will try to do some research in terms of what (if any) recourse we, who evidently are getting/having gotten hosed, may have. The immediate problem I see with our "group" is our abysmally small number. In order for any voice to be heard in any large bureaucratic arena, the cumulative voice needs to be loud, which can only result from a large backing. We don't have that backing. I see absolutely no way of knowing how many (hundreds? thousands?) of other applicants are in the same predicament as us. Also, I don't have the money to hire a top-notch immigration attorney who may have the legal know-how on how to negotiate through all this efficiently.

As a side-note, I'm sure you've heard this before, but I'll say it anyway as a fellow American- thanks for your years of service.

There are hundreds, perhaps thousands, of U.S. Citizens in every State of the Union who are experiencing, (or have experienced) the bureaucratic bungling of our broken immigration system. I personally don't have the money either to hire a high-powered attorney to guide us through this maze, but I would be willing to pony up a few dollars in the form of a collection/retainer to get this thing moving. Media attention, like Skynaut suggested, is a step in the right direction. Let's see if we get any other suggestions or comments.

Would it be possible to involve some newspapers, tv or journalists into this? They could make it heard! Esp when I heard that politicians in US wanted to give those illegals in US a chance to become legals, so that could be confronted with our cases, saying citizens of US have to wait for God knows how long to get their spouses legally!
Maybe someone should try writing to a newspaper? Just an idea!


I think media attention is a great idea! From what I have read here on VJ, our Representatives and Senators, and most certainly the DHS (USCIS) and DOS (NVC), are pretty much useless in response to our cries for help. Look at what the Tea Party has accomplished in the past year. Whether one agrees with the Tea Party or not, they have shown what a group of grass-roots CITIZENS can do when they are motivated by injustice. As an aside note, if I had performed my duties in the Navy in the incompetent manner in which USCIS and NVC perform their duties, I would have been discharged for dereliction of duty.

As you can see from my time-line, my petition was approved by TSC on 23 November (119 days ......GREAT!).............But wait; there's more.......I still have not received a NVC case number!!!! My petition is stuck in limbo somewhere between TSC and NVC. It's time to face the fact that all of us who were transferred from CSC to TSC got hosed by the incompetent immigration bureaucracy. "We" have all sent emails, called USCIS / NVC, and have contacted our Representatives and Senators, many times, but to no avail (yet). I read we must be patient, give the system time to work, 5 months, 6 months, holidays, blah, blah, blah......As for me, I'm tired of waiting. I served my country proudly and honorably in the U.S. Navy for 23 years, and I think I deserve better treatment than this. AS DO ALL U.S. CITIZENS!!! I truly feel for those foreigners currently living in hopeless situations, and I believe they deserve our help. But.......U.S. Citizens who are trying to do the right thing, and bring their fiances, spouses and children to this country legally should not take a back-seat to ANYONE. Perhaps we could start a grass-roots, political action group that would force Congress, the Administration, and the mindless bureaucracy to sit up and take notice of us. If we don't do something now, this situation will only get worse for future filers. COMMENTS?? SUGGESTIONS???

Well if I was DanTes and tomjoyce and I had a copy of everything I filed originally, I would ship that to the Chicago Lockbox along with a copy of your NOA1, transfer notice, and NOA2 and a cover letter detailing all the communications between you and USCIS. That way they have everything they need to resend to NVC immediately. Rather than sitting around waiting for them to find it, or finally realize that they lost it, just give it to them again. It could be that they are batching them and you guys are just the first to get NOA2 but they haven't bothered to send on to NVC because they expect to approve the rest of us soon. But the fact that nobody has been touched in 20 days or so makes me kind of doubt that.


GREAT IDEA!! But instead of mailing the package, think I'm gonna drive to Texas, wait for the stamp of approval (again), and hand deliver it to New Hampshire!! (then file a claim for gasoline and food). What do you think Tom?? Let's start a CONVOY!! (not really......before someone on VJ thinks I'm serious). I will wait til after the first of the year, then I will start knocking on my Senator's door (Harry Reid). Might even send an email to the White House. Quick update: I-130 approved by TSC on 23 Nov. Still no NVC case #. Sent email to nvcresearch@state.gov last Wed. Getting a bit frustrated as today it has been one month since my petition was approved. I called USCIS yesterday and talked to a tier 2 human. He took all my info, and said he would send an email to the adjudicator who handled my case, and that I should hear something from USCIS by Jan 6. Then I contacted NVC.......still no case #. The lady I talked to said that I should scan my I-797C
Approval Notice to them. I already did this last Wednesday at my 15 "business day" mark. She did say that my petition should have already arrived at NVC. She said anything beyond 3 weeks is not normal. Still waiting!!!!!! SO, you guys that have not yet received your NOA2 from TSC, don't feel too bad. Even though I got mine, I am stuck in limbo somewhere between TEXAS and NEW HAMPSHIRE!!! We got HOSED when our cases were transferred from CSC to TSC. MERRY CHRISTMAS.

:thumbs:AviatorBill, I agree with you 100%. The problem with the Bureaucrats is that no matter how inefficiently they perform their jobs, for the most part they cannot be fired. They just get promoted to a higher position within the agency depending on their seniority. Representatives and Senators come and go depending on the will of the people, but bureaucrats implement the laws passed by Congress, and signed by the President, pretty much as they see fit. The law basically states that the "goal" is to REUNITE FAMILIES!! Secretaries Napolitano and Clinton will be history in 2 more years (if not sooner), but the bureaucrats remain. Immigration reform has been placed on a back burner for the time being, and it is just our bad luck that a lot of us are caught up in the vacuum created by Congress. I certainly feel for the Haitians (and others), for all they have endured to this date, and I do not begrudge them the priority they are currently receiving (maybe a little bit). IF "charity begins at home" - I want to be reunited with my wife NOW!!! I am sure I will be slammed by these insensitive remarks, but it frustrates me that when I call NVC I have to press 2 to get into the system!!! Shouldn't I be pressing 1??? I think it this alone tells us how important we are at this particular time.

At this point I would be happy to drive to Texas, pick up my approved petition, and hand-deliver it to New Hampshire. While it may be true that none of us have a "Constitutional Right" to bring our foreign-born spouses to the U.S., the 6th Amendment gives even accused criminals the right to a SPEEDY TRIAL. Also, what about those unalienable rights espoused by the Declaration of Independence - Life, Liberty, and the Pursuit of Happiness?? Some of the "Simple Servants" at USCIS and NVC are definitely messing with our PURSUIT OF HAPPINESS!! Just venting......helps sometimes. Good luck to ALL of us in the NEAR future.

I am one of the four I-130 (IR-1) Petitioners that was approved by TSC after being transferred from CSC. My NOA2 date is 23 November. The problem I now face is that I have not yet received my NVC case #. To my knowledge neither have the other 3 petitioners. I called NCSC this morning, and the representative told me that my case had indeed been approved, and that it was forwarded to NVC. I then talked to a representative at NVC, and was told that since I had not yet received my case # by now, that I could expect at least a 90 day additional wait. Wednesday will be 15 business days since my petition was approved. I will send NVC an email with a copy of my NOA2 attached on Wednesday if I still do not have a case #. I don't think it will do any good though. I am now convinced that the transfer from CSC to TSC HOSED ALL OF US!!!!

After reading all your posts am very confused we recieved our NOA2 in the mail on Dec. 30th but it was dated Nov. 23rd it was approved for the I 130 petition but on the uscis site it still shows us in initial review with updates on the 24th and 26th does anyone know how we can find out if we were really approved or is this another mistake in the uscis office if its a mistake its a really horriable one now i am wondering if we will get a notice like many of you that our case has been sent back to the uscis office for further review

The same for me. My petition approved on the 23rd (hard copy received on 29th). I got touches on 24 and 26. LOTO advised me that the touches after my approval was when petition was transferred to NVC. Makes sense to me! Don't worry......we are APPROVED!! I haven't received the NVC case # yet, but I am calling them TWICE a day. Don't rely on the AVR......talk to a HUMAN.

Initailly, I was worried about not having touches at all. Now I am kinda worried if it will draw RFE. I hope not. My 5 months mark is appraoching. I read from others in another link that special cases are transferred to USCIS and the transfer is not normal. I am kinda worried about my case right now as it has been transferred from TSC to USCIS. I have not wanted anything so bad than approval in my life. God help us all


I know how you feel!! I was talking to my wife (beneficiary) via Skype, and she keeps telling me not to worry. I think this coming week June/July filers will be receiving SOMETHING. I hope and pray for the best (approval), but will have to take it as it comes. If it be a dreaded RFE, then I will just have to deal with it. GOOD LUCK TO ALL OF US!!!

Last email I received was on 11/10 - initial review (transferred to a USCIS office for processing). All the other touches were updates on the USCIS website.

DanTes, which of the notice did you ge tthe other day? Initial or post?

As you can see from my signature, I received ANOTHER touch TODAY! I really don't have a good feeling about all these touches. Perhaps my petition is providing some comic relief for the Janitors at USCIS!!!

Just a thought......I wonder if USCIS is sending some petitions to LOCAL offices for processing?? I received the TSC transfer notice, and then I received an email stating that my petition was being processed at a USCIS office. Seeing some peculiar emails and notices in the past few days.......other than the "normal" APPROVED.

"On November 23, 2010, a USCIS office received this case from the State Department with a request that we review it." This is the part that doesn't make sense to me. At this stage of the process, USCIS should not be getting anything from the State Department. Guess we will have to wait and see if others get the same message for approvals. Good luck to all of us.
