I just paid the $88 fee for my wife's I-130, visa. I printed the cover sheet, and it says to fill out Affidavit of Support. http://travel.state..../info_3197.html. Which one do I fill out?

Here's my scenario.

I'm filling it for my wife. I think I'm suppose to choose " If none of the above apply " column.

Use I-864EZ if you can answer YES to all three questions at the top of the form. Otherwise use I-864. The I-864P is a table showing household size and the minimum income requirements. If you are not on active duty with the U.S. Military, you will use the 125% column.

I have a few questions about my wife's Visa. I paid the $88 AOS fee, and now it says "Paid". So does the NVC sent my wife paper works now (with in 90 days)? I'm filling out form I-864, and it says to send it to NVC when I'm done along with the cover sheet when I paid the $88. Do I sent the I-864 with the cover sheet by it self or do I need to wait till my wife gets her papers from NVC, and send them together? I've got transcripts of last 3 years of tax, should I send it with the I-864? What else should I send with it? Is there a way to see if NVC send the papers to my wife?

I'm also thinking of contacting my congressman (MD) to make the process smoother, is that a good idea. Anyone did it?

The AOS and DS-230 are two different animals. The AOS is your "promise" that you are willing and able to support your wife. The DS-230 is her application for an immigrant visa. You can send the AOS as soon as it is marked paid. You must send supporting tax transcripts with the AOS. Check out the NVC shortcuts here on VJ, and be pro-active with your paperwork. Do NOT wait for NVC to send you anything!! Did you already send your DS-3032?

K-3 Spouse Visa Process & ProceduresI-130 rejected

Ok... probably stupid question, but I'm hoping my instinct is wrong.

I just received the I-797 NOA on my I-130 submission. It was rejected because of "incomplete address" (I guess the standard Costa Rican address of "400 meters west and 250 East of the church in san antonio, escazu, san jose, costa rica" wasn't good enough for USCIS).

Two questions:
1.) What the hell address should I put?
2.) Can I file the I-129F now? I can't find the answer anywhere online. It just says that when you file the I-129, you need to include your I-797... it doesn't say the 797 needs to have good news on it!


Give the address of the Church, or if a street and number is not available, MAKE ONE UP! I'm sure as long as it gets to her town, someone will know her or her family.

We talk on SKYPE daily (sometimes twice). I can't imagine this process without being able to see and talk to my wife and kids every day. The hardest part is trying to explain to our two daughters why they can't come to the States NOW! As USC, our daughters could be here tomorrow, but at their age they need their mama. I filed the I-130 on 12 July (received by USCIS on 27 July). I copy my SKYPE logs to a word document just in case the Embassy needs proof of a bona fide relationship. We also send pictures to each other quite often. I missed my younger daughter's birthday on the 3rd of September, and our 11th wedding anniversary on the 29th of September. My birthday is coming up on the 29th of October (not to mention Thanksgiving and Christmas coming soon). Being retired U.S. Navy, I knew how hard the separation would be, but it is something we all are going through. Pray for a quick journey through this crazy process.

I noticed you said your fiance is in the Army. I'm pretty sure that he only needs to make 100% of the poverty guideline, not 125%, since he is in the military. Please someone correct me if I am wrong. Does your fiance meet 100% of the poverty guideline? I'm sorry to hear that your having so much difficulty; I hope everything works out with good results. You are correct about 100% for active duty military.

i didnt see your response,unfortunately navy federal does not give a damn about costumer service,he has tried calling them,but their phone lines are all automated voicemails and the closest navy federal is about four hours away,it would be ideal to get it done without him having to physically go there,however its not a big problem.the only issue is time,i have to have something figured out in case the bank doesnt cooperate

We are starting the naturalization process for my wife. A little background:

- My wife has been a resident since 11/2007 (received 10 year card in Feb 10)
- I am active duty military for over 20 years
- My wife came here on a Fiance Visa
- She has not left the country since she came here

When we got married, my wife took her maiden last name as her middle name (as many Filipinas do). She took my last name as her last name. All of her documents are like this but her old passport from the Philippines lists her current middle name as her last name.

My wife recently got a call from her friend about how someone got denied due to a similar situation...something about possible fraud. I told my wife that her case isn't unique and I'm sure there have been countless others like this. There has to be some other mitigating factors.

Immediately after talking to her friend, she goes on an on how she needs to get a lawyer to change her name back. Obviously, this would present many problems since all of her documents since she got here have her previous last name as her middle name.

My question is this: can anyone shed any light on this? Is this an issue or an obvious misunderstanding and overreaction on her friend's part? I tried to search the forum but admittedly, have taken a break from the process (until now) because it's draining working full-time, running a part-time business and dealing with all of this. Now that she's approaching her three year residence mark, we are trying to start her papers. To me this reeks of overreaction but I'd like to know if there is any validity in this. I told her that if she starts changing things then that will definitely look sneaky and that her situation probably isn't new.

Thanks for your help. Sorry if this seems "newbie" like but I really don't want her stressing out and stressing me out in the process. Everything up until this point has been done without lawyers and I plan to keep it this way.

It says have you ever persecuted ( either directly or indirectly) any person because of race, religion,national origin,membership in a particular social group, or plitical opinion?


I had field a charge against one company they didnt hire me because my name doesnt sound American!! and they descriminated me because od that and i press chargeges against them the case still pending now in the court.

Do i have to answer yes or no to question 11? thanks i appreciate it.


Based on the information you have given, you can answer NO to the question (No. 11). The company you refer to PERSECUTED you; you are PROSECUTING them.

Present both passports to immigration at the airport upon departure. Both passports will be stamped. The U.S. passport will have the annotation "PP" to show that a valid Philippine passport was presented as identification. Children 12 years and below do not need a CFO sticker in their Philippine passports.

The U.S. Government makes a big deal of "Paperwork Reduction". In fact, there is a "Paperwork Reduction Act". BUT, we both know that if you don't send in what they are requiring, you will probably get a RFE (even though you have submitted it a half dozen times before to the same agency). Others who have gone through this more recently can give you better guidance in this matter. Just my 2 cents. Good luck on your Citizenship!!

I need your help please? I got my GC on Feb 05/2009, in that year I went to my country for 7 weeks, and then in April 2010 I went to my country again and stayed for 5 months and half. So does it mean that I was abroad for 8 months? and can not apply for the citizenship or I'm fine? also I have a physical presence here in us 25 months in total!

My wife is not yet eligible, but from what I read on the USCIS website, you must be PHYSICALLY present in the U.S. at least 18 months. You should be fine

My wife came here on a K-1 Visa and has her green card already. What if we want to postpone the citizenship? We would like to live in the U.S. 1 or 2 years and in the Philippines 1 or 2 years at a time. What would happen if we left for a year or two? Would we have to start over? Would it be easy to return?


I would say wait for 3 years and get her U.S. citizenship first, then her dual, and you're good to go. She could visit the Philippines in the meantime for a month or so at a time with no problems. With her dual, she can sponsor you for ACR.

What did they tell you at your interview? Are you doing a name change? A month seems a bit long in any case. I think I would call USCIS, and try to find out what is going on. The oath letter may have been mailed, and it was lost in the mail. I have read other stories here on VJ where the applicant missed their appointment.

"My suggestion would be- don't wait anymore, once you hit  one month time period after the submission of N-400,  you should be worried about your bio-letter. Make an info-pass immediately and ask for the fingerprint date"

There are several questions in secion 11 that cannot be answered by a simple yes or no. For example - questions 7b, 17a, b, 18a, b, 27b, 39 and 40. Instructions state that ALL questions must be answered. How did you guys answer these questions?? I am probably reading too much into the questions.

At this point I would definitely consult with a good immigration attorney. Also, contact your Congressman. USCIS has 120 days from your interview date to make a decision on your case. You said it has only been 3+ months since your interview, so you have a while to go before you can sue USCIS.
