K-1 Fiance(e) Visa Process & ProceduresNOA1

I have received the reciept(NOA1)from the VSC and it of course lists my fiance's name and date of birth,
but under COUNTRY OF BIRTH it says UNKNOWN,... IS THIS NORMAL OR DO I NEED TO CONTACT THEM TO CORRECT THIS?
Surely I did not leave this out on her G325A.

It said the same thing on mine. Don't worry!!

K-1 Fiance(e) Visa Process & ProceduresBeaurocrats Trying To Increase The Odds Of Failure?

Hello,

I'm sure the beaurocrats know that learning a new language takes two years or more, sometimes as much as up to five years.

Is that why they require the Fiancee be tested on their ability to speak English during the interview? So they have one more excuse to fail them (and destroy their life) at the interview?

Why not let the Fiancee learn English in America where she will be surrounded by English speaking people and available classes and then test her before the Green Card or something like that?

notmuch88tosay

Perfect English is not required at any stage (even for U.S. Citizenship). It might raise a doubt in the CO's mind as to the sincerity of the relationship if neither one of you could communicate verbally with one another. How do you communicate with the love of your life??

K-1 Fiance(e) Visa Process & Proceduressingle status affidavit

hi everyone, i need your help. My fiance who's in edinburg TX doesn't know where to get his single status affidavit. i need it for my Prism/CFO seminar here in the philippines. Do u have any idea where he could get it and how much will it cost? thank u so much = )

As mentioned, the U.S. does not issue a "cenomar". The only reason the U.S. Embassy issues an affidavit to contract marriage is because the Philippine Govt requires it for a foreigner to marry a Phil National IN THE PHILIPPINES.

K-1 Fiance(e) Visa Process & Procedurespassport photo requirements

Getting ready for interview soon I hope
So we had passport Photos done, which was harder and more costly
then I expected, But the problems now is
She wore a blue shirt with white horizontal strips.
So My worry now is this will not be acceptable to Embassy.
Because of the striped shirt ??? :bonk: :bonk:

Or should I have her retake the Photos $ 20 Euros or
run with the one we have ???
and risk them being rejected ???

thank you

I would personally do the photos with a solid color, but looking at the requirements listed below, I don't think stripes will matter.

Your passport photo must be:

  • In color
  • Printed on photo quality paper
  • 2 x 2 inches (51 x 51 mm) in size
  • Sized such that the head is between 1 inch and 1 3/8 inches (between 25 and 35 mm) from the bottom of the chin to the top of the head. View the Photo Composition Template for more size requirement details.
  • Taken within the last 6 months to reflect your current appearance
  • Taken in front of a plain white or off-white background
  • Taken in full-face view directly facing the camera
  • With a neutral facial expression and both eyes open
  • Taken in clothing that you normally wear on a daily basis:
  • Uniforms should not be worn in your photo, except religious clothing that is worn daily.
  • Do not wear a hat or head covering that obscures the hair or hairline, unless worn daily for a religious purpose. Your full face must be visible, and the head covering must not cast any shadows on your face.
  • Headphones, wireless hands-free devices or similar items are not acceptable in your photo.
  • If you normally wear prescription glasses, a hearing device or similar articles, they may be worn for your photo.
  • Dark glasses or non-prescription glasses with tinted lenses are not acceptable unless you need them for medical reasons (a medical certificate may be required)
  • Glare on glasses is not acceptable in your photo. Glare can be avoided with a slight downward tilt of the glasses or by removing the glasses or by turning off the camera flash.

K-1 Fiance(e) Visa Process & ProceduresG-325a foreign address

I've searched the forum... even used advanced search, but have not found the answer I need. I'm the USC petitioner.

For the section on the G-325a where it says "Applicant's last address outside the United States for more than 1 year."

Are they looking for domicile like on the i-134 form? On that form, I put my age and stated that I have resided in the US for my entire life.

The issue... A long time ago, in a land far, far away, I was in the military stationed overseas but still had my US APO Box as my "official" address. All contact was via that address.

But, I did serve and live overseas for 19 months, 8 days and 3 hours.

Do I show that address on both forms, neither form or what?

Active duty service overseas is NOT counted as having "resided" overseas for immigration purposes

K-1 Fiance(e) Visa Process & ProceduresApplicant age restriction?

No such rule about being too old to contract marriage in the Philippines. From 18 to 21 consent from the Parents, or Legal Guardian is required before marriage license can be legally issued. From 22 to 24 advice must be given by the Parents, or Legal Guardian. Advice letter basically states that the Parents or Legal Guardian is aware of the marriage. Family Code of the Philippines, Sections 14 and 15 refer.

I want my 12 year old daughter to visit me here in Las Vegas over the Christmas holidays. She is dual U.S./Philippine citizen with 2 valid passports. Anybody out there know if DSWD travel authorization is required as she will be traveling alone. Still waiting on my NOA2 for the I-130 I filed in July for my wife.

PhilippinesPolice Certificate
NBI is the only clearance needed from the Philippines. Your first clearance from NBI will have the notation "no record found". Good for 1 year. If/when you get your NBI clearance renewed look for notation "No derogatory comments". If you lived or worked in another country for more than 1 year since the age of 16, then you will need police clearance from that country also. Maybe others in this forum have more updated info.

PhilippinesMarried!
NSO will have her birth certificate and now your marriage contract. It will take awhile for the marriage contract to reach NSO. Both will reflect her maiden name. Because she is married to a foreigner, she will have to attend PRISM seminar and then get CFO certificate to get another passport issued in her married name. You can check out the DFA website to find out all the paperwork required for a passport.

PhilippinesCFO For Daughter
From what I understand, kids from 12 to 17 years of age need to attend "Peer Counseling" at CFO. According to Philippine Immigration she will present both Passports at airport immigration, and both Passports will be stamped when she exits the Philippines. Her U.S. passport will have the regular departure stamp with the annotation "PP" (Philippine Passport). Her Philippine Passport will be stamped with regular departure stamp. I just don't want her to get to the airport, and find out she also needs the CFO sticker in her Philippine Passport. When she enters the U.S., she will present her U.S. passport. I thought someone might have gone through this. Thanks.

PhilippinesCFO For Daughter
Both our daughters are US/Phil citizens. I am thinking of bringing my older daughter to the U.S. for a visit. No problem as far as U.S. is concerned, but I have a question about the CFO Peer Counselling and CFO sticker in her Phil Passport. She is 12 (will turn 13 in Feb 2011). Does she, in fact, need this?? Don't want any problems at the airport immigration. Also, does she need DSWD travel authorization?? Any info would be greatly appreciated.

You can obtain the form for parental advise from your local civil registrar. If you are 21 to 25 years old, you do not need CONSENT, but you DO need the parental advise form before you can get the license.

PhilippinesMiddle Names

Our I130 has been approved.
Now I find out from my wife that her middle name as changed now that she is married. From her mothers maiden name to my wifes maiden name.
Her NBI has her old middle name on it with her new married name. But her passport and other IDs have her new middle name with her new married name. Now what do I do.

Have your wife go back to NBI and get them to change it. Only takes 1 day. Tell them they made a mistake, and they will correct it. (hopefully)

My wifes NBI is in her married name it says (old last name) de(married Name) (first name) y (old middle Name) is this right the nvc had no problem with this shud she have gotten her nbi in her name before she was married to show a clean record?

The NBI clearance should be for ALL the names she has ever used / had (including aliases). If she is now married to you, then it should be in her married name. If the NBI clearance says No Derogatory Record - she is good to go.

PhilippinesMARRIAGE CEMAR

do i need this? its under other required documents in the philippines embassy page, never heard of it b4

Married persons are issued a Certificate of Marriage from the NSO. You MAY also need to obtain a CRS FORM 5 - ADVISORY ON MARRIAGES from the NSO. This is being called a CEMAR throughout VJ, and only adds to the confusion factor. In order to avoid confusion just call it FORM 5 or ADMAR.

PhilippinesCENOMAR (certificate of No marriage)

please help !!!!!

If you are not married, you need CENOMAR for CFO and interview at U.S. Embassy. If you are married, you MAY need "CRS Form 5 Advisory on Marriages" (some people refer to this as CEMAR). My wife did not need this form when she attended PRISM, but since learning of this form for married persons, she obtained one from NSO, just in case they ask for it at her interview and at CFO PDOS.

PhilippinesCFO seminar in Manila.

my nbi and bc and cenomar is no more with me .. embassy got it .. do i need to get new ones ?

The NBI clearance comes in two parts. The top half is what you submit to NVC, Embassy, etc....The bottom half is the same thing stamped "personal copy". The data sheet should be attached on the outside of the envelope you are not supposed to open. Do not detach it from the envelope, but make a copy of it. It is always good to have extra originals from NBI and NSO. Both agencies (at least in Subic) can do it in one day.

Philippines13 a resident visa
When you arrive TOGETHER in the Philippines, present your passports along with your marriage certificate to immigration, and you will be given a balikbayan stamp in your passport that is good for one year. Before the end of one year, take a trip with your wife to (Thailand). When you arrive back in the Philippines, your passport will again be stamped as a balikbayan good for another year. There are other ways, but this way is the easiest if you are going to stay for only 1 year and a few months. No problem IF you travel with your Philippine Citizen wife.

hi, I am just waiting for my baby's CRBA. Does that means even if my baby got his US passport I can also get him a Philippine passport? If so, what passport am I going to use in case he will be coming to the US? I already know that if he get approve he don't need a visa anymore to go to US.

Get the Philippine passport at the DFA. Use both to exit the Philippines, and the U.S. Passport at POE.

Hi guys! Is it also needed to have my dual citizen baby get registered at CFO? She has both US passport and Philippine passport. If so, what other documents should I bring during the registration process since she has a US passport and not a visa on her Philippine passport?

And by the way, I cannot find the GUIDANCE AND COUNSELLING FORM only the registration form on the CFO website, can anyone out there help me find to where I can get it online? Thanks a lot! :)

Philippinescase closed but pending rfe??? pc or nbi??

this is so confusing. i received an email from nvc asking me a police clearance. now i dont know wc one they are asking if it is nbi or police clearance. i only include nbi on my packet because on my understanding, police clearance are only for those who lived abroad for the past 6mos starting 16 yrs of age. But here's the thing, I went to school in Manila for college when i turned 16 so i put my address in my DS 230. Now they said on the email that a gap exist in my residence history. and below of it is instruction in obtaining police cert. so what do i need to do? unluckily its my flight tom goin back to the province coz i had my advance med here. i don't know what to do now, if i will not just go home yet and get that PC here or they need another nbi coz maybe they misplaced it. my hsuband is busy at work but he will call later about it, but i think its holiday in NVC. Here's another thing also, when I was trying to sign in at the payment portal it says SIGN IN FAILED i check my mnl case number and IIN it is correct. what does this mean now? case closed? but pending rfe???

pls enlighten me ppol. thank u!!!

All you need is NBI clearance for travel abroad even if you lived at a dozen different addresses all within the Philippines. Looks like you have CC, but have your husband give them a call to make sure. Although you should never leave a gap in time in the "from / to" portions on the DS-230.

PhilippinesAfter NOA2 recieved

We recieved our NOA2 August 10,2011 for the K 1 visa. What do i , the petitioner, do now? I called the NVC and retrieved the case number (MNL number) and the sent date( August 18,2011). But have still not recieved a letter from them. Or anything from the Manila embassy . Do we have to wait for a packet from the Manila embassy for my fiancee to go to the medical ? Or to scedule an interview? Or can we just do the medical at ST Lukes with the MNL number alone? And then scedule the interview online?

YES you most certainly can, and it is highly recommended you do so NOW! I'm not sure about the interview procedures, because I went the IR-1 route, and we were scheduled by the NVC.

Your POE will NOT be Vancouver. Your Port of Entry will be the first place you land in the UNITED STATES. PhilippinesMy 3-day Sputum Exam Experience
I must say that the St. Luke's experience (3 day sputum test, and 2 month culture) was the most agonizing experience of the whole process. Just keep on praying, and good things will happen for you. My wife had to contact the local county health dept upon arrival here in the States. My wife had been treated for TB about 2 years ago. The health dept doctor looked at all her past x-rays and record of medication she had taken in the Philippines, and told her that no further follow-up was necessary. USCIS was notified of this fact, and the case was closed.

I know several U.S. citizen (Filipinas) who live in the Philippines without dual citizenship. You can stay for up to 1 year (Balikbayan) even on an expired Philippine passport OR your Philippine birth certificate. You have to leave the country (Hong Kong, Thailand, etc for a couple of days, come back in, and you can stay for another year. Have a good trip!! My wife will be submitting her N-400 next month. Hope everything goes good for her.

Same with my wife. The only question the CO asked was "what took you so long to apply for a visa?" (I lived in the Philippines for 19 years, and we have been married for 12 years, with 2 U.S. Citizen daughters). The whole process was pretty easy from start to finish with the exception of being stuck at TSC along with the other 36000 petitioners who were transferred from CSC last year.
