My younger brother applied for K-3 for his fiance. When he was a minor as you were, he also had a small problem with the police, it may have been bigger problem then yours. His was was accepted and no issues came up. You should be good to go!

What happens when I129F expires before Interview?

Hi Guys,

Can you guys confirm about the automatic extension. Because USCIS just contacted me and said they found my application in the mailroom and are now forwarding it to NVC. But I still don't know what happened with the expiration date, if it was extended or not. Are you guys sure, in terms of have you seen or experienced this happening where its automatically extended?

Because the pace we're going right now, I doubt I will get an interview before two months (when the acceptance letter expires).

What happens when I129F expires before Interview?

Hi there,

Im currently in a limbo between USCIS and NVC, USCIS computer monkeys reading their scripts saying they have accepted my application and sent it to NVC & NVC folks stating they have yet to receive the application. Its been more than 8 week now and I have contacted my elected officials, anyways .. to my question...

I see my approval will be expiring in mid August and after doing some calculations and checking the average time the Islamabad embassy is scheduling interviews (obviously depending on my file actually being found), it looks as though the I129F will pass its expiration date prior to my fiance getting her interview. I wanted to see if this is an issue I need to be aware of? Im certainly going to bring this to my elected official so they bring this up when the file is passed to the embassy, but is there something I should do. The last thing I wanna do is try to resolve another issue though USCIS "customer support".

Has anyone experienced this before?

Just to add -

This was an arranged thing. but we wanted to get to know each other first so thats why we wanted to marry in March in pakistan after speaking over the phone and skype, etc. But once I got the job, I just told my new employers to hold off my start date, let me travel back for two weeks and ill come back and start. I knew i wouldn't be able to get enough time off to get married, especially the kind of marriages in pakistan that take weeks. And plus I wouldn't know anyone in the marriage

Also, when i say the parents will not attend the wedding, I mean her parents, they live in pakistan and cannot attend because of visas and stuff.

Im just suspecting the interview expects a straight forward case, and any type of issues like this, they get skeptical about it and put someone on AP for months/years only resulting in refusal for the visa at the end.

The thing is, I am planning to marry my fiancee when she comes to US. I went to pakistan in August to get engaged with her, but I just don't know if the embassy interviewer would mark this as a red flag since, typically pakistanis get married and then go to US on a marriage visa, especially if its a female.

Our plan was to marry in March but then i got a permanent job that I was going to start and i didn't think I would get enough vacation time to come to pakistan and marry. So we decided, I go to Pakistan for a week and a half, get engaged, keep getting to know each other, same time we will have the K1 visa process going... once the K1 is complete, she comes to US, her uncle and auntie will also be attending (they live in US). Another reason was that I have all my friends and family (at least who I keep in touch with) will be in US and would be able to attend. Ive heard there can be issues because the interviewer can first ask, why didn't you marry in pakistan and the reason needs to be a well off reason. And also they may get skeptical if the parents will not be at the wedding.

Ive seen some real horror stories where the interviewer alleged the interviewee is married (without much proof) and therefore the application would be rejected. I mean these guys, can pretty much do what they want. Our recourse is very little, heck even getting senators help would be limited. So i just want to make sure I dont make a mistake...

So if this is going to be a red flag, I just wanted to check with a lawyer on what the recourse can be if they say anything.

Any thoughts? Im really confused with this now. When i first did it, it soulded like a good idea.. but after 9 months, i just dont know what they will think.

Lots of people applying for visas have children. People wasting time with frivolous expedite attempts just make tne wait longer for us more patient couples.

I agree that a lot people applying for visas have children, and Im also 100% sure that all of them would use any possible avenue to not be apart
from them. Possibly you don't have children so maybe you don't understand what it's like to not be with him/her or in my case haven't had the opportunity
to have held her etc. In short like anyone else on the planet I'll be doing whats best to bring my family to one place. If I apply and its accepted good for us. As far as your emoji...get over it!!!!

Patience is a virtue! My future wife, and I have a 3month old daughter. I may try to apply for an expedite once I get the notification of my i29f being received...I know that a child does not fit the criteria, but I've heard every now & then it works!!! Praying for a speedy process!!!

Hi!

Mine took around 5 months and 2 weeks to the interview. For around 8 months from filling to have the visa in hands. I filled in January 23,2012 and the interview was on September 6. Is a long process but you need to be PATIENT. Good luck on your journey

offer of compromise/K1 Visa?

If you owe back taxes they usually take that amount off your income so you need to make more to bring someone . If you have a payment plan in place then you are ok.

I have a payment plan. All taxes filed up to date...I exceed the poverty guideline of 125% by several thousand dollars...The amount I can afford to pay is not allowing me get rid of the dept so I'm exploring my options. I think I'll wait until this process is complete to try to do the offer of compromise...Thanks

Protocol417 you are the best! Thank you! So you only sent Tax information for 2012? I was thinking I had to send tax information for 2 or 3 years. I attempted to access the IRS site and hit a dead end once I was logged in. I got into my personal information, but when I attempted to select a year It wouldn't show me my information for the selected year to print it out. I'll figure it out. Thanks again!

Thank you for the responses! I noticed that in the instructions for the I134 it states that you must show sufficient income or financial resources. Sufficient incoming meaning being over the 125% poverty line( tax returns) I'm assuming? If that is the case am I still required to give banking info? Not familar with Tax Transcripts? Meaning like a 1040ez competed? Intern's of the W2's is a print out from an employer website sufficient? or is something more official required?

Before Interview packet 3 and packet 4 question???

My Fiancés K1 interview/Appointment (Ethiopia) is in less than two weeks. I found this out because I received packet 4 for in the mail(Oakland, Ca) She never received packet 3. My fiancé lives several hours from the the capital. So in order to take care of everything necessary she needs to be there early. Is there anything in packet 3 that she needs? Or is it basically the same instructions in packet 4? Called the embassy in Addis several times can't through?!

This is what I see on our case:

On May 8, 2013, we mailed a notice requesting evidence/information for this case to you or your representative. Please follow the instructions on the notice to submit the material requested. This case will be held in suspense until we either receive the evidence/information or the opportunity to submit it expires. A new processing period will begin when we receive your response. You or your representative will be notified by that office of a decision or if any further information or action is needed from you. If you move, please use our Change of Address online tool to update your case with your new address.

I am lost! I feel like a panic attack right now.
1. How long does it take for this letter to arrive? Do people answer you over the phone about this RFEs at the USCIS?

If you guys knew what we sent... We sent a file with approximately 600 pages including:
- pictures
- phone bills
- skype, gmail conversations, emails
- flight tickets...
- wedding prep. documents...
- the ring certificate?

What exactly could be missing? Is this something I need to be worried about? Is too much too bad?
FYI they made a mistake at the beginning and put that I was from Salvador Bahamas instead of El Salvador. Could that be related?

Any comments or experiences from also RFE's requested would be greatly appreciated.

Best way to proof your relationship

The petition does not actually require you to prove your relationship only to prove that you have met iwthin 2 years of filing the petiion. This can be done by including passport stamps, plane tickets, hotel recipts, or other recipts from your trip. It is also nice to include a couple pictures in addition to the previously mentioned list. As for answering the question on the I129F asking you to detail your meeting I would go with short and sweet. They are only looking for the facts here.

Although it was not required, we've 'front load' all supporting docs and we were approved with no RFE. It sure will not hurt but make sure you'll only send copies of them as you'll need them at the interview stage.

We sent pics of our trip there n here.. and pics with each others family's. . Only sent 10..
I sent text files from whatsapp. It was super long so only sent what would fit on one page.. for each month.. at time it was 13 pages max..

Did same for skype logs.. 13 max.. felt it was important to shows months covered. .

Didnt send emails.. but instead printed out the inbox listing of our hotmails.. hers and mine.

We sti had our boarding passes. Confirmation of plane tickets that matched boarding passes.. and passport stamps..

No phone logs.. since all was thru skype

Total pack was 160.. ps. Make a copy of all before sending

Just keep the story as simple as possible. You don't have to prove how in love you are, just basic details on how you met. You can include a evolution or relationship letter, but simple and to the point is best. Think of it as a legal process and its more important to provide the evidence they ask for and complete the documents completely and correctly.

You don't have to include 600 pages of chats and emails, you don't want to weigh your application down with paper. I think I included maybe 20-30 pages of Skype chats. I included 9-12 photos and labeled them with the place taken and the date. Also included Boarding passes for the flights we took together as proof of having met.

I didn't want to make our application cumbersome to go through. Just kept everything minimal and made sure everything was labeled and organized very well. Also make sure everything is signed, especially make sure her signatures are originals.

That's the way I did it and we received our NOA2 with no requests for more evidence!

The one thing I wished I would have done differently is include the evolution or relationship letter. Some people say its good to have so when the consulate receives the package it gives them more details.

Translating documents for 129-F

Hi all,

My fiance and I are gathering up everything we need to petition and trying to figure out what to do about translating documents. He is Peruvian and speaks some English, but not great (intermediate level). When I sent him a copy of the letter of intent in English, he understands it. My fear though is that if he just signs an English version and the embassy later realizes in his interview that he is signing documents in English when he doesn't speak it fluently, they may start asking questions? If we are to have all his signed documents in English (including the G-325A form), should I translate them? Or does the translation have to be done by a 3rd party?

Also, my fiance doesn't receive mail in the house where he lives, but rather at his work. He would like to use his work address as his main one, but in needing to be 100% truthful on the application about where he lives, should we include his home address on the forms and follow up with a document explaining his situation and can any paperwork be forwarded to his work address? Has anyone done this before?

I'm still unsure of what will happen, whether I will move there or not. Just wondering how this move would affect the visa application process. We do plan to live in the U.S. and upon receiving the visa would go together.

Hi all, I'm just about to file the I-129F for my fiance who is living in Peru. A couple ?'s...I know it says the processing time for the service center in California is 5 months. How many more months do I need to estimate for processing once it has left CA and gone to the embassy in Lima?

Also, I've been offered a job in South America and am considering returning there for work. How would this affect the visa application process if I file before I leave the U.S. and then change my address? (I will mail the application on Monday and the job wouldn't start for another month or two) I believe this job would be paying me in U.S. dollars. Do I need to be in the U.S. to file? Do I need to be making U.S. dollars? It's so hard to be apart from my fiance right now and this would be an opportunity to be together again while we wait for the visa.

Hi everyone,

We are CSC-filers...August 6th NOA1, and trust me, y'all. We are counting the moments here, and actually need to stop doing that.

The fact of the matter is that, while we couldn't have known it at the time and filed when we did, we just ended up really unlucky in terms of the time of the year to file.

Had we all applied a month or two earlier, it would have been done faster. Most of us are approaching 6 months here, which is a month over the original 5 month deadline that CSC was operating with.

There's talk of them working on other visa applications, which is most certainly true, but we also got hit with Thanksgiving, Christmas, New Year's etc.

Any experienced person on the site will tell you "your time is coming...hang tight." And at the end of the day, that message has to ring true with us all.

It's really slower than sh*t at the moment and it really stinks for us all, but I"m really hoping here that in the next few weeks, CSC gets crackin' on the August apps.

My own personal prediction is that once they do, they are going to be poppin' them out like mad just to get them done...hopefully, it's not just wishful thinking on my part.
