1. You need to show co-mingling of assets, so showing the credit card statement just in your name isn't useful.

2. Include pictures of the joint cards and statements.  With American Express cards, it shows which account the charge was made under which is a big plus as well.

3. If you're sending joint bank account statements then there's no need to include the card copies themselves. 

As I said, co-mingling of assets is key.  The more, the merrier.  Insurance statements (medical, dental, vision, life) that show you as the dependant/beneficiary and him as the policy holder is key.

Also, trip plans/statements can't hurt either.  Hope this helps.

The ROC guide on VJ lists all of what I mentioned and then some that I'm sure I've forgotten.

I have joint credit card where my husband is authorised user,i am gonna include copies of both cards with letter stating he is authorised user.is not used(although it is not used much)

 

I have credit card which was opened by the help of husband's credit card and joint bank account,but its not joint credit card as that bank does not give joint credit cards.

We have separate debit cards with joint bank account which both of us use a lot. 

 

My question is-

1.should i include copy of statement of my credit card(because statement shows home bills paid by me using that credit card)?

2.If i include statement of my credit card ,do i need to include statement of his credit card as well(i dont see any harm but confused about the purpose its gonna serve,means just to avoid extra useless papers to be sent)

2,should i include copies of both debit cards.(i am conused about the purpose of copy of debit card in ROC because in bank statement debit card number does not show,it just states debit card used,nobody can find out which one)unsure.png

 

I am gonna include bank statements every month for entire period.cool.png

If you have a car and the insurance is in both of your names that's good evidence, as is a life insurance policy if he has one with you as the beneficiary.  The IO said during our interview that my life insurance policy was great evidence.  Oh, and also if you have taken any trips togehter the photos are helpful but not primary evidence, if you have any reciepts or trip schedules from them that's great evidence.

Utility bills I wouldn't say are a red flag, but they definately aren't primary evidence.  Financial documents are primary evidence from what I've been told.  Someone correct me if I'm wrong.  Cosigning car loan, mortgage with both names on title, apartment lease with both names, etc.

Wouldn't you have submitted a lot of the evidence from before 2 years ago during the original Visa process?  If not, then include it, otherwise the past 2 years should be sufficent since they more than likely already have the first year from your original visa filing in your casefile.

You don't have any life/health/auto insurance in both names?  Or, lease/mortgage in both names?  Joint bank account in both names?  What about investments showing your spouse as the beneficiary?  Best of luck!

So excited!!! Interview is October 22nd!! Here is the letter they sent for those of you who are still going through the process.

 

Thank you for the notification that you have all the documents needed in connection with your application for a K1/K3 visa.

All intending immigrants are required by United States law to undergo a medical examination.  Complete instructions for the examination are contained on the attached sheet.  This includes children of any age

All members of your family immigrating with you must appear with you on the appointed time and date.  If you cannot keep the appointment, please notify this office immediately so that the space can be allotted to another applicant.

Please read carefully the attached ?Application for Immigrant Visa and Alien Registration? (Optional Form 230).  Fill this form out completely, using a typewriter or printing in block letters, but do not sign it; you must do that in the presence of a Consular officer.  Every numbered part of the form must be completed.  If any part does not apply to your case, write in ?Not Applicable?. Do not use dashes or the letters ?n.a.? or other abbreviations to complete such parts.  A separate form must be completed for each member of your family who plans to immigrate with you.

We wish to remind you that you must bring all of the original documents that you have been requested to obtain, according to the list on the form OF?169 in order to make your formal application for an immigration visa.  Your application cannot be approved if you do not have the complete documentation.  All civil documents must be Original or Certified True Copies, i.e., they must be issued by the competent government authorities, with their seal of office affixed.  Photocopies of documents that have been certified as true copies by a lawyer, the South African Police, the Postmaster, or a Notary Public are not acceptable.  Each applicant must submit two color passport-size photos, measuring 2x2 inches (roughly 50mm square) with white background on glossy paper, un-retouched, and un-mounted.  The photographs must be full-face view in which the visa applicant is facing the camera directly.  Photos are required of all applicants regardless of age.

Additionally, the following original documents are required, as appropriate:

·         Valid passport, (including previous cancelled/expired passports)

·         Long-form Birth Certificate(s) for applicant, spouse, and children showing names of both parents

·         (A South African birth certificate must be computer-generated; a hand-written birth certificate will NOT be accepted)

·         Police certificate/s

·         Military Record/Certificate: Required only if you have previously served in the military, ie. prior to 1994, or furnish proof that you were exempt from this requirement.

·         Evidence of financial support or notarized offer of employment.  (Form I-864 is required in family-based petitions)

·         DS 230 (Application for Immigrant Visa and Alien Registration)

·         Long-form Marriage Certificate, giving marital status before the present marriage

·         (A South African marriage certificate must be computer-generated; a hand-written marriage certificate will NOT be accepted)

·         If applicable, also give any marriage certificates of any previous marriages

·         Death Certificate:  Death certificate of spouse if applicable.

·         Divorce Decree(s): if applicable ALL Decrees of any previous marriages

·         Medical(s) : PLEASE DO NOT BRING YOUR X-RAY PLATES

·         Application fee of $350 payable at the U.S Consulate General during the interview. You may pay by credit card, CASH dollars or rand equivalent. If you have paid $140 at First National Bank, you will be required to pay the difference at the Consulate during your interview.

 

All documents which are not in English or in Afrikaans must be accompanied by sworn translations into English.

Affidavits of support and evidence of prearranged employment must be no more than 6 months old when presented to the consular officer at time of application for an immigration visa.

A child, 16 years of age or older, who is included in his parents? passport but whose photograph does not appear in such passport, must obtain a separate passport.

MOST IMPORTANT

No assurance can be given in advance that a visa will be issued.  Only after all your documents have been reviewed, your medical examination completed, and you have signed and sworn to your formal application and have been interviewed by the consular officer, can a decision be reached by the consul officer as to your eligibility under the law to receive an immigrant visa.

You are advised not to make any travel arrangement for departure from this country, not to dispose of your property and not to give up your job until the visas has been issued to you.   A visa is valid for 6 Months from the date of issuance, which means that any time within that 6-month period it may be used to apply for admission into the United States.

This office will make every effort to expedite your visa application.   It is unlikely that you will receive the visa on the day of your appointment.  If approved, you may arrange to have your visa and passport collected the following day, or arrange with DHL, located in the lobby, to have these delivered to you. Should complications arise, you may be required to return to this office another time.  It is possible that you will have to spend the entire morning or afternoon in the office before final action can be taken on your application.

 

Please make certain that your documentation is complete and that you have the original and copies of each document (except for passport and TWO photographs).

 

IMPORTANT NOTICE:  Your application for an immigrant visa will be cancelled and any petition approved on your behalf will be cancelled one year after your scheduled appointment if you fail to keep your appointment.

Hello, 

 

I apologise if I am asking things that have been asked before. I just want to be sure that I am doing everything correctly. 

My US fiance forwarded me an email from the Johannesburg consulate. The subject was packet 3 and attached is the D156, D156K, DS 230, DS2001, DSL 1083. I was asked to complete these and email it back to them to schedule an interview. 

 

I want to be 100% sure of what my fiance needs to send me.So here are my questions:

 

1. Does he need to send me the copy he has made of the I-129F package or would it be okay if he scanned and emailed it to me? 

2. Am I correct in saying that he needs to send me: I-134 Affidavit of support, the copy of the NOA2 he received in the mail, letter of intent to marry and continued support?

3. All I need is my unabridged birth certificate, police clearance certificate from countries I lived in, proof of our ongoing relationship?

 

Am I missing anything? 

Once I have everything together I can email the DS230 to schedule an interview (as per their instructions) and will they then tell me when to go for the medical?

But, you don't need to fill out 156, 156k, DS230 anymore- it's all now us the DS160- online form. Sam&Lu and May confirmed that the consulate takes the online form now.  You might want to email the consulate and check.

I got mine after 38 days.  Because it hasn't been 8 weeks for you, I don't know if you'll get much help from NVC.  Just try calling the DOS, they're much easier to get a hold of.  Good luck!

Try calling DOS instead- much faster hold times and really friend service.  Both times I called, I was speaking to someone after not even 1-2 minutes :)  Much different from the 30 min wait time with NVC.  I did call NVC late one night- 15 mins prior to their closing and to my surprise I got someone right away, so try that.

US Embassy and Consulate DiscussionNEW PROCESS AGAIN FOR K1 visa effective after 10/07/2013

Just picked up Packet 3 from the Panama embassy today, and the news is true! Panama is already asking for the DS-160 form instead of DS-156, DS-156K, & DS-230. Aarrgghh! And we had already filled out sample forms for those three so we would be ready with all the information. Hope the DS-160 is an easy form.
 

 

DS 160 is a much much easier form to fill out.  You don't have to go back ten years to find employment and address history and a much more other stuff that really is insignificant.  DS160 is what people fill out for tourist visa etc, so it's much much easier.  I've filled it out twice before for friends tying to get a visitor's visa and am pretty much done completing the fiance's in preparation for his packet 3.  I couldn't be more happier about this transition.  I thought the old forms were so daunting! I, for one, am a very happy camper.  Just wish CSC would hurry up and send my file to NVC already.

We are in AP also after interviewing in Joburg 12/19/13. We are applying for a K1 Fiance visa.  My fiance is from Nigeria but in Joburg for work. Took us about 2 weeks and 5 phone calls to find out they have sent his birth certificate to Nigeria to validate it. We are still waiting on the visa.

 

Keep calling the consulate,and if you can, speak to Nicolas, he is the only one there who will give you a detailed answer. He is the one who told us what we were in AP for because we did not get a 221g form.  He also told us the office in Lagos that does the validations goes out in the field the last 2 weeks of the month and so to wait until the 2nd week of January and have my fiance actually go to the consulate and request to speak to the interviewing officer. We did that and so a reminder was sent to Lagos. Nicolas told us to call every other week and to alternate a visit to consulate every other week. So that is what we are doing.

K-3 Spouse Visa Process & Proceduresapostille of marriage certificate for I-130?
My spouse and I were married in Oaxaca, Mexico in July. We have been trying to get an apostillate of our marriage certificate, but many government offices in Oaxaca are closed to the public due to a teacher's strike that's been going on since May.

Does anyone know if an apostillate is needed for our marriage certificate for filing the I-130? None of the instructions from USCIS say it's needed, neither does the book from Nolo Press. I am considering consulting with a lawyer but wanted to check this forum first. I previously checked with a couple lawyers regarding fiancee vs. spouse visas but none of them ever mentioned getting an apostille.

According to the Nolo Press book on Fiancee and Marriage visas, you don't need to pay a translator to have your marriage certificate translated. Just have a trustworthy friend translate it and add a comment certifying their competency in both languages as well as their name, date, address and phone number.

Our I-130 was just approved today(NOA2)!!!!!!!!!!!

We were a bit late sending in the I-129 F for the K-3 visa. I finally sent that off Nov. 3. Now that the I-130 for the CR-1 visa was approved, it's my understanding that we can no longer pursue the K-3 visa. If this is true, the check hasn't cleared yet and I may as well stop payment and save some lana.

Does anyone know if it's quicker to get an interview date in Ciudad Juarez for a K-3 visa or a CR-1 visa?

If I were you, I'd find out how long it takes to get a CR-1 interview vs. a K-3 interview at your consulate. I don't know which country your from so I can't help you there. For us, it takes 1 year at Ciudad Juarez, Mexico to get a CR-1 interview whereas it only takes a few months for a K-3 interview. Ask yourselves if you'd rather be together as soon as possible, even if one person can't work, or if you'd rather wait longer but have permission to work upon arrival.

We filed our I-130 and I-129 F without getting an apostillate of the marriage certificate. We tried to get it apostillated but the offices in Oaxaca, Mexico were closed due to the political situation at the time. Both our petitions were approved.

Regarding the translation, I translated it myself and had a friend verify it. We added this to the translation:


I certify that I am competent to translate from the Spanish to English and that the above Marriage Certificate is a correct and true translation to the best of my knowledge and belief.

It seems like the consulate in Columbia has a fairly good turn-around time for IR-1/CR-1 interviews. If I were you I'd stay wit the CR-1 visa.

We had our I-130 approved before the I-129F, but we decided to go with a K-3 visa because Mexico takes forever with CR-1 interviews (10-14 months!). We should only wait 3 months or so for a K-3 interview.

Congratulations! In some countries in doesn't take that long to get a CR-1 interview, but in Mexico it can take 10-12 months!!! That's why we're pursuing the K-3 because it should only take 2-3 months to get an interview.

Yes, the K-3 process can speed things up. Our petition left the NVC Feb. 13 and the name check cleared with a couple of days. The consulate estimates our interview will be in May. I agree with the other posts that you should ask your lawyer to pay the fees for an appeal because it was his/her mistake. As far as the timeline on an appeal, I don't much about that. Since you're dealing with the USCIS, it may not be that long. At least I don't think it will be as long as the year long wait for a CR-1 interview. Buena suerte!

What you guys need to really compare is interview dates and not the actual approval dates. Everyone needs to remember the NVC has to process CR1/IR1 and the K-3 only passes through the NVC and gets to the consulate much faster.



True! Also consider that some consulates have a huge backlog, such as Ciudad Juarez in Mexico. Over there it takes about a year to get a CR-1/IR-1 interview. It only took us 3 months to get a K-3 interview. For us, it was definitely worth getting a K-3 visa.

I firstalled the California DMV to check, after having read the website. I was told that my husband needed to apply for a SSN, even though we already knew what without his EAD he would be inelligible for a SSN. Then my husband and I took the letter from SSN stating he was ineligible for a SSN. The DMV can check a database with names and SSNs. The DMV accepted, after we persisted, his K-3 visa and I-94 as proof of legal residence. I had to be very persistent because they thought the I-94 was a border crossing card only valid within 80 miles of the border!!!! Thankfully I asked for a supervisor who knew about K-3s and I-94s. So, even though it seems silly, you'll have to apply for a SSN before you get your EAD, then you can go to the DMV and get your license. Good luck!

Getting a passport is easy, getting a visa is another story.

My husband has gotten 2 Mexican passports fairly easily. The 1st one was for 1 or 2 years, but his tourist visa application was denied. He said the passport was no good afterwards.

You can get Mexican passports that are valid for 1 year, 2 years?, 5 years? and 10 years. It's cheaper to get it for a shorter time but in the long run it's better to get a 10 year passport if you plan on travelling.

Does anybody know how difficult it is to get a passport in Mexico.
Do they give them to everyone, or do you have to meet some
qualifications?

Yes, you must fill out online and print. See below to see what the CDJ website says. Ironically these instructions are not in the packet they sent me. This is for the visa application we're filling out for a K-3, I believe it's the same for a K-1. You can fill it out and save it as a pdf file, which can be opened with Adobe Acrobat. Then you can email it or print it and mail it the old fashion way. I DO NOT recommend USPS Air, we have a lost package. This time I'm doing it via DHL. I'm mailing it since I'm signing on the visa app. that I helped prepare the visa application.


These forms must be filled out on line, printed, signed by the applicant, and any third party who assisted. The EVAF DS-156 form contains a barcode that allows the electronic transfer of data, thus reduces the waiting time during the visa application process.

Note: If applicants fail to present the electronic forms the day of the appointment, the Consulate will not accept hand written applications and applicants will be asked to re-schedule their appointment using the
01-900-849-4949 telephone number.
