My co-sponsor is willing to provide me with copies of all materials, but has requested that she magic marker out all of her account numbers.

 

 Do you think the US consulate will be ok with this. Everything will be documented, the amounts, her name, address, and personal details, but for security reasons, she wants to block out the specific account information.

 

 Is this "cool" in anyone's experience.

 

 I can't be too demanding here and I understand what she's saying...but at the same time, I don't want them to be declared "invalid" if that's forbidden for some reason.

 

 Anyone have any insight on this.

Ok, so if that is the case then, obviously, my cosponsor would leave blank the second part about "spouses" or "children" that are being brought along too....because my fiancée will be coming just by herself.

 

 This is correct? Can we have someone that has had a co-sponsor confirm this info, mainly....

 

 

 That the Financial Sponsor is sponsoring the foreigner entering the country on the K-1 visa....and NOT the American (me).

I know that this probably such a simple question, but my financial sponsor is filling this out tomorrow, and I want to make sure I got it right!

 

 I am the American (petitioner). When I fill out the form, I am putting my foreign fiancée's name into the box at Question #3 ("Affidavit is executed on behalf of the following person"). That's obvious.

 

 But when my financial sponsor fills out the duplicate form, does she enter my name or my fiancée's name into Question #3?

 

 Is she sponsoring me (the American) or my future fiancée (beneficiary)?

 

 This would then have an effect on the next bit: "Name of spouse or children accompanying or following to join person"

 

 My foreign fiancée has no children, but is she the 'spouse' and I the one being sponsored...?

 

 Pardon the stupid question, but I really want to make sure I'm clear on this.

Clearly, I will be doing this for my fiancée coming to the country, but does the financial co-sponsor HAVE TO check this box???

 

 In my case, my aunt has more than enough assets, but we have no plans to take any money from her.

 

 After showing all financial information, if she checks the "do not intend" box, is that a bad thing? What if she provides a disclaimer saying that she does not expect that we will become a public charge?

 

 She's finishing the form today, so I want to make sure I don't flub this up.

 She signed the form and #5 on the I-134 clearly states that "I am willing and able to receive, maintain, and support the person named in item 3. I am ready and willing to deposit a bond, if necessary, to guarantee that such person will not become a public charge during his or her stay in the United States...."

 I am using my aunt as a financial sponsor. I am in the clear financially for the K-1, but we are still using her financials, just as a safety valve.

 

 She has several hundred thousands of dollars in assets.

 

 But for #11 on the I-134 form, instead of writing in "N/A (K-1 Visa Process for Permanent Residence), she checked the "I do NOT intend to make a specific contribution to support of the person named in Item 3."

 

 We are abroad now and awaiting our interview in a week.

 

 How screwed are we? For this question if she checked "I DO intend," she would need to give specific details on how that support would take place.

 

 Help!!

I doubt she'll have any issues.  They just asked my wife some basic questions and looked at the sealed envelope.  I was just waiting outside and she said it was easy.  Other members on here have posted similar stories.  Check the point of entry reviews for whenever she's flying to, but you don't need to be there with her as it's pretty easy. :)

Wasn't any problem at all with buying my wife's ticket to US.  They didn't even ask.  I just had to go to the airport in person to present my ID and CC to finish purchasing the ticket for her a few days before her flight.  She flied Korean Air.

Similar thing happened to our case at the consulate.  It was stuck in AP for over a month after approval.  They told my wife that there was nothing to worry about and it'd be issued in 7-10 days with the interview approval notice.  There was some hiccup in their system and her case "magically" went to issued 2 days after my congresswoman's Immigration Liaison staffer contacted the congressional liaison to the state department.  Hopefully this will happen to your case soon after your congressperson's liaison contacts them!  We never did get a response from the congressional liaison to the state department, so hence the "magic." :)

Bring at least the last year's tax returns.  I brought 3, and they took them all.  I recommend bringing 3 just in case.  You'll delay the process for at least a month if they ask for more than 1 year and you don't have it.

From our P4 it states: (it might have changed since we did this in August)

AFFIDAVIT OF SUPPORT (I-134) AND EVIDENCE OF INCOME:
The Consulate requires evidence that demonstrates that you and the members of your family who will accompany you are not likely to become public charges after immigrating to the United States.
? Please submit Form I-134 signed by your petitioner. The form should be accompanied by evidence of sustained income or financial resources, such as his/her most recent tax return.
? If the petitioner?s income does not meet the poverty income guidelines (please see http://travel.state..../info_3183.html), you may submit an I-134 signed by a joint
sponsor along with his/her most recent tax return and proof of U.S. citizenship or legal permanent resident status.

The DS-260 was the form used for the past couple years for K-1 applicants at Juarez. They have changed to the DS-160 for ALL K-1 applicants across the globe. It happened rather suddenly, but it is not a bad thing to streamline the process and make the same form requirement for everyone no matter what country you interview in. Kerry sent a memo about the change, and the last part of his memo is quite clear about not using the DS-260 for a K-1 >

Whatever site you are using is directing you to the DS-260 because that form is used for immigrant visas. A K-1 is technically a non-immigrant visa, but the consulates process them under the immigrant section because the K-1 actually does have immigrant intent. That is the same page London has posted on the K1 instruction page. It is worldwide for K1s it seems since you start by picking your location.

Maybe you are using the place where those getting true immigrant visas like spouse visas fill in a DS-260. What makes this all disjointed is a K visa is a non-immigrant visa. But is is always processed by the Immigrant Visa Unit. Instructions are always under immigrant visas and not where the non-immigrant info is found (tourist, student, clergy, etc). So now they switch K1s to 160s, yet leave things on the DOS pages that say K visa applicants do not do a DS-160. Well as of 4 weeks ago, yeah they do.

Another problem K1s in London have found is the online payment system says immigrant or non-immigrant at the start. If they pick Non-immigrant, then they get on a path to a student or B1/B2 appointment and can't back out. They have to create a new account with a different email address to start again choosing immigrant as the path. It's as poorly constructed as the Obamacare website.

K1 visas are the step-child of immigration. They don't quite fit the masses who are clearly either immigrant or non-immigrant. So they get forms and instructions that don't really work for them.







Thanks for the great info! I agree with what've said about a k1 visa being a hot mess! This is why I am so confused. Everything I've read says complete form 160 you but my only options to 260. oh well, I am NOT going to try to understand.

All of the above makes sense and I know my consulate in Johannesburg requires form DS160, but when I go online to CEAC and login in with my case number and NVC invoice ID, the only application available to me to complete is DS260, not DS160.  Should I just ignore that and complete the DS160?  I was so happy when they switched from the 156, 157 and 230 to just the DS 160 becasue it is so much easier to complete.  Those other forms seemed so daunting- who remembers all the places they've lived since they're 16?!  And my fiance was in the military, so how do we even decide what address to put during that time...DS260 is all those forms rolled into one and feels overwhelming to me, but if that's what we have to fill out, then so be it.  Can anyone give me some insight to why my only option when I log in to CEAC is DS260?

Fyi you do not need to AOS within the 90 days, just marry.  AOS can happen at any time after that, but obviously so that your soon to be husband can work and travel outside the USA, the sooner the better. smile.png

Our IO at the AOS interview commented on the fact that we got married and filed in the 90 day time frame.  There are some members who feel it does not matter if you file in the 90 days.  Why take a chance after all the time and money you spent to get this far.  PS Don't come to AZ is you are not squared away on your documents, and you should know CPB is making a big push to be very active in Ca.

You're absolutely right- why chance it.  We've endure this much, can't stumble in the last leg.

 

90 days, my k1 entry stamp was 10 oct and it is good until 7 Jan, thats 90 days including the day you come in. We got married on 20 Oct and filed for aos within 10 days, might as well.

In my ex's family they have two birthdays if the they don't fall on a weekend.  The family birthday with parents and siblings and then a big birthday on a weekend so everyone can come.

 

That was my idea of moving the birthday.  He wouldn't have to wait, he'd still have a birthday party with his parents on his birthday, but then the family gathering would be after your fiance came.  It was a thought but hey if the kid is gonna throw a fit, let the tail wag the dog by all means. 

 

 

Guess in the end, USCIS wins.  He'll just have to come later so we can get married and file for AOS within the 90 days.  Better safe than sorry ;)

The CBP's initial involvement is somewhat limited to accepting and processing the foreign fiancé(e) with their K-1 visa and associated paperwork at the POE;  unless at the POE, the foreign fiancé(e) declares that they do not intend to marry their US citizen/sponsor as required by the terms of the K-1 visa. I am not sure if that has happened very often. 

 

By way of example, at my then-fiancée's POE, she was asked/instructed by the CBP officer to get married within 90 days of arrival and to complete her processing. Check our signature line to see when we started the AOS process.

 

The CBP will not know if and when the USC-sponsor and the foreign-fiance(e) will get married. That fact will become evident to DHS when the AOS applications/paperwork is submitted to USCIS.  The AOS application will likely be denied by USCIS if the marriage occurs after 90 days.  Review the pertinent VJ FAQs: http://www.visajourn...k2visa-aos.html

 

One possible secondary scenario that could involve the CBP is if the couple had gotten married within the 90-day period, yet had not started the AOS process and the alien-spouse's Form I-94 had expired, and subsequently was stopped by a CBP officer, at a roving inspection station (there are forum threads of those types of operations occurring along the southern US border area), the alien-spouse may be detained by the CBP for further processing, that may include deportation. There are numerous variations of this scenario, the end result is usually more trouble and hassles for the couple.

 

 

 

You could have come in April, then get married at the courthouse just to satisfy the obligation to marry within 90 days, then have your wedding ceremony as planned, just no need for the license at the wedding since you will already be legally wed.

 

 

Also, as to the above stuff about being sent home, the CBP would not know if the K-1 entrant would be marrying for sure in the 90 days, and there is no deadline or requirement to also file for AOS within those same 90 days, so there is no issue about being sent back home upon entry because of that. And, if they married after the 90 days, they could still file for AOS, but would need to file the I-130 in order to be eligible.

Could you ask for your niece's birthday party to be thrown the weekend after so that your fiance would be able to be there to meet family before the wedding?

Move an 8 year's bday to accommodate old people- the kid would have a fit! lol.

 

 

One other option would be to have him come for the family function, get legally married civilly within the 90 days and still have the ceremony as scheduled. 

 

 

remember that your day of entry is day 1  and day 90 is 89 days later   Also remember that the day the marriage is recorded is the one that counts not always the day the wedding take place 

 

Thanks for the suggestions everyone about getting married civilly first.  I want to have everything done in one day so that when we are being introduced for the first time as Mr&Mrs or have our first dance as a married couple, it'll actually be our first time.  It's silly and perhaps because I'm a woman, but it just wouldn't feel as special to me if we have the civil ceremony and reception two different dates.  Otherwise, we'd have the ceremony once he arrives and wait until he is working and able to help me save for the wedding so I can have the wedding I imagine, but alas, my brain seem not to be practical anymore and my heart wants it all done at the same time and the heart wants what the heart wants.

Sorry, this may be a dumb question, but nevertheless, I'm curious.   Does USCIS count the 90 days as calendar days, for instance, our wedding date is set for July 12, 2014 and I'd really like my fiance to be here on April 12, 2014 because it's my niece's bday and a good chance for him to meet the family.  But if I count 90 calendars, he'll have to be here April 14th and not april 12th.  But if we're looking at months, 3 months from July 12th would be April 12th.  Does that make sense?  Of course I'd rather have him miss the birthday party so he can actually be here for the wedding, but if I can have my cake and eat it too, life would just be so much better :)

I should add that if we just move ahead with scheduling an interview and taking the risk of hoping the CO would waive his offense, we'd have to complete a new DS160 admitting the criminal offense and explaining it.  In the current DS160, we marked no to the question about a prior drug conviction (because we didn't know that it was on his record).  Also, he never appeared in court, everything was done at the police station.

Long story short, my fiance has a prior conviction for marijuana possession.  On the police clearance it just has that a small fine ($10) was paid because he was in possession of a dependence forming substance.  Fiance said it wasn't his, but he was arrested because it was in the pocket of the clothes he was wearing (I know same story everyone tells, but in his case, I believe him because of the circumstances that led him to wear his friend's clothes).  His friend came to the police station and admitted that it was his and the friend paid the fine, so my fiance didn't think about it again and certainly didn't think it would be on his record.  He can't expunge it because it has only been 5 years and 10 yrs needs to have relapse.  Fiance has never had any criminal charges before or after the incident and he doesn't even smoke pot.  

 

The court advised him that he can get a lawyer and try to get it expunged.  That process may take a few months but with no guarantee that it would work.  He did speak to a lawyer and the lawyer said he'd help (for a fee of course).  Lawyer told him to get an affidavit from the police station confirming his story and the lawyer would write another letter explaining the situation and send it to the police head quarter and get it expunged, but I'm so skeptical.  Of course if it works, I will, but it's just a shot in the dark.  The money isn't the issue, I just don't want to wait months on end for possibly nothing.

 

I want to call the consulate and see if they would give me any indication on whether we should try to get it expunged or if they may waive it since it was a one time offense.  I know it's a long shot- but I thought I would give it a try.  I have read that there is a waiver that he can fill out if he does get rejected, but is this something we can do preemptively?  

 

If anyone has any experience, insight or advice, I'd love to hear it.  Thanks in advance!

I feel your pain and frustration! We're excited about our quick approval from the California Service center but we're dreading dealing with Ciudad Juarez.

I'm looking for an answer too about speeding up the process at Ciudad Juarez! We got our I-130 approval on Wednesday, which was much quicker than we expected. We've already sent off the I-129 F for the K-3 visa but I don't know if we can do this now that the I-130 was approved.

Have you contacted the consulate in writing? Have you written to your U.S. Congressperson? The Nolo press book on Fiancee and Marriage visas recommends this when you've exhausted all other possibilities in regards to contacting the consulate.

Has anyone here used a lawyer for k1 visa? Is it better to use an attorney? Is it faster to use a lawyer?


I did some research myself before consulting with a couple of lawyers. I found that the lawyers didn't tell me anything that I already knew myself. Our case is pretty straightforward and I have found the VJ forum as well as Fiance and Marriage Visas by Nolo Press very helpful. We decided that it wasn't worth $1500 minimum to hire a lawyer to fill out paperwork that will require us filling them out ourselves so that he/she has the necessary information to fill it out. Plus, my husband is a law student in Mexico and my father-in-law is a retired lawyer, so they've been helpful as well.

An upper-middle class friend of mine as well as her friend both insisted that a lawyer was necessary. However, my friend and her husband needed a waiver of her husband's J-1 exchange visa homestay requirement of 2 years. As it turns out, they have had to produce drafts of their I-130 and G-325As, then the lawyer checked it over. It actually took them longer to assembe their petition than it did for us. Why bother in my opinion. They've gotten a few helpful hints, but once again if you do some research by reading the Nolo press book, then you can find out yourself.
