Hello,

Question. We got the hard copy today and the last name of my fiancée (the beneficiary) has been reversed.

In Brazil, people have have two surnames, the last names of the mother and father.

As a hypothetical example, a woman's name would be "Maria Rodrigues Silva," with "Rodrigues" being the name of the mother and "Silva" being the name of the father.

Using this example, on the NOA1, they've listed her name as "Rodrigues Silva, Maria," last name first, first name last. That is correct.

But on the NOA2 hard copy which I just got, they've listed it in the following manner: "Silva Rodrigues, Maria."

So they've switched the two last names in the incorrect order.

Obviously, we are worried about this causing a slowdown or in a worst-case scenario, a major delay in the processing.

I've filed an e-request online to fix the typographical error and I will call to USCIS tomorrow to try to get this changed ASAP.


Has this happened to anyone before? Is this is a big deal, in your opinion?

I'm praying this isn't the case.  From my observations it doesn't seem to be a lottery system but something more like a hybrid lottery system where a (random?) group of case numbers are allowed to book the appointment at some (random?) amount of time.  How they go about selecting who gets to book I have no bloody idea!  Maybe it's based on when paid but I don't really know.  It's been a week now and still can't book the appointment.  My Fiancee is in tears over this process too.

 

 

I forgot to mention, this is my effort to schedule my fiancee's interview date through the CGI Stanley website. We have been trying for several days and some applicants have been able to schedule their interview and they just now paid their visa fee! This new system is like we're trying to play the lottery. Whoever can accidentally hit the calendar the instant they release new dates is the winner! It's not fair to those who have been in the process for longer than them.

I got started getting the financial documents together for the affidavit of support right after I submitted the initial I-129f.  Can't hurt getting the employer letter, bank statements and anything else right now.  Your interview will most likely be around end of October-first of November depending on when you get lucky with the interview date lottery nonsense, but I'd get it sooner than later.

The i-94 # won't be available electronically through the website until 2 weeks after she arrives from what I've heard before you can apply for a SSN.

If anything, the B-2 denials actually help your case.  My wife had a B-2 denial a few years before we did K-1.  The VO said that it helped show that our relationship was genuine since my wife wanted to come visit me. :)

NOA2 APPROVED!

I got the email at 9:46PM California time.

Omg I'm so happy I'm shaking.

I emailed them when we had to submit for a COC.  They emailed me back a completely different form than what was on their website.  I'm not sure if they just ignored the form that you submitted originally since it was the wrong copy or what.  I'd say try to submit again with the form that she emailed you.  I'm not sure what else to tell you, I'm sorry for your trouble! :(

Thank you very much for the reply!  smile.png  His biggest concern is that he's not IN SA at the moment.  He's in Ireland, and he's thinking it'll take up to 6+ months to get the police clearance.  This worries me more than anything. My hope is that he'll be at the interview stage in 6 months' time.  Can a family member of his request it for him?  Unbelievably, he has pretty much all the other documents he would need from SA, apart from that. 

 

I understand why he's concerned because things in SA take forever and people are not friendly.  He can have a member help submit it for him, but he has to get finger printed and he has to do that himself.  I'm not exactly sure if he has to get finger printed at any particular place (eg consulate), so you may want to try googling or searching the SAPS website.  When I was researching, I remember reading about people who lived abroad and getting their PC done from abroad.  Good luck.

Wow that is really long wait time, would you mind sharing the medical experience, plus the embassy never mailed a letter with specific instructions, just an email directing us to there confuing website, DS160 done but wasn't clear on what else they needed we dud DS230 and 156 something or other. This is why I'm so stressed not to many people from SA consulate I can seek advice, I'll take anything.

Yes, all you need is the DS 160.  The DS 230 is outdated and so is the 156, that is why I say to read and do some search on the site.  All of your questions have been asked before and answers given.  He's not going to do his medical until it gets closer to the interview date. I don't want to risk it expiring, since it is only good for 6 months, if we have to apply for a waiver.  If you are in Cape Town, the doctor I hear is nice, their staff is very helpful.  I spoke to them when I was visiting my fiance in December.  Don't be nervous.  You should have received an email from the embassy with instructions to complete the DS 160, medical, police clearance and whatever documents you need.  this is Packet 3.  We didn't receiving an email, so I had to send multiple emails to follow up and we finally received our Packet 3 email, but the instructions were wrong so I had to email back for clarification.

 

When I emailed them back our packet 3 to schedule an interview, we didn't get an interview notice the first time, so we missed our appointment.  I called to follow up and the person I spoke to said she'd follow up on my second interview request.  She then called my fiance to let him know that he missed his first interview, but he told her that he didn't get a letter, email or phone call letting him know that he had an appointment.  She sent us an appointment letter shortly after, but she put down the wrong VISA type on the letter, but I confirmed with her that it didn't matter.  From what I've read, this consulate sounds like they have their ###### together, so maybe we just got someone who is overwhelmed or doesn't know what she's doing.  Either way, every time I call, she's really helpful and friendly, which is a lot more than I can say about the SAPS.  If you don't know, customer service is almost non-existent in SA and especially with government workers (I guess the same can be said of our civil servants..)

I had to reply to your post. Fiance and I are still gathering documents police clearance from south Africa and Zimbabwe, he's Zimbabwean, haven't done the medical, our approval is good until May and I'm going out my minf with worry, does it really take that long to get SA clearance? I'm so worried about that.

Thank you.  It doesn't take that long to get the police clearance, but if your fiance was ever arrested and have a prior conviction, it'll take longer, but shouldn't be more than 12 weeks.  If you already have all of your other documents, then you shouldn't worry.  I see that you seem to be really nervous from your other posts, so my word of advice is to just relax and breathe :) There are so many who have gone through the process and documented their journeys so that the people who come after them, like us, will be more knowledgeable and hopefully less stressed out about the situation.  If you get nervous, read other people's stories and struggles.  If you are unsure of something, ask or do a search on the page and see if anyone has gone through what you're going through.  All I'm trying to say is that, don't worry so much because what will happen will happen and stressing about it won't help matters.  I don't think you have anything to worry about (I know, easier said than done).  Good luck to you :)

Good luck!  I have a question: I was reading your timeline, and it says that you were waiting for his documents from his home country (SA?).  Does this mean that he lives elsewhere currently, or did SA take that long even though he still lives there?  My man is also South African, but living in Ireland (citizen of both now) and we've been debating about how long it'll take to get these documents.  :-/ 

 

Hi There.  I saw your question on another post and meant to answer, but got sleepy smile.png  There are a few agency that will help you get his Police Clearance- you can google it. The process normally only takes a few weeks- the website says 8, I think- don't quote me on this, but from what I've seen, it only takes 2-5 weeks, if there are no prior convictions.  My fiance sent his in Dec 4, they didn't start processing it until Dec 19th, I think, and because of a prior conviction, they didn't finalize it until Feb 4, which wasn't as bad as I thought.  If your fiance has no prior convictions, it should be fairly quick.  But if there is a prior conviction, it may take up to 12 weeks.  Once you submit it, you can check on your progress on the SAPS website. 

 

Ours took a while because of the labor strike so the mail didn't arrive for another 2 weeks.

I saw that someone had posted a Feb Interview topic and thought there should be a March Interview topic so you can post about your interview experience.  

 

Our interview is on March 27 and I am expecting a denial because he has a record for marijuana possession from 5 years ago (long story) and will apply for 601 waiver if he is denied, so I guess you can say I am expecting the worst, but hoping for the best.  It's so nice to read about other people's stories and approvals because every time I see an approval, I gain a little bit of hope.

I was so discouraged when my fiance and I found out that his police clearance came back with a record of marijuana possession.  A fee was paid and he never thought twice about it and didn't think it would be on his record to haunt is years later (it wasn't his to begin with..here's the link to the back story if you want to read about it

I searched on VJ and other sites for other people's stories and hoped to find glimmers of hope, but the more I searched, the more depressed I felt because for every 1 story of someone getting an approval with a prior conviction, there were hundreds upon hundreds of denials.  Nevertheless, we submitted our application and explained the circumstances surrounding the arrest and hoped for the best.  I hoped for the best and expected the worst.  I couldn't sleep the night my fiance had his interview (day there, night here) and was so nervous and stressed out.  In the end, he said the experience was painless and easy.  They didn't ask him any questions about the arrest, only the usual questions of where/how did you meet etc. 

 

I was so sure that he would be denied a visa and we would have to go through the waiver process, but he was approved and the CO never even asked about his police record.  I don't know if it has anything to do with the fact that it was just a fine and he didn't serve any jail time or that people's views on marijuana are becoming more lax, but whatever it was, we are so happy to receive the approval.

 

I just want to share our story and hope that we can provide some hope for those in a similar situation.  Please stay positive and don't get discouraged.  You really never know what is going to happen and if you are in a tough situation and although the odds seem like they're stacked against you, don't give up.  There is always a chance that you'll be that 1 person out of a million who'll get approved dispute the odds.

Where has he applied? I applied at Home Affairs in Pretoria and it was ready in a week. Pretoria is quite fast because the head office is here. 

 

He's actually from Congo and his passport was stolen when he arrived in South Africa, but he hasn't gone anywhere, so hadn't had a reason to get a new one..until he met the woman of his dreams!  jk.  DRC is full of corrupt politicians and red tape that only move at the smell of money.  Apparently there were no more passport appointments at the embassy (in Pretoria) until Jan, but one of the employees squeezed him in (as a favor or so we thought because she didn't get his birth certificate for him when she was in the DRC, but he had paid for it- thought she felt bad) but when he got to the embassy, she pretty said there are no appointments until Jan, but I'm pulling strings to get you in today, so I'll need 500r please. No wonder that place is a ###### hole, but I digress... no one said I had to love his country too.

 

We sent packet 3 day after you and just called consulate to check and was told booked out 6 weeks now. UGH!!

 

6 weeks is right around the corner!  Don't worry, it'll be here before you know it!  6 weeks means before Christmas, so maybe he'll be here before the new year!  What a great way to ring in the new year.

As for us, we'll have to be patient and just wait.  He is waiting for his passport which may take 2-3 months, so there's nothing I can do but just be patient.

Once I sent back the notification of readiness, I received the email containing my appointment letter within the hour.

 

wow- that is super fast!  We are very lucky that the consulates we're dealing with are efficient and from all the reviews very friendly.  I've read horror stories about other consulates, so I count my lucky stars :)
