Use a joint sponsor. Seeing as you both live in Australia, the current income you are on now i'm assuming will be done when you both migrate back? A joint sponsor can be anyone that is a US citizen and lives within the US and meets the requirements of the poverty line.

It has been known to take around 30 business days for a case number from the NVC.. follow the NVC April thread and there's a spreadsheet you can look at to see the timescales. If the NVC said they received the case, they have. When they say they're entering it into their system, they are inputting a case number, etc.

As per what the USCIS processing times say, it is really an unknown when you may get a NOA2 for your I-130. You can call but they will probably say you're within processing times, and to wait.. or try to even put a service request in. A lot of people on here have been waiting up to almost a year. There are some cases where they have been processed within 5-6 months.. depends on how fast USCIS has been working, but there has been a massive backlog for the past few months..! It's a waiting game! Good luck!

My wife just put our address we are currently living at in the UK, we received the notification of the NOA1 and NOA2. You will be able to see any case status updates on the website as well, especially if you sign up for the e-mail notification it will give you the receipt # as well. 

It really doesn't matter which one you put, but bare in mind if you get request for further evidence from USCIS, it will take a couple weeks to possibly to get to Sweden.

Regardless of where you live, being a US citizen requires that you file a tax return with the IRS. Don't know where you got the idea being outside the US, and not earning income in the US makes you exempt. 

 

You both need to fill out I-864 forms, you're the petitioner and always will be a "sponsor" and responsible for the immigrant you are petitioning for, even if you don't make the 125% threshold. Your mother will be a joint sponsor, and will be able to help sponsor for the principal applicant.

Plus, your income will be 0.00 if the income you're receiving in Japan is going to end once you move back to the US.

Hi All,

 

This is one area with very scanty any no particular trend for. We need people how have actually gone through the process up to the interview stage to clear some gray areas.

 

1. Is it okay to fill 0 as your current income because your income will not continue when you move to US?

2. Is there any advantage of include what you have in your savings account in the USA as part of your access even when your joint sponsor has adequate income?

3. When you use the foreign income tax exemption, line 22 of your IRS form 1040a will be $0. Is that the correct information to enter in the Part 6 ...13a, b and c of the AOS?

4. Do you have to have a job in the USA to proof domicile successfully?

 

Please share your experience through the NVC stage and at the interview.

1. Yes- Because the income will not carry over to the US you will have no current income to support your spouse on the income you are on now. Foreign income doesn't count. $0 is acceptable.

2. Only advantage I can see is if you need savings for when you move back home, as it's good to have savings just in case for any emergencies, or to get back on your feet.

3. Yes, you put what it says on your federal tax transcript for the total income you made, adjusted income if you filed an 1040ez.

4. No you don't have to have a job in the US to provide sufficient US domicile, there's a list of documents you could to provide you have maintained US domicile or are re-establishing your domicile. This can be found in Saylin's NVC thread in her Wiki. The job does hold a lot of weight, but it really depends what satisfies the CO at interview.

Hi again!

 

 So i've been battling the I-864 form now for a while, and it's really confusing..

 

 So, I am the beneficiary, my wife is the petitioner, she currently lives in Sweden with me, shes unemployed with 0 income. She's been here since mid 2012 and I have been supporting her since then.

We have a joint-sponsor, we already got all of her paperwork, and it checks out!

Now, here's the problem: filling out my wife's I-864.. I am really not sure how to proceed.

 

We are stuck at part 5 and 6.

 

Should we add our joint sponsor in part 5?

 

On part 6. since my wife is unemployed with 0 income, should she then add me on part 6, question 6.a ?

If so, do I need to send in any information along with this application? or do we leave this blank?

 

Since her current income will be 0.

 

But since I am supporting her in Sweden, should the current annual income be my income?

 

I will not keep the same job when I move over to the U.S so the income I have at the moment will only be in the works until I move to the U.S.

 

 

Then we move onto part.7 

 

Do we need to fill this out with MY savings and assets ? or do we also leave this blank?

 

 

 

 

 

 
1- Part 5: No you don't add your joint sponsor. Your wife isn't a dependent on someone else's taxes. It just stays two. Since she would only be responsible for herself and you. (Assuming it's just you and your wife within your family right now, no children).
 
2- No, your income will not carry over to the states, so therefore you don't put anything there. It will just be 0 on questions 5, and 10 on part 6. 
 
 
3. Part 7- If you want to add your savings and assets, but that's usually if you're income isn't sufficent and you can show that it equals 3x over the poverty guideline. Plus, you would have to show proof of all assets, and all evidence.
 
If you have a joint sponsor who makes over the poverty guideline for your petition, you should be fine. Your wife still has to fill one out do to the fact that she petition for you and will always be your sponsor/petitioner.

I'll start off for you :P

We received a checklist for a w2! (AOS Package). The W2 form didn't exist since my wife worked in the UK! (We have P60's, which she included). She also had a note saying the UK did not do w2's, only P60's. 

We were able to speak to a supervisor, who said they would remove the checklist- It took 31 business days to remove their error.   :bonk:

Hi Everyone! I'm new here but I've been looking at this site for over a week. I met my fiancee through an online introduction agency "Ilovelatins.com" over a year ago. So far, everything has been wonderful except of course for the slow K-1 processing times due to IMBRA.

In any case, I wanted to let you all know that there is supposed to be a story in the New York Times soon. I believe it will be written to highlight a number of things including the impact of IMBRA and the growing attraction for Americans to seek out foreign spouses.

The reporters name is Eduardo Porter and he has already interviewed Gary Bala (a visa attorney) and Sam Smith of I Love Latins. Sam sent out an email about this last week and I contacted Mr. Porter too. I have an appointment for a phone interview with him on Tuesday afternoon to tell him about my fiancee and our case.

Hopefully, something good will come of it. If I hear about the story being printed, I will post a topic here to let everyone know. If anyone has any suggestions for something I might tell Mr. Porter, let me know! I'll be happy to pass it along.

Well, then for the sake of openness and completeness, I will choose to put the apartment that we "lived together" in after we were married on the I-130.
Especially considering that for our Proof of Marriage, I am including bank statements with that address and bills from the apartment.

But on the G-325a since it asks for "Residence" I will exclude my "visits" to Germany, as my wife will exclude her "visits" to the USA. Since legally and technically, that seems to be the correct answer. We were tourists during those trips--hence the tourist visas. It doesn't seem right to claim residence while on a tourist visa, however you could "live together" while on a tourist visa.

Does that sound correct?

I'm just trying to avoid any problems, while answering each question asked properly.

I guess it becomes a question of terminology, Living Together vs Residence

Are these terms interchangeable in CR-1 speak, or are the two completly different things?

For instance:

Question 21 on the I-130 "If filling for your husband/wife, give address at which you last lived together."?
My wife may have been on a Tourist Visa, but we did "live together" It doesn't say residence. Does that sound right?


But on G-325a, it asks, "Applicants residence last 5 years"
Since we were on Tourist Visa's then it would not count as "Residence" and we would not list our travels on Tourist Visas.

Does any of that make sense?

It just seems strange to answer differently on 2 forms I'm submitting together--I don't want to be accused of fraud, or cause any questions.

Does anyone know for sure what the correct way to answer these questions would be for me?

Hello,

I'm just about to begin my visajourney, and I have a question about residency.

My wife (girlfriend at the time) entered the United States on a Tourist Visa, and on a whim we decided it was time to finally get married--we had been traveling between Germany and the United States for almost 2 years. Staying as long as visas would allow, then moving to the other country.

After we were married, I added her to all the bills to our apartment, and she "lived" here for a few months--until eventually returning to Germany.
Now I'm beginning the paperwork to get her CR-1 and I'm not sure if any of it is actually considered "residency".

My question is, Since all our living together was technically done on tourist visas, does any of it count while filling out question 21 on the I-130 "If filling for your husband/wife, give address at which you last lived together."? Did we live together? or do I put "none"?

I will be submitting Joint Bank account info and Bills in both our names that have this apartments address on them, does that matter if she was technically not "living" here?

And on G-325a, Where is asks, "Applicants residence last 5 years" Do we not list the various times we "lived" together in Germany and the United States, because we were technically tourists?

My tax returns for 2006 & 2007 show me as under the Poverty Line. (I lived with my wife in Germany for most of them)
But my 2008 return is well above the Poverty Line.

Do I have to show Income over the Poverty Line for the past 3 years?

Do I need a Joint Sponsor? Or is my 2008 W-2 (over Poverty Line) and Letter from my employer stating my 2009 salary (over Poverty line) enough to show support?

Yeah, I am still shocked at the speed at which the Vermont Service Center processed our case.

I was so scared sending it to them, I thought the only chance I had at a quick process was being transferred to California.

I have no idea how I got my NOA2 so quickly.

And I was in Germany visiting my wife from Feb 13th through 25th; if I had been home it could have been even quicker!

I labored over our applications; everything was as perfect as humanly possible. But still, I do not think that I can take all the credit for the speed in which I was processed.

I can only hope that I am not just some fluke, and that the visa process begins speeding up for everyone!

Yeah, I had that exact same message. It drove me nuts!
It means that they aren't completely finished looking at your papers--nothing to worry about.
A few days later it had changed to a message saying they received my papers and were reviewing them, then case complete!


Here's a quick review of my calls:

I called and got a guy who told me that my I-864EZ was complete and they were reviewing the DS-230.

The next day I called and got a woman who told me that they were reviewing my papers.
I said to her, "I spoke to someone last night and was told my I-864 was complete." and she just repeated the AVR message again...

I hung up, immediately called back and was told my case was complete!


Getting the right operator makes all the difference...

But yeah, don't sweat that message. And the AVR is usually a day or 2 behind the actual progress, if you call you'll know for sure (assuming you got an operator who's willing to do their job.)

Hey Everybody,

Figured I should give an update on our visajourney.

Lara had her medical--Had to get a Gardasil shot... Didn't expect that! (Cervical Cancer is not contagious!)

Had her interview on Friday, April 3rd, 2009
EASY, 2 questions:

What does your husband do for a living?
&
How did you meet?

They didn't ask to see any of the photos or other proof she brought.
and that was it!

Only problem was her passport photos (she had to show her ears--something new I think)
They have a machine in the Frankfurt Embassy, so no worries.

Visa Approved!

She picked up her Visa yesterday! April 7th 2009
She could have got it a day sooner, but didn't have the time to drive to Frankfurt on Monday.

We bought her plane tickets in advance, so in 5 days Lara will be in the United States as a Permanent Resident! (Conditional, of course)

April 13th 2009!

One day before our 1-year Wedding Anniversary! biggrin.gif


All together from the Notice of Action #1 till she picked up her Visa was 99 days!

Faster than I ever expected!

Now I have to clean the house before she gets home and kills me! hahaha

its a government agency, they never know what is going on, especially the people at the Tier 1 level, you are only going to get partial straight answers from tier 2 where they actually have that information. do not put any stock into what they say when that first person answers that phone, a trained chimp could do their job blind folded, they are just following scripts they are given and have no actual information other than what we see when we log onto the web. just keep hoping and believe that every day someone might get off their duff and approve your papers, that is the only thing i can think of to keep me going.. is that one of these days i will be able to call my SO and tell her the papers have finally been approved.. kicking.gif
