OK.... slightly confused now.....So do I need him to send me his letter of intent, bio form, and pp photos BEFORE I send the petition? Does his info get obtained after APPROVAL....?????

As far as I knew I send those things from him along with the petition?!?!?!?!

Yes all of those things need to be included in your petition packet and all that require the beneficiary's signature will have to be sent to you via post before you submit anything.

Actually I wish I had more forms to fill out because I've already finished with all of the post approval forms (with the exception of ones that would be out of date if filled out too soon), hence why I am obsessively reading every immigration thing I can get my hands on and pestering others in the process. :hehe: Sorry everyone!

After doing some digging on the web and VJ I've found other forums regarding emails that are identical to the one I received (for a few different kinds of visas though). The reply these posters have gotten have all been saying that this means they won't have to go through an interview and such...but this couldn't possibly be true, could it? Rationally I'm thinking it must just be a mistake but, at the same time we have a very uncomplicated case (no divorces, no criminal records, living together, no children, he has been granted a visa before and has half brothers with dual citizenship)...etc.

Ah I'm doing my own head in with this....I'm definitely calling tomorrow! :wacko:

Yeah I figured it was normal that it got sent to Texas but I double checked before we sent it and made sure Vermont was the service center for our state (Florida) so I'm just stressing out now that I did something wrong and that this will slow down our case. :unsure: What is even more upsetting is that the California center (based on the timelines) seems to be an entire month behind Vermont!

I just received this email from the USCIS saying that our petition has been transferred to the California Service center. Last week when I got the NOA1 Email from them it said our case had been sent to Texas for processing. What's going on? Does this mean something is wrong?

In response to your question about your fiancee's cat: I know when bringing animals out of the States they're required to be quarantined for 6 months and I think the same procedure applies when entering the US with an animal.

Definitely do some research on it, the UCSIS website may even have some information on the subject.

I don't think everyone gets asked, but it is definitely a common question. Have a think about it... surely you and your fiance discussed the question of where to get married? Maybe you decided to get married in the USA and go for the K1 because you didn't want to be separated after being married, as would happen with a spousal visa app; maybe it's easier for family to go to the wedding in the USA. Maybe you have a church you want to get married in there....



So if we are living together in the beneficiary's country until the k1 is granted and the interviewer asks "why didn't you marry in Ireland and then apply for a spousal visa?" Would it be acceptable to say that we felt it would be special to have the civil ceremony in the city where we met and then later celebrate in Ireland once we've settled in?

I guess I didn't realise it would matter to them which visa path we took as long as we were honest and did everything by the book.

Many people are confused by this requirement. For the petition what they want are letters of intent from both the petitioner and the beneficiary. Like these:

Fiancée Letter of Intent

Dear Sir or Madam:

I, (your name), do hereby state that I am legally able and willing to marry (fiance/e's name), and intend to do so within 90 days of his arrival into the US using the K-1 visa.

For the interview you'll need updated letters of intent and a receipt for the engagement ring (though I don't know if it's required).

They did on my Romanian passport, that's what I entered Turkey with....should I make copies of that one too? Am I allowed to have two passports? My mother said I shouldn't send that one because I'm not allowed to have a second passport or something...


Hm, I'm sot sure if you're allowed to have two passports or not. Do you have dual citizenship? My soon-to-be-brother-inlaw has dual citizenship and he has two passports.

No, I'm the only one who's visited him because I have free passes. I won't be able to go until December due to my work schedule. Would the receipt he sends me from the travel agency where we booked our excursion to Turkey this summer be enough? In my letter describing our relationship, I mention that I've visited him 5 times in 2009 and twice on 2009. Do you think that they'd get suspicious since I have no stamps on my passport? Should I just mention our trip to Turkey (for which I have proof of?)

It's ridiculous because we've spent sooo much time together and can't prove it. Wow....

If the receipt from your trip to Turkey has both of your names on it then it should suffice. Did they stamp your passports when you entered Turkey by any chance?

Has he come to visit you in the States? If so then his passport stamps could be used to prove you've seen each other within the past two years. Or perhaps you could make one more trip over there before you file and when you fly into Romania ask to have your passport stamped. Another thing you could do is visit and treat yourselves to a night in a hotel and use the receipt from that.

I wouldn't worry about trying to explain his surname because no matter what you say they will probably still look into it. My fiance was born in Kuwait and has an Arabic birth certificate but his entire family is 100% Irish, it just so happened that his dad had a job there for a few months when his mom was pregnant with him. I too was worried that this would cause problems but I know there's nothing I can do but wait for them to clear him themselves. :)

I think you should be fine with that (though someone else may be able to verify that better than I). But perhaps you could create a savings account and transfer most of your funds into that. It seems like it would be more secure anyways since with a checking account (assuming you use a check card) if someone gets a hold of your information you'll be out of your life savings.

I believe they would allow you to submit new primary evidence after receiving an RFE, and I've haven't read anything on here to suggest otherwise.

Unless you have complications in your case you may want to drop the lawyer...his comments seem a bit dodgy. :unsure: I read about a lot of people on here who've used lawyers that actually messed loads of things up on their case, costing them time and money.

So I decided to tackle this Fiancee visa on my own and I hope I am making the right decision. Tons of information out there, but I wanted to know a few things. I started filling out my forms and I notice that when you do it by computer you cannot type in the whole address sometime so what do I do? Also I have 2 years worth of email trail, what is appropriate? On these forms they ask for state or province, but my fiance is in Panama so there is no state or province so do I leave that open? Form 325A (employment last 5 years, I have been employed at the same location since 2000 but I cannot fit the address so what do I do? Please help..



Try and fit the addresses as best you can, if you haven't already try abbreviating words like 'road,' 'circle,' etc. If they still don't fit include an attachment on the following page.

You don't need to prove your relationship at this point of the process, only that you've seen each other within the last two years so including emails would be optional.

Put his county in place of the province.

You can list your Scottish address and they'll send it to you there (my last notice was sent from California and only took a week to arrive in Ireland).

I'm not sure what you should do about the situation with your taxes. Did you know you were supposed to file or was it an innocent mistake? It may be something you'll need to sort out with the IRS first.

It's nice to meet another overseas American applicant, and interestingly enough we share the same name :P

I don't know if this will apply to you. Some of my records have the "JR" suffix (birth certificate) and some don't (passport) so I left the "JR" out on #1 of the I-129F form but wrote in my full name with the "JR" at the end on #7 "Other names used." My I-129F petition was just approved yesterday without any RFE's. Hope this helps.

Hi guys, I've seen this topic before but there was no clear clarification about it and we just want to make sure that we don't have a rework just because of this small detail.

Okay, in I129F form how do you fill it out if your name ends with a suffix JR?
In what area will we put the suffix when there is no specific box asking for the suffix?

Sample name: John Ray Doe JR

Will it be--
LAST NAME: DOE
FIRST NAME: John JR
MIDDLE NAME: Ray

Or will it be safer to just put--
LAST NAME: DOE
FIRST NAME: John
MIDDLE NAME: Ray
and fill out Other Names Used John R. Doe JR
