K-1 Fiance(e) Visa Process & ProceduresI-134: 100% or 125%
for the i-134, do i have to meet it at 100% or 125%? I read on travel.state.gov once that it had to be 100% for that form, but now i'm second guessing it. And do assest have to be 3 or 5 times the difference if you do not have sufficient income?

K-1 Fiance(e) Visa Process & ProceduresPre-NOA2 prep? (for my GH folks, esp)

Its nothing to worry about. It doesnt change anything if you have already given him copies of the I-129f petition you filed. Some people wait and later send the copies of the I-129f to the beneficiary when they have received the NOA2 so that they can anticipate the interview date and attach their recent pay stubs ot the copies and send to the beneficiary.

oh ok. Good. It's actually easier for me to hand deliver the papers to my fiance. He comes up for visits every few months or so why pay postage if I'm going to see him anyway. Thanks!

Just out of curiosity, why would we have to wait until the NOA 2 to send a copy of the I-129F packet to the foriegn fiance? I'm still a month or so away from a NOA 2, but my fiance was visiting me last month and I just gave him the copy of the packet. Should I have waited and why?

K-1 Fiance(e) Visa Process & ProceduresMedical Exam and Lost Records

My husband is Chilean and also has NO idea what he's gotten. We're going to try and contact his pediatrician... but most likely it will be a dead end. I'm also assuming he's gotten MMR, Small pox and polio. I think it's safe to assume that he hasn't had a flu shot, Hep A and probably could use a tetanus booster. So we're going to look into getting those ahead of time and see what insurance will cover. Has anyone else gotten them ahead of time? Is it more cost effective than getting them at the medical exam? Thoughts?

I'm not sure if it would be more cost effective. Can't hurt to get the vaccines done ahead of time as long as you can get some sort of record of it to take to the civil surgeon. After doing some research, another option could be to have your husband get a blood test done and with that, the doctor can see what vaccines he's had already. I'm going to try to get my fiance to do that. No sense in getting shots twice. That's how I look at it anyway.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam and Lost Records

My fiance is also from Chile and although he received his vaccinations as a child, Chile is not so great at keeping medical records, and he has no record that he ever got the vaccinations. He spoke to the doctor who will perform his medical, and she said that it is normal for Chileans not to have their vaccination record, and she will give him everything he needs (he has proof of the vaccines by the scar on his arm). His medical is in two days, and I can let you know what happens if you want.

I would not worry about your fiance not having his medical record or vaccination record, assuming he is in generally good health.

Thank you so much!! That will be so helpful to us!! Based on years, I'm almost positive he has had MMR, DTP, Polio, Small Pox, and maybe Hepatitis B since that one came out in 1982. He went to the American International School so I'm assuming they would have abided by whatever was standard in the USA at the time.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam and Lost Records
I understand that my fiance needs to produce his vaccination records prior to his medical exam. However, we've come across something that may be problematic.

My fiance was born in Chile. When he was 6 months old, his dad got a job with the UN and the family relocated to Israel. They lived there from late 1980-1985 (or 86). It would be during those years that my fiance would have received his all vaccinations at his elementary school, which was in Tel-Aviv. The family relocated to different countries between 1980-2004 (Israel, Cyrpus, Honduras, Chile, back to Israel, Canada, back to Chile where he lives now). The records never followed them where they went. He's not to sure they even existed in the first place.

Is there anyway to find a record or even create a new one? Would the doctor doing the exam be able to assist with this? Not sure what to do....

thanks!

K-1 Fiance(e) Visa Process & ProceduresGetting a Police Certificate
My fiance lived in Canada for 8 years and will need to present a police record to the embassy from there as well as Chile. Yesterday he went to the civic center in Santiago where they can take finger prints and send them off to Canada to get the record. However, they told him that without a document stating that he has to have this done, they can't fingerprint him/get him the Canadian record. What document(s) could show that we need this police record? Would a NOA 2 be sufficient? Or would there be something the embassy packets that say he needs to obtain police records?

I am sorry for you guys.

Just to cheer you up, even though sometimes international mail can be slow, I just sent mail (regular, cheap mail) from france to New zealand, it got there in 4 business days...So you can also get lucky (I hope you will!)

Thank you so much! :) You could be right and we may get lucky, but My fiance has had to wait 6 months from things to arrive to Chile from Canada. We kind of have a plan to avoid some of the wait. We're thinking that my fiance should just get the finger prints in Chile and express mail it to the USA. Then from here I express mail it to Canada using the USA address. Canada wont express mail it back but we're it'll probably take less time mailing from Canada to the USA. I'll see him before the interview anyway so I can just hand deliver the police certificate to him. Sure, it'll still take 2 months to process but my logic is that faster we get it to them there's a chance we'll get the certificate a little quicker.
Mailing it express costs more too but I'm willing to pay it to prevent our interview getting pushed back any farther.

I just want to throw this out there about the police certificates...***for some countries you will NOT be able to obtain a police certificate without a letter stating that you need one.*** My fiance and I are having this problem now. We were trying to get his Canadian police record from Chile and we started looking into this weeks ago. The municipality in Santiago is slowing us down because they won't take his finger prints without proof he needs this done. Also, Mounties aren't accepting digital finger prints at the moment we have to do things the old fashioned way with ink and snail mail -_- We need the finger prints sent to Canada however it's going to take at least 2 months or more for us to get the certificate in return. We just got out NOA 2 yesterday. We feel kind of screwed right now.

K-1 Fiance(e) Visa Process & ProceduresPreparing I-134

I'm curious myself...what is this stuff in section 11 about intending/not intending to make contributions ? I will also be using a co-sponsor. Why would you put "k1 visa process for permanent residence" ?? That doesn't seem to answer the question they are asking there. Can someone further explain the section 11 part of the I-134 ? It seems weird to me and I don't know what I and my co-sponsor should put once we are at the point in the process.

Thanks for bringing this up. I've wondered about this too...

Thank you! That was very helpful!

Thought of another question...
back in august my soon to be father in law bought a house for me and my fiance to live in. My father in law owns it and pays all the bills on it. Considering I have a low income (graduated college in May) and need a co-sponsor as it is, would it help our case to write a letter to the embassy explaining my living situation? I figure maybe it'll help if they see that my fiance and I don't have rent to pay so our savings will last longer since our only real expenses then will be gas, food, and my student loan payment which is $300 a month (i know it's still alot but it could be worse too).

Thoughts????

K-1 Fiance(e) Visa Process & ProceduresPreparing I-134
Hey all! So I got my NOA 2 today and I'm getting a start on the I-134. I have some questions that I need answered for myself AND my dad who is my cosponsor.

1. For section 3, it asks about the beneficiary's relationship to the the sponsor. What would be the appropriate answer? I was thinking "future son-in-law".

2. Section 11: Should my dad check that he will make specific contributions and explain or should he leave it blank like the example form on the VJ site and put N/A (K1 VISA PROCESS FOR PERMANENT RESIDENCE)? I was going to put that for my I-134 but I'm not sure that would be appropriate for my dad to fill out.

3. In regards to letters from the bank and employers, are they going to be addressed to the embassy or to the sponsor? Any there example letters around? (could have sworn there were some examples here on this site but I can't find them now)

4. Do we need to submit tax returns/W2s for the past years or will the most recent year be sufficient?

I think that's it for now. :)

K-1 Fiance(e) Visa Process & ProceduresWould this screw up our application process???

Hi,

I am currently in Australia and I am also trying to get a police clearance from Canada as quickly as possible. I did a bit of research yesterday and found a company that is accredited by the RCMP to scan ink fingerprints. The company then sends the electronic fingerprints to the RCMP and it takes three days to get the police clearance. They accept money orders or credit card payments. It costs only $50 (incl. RCMP processing fee).

The company is called Safran Morpho (formely known as L-1 Identity Solutions). I tried to post I link to the company's website in this message but it kept failing. Safran Morpho (formerly L-1 Identity Solutions) is listed as an RCMP-Accredited Fingerprinting Companies on the RCMP's website. Go to RCMP's website > Vulnerable Sector Checks > Scroll down to section Fingerprinting for a Vulnerable Sector Check and click on RCMP-Accredited Fingerprinting Companies link. (sorry, unable to post link to website for this as well).

There are many other companies on the internet offfering similar services. They all claim to be accredited by the RCMP but I can't find their names listed on the RCMP's website.

Oh thank you for this! I will have my fiance look into this asap. Hopefully this will work for us :)

K-1 Fiance(e) Visa Process & ProceduresWould this screw up our application process???
He did contact the Canadian embassy in Chile. He can't get it through them. He would have the go to the municipality in Santiago to get fingerprinted and then mail that to Canada. Since the Mounties won't accept digital fingerprint scans from outside Canada(which would only take 3 days to process) he has to get them done the old fashioned way with ink and paper. This process would take at LEAST 4 months to process delaying our case. Going to Canada is going to be quicker and easier.

We're not trying to get police clearance from Italy. Were trying to get a passport since my fiance technically has dual citizenship. On an Italian passport he could go to Canada without a visitor's visa. Otherwise on his Chilean passport he'd need to get a visitors visa which would take 2 months. We just want to know if getting the Italian passport would jeopardize getting our K1 visa, especially since I never mentioned it on the I-129F because he doesn't currently have the Italian passport.

K-1 Fiance(e) Visa Process & ProceduresWould this screw up our application process???
Hey all! My fiance and I just got out NOA 2 and are trying to obtain a police record from Canada. We are having difficulty doing this in a timely fashion. My fiance has determined that in order to get the police record from Canada he will have to make a trip up there. It seems that Chileans need to apply for a visitor's visa to enter Canada which could take up to 2 months. Now here's where things get complicated...

My fiance has dual citizenship with Italy. He obtained that through his brother who lives in the EU. My fiance has never lived in Italy nor does he have an Italian passport at the moment He was thinking about applying for the Italian passport because with that he won't need to apply for a Canadian visitors visa. He can just go to Canada, get the police record and come back to Santiago. My question is would obtaining the Italian passport jeopardize obtaining a K1 visa (or even our AOS for that matter)? I never mentioned it on the I-129F and was told it wasn't necessary since my fiance didn't even have an Italian passport. So if he were to get it now, I don't want that to mess things up somehow.

K-1 Fiance(e) Visa Process & Procedures2013 Poverty Guidelines

While we're on this topic I have a question that I'm still not clear about in regards to this.

If your income is greater than $19,387 a year that means you don't need a sponsor? My income is $33,250 a year but I don't have that much saved up yet because I just got back to the US in August and it took me awhile before I found this job (have been here for 3 months). I'm worried that because I don't have that much saved in my savings account that will be counted against me.

But...from what I've read, as long as my income is high enough, what I actually have in the bank right now isn't as important. Is that correct? Saving is so hard when they keep tacking on fees and I'm paying rent for a house where we can live!

I think your income would be sufficient.

Just in case anyone was wondering...

"K visa applicants are encouraged to get the vaccinations required under U.S. immigration law for immigrant visa applicants. Although such vaccinations are not required for K visa issuance, they will be required when adjusting status to that of legal permanent resident following your marriage. Applicants are therefore encouraged to fulfill these vaccination requirements at the time of the medical examination."

My dad is co-sponsoring me and my fiance. On the form they ask about if he owns property and what the value and mortgage is on it. If my dad owns a home (which he does), is it necessary for him to put it on the form? At first I thought no because they will want to look more at his income but now I'm not so sure. I need to know soon. Our visa interview is coming up very soon so I need to let my dad know now so I can get that info to Chile asap!

Congrats on your approval! Your petition should go to NVC first. They assign it a a case number then forward it to your consulate. Give it a week or so after your NOA 2 and then call NVC to get your case number. You'll need that in case you have any questions for the consulate later on.

€395... oh my God!

It was €366 back in January.

Scary stuff.

Yes its crazy how it rose by nearly 30 Euro, I had a quick coffee downstairs with Dr. Gleeson after (rugby&soccer talk)he was quite honest with me and said basically that it so expensive as you have to pay for 'the view'. Blackrock Clinics rent must be through the roof. In fairness he is a very nice man and it was an ok experience and worth every penny for the end result, but no excuse for nearly 400 quid

I am trying to get all the paperwork organized to send in with the I-129 and I just noticed that I have to submit a passport photo of my fiance. Someone that I know that lives in JA told me that she though the photo had to be signed by a JP. I thought that was only the case for when he is applying for his actual passport. I just wanted to clarify that he doesn't need to have the photo I submit with the initial paperwork signed in any way.

Also, I have to send him the 2 forms to sign and was thinking UPS? I know they also use DHL there so I wasn't sure what is the most efficient way. It would be going to a post office since there is no actual address.

Thanks for any info you can offer...we are just starting this process and any guidance will help since he has no clue as to what to do..it's like the blind leading the blind!

K-1 Fiance(e) Visa Process & ProceduresConflicting info about Police Report

the police certificate is only good for a year and its very much likely that it will be good leading up to the interview if you file anytime soon, it doesnt really cost much so if he wants to go ahead to see if he is clean, he can try doing the express for $2000 and he should get it back within a week. he can do it in montego bay and pick it up same place in a week time. If he has been convicted or anything like that, im told it might take a bit longer.

Thanks, I was hoping it could all be done in Mobay since Kingston is such a hike. I would rather have him get it now because he has never been to jail but has been brought to the station once or twice and he is not sure if it will show up on the report or not since it was minor. That is the only thing that could possibly keep this from not happening, so keeping my fingers crossed!

He is almost 4 hours from Kingston, so if there is a more convenient way such as the St James station in Mobay, it would be much easier. Someone posted on here they were able to pick theirs up in St. Mary, which is one of the stations listed...any help is appreciated.

K-1 Fiance(e) Visa Process & ProceduresIs hiring an attorney necessary to apply for K-1 Visa for Dominican Fiance?

Do not hire an attorney. They will make you do all the work too, and just check over your paperwork. You have to do most of the legwork, gathering documents, photos, filing out forms. There is very little the attorney will do that you can't find help here for free!

But forget about the ASAP part of your post, be prepared that it will take 8 to 12 months probably. At least 6, if everything goes as fast as it possibly can!

Ok, thank you very much. This helps a lot!

Is not necessary at all if you read through the guidelines over a few times..most important is to gather a evidence proving you guys have met in person at least once within the last two years, and of course are able to marry (both are single), then you can start to prepare your package. From my experience, VJ has helped me much more than I know any attorney could. Read some of the stories and start practicing filling out forms...any questions you have we are always here to answer them, or try our best to answer them.

Good luck Mrs.Lopez! :D

Right now the tickets to Santo Domingo in November and December are crazy so I'm not sure after I return in August if we will be together for the holidays Posted Image. I usually fly out of Orlando or Jacksonville, Florida so I am ticket stalking now. I will have my sister who is an attorney double check the paperwork after I complete them, my only concern was she has never practiced immigration law and its details so I was a little doomed.
