Yes, VISITOR to AOS is perfectly LEGAL to do! (lol...I for one have done such...see my vj timeline...)

No, it's not illegal that you came to the US and get married while you were down here for a visit.
AS LONG AS YOU CAME HERE WITHOUT PRIOR INENTION TO IMMIGRATE ON YOUR VISIT and not do this as to avoid and/or break immigration laws, then it's fine and legal to do such.

I was in the same situation before too, as I came over to visit my boyfriend (now husband), on a tourist visa (which are rare for Canadians, as Canadians generally don't need visas to visit the USA) from Canada for 2 weeks, and then ended up getting married here in the USA, and overstayed (for 8 months until my AOS was finally approved), and then filed the paperwork with immigration. And yes, I did get approved and got my green card afterwards. For more information on my sitation, see my VJ timeline (the link can be found on my signature).

The next steps for you (WITHOUT PRIOR INTENTION) are:
1) DO NOT LEAVE THE USA AND DO NOT RETURN TO CANADA until your case has been fully approved, otherwise your case will be abandonded and you will run into the risk of never being able to come back to the ever USA again.
2) File the following paperwork: I-130 (Petiton for Family Member), I-485 (Adjustment of Status), I-864 (Affidavit of Support), I-765 and I-131 (Employment Authorization and Advanced Parole), and the I-693 (medical forms).
3) Hire a good immigration lawyer, if you run into any more problems, and/or if you are totally unsure about your situation.

In fact, I had no clue about the immigration/visa process when I got married and afterwards and was 'stuck' in the USA...
Definitely no intention at all in my case....Just visited...got married..then realized..Uh Oh....Can I stay?
So I went to seek the advice of an immigration lawyer....
And it was the lawyer that said that I should do the Visitor to AOS route instead of the other immigrant visa routes....(no point in going back for me..)...
Definitely not a loophole here! It is legal! But yes, it does carry a lot of risk in this process!
For example, if there was a denial, it could not have been appealed (unlike the other visa routes), and would have been deported...scary....
But we took that risk anyways..and it paid off for me....Can't say that this works for everyone though...
Again, contact a lawyer if in doubt of your particular situation....Which I advise anyone to do in this and in any case...
Every situation is different...So don't pre-judge as to one way is better than another way......
As long as in the end it all works out well, then so be it...

P.S. If you HAVE PRIOR INTENTION TO IMMIGRATE ON YOUR VISIT you're probably better off filing for:
-A K1 (fiance visa...go back to your former country, file the paperwork, get married in the USA, adjust status, get green card)
-A K3 (marriage visa...go back to your former country, get married in the former country, file paperwork, come to USA, adjust status, get green card)
-A CR-1 (marriage visa...go back your former country, get married in the former country, file paperwork, come to the USA, get green card...)

Please if anyone else has something to add .....Also still wondering if I can apply now for the AOS where I have ready filed our I-130 in late October????

The whole situation calls to intention. Did you intend to get married during this visit, or just visit? If you came down to visit for 3 weeks, and got married instead, you could apply for AOS now. Since you mentioned you applied for the I-130 in October, I'm wondering what address you used as the Canadian? Have you received anything back about your petition?

If you come as a visitor, with no intent to stay, and stay you did, and got married in the interim, you could stay and apply for your adjustment of status. You'll more than likely get an interview, and have to prove at the interview that you had no intent to stay here and do this. Things they'll be looking at, are your ties to Canada. If you were only coming for three weeks, what did you do about your job? Your apartment? Your personal belongings? How did you clear up your Canadian ties? Bank accounts? Leases? Answering some of those questions for us, will help to better understand where you now stand, so that we can advise you better.

If you do end up applying for your AOS while here, you'll not be able to go back to Canada until the process is finished and you have your GC in hand.


Okay I will try to answer some questions...Yes I came as a visitor, knew we were gonna marry but I was gonna return to Canada after three weeks, decided not too hence that's why I am still here, but knew i had to return after 6 months. We filed the I-130 late October and got our first notice saying they recieved it...so wondering if it's too late to file AOS? I still have bank account, an apartment, a mailing address, credit cards. Still have personal belongings there. I had quit my job about a week before I came here cause things were just not working out. I hope this gives you a clearer picture. Thanks again

Hi there gonna try to explain a little, Arrived in California Sept 30 2009, was suppose to be coming for 3 weeks, end up getting married and decided to stay for 6 months because from my understanding I could stay here as a visitor for six months legally. We have applied for I-130 in late October after getting married in early October. Now we're wondering if we should have applied for AOS?? Or is it still possible to apply for AOS? If I applied for AOS would I have to go back to Canada at all other than to tie up loose ends? Is this a shorter process??

There should be a case number on the NOA1 or on the back of the cashed cheque. You should be able to check on your case with this number. I thinkk when we had to inquire on our case the number started with a W



I have tried going in online with the case number and it comes back with nothing, just said it's being reviewed. Has been like that since October. Will I get to talk to someone if I called? And would they give me more info?

I was K1 and may be different but they told me the GC is good for 2 yrs. and that I had to renew 90 days before going by the anniversary date of issue on the GC not when I activated the Visa. She was very strict in telling me it had to be inside the 90 day window and not before then or I'd get the renewal application returned

I spoke to someone at the International tax service this morning. He told me this would be my final yr. filing a Canadian tax return as my leaving Canada taxes would be in the 2007 return
I told him I would still have income each yr. in Canda and he said if I wanted I could continue to file a section 217 each yr. as my pension income would fall into that eligibility and if I thought it would be to my benefit for a refund. Or I could just not file at all after this yr.

If you don't have income in Canada after this yr. I can't see why the accountant would think you would have to file Canadian taxes again

I honestly don't know why Canadians complain about non-federalized health care. I live 1,000 miles away from my daughter and the rest of my family (brother, parents, childhood friends) and 2,300 miles away from my husband and son right now. Please don't complain about how it sucks in the U.S. All I can say is... well, never mind, I will just offend everyone here. Be thankful for what you do have.


Wow! I lived in Canada for 53 yrs. and never saw the health system as laclustre or even worried where my tax dollars went as long as myself and others requiring health needs got them. When you don't see the tax deduction in your pay you don't miss it. I raised 5 kids in Canada and when they became ill the health care was always there.

So what one goes to a hospital to get an X-ray big deal It doesn't cost anything. I had 3 dealings with how health care is run here in the U.S while doing my I- 693 Civil Surgeon thing. Pay to see the CS, pay for a TB needle test I didn't need and pay for and X-ray to prove it.
You had health insurance to pay your medical bill. What about those here that don't have that luxury? They suffer with illnesses because they can't afford the health care. I'd much sooner pay the tax and be able to get health care.
By the way lots of people don't qualify for the GST. I never ever got GST when I was in Canada but got everything else that Glorious Country offers it's citizens

I don't believe you report his income as there wouldn't be any eligible spousal exemption or credits for him on your Canadian tax return and you're not going to receive GST or any other Gov. benefit programs now so I can't see where reporting his income would matter

Hi Tom,

I haven't had much experience with non-resident part year returns lately but, I do use Ufile and i'm looking at it right now. I'm not sure which section you are referring to, if I select non-resident as at 12/31, it doesn't give me 4 choices.

In the emigrant section at Ufile you get these choices:

Immigrant, emigrant or non-resident

Select the relevant option. If none is relevant, click Next.
You immigrated to Canada in 2007
You emigrated from Canada in 2007
You were a non-resident of Canada for all of 2007.
You were a non-resident of Canada for all of 2007 and you are making an election under s. 216 of the Income Tax Act.
You were a non-resident of Canada for all of 2007 and you are making an election under s. 217 of the Income Tax Act.
You are a non-resident of Canada and you wish to file a NR6 return.

I tried selecting the emigrated section and it just asks for income in Canada and other countries, what day you left Canada etc.

If this isn't what you are seeing, try using the search box in the upper left and entering Immigrant, emigrant or non-resident, should bring up a pop up screen, then click where it says:

Immigrants
Date of arrival *
* Needs tick in Interview Setup.

That will take you to the screen where you enter that you emigrated.


In U-File, this is what I found works best through trial and error and on advise from http://forums.serbin...=emigrant taxes.
1. On the Identification page, put the Province you last resided in under "Province of Residence"
2. On the Current Address page, put the U.S. address where you now reside
3. On the Emigration from Canada page, put your departure date
It should all work out


But it asks for Province of residence on Dec. 31. I didn't reside in Canada on Dec. 31 and my departure date in June isn't going to match Dec. 31
Also if I do put being in Canada on Dec. 31 I'm not sure how that is going to affect my resident status in the U.S. for the foriegn oncome tax credit (form 1116) when Lorry files married /jointly on her U.S. return

When we first attempted to do our taxes here in the USA, I called up H&R block and told them my situation,they assured me they had a Canadian "expert" on staff. He was nooo expert. Your first visit to H&R Block sounds identical to what we just had done. I even showed her some of the answers to tax questions I had from VJ regarding Canadian source taxes and income and the 2555 and the 1116 for non-resident along with things from the IRS site.
But it was " oh no we don't need all that stuff" and all she did was photocopy my GC and proceed to fill out Lorry's taxes as married jointly

We both asked several times are you sure no forms for the Canadian income have to accompany the filing? She then said "okay let me call Allen, he's an expert on these situations".
So she calls Allen and explains to him that I have Canadian source income and taxes were paid in Canada and that I arrived in the U.S. in June with my Visa and married in July.
Allen asks if I had any U.S. income since coming here? " No he only has the Canadian income slips".
Allen then tells her no need to even show his income from outside the U.S just get his SSN and file normally as married jointly

Although they figured Lorry out for a nice big refund of $2800 we are both very doubtful of the whole filing process they did for us

Although we did get a free T-shirt and hat from them to wear in prison lol.lol

We went to Jackson Hewitt as they assured us they had staff familiar with our situatation on income and taxes paid in Canada and filed married jointly.
When I showed all my Canadian T4'S she said that my income from Canada wasn't required as it was below I think she said $80,000 and was money made outside the U.S.
When I asked if she was suppose to fill out a form 2555 or a form 1116 for foriegn tax credit she just kept saying no it's not required.
So we let her fill it and send it to the IRS as she stated was the proper procedure. We both still think it's coming back as not prepared correctly.

Yep, the QE II Health Sciences Centre on Robie Street. You have to go to the business office first to pay the fee, and then take the receipt to the radiology and lab units. Make sure they give you a x-ray film and not a CD-ROM.

Look for the sign for the Wendy's on Quinpool Road and you are in the right building area, you just have to go around to get to the entrance to Dr. Doane's office. The easiest way is to take the left where the sign for the Neighborhood Market is - go around and park in the big parking lot.

Thanks Lona, getting the waiver is the best thing that could have happened, had they refused in my present state of mind I would have cancelled the entire process out of frustration. Sharon's dad is not going to get better, he has been given hours only and has 24 hour care givers to make his remaining time as easy as possible. My trip is to support Sharon and say goodbye to her father if I can make it there in time, both he and Sharon's mother have been asking that I be there.

When they told me I had my interview it came as a shock. I called on a Fri and was told nothing was scheduled Then sent an e-mail the following Wed and was told my letter for an interview was mailed the week before


I'm very curious to see what their response to my email is (if they even bother answering!) I'll be SO happy if they respond to it with a date, but am not getting my hopes up just yet! :)



If they don't answer after a couple days just keep resending it to em. That's what I did, if no return mail I kept sending till they did reply. Eventually they'll reply

I have just one question that would help me tomorrow, do I bring the medical documents and the x-rays with me to Montreal or are they only for the AOS portion of thte journey?

You take the X-ray and the sealed medical envelope with you to MTL. They'll ask for the envelope didn't ask for my X-ray in fact I have it here in the closet
