a black and white photocopy of your certified copy is sufficient, as long as it is the "long form" that lists your parents' names.

They want to see copies of evidence that you have met in person in the last two years. Some people include varying amounts of ongoing relationship evidence, personal choice really. I think we included a couple of emails and some phone records, nothing too extensive.

Thats one of the reasons why you might see that your application was "touched" several times ona given day but no change in status. The adjudicator began working it (touch), went to lunch (touch), came back from lunch (touch) and finished reviewing it and sent it off to be processed (touch). Its touched when it goes back into the que and etc...

Keep in mind everytime a file changes hands whether its signed out to an Adjudicator or some satff person, its gets "wanded" ino the system so they can track who specifically has the file. Each file has a scannable bar code. Sometimes you'd be working a file that has someone else working another compnent of the file or one of the family members. We would alwaystry to keep family members together and approve them at the same time.

Make sure you have pictures, it is undeniable proof. Reasons I have heard for denial:

You only have to meet once in person in the last two years, per the instructions. The second visit will go over well during the consulate interview. And if asked about why you haven't met more, you can also talk about how he was turned back at the border.

You are the "sponsor" as the USC in this situation. A co-sponsor comes into play if you the sponsor do not meet the financial eligibility requirements.

Can I give you two a brief word of advice?? It is really super easy to get stressed out and overwhelmed with this process. You can do it. Just take the time to read everything here on VJ, on the USCIS website, on the forms themselves, get yourselves informed and aware of the process as a whole, and you will be fine. The more you stress and dwell on stuff that is really out of your control, the harder this is going to be on you. You will get through it, it's gonna take some time, but you will get through it smile.gif

TayL, I had $4,000 in CC debt and about $20,000 in student loans when I went through the K-1 process. It had no bearing on my petition. Neither did my medical history, which included multiple knee operations and a stroke.

Just so you know, any student loan programs ie. interest relief, etc. will cease to be available to you once you move to the US.

Sorry, I'm in the "K-1 visa is for fiances, not people who think they are going to get married and need the 90 days to make sure" camp.

In my humble opinion, when you give/accept the marriage proposal, you have already figured out that yes, you do want to get married, and yes, you understand what that means, and yes, you understand that it's gonna be rough settling in, and yes, you have taken the time to already get to know one another, in person and not. Jerry proposed to me once, and I told him "not yet", because I hadn't met his family yet, I didn't know what Tulsa was like, or what his life was truly like in the US. So I made a point to visit, check things out and think about whether or not I thought I could live here in the US. Once I was at peace with that particular answer, and a few other things, I was ready to accept his proposal and all that meant.

Now I know people are going to pipe up and say "well that's easy for you to say, you're from a country where it's easy to travel to the US -- no tourist visas, no travel restrictions, etc etc". You're right, I was blessed in that respect. But I don't want that point to overshadow my overall message. In reality, Jerry and I spent a total of 26 days together in person, the rest of the time we spoke incessantly. Not just about the minutiae of daily life, which is important, but purposefully asking each other questions and talking about things we knew would come up once we married and moved in together. We made sure we were on the same page in matters of faith, fiances, goals & dreams, family, etc etc. so we knew what we were getting into before this whole thing went down. I'm not saying the first couple of months were a piece of cake, but the work we put into it beforehand certainly made things easier in the long run. We got married on day 7 of the 90 day period, in a modest (20 people wedding, 80 people reception) religious ceremony with all the trimmings, and on Nov 7th we will be celebrating our 3rd anniversary.

The reason i am concerned is that a visa once it is issued is only good for 6 months and the airlines wont allow a pregnant paasanger after they are 7 months and there is some concerns of flying a newborn baby until it reaches 6 months of age so i am worried we might lose the visa during this short window of oppertunity.

Congrats on the pregnnacy and I just wanted to let you know this is not true. Newborns fly all the time. And most doctors will let you fly pregnant into your 8th month as long as there are not complications.

+ Always send in the LONG version of the birth certificate (USC) - not the short one. If you only happen to have the short one, include copies of ALL pages of the passport of the US citizen.


That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship). Also, some places issue only one form of birth certificate, so there's not always a distinction between "long form" and "short form". Just telling folks they have to file the "long form" may be more confusing than helpful if there is no "long form" option in their place of birth. Finally, some USC's were born abroad, so they don't have the option of using the birth certificate to provide proof of citizenship.

Excellent point.. shorthand language can be confusing. I don't know where the regulation is, but doesn't it say that the birth certificate (if used) must have the names of both parents on it?


Methinks that is correct. My short form BC card was not acceptable since it didn't have enough information on it, like my parents' names.

I knew my husband for almost two years before I moved to the USA.

We were lucky to get to see each other every three months. When I came to the USA to live, I thought we should still wait almost until the 90 days were up just to see how we all (blended family) got along living in the same house. I didnt make that decision because I didnt love my fiancee. I did it to see how things went with us all living together. Having to live with someone is totally different then visits from each other. We all get caught up in the romance on those visits. If anyone says that dont they are full of themselves.

I just didnt want to come here and get married 2 days later just so I could get my AOS sent out so I could start working. That was not our plan.

Everyones plan is different

I agree, be prepared for questions like that at the interview. My officer seemed surprised that we got engaged after the second time we had met in person, and asked a number of follow up questions (have you met his family, did he meet yours, etc etc).

Here's where I see the difficulty laying.

You both entered into this visa process together, hopefully understanding the timeframe required (ie. marrying before 90 days were up). You both signed letters of intent stating that yes, you are free to marry and will do so within the guidelines of the visa.

Now, I am one who advocates making sure before making huge decisions -- getting married is a big one and not one to be entered into lightly, so I appreciate what is going through your fiance's mind. However, the assumption by USCIS is that when people begin applying for the fiance visa, they've already got this one figured out and will be getting married within the 90 days like they say they will. So to answer your questions, if your fiance decides to go home having not gotten married, reapplying for a K-1 may be much more difficult. I'm not saying impossible, but you probably will be subjected to more scrutiny. Same with the tourist visa, I honestly don't think you'll get one, but I could be wrong.

the old-style forms had you fill out the top sheet and there were carbon sheets in between, so you only had to fill it out once, wasn't so bad :)

Be aware that K-3 takes just as long as K-1 to process, so canceling the K-1 will set you back about a year, from what I read the Dominican Republic is one of the slowest embassies to process cases.

To cancel you will have to contact the embassy with the case number assigned by NVC, and request to withdraw the petition.

From what everyone is saying,it all depends where you are getting the paper work done. Canada and a couple of the well wealthier countries arent as long of a wait. Canada, UK, Aus, Etc.. Good luck with your K-1 I hope everything turns out well for the both of you. Me and my fiance are getting everything done through K-1 as well.. I am from the United States and shes from Canada.



If you look real close, twincactus is dealing with the DR as well, so she is talking about DR specifically and not the K-1 process in general. DR is known for long wait times.

To the OP: best wishes to you in whatever decision you make, although I tend to side with those advising you to stay the K-1 course. :)
