We sent off our first package to Nabraska about 2-3 weeks ago. They have cashed cheque and we have recieved notice of receipt but nothing else.. Is this the norm?

Yes.

You have now entered a period known as hurry up and wait. Keep an eye on processing dates and be patient. :)

K-1 Fiance(e) Visa Process & ProceduresTime between receipt and NOA1?
on the USCIS page itself I think they stated expect 14 days for the NOA1...

Here is the "official" word:

NOTE: Due to an unusually large volume of receipts at the Service Centers, it is taking longer than expected to enter cases into the system. Depending on the type of case and service requested, it may take approximately 14 days to generate and mail receipt notices. Once the receipt notice has been generated, it may take an additional 2 to 3 days for customers to receive their receipt notices in the mail.

K-1 Fiance(e) Visa Process & ProceduresApproved...and some questions...

So, two questions:

-Will the approved I-129f make it any harder for him at immigration than it would otherwise have been?
-Should we explain to the embassy that he is putting off his interview until after he returns in December, or just delay sending in the material? Or both?

1. I'm gonna to have to lean towards yes, as your fiance is clearly intending to immigrate to the US. I would humbly advise him to gather as much proof that he still has ties to whatever country he's from (it's not immediately clear to me where he is from) -- perhaps an appointment letter from the embassy??? ;)

2. It depends on how quickly the consulate/embassy you are dealing with is currently scheduling appointments. If they're taking their time, I'd send in the packet three info when you can. if they seem to be quick on the draw, hold off on sending back the info they need, they won't schedule your appointment until they receive what they need.

Oh, and congratulations! :)

K-1 Fiance(e) Visa Process & ProceduresForm I-129F, Question 18
Since my fiance was the USC, and since he was the one submitting the petition, he wrote the answer to that question. I think it was 10 sentences, max. Had all the pertinent facts. :)

K-1 Fiance(e) Visa Process & ProceduresHow much evidence is too much?
It's not a matter of throwing a ton of evidence at the adjudicators, it's a matter of being smart about what you submit. As Yodrak said previously, if you send in evidence that brings up more questions than answers, why send it in?

It's a balance between sending in not enough evidence (or evidence that does nothing to bolster your argument that you have a legitimate relationship) and sending way too much. I use this analogy every time this topic comes up: think of your relationship as a big puzzle, and all the forms and evidence as the pieces. If the evidence you submit, in conjunction with the documents you have to fill out, does nothing to fill in the big picture (yes, you have met in the last two years, and yes, you have a legitimate relationship), then it doesn't fit and don't include it.

K-1 Fiance(e) Visa Process & ProceduresQuestion in writing down the letter of intent (both beneficieary & petitioner)

hi there its best to just write USCIS-
my name, where i live, what i do for a living, tell about yourself, your age, how u met your fiancee, and how u fell in love, when you met, what u did together while u were together, what your family thinks about her, ... i was told by my atty that it best be at least 2-3 pages long. tell everything u can about your relationship from beginning and to present time... and how u miss her and what not.. and what u want in the future and make sure that it fits with her intent letter... you dont want to put something in detail and then hers say something diff.. so check with her.. then at the end of letter write that u intend to marry within 90 days of arriving into the U.S. best of luck!!!!

michelle/otman

The letter of intent does not have to be 2-3 pages long! The example already posted in this thread has been proven time and again to be sufficient. Your attorney is confusing that with question 18 on the form asking how/when you met your fiance -- and that does not have to be 2-3 pages long either.

K-1 Fiance(e) Visa Process & ProceduresQuestion in writing down the letter of intent (both beneficieary & petitioner)
We submitted our K-1 petition before ever finding this website, and we had nothing to go by. So we both wrote our own letters, both basically saying that we both are free to marry and intend to get married within the 90 day timeframe. No embassy/consulate address, nothing. Just dated and signed. The letter you've posted is fine, and just substitute each other's names in the appropriate slots. When you get to the visa interview stage, that's when you put in the appropriate mailing address of the consulate you are dealing with if you wish when you submit updated letters of intent.

K-1 Fiance(e) Visa Process & ProceduresWill I be able to get another fiancée or a spousal visa again?
Joseph, considering your past history, and especially considering the scrutiny you underwent with your second petition, I do believe it will be in your best interest to consult with a good immigration attorny. It looks like you have a number of large hurdles to cross.

K-1 Fiance(e) Visa Process & ProceduresWorried about Montreal Consulate being SLOW...

:crying: I'm gonna take my Mommy and Daddy with me.LOL But seriously I am. I know they can't come with me to the interview but they'll be close by. I'm still debating taking the little guy to the interview I'll wait until I get packet 4 and see if it says he needs to come if not I'll call them about it. But the terrible 2's are in full force right now. Being stuck in a room for hours with him doesn't sound like fun. So if he doesn't need to be there I'll leave him at the hotel with his grandparents depending on his mood that day. Then again he's such a cutie ( bias momma ) I'm sure no CO will deny him a visa. So who knows. Not sure about the rest of you but I still worry we over looked something and they are going to laugh and say heck no we are not letting you in to the USA. I'll probably worry until I am holding that visa in my hand and I'm through the POE. Oh and FYI I got my medical by courier today woooooohoooooooooo another thing done.

Freda you will do fine at the interview.

I doubt that the little guy has to come with you.

I believe its starts at an older age before they have to attend.

It can be along wait there. Some get in and out fast and others dont.

I dont know why but I had my interview fast and was approved by 9:30. I didnt get my visa in my hand till 11:45. I tell ya I was freaking sitting there thinking that they changed their minds about it  Everything possible was running thru my mind, cause everyone else was in and out that came in after me. I even went back to the women at the counter and asked if there was a problem why I wasnt getting it like everyone else. I cried when the lady finally passed me our visa's. :crying: I had to sit down and look them all over before I left to make sure there was no mistakes, and I sobbed with relief. Roger had already called our room to see if we were back becasue we were taking so long. I couldnt even really talk to him when he called back. My son said to Roger, she's crying...... Thank god your in another room when they pass your visa to you and not in front of everyone else sitting out front. Oh the memories. Just enjoy the moment when they pass it too you, all this is so worth it. (F)

K-1 Fiance(e) Visa Process & ProceduresWorried about Montreal Consulate being SLOW...

I'm probably going to montreal by myself too :crying: Scary to me too. i get to worry about interview (when i get it) AND worry about traveling there by myself. i might not make it. lol

Getting there is no problem, I'm flying Canjet for the first time. its once i get there. a new airport and city :help:

You guys will do fine being by yourself.

I went with my 16 year old son to our interview and things are not so bad there.

I got a taxi to my hotel, we walked around abit thru the day, and then stayed in our room when it got dark out.

Trust me you will be OK in Montreal. Just be careful.

i kinda miss posted. travelling isn't the problem. it's once i get off the bus! (im taking greyhound bus) i did so bad in french and i know they would speak english in the consulate, but once im doing and going to eat i feel like im going to get lost and no one will understand me and they all will speak french only. man i know im being soo paranoid but i can't help it.

I only speak English and did fine.

People at the hotels and food places do talk English.

All the police there talk English.

Try and be calm if you can.

K-1 Fiance(e) Visa Process & ProceduresWorried about Montreal Consulate being SLOW...

The only time I have seen Montreal accommodate a "please fulfill my request for an expedited interview date" request was for someone whose fiance was due to be deployed to the Middle East. I myself sent a request for a specific date (so my pregnant sis in law could make it to my wedding) and was ignored. ;)

FWIW, Montreal only started "slowing down" again when the DCF procedures came into being, so they have more a case load to deal with now. For a while there (before my interview in 2004) they were taking up to 4 months to get everything done for a K-1, and then it sped up to 1.5-2 months, and perhaps now it's settling back to the previous 3-4 months.

Methinks you will get your packet 3 within a couple of days from them receiving your case, they're pretty prompt with that part, it's the waiting for the appointment date, and then the wait for the appointment itself that will probably take a bit of time. But we can console ourselves with the fact that Montreal is one of the best consulates to be dealing with, compared to others. :)

You mean they'll ignore my request to expedite the date because Karen can only come on a specific week? (which is in two weeks and i still dont have a date)

I really cant see them expediting cases either unless its a real emergency like Cassie has said.

Sorry to say but I dont think your going to be getting an interview date within two weeks if you were not already told about it. I could be wrong, thats just MO.

Why did you tell them to expedite it Joel?

So that Karen could go to the interview with you?

I dont think that their going to think that is a good enough reason to speed up your interview. In Montreal the finace is not required to attend the interview.

I hope you get it when you asked, but just dont get your hopes up to high about it.
