melo, hun, you NEED to relax! Seriously, before your brain explodes! And I am saying this very respectfully. :)

You are K-1, NVC is not an integral part of the process, and they won't give you much info at all, so there is no use in getting your body stressed out for nothing. You are so close to being at the consulate stage! Paul is right, stop calling them, and concentrate on the ultimate goal -- your interview. :)

K-1 Fiance(e) Visa Process & ProceduresRFE from VSC

Where currently trying to put the proof section together so this post has been very interesting.

One thought crossed our minds and we thought we'd post it.

We have a video which we made for my fiancee's mothers 50th birthday while we were living together in the states. We thought we would add the DVD into the package along with the lease etc.. Do you think they would watch it?

Honestly? No. I don't mean that to sound rude, but I highly doubt they would.

K-1 Fiance(e) Visa Process & ProceduresRFE from VSC

What these people at USCIS don´t take in consideration, is that when we start a relationship like this, we´re not usually aware that if this relationship gets serious and we decide to get married, we´ll need all these papers, so it´s not a custom for me to save every receipt from when we were together, only letters, cards and pics, which I find are important memories. Hence why I don´t have a history of hotel records, phone bills, and park entrances, we do have a couple, but some don´t show any dates so, doesn´t prove anything.

Funny you should say that. For some reason -- either I just knew we would stay together or I am just simply a compulsive packrat -- I saved everything, and I mean everything -- even the padded envelopes Jerry would send me cds and stuff in. It made for a bagful of stuff when I went to my visa interview.

the key to all of this is -- and kaydee and aussiewench have already alluded to it in previous posts -- creating a picture of your relationship. Each answer, form, document, picture all need to work together to bring that picture into focus -- that you have a valid, loving, REAL relationship.

Hey, you are amongst a group of people that completely understands! :) Just don't get too stressed out too early, you have a ways to go yet -- save it for the big stuff, like waiting. ;)

K-1 Fiance(e) Visa Process & ProceduresNOA1 and 2 Who? What? When?
The NOA1, NOA2, and notice from NVC (some get this, some don't) go to the USC only -- I personally have not heard of any non-USC getting their own copies. *shrug*

Once the petition gets to the consulate, all paperwork then goes to the non-USC.

PS. Relax. :)

K-1 Fiance(e) Visa Process & Proceduresjust a few questions

There are mistakes everywhere, but they should consider we´re nervous couples in love and dying to be together. :P

No offense, but many couldn't care less! When you are dealing with 100s of thousands of applications each year, things tend to blur and faces/stories get replaced by case numbers and piles of paper. ;)

babydoll -- contact Montreal directly, either by phone or email, and they will be able to tell you if your case is there.

K-1 Fiance(e) Visa Process & ProceduresHow to track after NOA2
We found out when our petition made it to the NVC, because by good fortune we happpened to call the day it arrived.

This is our timeline from that part of the process, how we tracked things is highlighted in bold:

August 18, 2004 - NOA2 received by mail (we were approved August 12)

August 23, 2004 - petition on its way from NVC to Montreal! (we called them and found out)

August 25, 2004 - letter (dated Aug 23) from NVC to Jerry telling him that our petition will be on its way to Montreal "within a week"

August 25, 2004 - our stuff is in Montreal, judging by the date on the Pkg 3 letter

August 26, 2004 - Package 3 sent from Montreal

K-1 petitions get shipped in batches from the service centre to NVC, so depending on the schedule, your petition could be there now, or a couple weeks from now. If you call the NVC number, K-1 cases do not show up on the automated system, so you have to talk to an operator to get any information.

Most people (the USCs) will get a letter from NVC stating that the petition has arrived and will be sent on its way to <insert your applicable consulate here> within the week or so. Others get surprised when they hear from the consulate. ;)

You won't be able to track your petition anymore online, since you are now dealing with the State Department and not USCIS.

K-1 Fiance(e) Visa Process & ProceduresWorried about Montreal Consulate being SLOW...
The only time I have seen Montreal accommodate a "please fulfill my request for an expedited interview date" request was for someone whose fiance was due to be deployed to the Middle East. I myself sent a request for a specific date (so my pregnant sis in law could make it to my wedding) and was ignored. ;)

FWIW, Montreal only started "slowing down" again when the DCF procedures came into being, so they have more a case load to deal with now. For a while there (before my interview in 2004) they were taking up to 4 months to get everything done for a K-1, and then it sped up to 1.5-2 months, and perhaps now it's settling back to the previous 3-4 months.

Methinks you will get your packet 3 within a couple of days from them receiving your case, they're pretty prompt with that part, it's the waiting for the appointment date, and then the wait for the appointment itself that will probably take a bit of time. But we can console ourselves with the fact that Montreal is one of the best consulates to be dealing with, compared to others. :)

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how you met in person in the last two years.

The intructions also state to "Make sure to sign and date it." Do both the Petitioner AND the Beneficiary need to sign it or just the Petitioner? My gut feeling says just the petitioner.

thanks so much!!

sorry to ask again, but does anyone know the answer to the above question? :D
Do we both need to sign the declaration??

thanks!

It is only necessary for the petitioner (the USC) to sign it. Your non-USC fiance has to sign the g-325a forms (all four sheets) and their letter of intent. Make sure the signatures are original.

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how you met in person in the last two years.

Does anyone think this journey is more based on Looks? Age? From the picture you send in? And not to your writting skills. I only palced Russian Dating Site and Personal Vist and Date's.

Imagine this process is like a puzzle, and every document, photo, form, and answer submitted by you and your fiance/spouse provides another piece to show off the overall picture -- a valid, loving, ongoing relationship between two people who wish to continue that relationship together in the US. The people reviewing your file at the different stages of this process look at everything to see if the pieces fit together.

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how you met in person in the last two years.

you can fit it in on the application ... some people want to go into a full fledged dissertation of their love story! while the adjudicator LOVES to read it ... it's not necessary at this point. you need to PROVE that you met and show proof that you have met within the last 2 years. save the extraneous proof of your relationship for the interview!!

People have gotten RFE's for not including how their relationship started -- essentially why they decided to meet each other in person in the first place. this is particularly important for those who met online.

It is possible to provide the essential particulars of the relationship without it becoming a Harlequin romance novel. ;)

K-1 Fiance(e) Visa Process & ProceduresDeclaration of how you met in person in the last two years.
From what I have seen here on visajourney, you can go brief (one line) or a full page or anything in between -- I have seen all sorts of examples of what people have done. However, I humbly suggest that you give a thorough, yet succinct summary containing how and when you started your relationship, and how/when/where you have met in person in the past two years. The dates you include in this statement should correspond with the evidence you provide to show that you met when you say you did.

For the record, I think our statement was two paragraphs long, maybe 10 lines in total?

K-1 Fiance(e) Visa Process & ProceduresEntire Visa Process
You will be getting an official NOA2 from USCIS in the mail -- MAKE SURE YOU KEEP THIS SAFE -- you will need it after you get married and applying to adjust status to become a permanent resident.

Your petition will be sent to the NVC, and then onward to your consulate. This usually takes a couple of weeks.

As for the way the consulate in Germany deals with things and their timeline, you'll have to do some research on that. There are some VJ'ers that have gone through there that probably could help you more specifically.

In my humble opinion, I wouldn't recommend your fiance staying too much longer in the US -- there is a lot of stuff to take care of, like his medical, police report, etc etc. Plus whatever he has to do to wrap things up in Germany and get ready to move to the US permanently.

Best wishes to you both :)

K-1 Fiance(e) Visa Process & ProceduresFeeling Discouraged

Cannot get down in the dumps. Look at my timeline and I have to stay positive or I would have no hair or all gray and my ulcer would be more inflamed. Seriously do not compare your timeline or journey to anyone else's and try to be supportive of others is what keeps me going. Find something else to keep you motiviated a hobby, a good novel or something else other than your timeline. Good luck and pray for patience.

Mary

Ayyyy, Mary, you sweet thing :star:
What will we do when you are finally through with all this and we don't have a worst-possible-case to remind everyone how lucky they are to only be waiting a couple of months?
Hearts and flowers for you today :)

K-1 Fiance(e) Visa Process & Proceduresreasons for slow processing??!!!
CSC is running a bit slow right now for a couple of reasons:

1) Near the end of last year (can't remember exact timing), CSC uncovered a major marriage visa fraud ring, and if I remember correctly there was a staff member involved? Not sure. Stuff slowed down considerably as they cleaned up that mess.

2) CSC has been handling TSC k-1 applications for months now, to shift some of the burden from TSC.

3) compared to VSC, everything looks slow ;)

Keep the faith folks, you will hear something soon!

K-1 Fiance(e) Visa Process & ProceduresDocuments Needed at POE?
You need the mysterious brown envelope, and your passport with the visa in it. I had all my stuff from the K-1 petition process in a bag that I checked on with me, but they didn't need anything else from me at the POE.
CassieFemaleCanada2006-04-02 18:49:00
K-1 Fiance(e) Visa Process & ProceduresHow do you deal with loneliness?
I worked. a LOT.

Sure, we talked all the time, and planned our wedding, etc etc but having something other than the immigration process to think about helped me to deal with being apart. So fortunately, I was doing a contract that required quite a bit of over time, and mutlitasking of multiple projects, so it kept me from dwelling on how much I missed him.

K-1 Fiance(e) Visa Process & ProceduresEmergency Expedite k1 visa request
The only time I saw the consulate in Montreal expedite a K-1 visa interview was for a couple where the USC was due to be deployed. Not sure if you will get the same consdieration from the consulate you are dealing with, but it can't hurt (when you get to that part of the process) to ask for an expedited interview date.
CassieFemaleCanada2006-04-02 18:56:00
K-1 Fiance(e) Visa Process & ProceduresMontreal takes forever
Sheesh, and I thought waiting two months from the sending in of packet 3 to my appointment date was swift! I sure wasn't complaining, seeing as it used to take 4-6 months.

Also keep in mind that Vancouver does not process nearly as many as visa applications as Montreal does (they don't do the IR-1/CR-1 ones, for example), nor does it offer the DCF option, which Montreal now does.

Frankly, I didn't mind the wait considering its one of the "easiest" and one of the more open consulates to deal with.

K-1 Fiance(e) Visa Process & ProceduresProof of having met in the last two years and ongoing
Your petition is like a puzzle -- each answer, form and shred of evidence needs to fit together to make a cohesive, obvious picture of two people who have a valid relationship and have met in the last two years.

Save the bulk (if not all) of the proof of relationship stuff for the interview.

K-1 Fiance(e) Visa Process & ProceduresAs Montreal draaaags on...

well, I hope things speed up with the consulates for all of you soon.

For some crazy reason, I thought it only took a month from NVC to interview.... what dreamland have I been living in?

dunno, it never has been that quick since I have been tracking Montreal (August 2004). Although, I did receive my interview date about a month after leaving the NVC. But things have changed at Montreal since then (getting visas next day, the DCF option, etc).

Best wishes to all those waiting! :)
