I went thru this as well with my step childrens mother ( well what ever she is).

She was just jealous that he was happy and she tried to cause as much ####### as she could between me and my husband.

His son was kept from us for awhile becasue of me....lol

Some ex's are just plain TROUBLE. You just have to deal with it the best you can.

Good luck to anyone that has new step children going thru this process.

It is not an easy ride.

CanadaCanadians and Thunderstorms
We have some really bad thunder and lightening storms here in Alabama.

I have been here three years now and I still jump when the thunder rumbles.

It just seems like it is on the roof of my house............I hate that loud noise. They are way worse here than in Nova Scotia. People say becasue its so flat here that it sounds so loud. We have plenty here in the summer. Usually one a day , sometimes it is over fast, other times it last for hours.

My husband loves to sit out and watch the storms.

CanadaWell
Been here in the South now for three years, and I still miss my friends and family at home. My friends call all the time or I call them. Sometimes I just wish I could be there for 24 hours when I know there all going to go to a camp or party with all the girls.

If my oldest son and parents could move here I would be fine.

CanadaWhen you tell people you are from Canada
Yeh, people like to hear me say Car. They say I call it a krrrrrrrrrrrrrrrrrr, not car. I tell them I am saying car and you have a problem with your ears if you here krrrrrrrrrrrrrr......lol

Same with the word about. They tell me I am saying a boat or aboot. Nah I dont think so people. I guess being in the South they never hear Canadians talk.

I do have to repeat myself alot of the times at work. I think I talk to fast for them down here and they just can not make me out.

Well sometimes I can not make them out either.

Like come errrrrrrr, instead of here.

Its like issssssss, not this.

Winner instead of Winter.

I could go on for awhile with the words they dont complete in the South.

i would like to thank everyone for the information and guidiance. I really appreciate it. i think i will most likely do the k3. i understand it may take a while..but it will give me some time and to prepare leaving canada. my concern now is the medical examination. I had a brain injurfy 4 years ago, although i may have a bit of a memory problem, and neck pain. everything is fine. i am not a violent person to cause harm to myself or others. i have not been able to work. right now i am taking courses to complete my degree in business admin. Wil having a brain injury stop me from entering US? thanks

I'd go CR-1, but that's just me. smile.gif You would wait about the same time as the K-3, and end up with more (like your green card and automatic work authorization) once you get to the US.

No, a brain injury will not stop you from coming to the US. I had a stroke and I got through the medical just fine. smile.gif

CanadaU-pack moving questions
Due to circumstances, I waited almost a year, and had my stuff shipped to me through a moving company. It was easy -- they told me what to have ready and filled out, I left the paperwork with my parents (where my stuff was stored), and they took care of everything. Everything got to me in one piece, they were fantastic. But it did cost a bit, but worth it for us.

Like Kritkit said, there's a few threads in here that deal with moving, hopefully they will help. smile.gif

Cassie, I thought you didn't need an AP if you were granted the K-3 visa, or are you just referring to the K-1? I thought it was multi-use for two years...am I reading this all wrong? huh.gif

Yep, K-3 is multi-use, but you still have to apply for EAD and AOS. Hence me not putting AP in the list for K-3. I'm gonna re-write my post though, because I don't make that real clear. smile.gif
CassieFemaleCanada2008-05-31 09:32:00
CanadaK1, K3, and CR1
To be really simplistic, think of it this way:

for the most part, fiance visas process quicker, and you are together quicker, but after marriage you then have to wait to get the EAD card (employment), AP (for you to travel out of the US and then get readmitted back in), and adjusting status to a conditional permanent resident.

Spousal visas (CR-1) take longer to process, and you will have to be separated for a while, but once you are done and come to the US, you are done for two years (you'll get your green card soon after arriving in the US) -- that part alone saves you $1010.

K-3 used to be a quicker way to get your spouse to the US, but then you still have to apply for EAD and AOS and have that wait. But K-3s are processing as slow as CR-1s (or not at all in many cases), so I personally wouldn't bother.

Do some reading and researching here on VJ and on the USCIS website, figure out what is important to you (quick reuniting versus financial concerns, etc etc) and go from there. We're here to give you a helping hand if you need it. smile.gif

the part II about residency..
What's the difference between 10A and 10C ?
I don't get it....

10A
A. Applicable to NONRESIDENT ONLY
(1) All household effects acquired abroad for which free entry is sought were used abroad for at least one year by me or my family in a household of which I or my family was a resident member during such period of use, and are not intended for any other person or for sale. (9804.00.05, HTSUSA)
(2) All instruments, implements, or tools of trade, occupation or employment, and all professional books for which free entry is sought were taken abroad by me or for my account or I am an emigrant who owned and used them abroad. (9804.00.10,9804.00.15, HTSUSA)

10C
(2) Any vehicles, trailers, bicycles or other means of conveyance being imported are for the transport of me and my family and such incidental carriage of articles as are appropriate to my personal use of the conveyance. (9804.00.35, HTSUSA)

You want to check 10 C, because 10 A should read "Applicable to RESIDENT and NONRESIDENT" -- since it is just you moving to the US, you want 10 C

As per question 9, you are a 2 a (non resident emigrating to the US). Therefore, since 10 C is applicable to a non-resident only, that's the one you check.

QUOTE (TheATeam @ Jun 9 2008, 02:45 PM) <{POST_SNAPBACK}>
I know that this question has been asked and answered, but I've searched everywhere and can't seem to find it. On the I-485 it asks for the "Place of last entry into the US" and to give the city and state. Then it asks if a US Customs officer inspected you. Well, the answer technically is Edmonton, Alberta for me then, but do I put Seattle, WA where I first technically touched US soil? It's a little confusing! Any help would be greatly appreciated! Thanks!

You put Seattle, WA. , and yes, because Seattle is where you officially touched down on American soil, and yes, you were inspected by a Customs officer (just not in Seattle).

(Don't worry about being confused, even the officer filling out my I-94 form at the PFI in Calgary messed that part up (she put Calgary instead of Denver where they ask for entry point)

CanadaIf I have any children in US, will they have Canadian citizenship?
QUOTE (cattattude @ Jun 9 2008, 11:43 PM) <{POST_SNAPBACK}>
The new law changes the rules for people born outside Canada. Individuals born outside Canada to a parent, who was a Canadian citizen at the time of the birth, will only be Canadians at birth if:

the parent was born in Canada;

the parent became a Canadian citizen; that is, by immigrating to Canada and being granted citizenship.
This means that children born in another country after the new law comes into effect will not be a Canadian citizen by birth if they were born outside Canada to a Canadian parent who was also born outside Canada to a Canadian parent.

If I am reading this section correctly - my children would have Canadian citizenship because they are born to a Canadian parent - despite being born in the US.

However if my children who were born in the USA have children (my grandkids) in the USA - the grandkids would not have citizenship since they were born to parents, who despite being Canadian, were born outside of Canada.

This is really confusing. Probably taken from an LSAT test somewhere.

Not automatically, that's correct. But I am sure that they would be able to apply for it based on the citizenship of their parents.

It is confusing, but I guess it is an attempt to right the wrongs for those people who lost their citizenship due to being second generation by restoring their citizenship, but then closing the loophole.

QUOTE (Vox @ Jun 9 2008, 11:27 PM) <{POST_SNAPBACK}>
Check this out http://www.cic.gc.ca...citizenship.asp and http://www.cic.gc.ca...nship/proof.asp

No later than April 17, 2009, the law will change for people born outside Canada. If you were born outside Canada and your parent was a Canadian citizen when you were born, your child born in another country on or after the new law comes into effect will not be a Canadian citizen by birth.

Does it mean that children of Canadians living legally in the US can’t get Canadian citizenship after April 17, 2009????

This isn't what the new law is saying. They are talking about your future grandchildren.

From the quote in my post above:
QUOTE
This means that children born in another country after the new law comes into effect will not be a Canadian citizen by birth if they were born outside Canada to a Canadian parent who was also born outside Canada to a Canadian parent.

Your children will automatically become Canadian citizens, but your grandchildren won't if they are also born outside of Canada. Does that make sense?

CanadaIf I have any children in US, will they have Canadian citizenship?
If you read this section (found at your first link listed), it seems that where the Canadian citizen parent was born factors in on whether or not your child will automatically be a citizen or not.

QUOTE
Persons born or adopted outside Canada after the new law comes into effect

The new law changes the rules for people born outside Canada. Individuals born outside Canada to a parent, who was a Canadian citizen at the time of the birth, will only be Canadians at birth if:

* the parent was born in Canada;
* the parent became a Canadian citizen; that is, by immigrating to Canada and being granted citizenship.

This means that children born in another country after the new law comes into effect will not be a Canadian citizen by birth if they were born outside Canada to a Canadian parent who was also born outside Canada to a Canadian parent.

This limitation will also apply to foreign-born persons adopted by a Canadian parent. Adopted children of Canadian citizens will be considered to be the first generation born abroad. This means that:

* if a person adopted by a Canadian parent has a child outside Canada, that child is not a citizen by birth;
* if a person adopted by a Canadian parent adopts a child outside Canada, that child will not be eligible to apply for citizenship under the adoption provisions in the Citizenship Act;
* if a person born outside to a Canadian parent, in the first generation born abroad, adopts a foreign-born child, that adopted child will not be eligible to apply for citizenship under the adoption provisions in the Citizenship Act.
