A long time VJ member (Sharon) has one that she bought in Montreal. So these kind of flags do exist. They aren't "official" flags but cool nonetheless.

CanadaMoving: Canada to USA. What company did u use to ship ur stuff?
I used Premiere Van Lines, and they were excellent. Not one thing of mine was broken, misplaced, or scratched, which is a miracle considering my curio cabinet has glass shelves. They were very efficient, friendly, and had all the information and forms I needed.

It cost a little over $3,000 to ship from southwest Nova Scotia to Oklahoma, because I have a lot of heavy things, particularly books! And I got dinged with high gas prices.

Another funny thing with my appeal. The lady called me back and said the judge denied my appeal,BUT she was overriding it and I was approved! weird!!

Sheesh. You've got horseshoes "somewhere" on your body. LOL

Did the appeal people have any idea about your situation? I had to explain EVERYTHING during my phone interview with them. Not surprising as they're members of the community rather than EI workers. How the heck would they know about the ins and outs of the K-1 saga on my end. Had a 45 minute conversation on the phone. I thought I had a pretty good case. Was feeling good about it afterwards. Got the letter awhile later. Unanomous denial.

I --well more my wife did,lol-- wrote a letter explaining our situation!! I think it all depends who gets your case. I never expected to get EI, wasnt till I was here in the USA that Cassie stated it was possible.

Wow Gala...that is awesome information! Really conflicting tho between the USCIS & Canadian EI...they say there's no discrimination...ya right...
You have to really wonder why they made such a rule...a K visa is a K visa, bottom line, they should all be treated the same...you and I still have to apply for AOS & EAD...all that fun stuff...I just don't get it!

all the best.... good.gif

I'm a bit confused as to how we K-1s are being discriminated against, if K-1s and K-3s both are required to seek Employment Authorization, etc?

I'd recommend all EI filers with an I-94 to print out that document I linked to and send in along with their supporting documentation for EI.

She's talking about how K-3s are denied the temp EAD (it was brought up in another thread)

Ahh, so it's greencard or bust for them?

In that case, it is totally unfair.

well, they have to wait to get EADs like K-1s, but for some reason temp EADs are a no-go, I guess.

So we're finally getting our butts in gear and gathering our documents for removing conditions in about 3 weeks or so. However, with some of our documents, we're getting things changed to be in both our names this month when we will be submitting our application next month. For example, we've sat down and have finally finished our wills, which we will get witnessed and signed and notarized on Tuesday. Will it look bad that we are getting some key things in both our names now in the "eleventh hour" so to speak ??

Removing Conditions on Residency General DiscussionRequest for Evidence

Look through some old list here from people who have succeeded and see how creative you can get. You must include what they have asked for, or an explanation of why not (as with the bank account) but you can also include other evidence that might tip the balance in your favor. I do not normally think that personal affidavits are the best choice, but you can certainly include some letters from people who know you as a married couple. See the form for instructions.

One of my best friends had a similar problem -- the adjudicator didn't think that she and her husband shared a residence. One of the things she did was get a signed affidavit from the guy who delivered her mail, who attested to the fact that yes, they both live there, and yes, he has delivered mail addressed to both of them at the same address. Pays to live in a small town sometimes. ;)

I agree completely with the sound advice meauxna has given you, and wish you the best of luck as you get this all completed. :)

Please learn from me.......

First I forget to sign one of the cheques I sent in with my AOS package -- delayed things a couple of days.

This time I remembered to sign the cheque.......but somehow forgot to check off the appropriate box in Part 2 of Page 1 of the I-751 form.

How is this possible???????????

No wonder my darn cheque hadn't cleared my bank account yet!

(Interestingly enough, my entire package was sent back, bound together at the top with one of those lovely ACCO fasteners)

Removing Conditions on Residency General DiscussionBad News after I-751

of course he can call USCIS, but i doubt he will get a personalized answer. u may instead consult an attorney just to prepare ur RFE package.
also loli, i just dont understand what do u mean by duration of marriage. of course, u have ur marriage certificate and when u got ur conditional residency. this should show them how long u have been married. may be i am missing something here. get some notarized affidavits from family and friends stating that they are aware of u guys being married for so long etc, which might help u. SEND COPY OF 2006 JOINT TAX RETURNS. also, please submit any updated financial stuff that u previuosly sent with current active dates on them. how about any recent photos with family and friends.

they want evidence that spans the duration of their marriage -- ie. joint bank account established as soon as possible, bills in both names established as soon as possible, etc. The marriage certificate establishes the date the rest of the evidence has to cover. For example, I was married in November 2004. We were able to have my name added to Jerry's bank accounts in December, so I included copies of our bank statements from December 2004, then one from 2005, 2006, and the most recent in 2007. I included other evidence that also covered the time span.

To the OP: USCIS wants to see tax transcripts, or if you don't have time to order them, show evidence that you filed as joint / received payment, etc. as kkg previously suggested.
CassieFemaleCanada2007-05-13 19:32:00
Removing Conditions on Residency General DiscussionBad News after I-751

i dont think it is a extranneous or random stuff. the additional "marriage-related" evidence wouldn't hurt and should supplement ur application if u have "limited" comingled assets.

They already included "marriage related" evidence with the original submission. Now they are being asked for something very specific that wasn't addressed fully enough to satisfy the person reviewing her file. The OP needs to focus on what evidence could qualify in this area. So they don't have a joint banking account? Ok, show how bills are being paid by both parties, like Kezzie suggested, and include an explanation of why they felt a joint banking account wasn't necessary. Or take a look at other asset/liability possibilities and see if they apply in their situation, such as the list of things I provided. Throwing travel itineraries in the mix isn't what they are looking for, UNLESS it can be shown that the expenses of the trip were shared by the two of them.

I am being so insistent on this point based on experiences both here on VJ and also in the case of a good friend of mine. Her application was held up because of one specific area of her application. Once she brought forth evidence that directly addressed the concerns of the adjudicator, she was approved.

loli,
first of all don't panic. the USCIS cannot reject u if u have a legit marriage. they will call u guys for an interview if they have somethings to straighten up. there is no way they will outright reject u.
please re send additional evidence such as photos, travel itineraries for vacations together, notarized affidavits from friends and family (may be 4-5 affidavits should suffice), any mails that . did u file the 2006 tax returns (jointly). if so please send them. THEY R VERY IMPORTANT.

none of what you suggest answers the request of evidence of "variety of joint assets/liabilities"

do you own vehicles? Get both of your names on the titles.
has your husband added you to the title of the house?
we received our state tax return cheque in both of our names -- can you provide a copy of something similar like that?
do you have any joint financial investments (savings accounts, Roth IRA, mutual funds, etc)
wills listing each other as beneficiaries could also be helpful.

Good luck!

hi cassie,
sending the joint tax returns for 2006 is extremely important. in addition, she can send additional evidence that i mentioned. it does't matter whether they aks only joint liablity/asset. the point is whether ur marriage is legitimate and how u can prove it. some people dont have much joint financial responsibilities and show other proofs indicating a good marriage. so i would therefore suggest to send any eveidence that u can think of in addition to financial stuff.

But they aren't asking for additional random things, they specifically asked for evidence of joint assets/liabilities. Why bog it down with extranneous stuff not requested in the RFE?
