K-1 Fiance(e) Visa Process & ProceduresShould I hire a lawyer to do the paperwork?
Everyone's experiences here are different, and when the "should I get a lawyer?" topic comes up, you'll get all sorts of answers...

--I did it myself, no problem
--I did it myself, underestimated or didn't understand how certain factors would impact my case, and had tons of problems
--I used the services of a lawyer, and had no problems
--I used the services of a lawyer, they had no clue what they were doing and caused so many problems and delays it was a waste of money

The fact that you are here on VisaJourney and trying to understand the process early in your relationship is good. There are links and guides and experiences here galore. I humbly suggest reading as much as you can, and start evaluating things against your personal experience. An initial consultation with an AILA-certified lawyer well-versed in family-based visas could also help as well. Just get yourself as educated as you possibly can, even if you decide to go with the services of a lawyer, so you can keep track of what they are doing (or not doing, as some people have found).

Best wishes to you! :)

GHAAAAA!!! Am I the only one near to blowing a gasket over their pointless bureaucratic bullshit?

Sounds like it! wink.gif

I can understand your frustration. However, knowing that I was dealing with immigration, my personal frustration was tempered with the fact that I was asking for the privilege to enter the US, and the process of doing so would be long and involved. I was not expecting rose petals and a red carpet! wink.gif

You're right, 30 years ago it probably was that easy. But thanks to people that have gone through this process and chose to be fraudulent and flaunt the system, we now have to jump through hoops to get what we want (the visa). It sucks. But in the grand scheme of things, it was something I was willing to do.

Why does the length of time someone waited to receive NOA2 have anything to do with this?

Do you HONESTLY think that if a person gets a quick approval, they have NO empathy for others less fortunate?

Do you HONESTLY believe that just because ONE step of an immigrants visajourney is quick, that all the steps will be quick?

the problem with being that brief is that I have seen people being RFE'ed for not providing a modicum of background information to explain how/when the relationship started.

Go for shorter and to the point. Any date you mention should be backed up with evidence that you provide. They do not want a harlequin romance novel, they want dates and facts. In your case, indicate that you had been friends since whatever date, indicate when your relationship changed to romantic, when you met in person, and when you became engaged.

Our answer to that question was no longer than three short paragraphs long.

In February she was here for 2 weeks then when she tried again in July it was denied, the guy didn't even look at her, he saw one piece of paper and said she didn't have enough proof she was coming back.

What do you see as different now? What transpired to cause the CBP officer to look at proof she would return?

Please help us help you.

If she's honest with the guy and say she's getting married, and wants to wait out the 6 months here with me while we plan our wedding and then fly back for the interview and then fly back here to get married, can he really say no to that?

Sure, the officer can say no! How does he know that she's telling the truth?

QUOTE (rebeccajo @ Oct 31 2007, 09:55 AM) <{POST_SNAPBACK}>
Since when is even 80 days for AOS approval 'some time'?

You know what I REALLY don't understand? How can anybody be a member of this community and assume they will get a greencard in under 90 days? I mean - you wait MONTHS for the visa, right? Then, you read about people who file for AOS and get caught in namecheck..........

I'm not picking on you Drew. Actually, since you seem like a nice guy (and reasonable too), I'm purposely raising this discussion in your thread because I'm hoping for a nice and reasonable chat about it.

How can VJ members just blindly assume they will get a rapid greencard?

I was thinking the same thing! I got my GC in 5 months or so and thought that was quick! wacko.gif

To the OP -- what you are going to have to worry about is the time gap between the temp EAD and the regular EAD, getting the SSN, and whether or not employers will accept the temp EAD.

I'm the non-USC, and I moved while we were waiting for the approval of the I-129f. We waited until we knew my case number and that my petition was at my Consulate, and then my husband emailed the Consulate with the information. It seemed not to be a problem then.

as far as the evidence of engagement was concerned, I had:

--pictures from the day we were engaged
--the ring, and the ring receipt

--pictures from our wedding shower

This was part of my overall set of evidence that I took with me to the interview.

K-1 Fiance(e) Visa Process & ProceduresGetting married before fiance visa approved
Sure, you can get married, but then the FIANCE visa process will no longer be valid, and you will have to start over with a spousal visa.

K-1 Fiance(e) Visa Process & ProceduresI want to be with my fiancee
no matter what route you choose, you're going to have to wait. Once you accept that fact, and the fact that Nov 10 will probably have to go by the wayside, you'll be ok. :) It sucks, but you'll be ok. :)

There are pros and cons to fiance vs. spousal visas. Take a deep breath, read the guides and threads here in VJ and on the USCIS website, and make decisions based on what you learn. We're always happy to help!

Visit USCIS.gov site.
Register & set up your portfolio using your receipt number.

Example of a receipt number: WAC1234567890

Yeah, I just did that. It says "Received and Pending" just like it's said for the past 4 months.

Does the "touched" status appear when you check the case status by typing in the receipt number?

Sorry, it's just that I've never seen "touched" on my status anywhere and I can't find that "Last Update" column the OP is talking about.

The idea of "touches" is not something USCIS tracks, it actually means nothing to them, so you will not see the word "touched" anywhere on the screen when you check on your status.

When you login in to your case portfolio (which is not what you are looking at when you are at the "case received and pending" screen, btw), look at the "last updated" date. if it changes, it means you have been "touched".

Edited to add -- you need to set up a case portfolio to get the columns we are talking about. smile.gif

For all information that would not fit in those tiny boxes, I wrote see attached, then attached a sheet of paper referencing the section or item number. Also, on the attachment, be sure to reference the form and fiance's name and Receipt #...just in case the two documents get separated.
