Hi everyone,

We have just been informed by our Senator's office of the following:

"The processing times on the USCIS regarding I-751's out of the Texas Service Center are INCORRECT."

As of October 19th, I-751's are being processed with a receipt date of February 13, 2007."

WOW.....

blink.gif

Per my Senator last week, TSC is processing I-751's with a receipt date of 2/26.

Ouch... are they working backwards?

that would imply they were working wink.gif

Who knows anymore. When different senators get different dates that are no where near the posted "current" (ha!) processing times, one quickly loses faith in the ability of TSC giving a straight answer.

Thanks for this feedback. Amazing. Even the Senators are getting conflicting information.

I called my Senator's office again today, and asked them to clarify the processing time frames.

Well, even though they don't completely jive, at least we know that they are working in February, instead of the misinformative "April 13"

Removing Conditions on Residency General DiscussionThis might sound kinda stupid...
You will need your I-751, and copies of any evidence you wish to include with your submission. I humbly suggest you do a thorough read-through of the information in this forum, both threads and pinned topic, to have a good idea of what others have sent in, what people have been getting RFE's for, and approximate timelines of this part of the process.

Best wishes to you ! smile.gif

Cassie,

In your case, was the packet returned to you pre or post biometrics? Also, was the unanswered question important or unimportant, in your opinion?

Thanks,

I sent in the package, it was immediately sent back to me because I failed to check off a key question on the first page of the form-- part 2 "Basis for petition" Somehow I forgot to check one off! So yeah, the question I didn't answer was kinda important! blush.gif

I resent the whole package back, received my biometrics receipt, my biometrics appointment notice, and then my extension letter.

I am from North Carolina. I sent off my package to Texas Service Center a month ago and today I recevied a NOA from California Service Center. I was all excited that I finally received a NOA, then I looked at the bottom of the paper where it listed the mailing address of California Service Center. I started to have a bad feeling... I am afraid that there was a mix up while my case was being processed and ended up in California Service Center instead of Texas Service Center. I am afraid that they are gonna schedule my fingerprinting thingy in California office... Has this happened to anybody?

Not true. You have 90 days to file. If you file after your card expires, that's when you have trouble.

from the filing instructions on the I-751 form itself:

QUOTE
When Should I File the Form I-751?

. Filing jointly. If you are filing this petition jointly with your spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires.

. Filing with a request that the joint filing requirement be waived. You may file this petition at any time after you are granted conditional resident status and before you are removed.

. Effect of not filing.
If this petition is not filed, you will automatically lose your permanent resident status as of the second anniversary of the date on which you were granted conditional status.

Removing Conditions on Residency General DiscussionPostponing Biometrics for 10 months?

BTW when i was crossing borderi had 2 problems

1) at the departure airport they won't take a COPY of NOA1 Status Extension letter, they didn't let me through untill i found the original (don't ask me how)

2) at the destination point customs officer said i coudn't be out of country for more then 6 and less then 12 (that is 11) months without some "Reentry permit" witch "looks like a book like passport and where they can put stamps" - may be i got it wrong, but they were not happy to see me with just my passport + expired greencard and NOA1 (which they ended up stamping)

so folks, i donno whet else is exactly needed but before traveling you should call or schedule infopass and get that mysterious document

You need a re-entry permit if you plan on being out of the US for an extended period of time (at least 6 months? not sure).

If they want W-2s or tax transcripts, then they should change the instructions on the form to state that. The instructions as written say nothing about tax transcripts or W-2s.

My understanding is that AOS required W-2s and/or transcripts because part of the AOS decision is determining the sufficiency of the affidavit of support. I don't see what purpose they would serve in the removing of conditions phase, because the goal is to determine whether the marriage is bona fide.

They want to see that you as a couple have merged your financial assets and liabilities as part of the evidence needed to prove a bonafide relationship. One of the ways is to include tax transcripts, which indicates if you have filed jointly.

Many people who have gotten RFE's at this stage of the game usually report the RFE is for additional financial evidence.

American Airlines from any place I have departed from in the US have never asked to see my green card. It's not part of my ID that I show when getting checked in. The only time I show my GC is going through US Customs & Immigration checkpoints. Curious that some airlines care about seeing the GC.

From what I understand, the OP is referring to traveling overseas. Not only the Customs and Immigration folks will want to see your GC, but so will airline employees before you check in on a flight to the States.

Erm, so am I smile.gif I have never been asked by airline employees to show my green card when flying back to the US, ever. I am not sure if it's because I go through a PFI immediately afterwards or what.

The time I went through the PFI, I produced both my GC and extension letter, and the officer was very happy to see I had my paperwork in order. The extension letter (NOA1) is very distinctive, in the same vein as any Notice of Actions. Not really easy to fake them.

Cassie, it probably depends on the country you're flying out of. I know that in the case of Germany airline staff prescreens for visas or greencards (of non-US citizens) before checking in on a US-bound flight. I think it has something to do with some law that the airline is responsible for return transportation in case the passenger is denied entry into the US.

Well, that makes sense! Thanks tweety! smile.gif

probably depends on the airline or the place you are departing from - both Lufthansa and United wanted to see the card, even if it's expired, because the extension letter refers to extending the status for a year from the expiration date of the card and they need to enter that date into their system.

Removing Conditions on Residency General DiscussionRFE, is it serious or just a normal procedure?
Your RFE is a typical one that I have seen a lot here on VJ. They want to see that you have co-mingled your assets and liabilities.

--things like your life insurance is a good thing, showing that you are each other's beneficiaries
--do you have a will?
--letters of support from people that have known you for at least two years are always a good idea

--a sample of bills, bank statements and such spanning the length of your marriage would be good
-- do you have any savings accounts, investments, etc etc with both your names on it? Any loans, credit cards, etc??

Just because the house payment is in her name, are you giving money towards the payment? Show it. Show how your bills are being paid -- is it coming from your account or hers? If it's from a joint account, show how both your paycheques are going into it. (I am assuming you are both working).

Be creative. smile.gif
