We will be sending ours to TSC also. Then the waiting begins again. Hope it doesn't take to long to get a NOA1 back my lisence expire May 25th. I will be heading to Atlanta also to see if I can get a stamp.

Well, basically you haven't met the minimum burden of evidence so they are asking for much more than what you originally provided. You have to demonstrate that you have an ongoing, legitimate relationship in a shared residence. Frankly, right now, they don't believe you based on what little information you provided, so you are going to have to get cracking!

Birth Certificate: I don't have any children
Are you sure they are asking for the BC of a child or for your spouse?


Copies of Joint tax returns: I simply didn't make enough to file jointly (I'm a sub)
Copies of mortgage agreements: I don't have any damn mortgage
Copies of Insurance policies: Don't have any whatsoever. We go to Mexico for medical. She can't drive yet so I don't have joint car insurance and we're too young for life insurance.

Copies of credit card statements: I did submit copies of my joint bank account.
Copies of loan documents: I don't have any loans whatsoever.


They are looking for evidence that you have started to co-mingle your assets like a typical married couple would. You've had two years together, so they are expecting typical things like : lease/mortgage, bills/expenses, tax returns, insurance, etc. Since you state that you don't have these things, you need to explain that to them and provide other sources of evidence that you two are legitimately together.

You're not too young for life insurance, by the way. I've had a life insurance policy since I was in my teens.

Since you don't have utility bills or mortgage, and since you live with your parents, it probably would be best for them to provide you with a notarized affadavit stating that you are living with them and have been living with them since (insert date here), and any details of the financial arrangement that you and your spouse have with your parents.

If you have wills listing each other as beneficiaries, that would help.

You must have filed income tax returns, you'll need to submit copies of them.

If you have any bills listing you or your spouse on them, submit copies.

How are you supporting the two of you financially? Provide evidence of that.
Can't stress that one enough!

You'll probably need to get more notarized statements from family/friends who know you and your wife and can attest to the validity of your relationship.

Does your spouse have a state ID yet? Or a library card? Anything that lists her current address?

Pictures of the two of you together since your marriage?

When I put together my evidence for removal of conditions, I didn't purposefully resubmit stuff that was included in my AOS submission, unless it was warranted, like income tax returns, etc. I focused on providing evidence that spanned the two years, as opposed to the seven months between our marriage and the AOS interview. There are quite a few things asked for in the AOS submission that are not necessary for the I-751, so I wouldn't make a exact copy of everything you previously submitted.

Will your entire file be there if you get called into an interview? Not sure, but I am going to say probably, based on my experience at AOS. The adjudicator couldn't approve or reject me right then and there, since he didn't have what he called "both parts of the file" in front of him at that point. He had everything there that was submitted for my AOS by mail at the interview, but was missing the rest of the file that came from the TSC. he told me he couldn't say yay or nay until the file was reconciled and he could look over everything. Fortunately, the file was already at OKC and we didn't have to wait long for approval. So long story short, I think your entire file will be there, but the interview will be concentrated on your I-751 submission, IMHO.

Thanks for the responses. To answer some questions, the blue Notice of Action didn't have much to say.
It's like we didn't send anything in at all. The first page says the documentation submitted is insufficient. Respond with the evidence requested on the attached page.
Page 2 reads like the original instructions for the I-751.
--additonal documents to demonstrate the circumstances of the relationship from the date of the marriage to the present date.
--birth certificate of children
--lease or mortgate
--financial records
--the famous "other documents"line
--Affidavits
And then it says not to send copies of documents previously submitted.

So I'm guess they just want more of everything. Our landlord has agreed to write an affidavit, so that should help. I have a good friend of my wife and one of my friends to write one too.
As for other documents, I'm planning to send in the IRS tax transcripts for the last three years.
Going through our stuff with both our names on it, we found our guarantee/certificate from the jewelry shop where we bought our wedding rings, complete with commemorative photos of them sitting in the case (places in Japan do this). Should I send that in? It's in Japanese and would have to be translated, but that's not a problem. Talk about random evidence though.

I just wish I know what aspect they wanted to know more about, our finances, our "good faith" togetherness, or evidence to the fact we were always living at the same address. Most likely it's all of the above I guess.

-what about joint driver's licences showing the same address - or a State issued ID card if one of you or both of you don't drive?
sadly we never got around to getting my wife her state ID, and mine has an old address.

She has 401-K with me as her beneficiary, so that should be a nice addition.

No wills. Wouldn't be rather odd to make one out now. Still, that's an idea.

sounds like it to me, and Kathryn has given you some great ideas. :) I would also look at the pinned topics in this forum, as well as other "evidence thrads for some ideas that might be "out of the box" and help you .

Just FYI, we finally got up off our rears and finished our wills so we could include hem in our packet :)

I'd also consider submitting some photos of the two of you together, and some affadavit letters from people who know the both of you :)

I would send in some utilities or bills even if they are just in your name and I would send in some bills or something that are just in your wifes name.... it would prove that you are living at the same address...



that's my question as well. Usually they give an indication of what they are looking for.

include a copy of the lease for the apartment (if it states the actual location of the apartment). Or, you could get a written statement from the building manager or neighbors stating that both of your parents live there, they see them together in the building all the time, how long they have lived there, etc etc.

Lots of people have a "mailing address" (like a P.O. Box) and a "actual physical address" . This should not be a huge problem.

No bio appt's at this time apparently...


That stinks. I wish the service centers were consistent with each other instead of one always seeming to be faster than others or slower than others. We all pay the same fee, we should get the same service at all service centers. :yes:

You shouldn't have any problems traveling. After you apply to remove conditions, the 1st NOA you receive will extend the GC for one year. Have that handy with the original GC when your wife returns to the US.

Thats is good to know because we plan to go to Thailand in May and we were worried that the GC wouldnt be there on time, so after the first NOA it automatically extends the temporary GC?


It extends the validity of your conditional green card, yes.

I did not want to go with the letter either but I am a little bit worried that there is almost no financial stuff. Other than that, we have many pictures, car and health insurance, dmv letters, doctor bills, etc. We do have the paperwork from the old checking account and credit cards on both names but these are old.



usually when they send an RFE for insufficient financial information, they make it pretty clear that they are looking for evidence of joint assets and liabilities. this could include things that beckypua mentioned, as well as income tax transcripts for the years of your marriage, mortgage/rent agreement in both your names, etc. If you don't have a joint chequing account, think outside the box for evidence. For example, if your hubby is working, can you prove that his cheque is being deposited into the current bank account to be used towards joint household expenses?

Based on the processing times, it's going to take around 7-8 months for the card. The biometrics appointment is currently a ####### shoot. ;)

Maybe I'm confused. You got an NOA incredibly fast compared to most other service centers. And it has been less than two months since you applied. Sure, you can vent, but are you really getting things in perspective? Is the delay really holding your life back in any way? Or maybe I don't know the full story.

(That's probably a comment to most people who seem the think they have the right for immediate approvals, not just you by the way. I'm not really sure where everyone got it into their head that I-751s are supposed to be fast? Was I off school that day?)



the frustration methinks (and you can correct me on this Reinhard!) is that he might have gotten his NOA1 quickly, but all of a sudden Texas has gotten super-slow with sending the biometric appointment information. I say all of a sudden, as I applied only a month and half before he did (may) and had my biometrics completed within a month of my NOA1, he'd already been waiting a month and a half.

sounds good :) From what I have seen, most RFE's during this step of the process usually have to do with financials -- mingling of assets/liabilities. Keep track of that stuff and that should help a lot. :)

The letter (NOA) specifically states:

"Your conditional resident status is extended for a period of one year from date of expiration on your Form I-551, conditional resident card. During the one-year extension you are authorized employment and travel."

Time: 1:45pm AST
Place: Halifax PFI

We stepped up to the counter, and I laid out the following on the counter while the officer was looking at J's passport:
my GC
the extension letter
my Canadian passport (in maiden name)
my boarding pass (in maiden name)
a copy of my marriage certificate if needed

The officer was very impressed that I had everything I needed, and checked the dates of my GC and extension letter. He then proceeded to give me an explanation of what I had gone through so far (from K-1 to filing for removing conditions) and then a reminder that I could apply for naturalization next year AND keep my Canadian citizenship. J and I looked at each other in amusement since we were well prepared, thanks to VisaJourney and such, but we remarked afterwards that he was probably the most informative person we had dealt with in this process so far --- and he was even right! tongue.gif


So basically, it went smooth as silk. It would have taken no longer than 5 minutes to get through the PFI, if we hadn't had the free information lecture. wink.gif

good question, I am not sure if after the whole thing was over with if she received her conditional or 10 year card. I assume 10 year, since they had been married 5 years before applying for it (long story!) -- however, they had to go in for interviews (2 in total), so who knows. I'll have to ask her for specifics. All I know is that she was initially denied, but she went back armed with more evidence, including a bunch of affidavits, which helped in getting her approval.

That's exactly how I see it, too. I will have no problems providing Affidavits if they ask for them later, but I really think we have enough evidence proving we're a real couple more than a couple of letters.

If I remember correctly (and please someone pipe up if I am wrong), I-751s sent to TSC from July 1 onwards are being transferred to CSC. I need to find where I read that. The rest of us that applied before that date are out of luck on that one, I guess.

I just arranged my evidence in categories, and made sure I included a table of contents sheet for reference.

I used binder clips. No hole punching.

I used the address included on the I-751 form, as USPS gets the package there as quickly (and cheaper!) than Fed-Ex, IMHO.

If I remember correctly, your I-751 will be transferred to CSC, so don't be surprised!
