Removing Conditions on Residency General DiscussionAssembling I-751 package
i organized my evidence into categories, and included a cover sheet for each category listing each piece of evidence within that category. I identified or explained some evidence on the copy itself or on the category cover sheet. I clipped everything together with a large binder clip with my overall cover letter and cheque on top.

erm, more like vice versa........ have you looked at our loser list lately?

Well, I don't know about Texas, but Vermont is currently doing March 1, 2007 -
that's 7-8 months processing time for your average I-751 (10 months officially).

Unfortunately, based on realistic timelines of people on this site, the dates on the USCIS website mean nothing... I don't even bother checking the dates - unless you want a quick giggle... whistling.gif laughing.gif wink.gif

At least according to the "Conditional GC Approved without Interview" thread, Texas is a lot faster than Vermont:

UserName....Service Center...I-751 Date....NOA Date.....Biometrics....Interview......Approved...Remarks

Service Centre VERMONT

Service Center TEXAS

crommm............TSC...CSC..09/26/07......09/27/07......11/17/07......

Because TSC isn't actually processing them! CSC is doing their work!

Everything submitted to TSC post - June 30, 2007 are getting transferred to CSC and now VSC, and getting approved within a few months. Those of us who submitted before that date are closing in on a year with no action. sad.gif

TSC's "official" processing time is April 8, but when senators put in a request, they are getting processing dates that conflict with the "official" date. So we don't know where they actually are. 'Tis frustrating.

The extension letter extends the validity of the green card for a year, so you can travel with it with little to no problems. Some people take the added precaution of going and getting the I-551 stamp in their passport.

Think about working on other kinds of evidence -- ie. insurance with both your names on it, listing each other as beneficiaries, wills, investments, etc.

Removing Conditions on Residency General DiscussionMajor RFE Received
QUOTE (spi9959 @ Jan 28 2008, 05:18 PM) <{POST_SNAPBACK}>
Well, I'll tell you this: based upon what they are asking of you in the RFE, others reading this forum submitting information will not likely be giving them a "smattering" of bank statements anymore, if they can help it. Why wait for possible RFEs? Accumulate a lot of information in regard to the categories of information they ask for including each and every monthly bill, account statement, etc. And, no, bank statements aren't confidential when it comes to USCIS.

I do wish you the best of luck and I'm sure you'll be fine. I think all of us may have learned a lesson from your experience.

Based on what I have seen in the past year that I have been following this particular forum, most if not all RFE's at this point in the game have to do with co-mingling of assets and liabilities. Bank statements are only a small part of that puzzle. And if I was applying now, I still wouldn't send them a copy of every statement and every bill. But that's just me.

The mistake that I see a lot of people making is that their packets are light on evidence in general, and financials in particular. Filling up the submission with a lot of extranneous paper isn't the solution, IMHO, but a critical eye is needed to evaluate whether or not the evidence submitted will answer the question "Does this prove that we have an ongoing, bonafide relationship living in the same residence?"

Lovedolphins, I know that getting an RFE sucks, but I, as a fellow member of the TSC Losers List, am encouraged that TSC is doing some work! smile.gif Best wishes that this gets cleared up quickly! Don't worry too much, you have lots of time to gather what you have been requested to send. smile.gif

Karen -- I'm going under the assumption that I won't have to fly to Vermont if an interview comes my way, kinda like when I didn't have to go to Texas for AOS. But then again, this IS USCIS we are talking about here, and only the good Lord knows what is going on in their minds this days! wacko.gif

We are currently living with his parents and have been doing so since we got here.

As for mail....that is all sent to a P.O. Box which we have been told won't prove anything.

We don't have any magazine subscriptions, gym memberships or anything of that kind. And again that would be sent to a P.O. Box....and the P.O. Box is not in our name.

We can most likely get an affidaviat from a family member but no friends or people we work with since they don't want immigration "all in their business".

Get a sworn affadavit from your parents explaining the living situation.

how about library memberships? I know ours requires that they have your civic address as opposed to the mailing address?

I have yet to hear of anyone who wrote affidavits getting immigration "all in their business" -- are they really that adamant that they won't help you in this way?

I have noticed that you have some time (at least two years) until you have to send in your petition to remove conditions -- you do have lots of time to collect evidence -- joint tax returns, insurance, other assets/liabilities, investments, wills, pictures, evidence of trips, maybe even a child? smile.gif etc. Now that you are aware of what you don't have, start doing research (this forum has lots of excellent suggestions!) and focus on what you can get now and in the future. You have time!

Removing Conditions on Residency General DiscussionRemoval of conditions on CR-1
get wills making each other beneficiaries
get letters of support from people who have known you and can attest to the fact that your marriage is bonafide
submit evidence of joint tax returns
are you renting? where are you living? what can you rustle up that proves you are living at the same place?
any letters/mail addressed to the both of you?

think outside of the box and try to round up anything that proves what they are looking for: that you have a bonafide ongoing relationship and a shared domicile.

If you are eligable for citizenship and that is what you want, what you should do, is send the N-400, which will push adjudication of the I-751 if it already hasn't been adjudicated.

These is unbelievable, you guys never going to give up with this N-400 quick fix for I-759 application

When will you realize that this isn't a quick fix? It is just the next thing in line of this process.

It isn't a quick fix, but it will spur a lagging application. Of course, the alternative quick fix is to leave things as they are and just practice patience. smile.gif

right, but I'm not going to send in the N-400 for the express purpose of moving my I-751 along. wink.gif

No ,you're not obligated to make appointment for another extension but ...how about if you need to leave the country and say you want to travel ?
No matter what you choose you still have to waist time and go through a lot of aggravation with them, that seems to be the case with USCIS
A lot of people here on VJ think that just jumping in with another application (N-400) and pumping more money will speed up the process but I think that's totally BS .We should not have to do that kind of compromise

mad.gif mad.gif mad.gif mad.gif

You realize that many people on VJ are going ahead with naturalization because they wanted to in the first place, right? And that getting citizenship is taking up to 18 months or so (the last I checked) -- hardly speeding things up!

I don't plan on applying to naturalize for the sake of hastening my I-751 along, but because I meet the standard timeframe to apply and it was a decision my husband and I came to independently of the mess TSC was in. If I wasn't in the mood to get citizenship, I'd sit and wait for the 10 year card to come along. Simple as that.

Removing Conditions on Residency General DiscussionJoint bank account -- totally necessary?
QUOTE (elmcitymaven @ Feb 21 2008, 05:44 PM) <{POST_SNAPBACK}>
I guess it's the principle of the thing. Why should I complete an unnecessary business transaction by placing money with a bank in order to satisfy a government agency as to the bona fides of my marriage? I will open a joint savings account, no probs with that, as it is saving together for our future. But to both of us, our checking accounts symbolise our own selves, and the right to determine at least part of our own expenditure.

Wow, I am getting waaaaaaay too philosophical about this. tongue.gif

USCIS isn't demanding that you open a joint account, they want to see that the two of you are co-mingling your assets/liabilities, like a typical married couple. Usually that does mean joint banking accounts, but since you don't have those, think outside the box. I humbly suggest you take a look at RFE threads in this forum (99% of which are usually related to financial evidence) to maybe get some alternative ideas of providing that kind of evidence. smile.gif

Oh, and I suggest writing your wills and including them. smile.gif

I get upset, too, but to say you cannot do your work or you cannot travel is simply incorrect. It's not THAT bad guys.. just annoying wink.gif

I get to read some of your comments here and some are just crazy
How can you not see this whole mess being terrible wrong ??????
Expired status ,having to go every two months for a stupid extension stamp in the passport ,lose time for work ,lots of agravation ,stress and more .....still you don't see the situation to be THAT bad
That's just insane !!!!!!
I'm sorry but you must be living in a different world

Aye, and I must be her next door neighbor.

Iansig, the process sucks, it's unwieldly and archaic. But no amount of !!!!!!!!!!!!!! and swearing on a message board is going to change it. You sound like a very motivated person -- why not channel your energy into an organization that is lobbying for changes to the system? There are a couple of VJ'ers doing that as we speak (rebeccajo comes to my mind immediately).

Just because people don't scream and shout with righteous indignation like you do, doesn't mean they don't care. It just means they choose to deal with things differently.....and IT"S OK.

Biometric Appointment

We just got our letter yesterday. Do I need to be there also or can my wife who is filing for AOS go alone?

If your wife needs an interpreter, you can accompany her. Otherwise, only she will be admitted in the building to get her biometrics done.

Wow they won't even let the spouse in? No she doesn't need a interpreter, I just can't take the day off.

Thanks

I went for my biometrics on June 4th. The security guard asked my husband and I if the appointment was for both of us or just me. When I replied "me", he asked if I spoke/understood English well enough without requiring an interpreter. When I replied yes, he nicely told my husband that he couldn't come with me to the appointment. My district office has a relatively small waiting room for biometrics -- if everyone there when I was there had their spouses with them, it would have been standing room only!
