If you take a look through this forum, you will see that many people have traveled successfully with their expired GC, their extension letter, and some have gotten the added insurance of going to their District Office and getting the I-551 stamp in their passport. I am one of those success stories. smile.gif

You have gotten a pretty typical RFE at this stage of the game. They want to see that over the past two years (and since you have been married, really) you have begun to mingle your financial assets and liabilities. By the looks of the list of evidence you initially provided, you were very light on this kind of documentation. There have been some excellent suggestions already in this thread for additional proof you can send in. I personally would focus on the following:

--anything that proves you are each other's beneficiaries -- wills, life insurance, medical insurance, etc etc

--anything that proves you are co-mingling your assets & liabilities -- tax transcripts from all the years you have been married, copy of mortgage/lease, joint bank accounts, joint investments, bills in both your names (or, if you are keeping your money separate, show how things are getting paid -- ie. You are paying the phone bills, he pays the cable bill, etc etc).. I would include a sample of those kinds of things that span the existence of your married life together, Ie. not every single bill from every single month.

-- anything that proves you live at the same address

Anyways, it sounds like you will be ok. Don't freak out too much. smile.gif

When you enter the US using a form of US identification (normally a passport, in your case your wife's GC/extension letter), you don't get a stamp, because you are not a visitor, you are a citizen/permanent resident of the US. When you went through customs, they probably scanned/swiped your wife's green card? That's how they keep track of when she comes back.

I have a problem with the fact that I will probably have to apply for citizenship to get my I-751 moved along, and will have to waste time and energy to go get the extension stamp to extend the extension letter.

It sounds like the lifting of conditions requires less in legal documents but more in actual proof of a legitimate marriage. Except for the USCIS form and biometrics, I do not see that evidence is required such as proof of birth, passport, divorce decree etc. The real work now is gathering the evidence to establish a lasting marriage. I have plenty of time to get it together.



The most common RFE I have seen reported in this forum is for lack of financial evidence -- they really look for evidence of financial co-mingling of assets and liabilities. The key is making sure that you have a good balance of financial evidence and other bonafide relationship evidence.

Okay guys, I will try and calm down but, I'm sure you can understand my extreme frustration with the current situation.

The first letter is blue and in the upper right hand corner is titled: I-797E, Notice of Action. Below my wife's name and our home address it states:

RETURN THIS NOTICE ON TOP OF THE REQUESTED INFORMATION LISTED ON THE ATTACHED SHEET.
Note: You are given until MARCH 4TH, 2008 in which to submit the requested information to the address at the bottom of this notice.

Pursuant to 8 C.F.R. 103.2 b (11) failure to submit (ALL) evidence requested AT ONE TIME may result in the DENIAL of your application.

On the Attached letter which is white and states:

REQUEST FOR EVIDENCE - I-751

IDENTITY DOCUMENT: Please submit a photocopy of the Department of Motor Vehicle issued driver's license and/or identity card for each party to the qualifying marriage.

AND

RESIDENCE: In order to establish eligibility for removal of your conditional status, you must submit evidence of your communal residence for the past two years. Such evidence may include but is not limited to the following:

Copies of rental lease(s) or rental agreement(s) showing joint tenancy at a common residence signed by you, your spouse and the owner(s) of the property (or the property manager).

Copies of utility bills such as telephone, gas, electric, water, cable etc. or other statements issued in both your name indicating your residential address.

If applicable, submit copies of military Basis Allowance for Quarters (BAQ) form for housing and/or DD Form 1172 for dependent military dependent cards.

Any other documentation which show that the marriage was not entered into in order to evade the Immigration Laws of the United States.


Now I submitted all of this information and then some back in August of 07' We already submitted both our driver's licenses. It was a stack of evidence and inch thick!

Do you guys think there is a problem because my wife's name is not on the mortgage to the house or our utility bills? I bought our home over 10 years before I met my wife.

No, they are not asking for yet another I-751 form, they are asking for further evidence in relation to the I-751 that you previously submitted.

Personally, for the identification section I would send in the photocopies of your driver's licenses (front and back), as well as a copy (front and back) of your wife's green card.

They are definitely looking for evidence of shared domicile (see bolded sentence above). Whatever you sent in beforehand did not convince them that you live at the same residence, so you now have to convince them that you do. Since she is not listed on the mortgage (or deed, I assume) or utility bills, you do have time to add her to these things and get a copy indicating such.

Other things to include:
--definitely highlight the address on your driver's licenses to show you live at the same address, and include any other things that do the same -- library cards are good for this as well.

--joint tax returns are helpful

-- notarized statements from people that can attest that you live together, you have been living at such and such address since she came to the US, etc.

--anything addressed to both of you showing the shared address -- any recent Christmas cards? insurance statements? medical bills? etc etc.

Take a good look at other evidence threads in this forum -- there are lots of great suggestions in those that may help you overcome this burden of proof. This can be done! smile.gif

Even though the up to date, 2007 form clearly stated that if I live in Florida I was to send the form and the $400. + dollars to Texas? Do I have to send the money again along with the form, articles of evidence and letters from family and friends attesting to our marriage for the past 2 years???? This is extremely frustrating.


yes, your petition is being forwarded to California, even though the form says to send it to Texas. Those of us who filed before June 30th would love to be in your position!

If you received the extension letter already, then this letter from California is a request for further evidence, not a request for another complete set of papers and fee. What exactly is the letter from California asking for?

However, when I going back to the states on Oct from oversea, they only look at my greencard.


You have to go make an infopass at your local district office, take your paperwork (extension letter, etc) and explain that you need the I-551 stamp. You will need the stamp if the extension letter has expired or is close to expiring, and some people got the stamp anyways because they were afraid that officials in the countries they were visiting would not understand the extension letter.

When I travelled with my expired green card and my extension letter, the officer made sure he looked at both.

This (what I highlighted) is the normal course of events. The extension letter extends the life of your green card until they can look at your petition. For some people it has only been a couple of months for them to get their card, for others it's encroaching on a year or more. if by chance your application does not get approved by the time the extension letter runs out, you get an INFOPASS and go to your local district office and get your passport stamp with the I-551 stamp which extends the life of your extension letter. You will not have to send in a whole new I-751 package next year.

After you send in your application to remove conditions on your residency (Form I-751), you will receive a NOA letter that extends the validity of your green card for a year, to cover the time it may/may not take to process your application. Take your expired card, the extension letter, and your ID you normally take on an overseas trip, and you are good to go. Some people get the added insurance of getting the I-551 stamp in their passport (you will have to make an INFOPASS for this at your local district office), because some officials (customs or airlines or otherwise) are not familiar with the extension letter.

Look for people who have filed with Texas after June 30, 2007, and you will get a good idea of the timeline, it's only a couple of months because they are transferring to CSC or VSC. Those of us who filed before that date will skew your results.
