You don't need a waiver, but you do need to file. Explain that you were expecting to receive notification of the need to file and did not realize until now that such instructions are not coming. Personally, I would not use a lawyer as that would delay filing even later than you are and may cause you more hardship in the long run. Download the I-751 form, get photocopies of all of your evidence, write your letter addressed to USCIS and sign it from the two of you, and get it into the mail asap. Apologize profusely in your letter and ask them to accept the application even though it is late. Use a personal cheque for the filing fee as you will be able to see when it is cashed. Once it is cashed you can feel pretty comfortable that your application has been accepted. Good luck - and don't waste any more time - get that application in!

Since we just discovered all of this yesterday (Sunday), I do not have the evidence. Do you think I should file it without the evidence and then send the evidence in a couple of days once we get it all together (need affadavits).

My wife thinks we need to go to the San Antonio USCIS office but I am fearful of doing that.

I have completed the I-751 and can send a check tomorrow.

Do you have any hard evidence of a possible 60-day grace period? This is the first I have heard of such since I began searching the web yesterday.

I agree that telling them the truth that it was simply an oversight instead of concocting an excuse as my wife has suggested would be better.


No. Take the extra day or two to get everything together, then send it ASAP. If you send in the form, and then send in a separate packet of evidence, I can forsee two potential problems -- one, that your packet and evidence never get reconciled together; and two, that they open up your first packet, see no evidence accompanying the form, and send it back for insufficient evidence.

Me and my husband got married last year in july in Germany and he got to the staates in August and i in Oktober.

- ID-Cards showing him as my sponser (he got out of the military)
- a conformation from my parents-in-law that we living together with them and don't pay rent
- my application for my job showing him as my case in emergency nummber
- car loan with both of our name on
-car insurance with both of our name on


We don't have any accounts together, no life- or health insurance, no credit cards or phone bills.


Would this be enough or does anybody has and idea for more evidance??
(No i'm not going to have a baby with him)

Nebraska's petitions are automatically being forwarded to California now. California and Vermont are the only two centres now processing Removal of Conditions. This has been going on now for a while (Texas forwarded cases to CSC last June, and then another batch in January 2008, Nebraska transferred everything to California starting in March 2008 or so), they just made it official about 2 weeks ago on the USCIS website.

Just so you know, VSC is in the middle of a major slow down right now. If you are worried about not getting your extension letter in time, make and INFOPASS at your local office and go get the I-551 stamp in your passport. You should receive a stamp valid for a year, although don't be surprised if they only stamp it good for 6 months.

Edited to add: looking at the site and at people who weren't transferred to VSC from TSC, they've been getting their letters about a week later? Don't forget, there was a holiday in the middle of that, so there was a short week.

1) & 2) yes. There has been a huge backlog in sending out NOA1s from TSC which has been tracked in this thread:

People have gone to the INFOPASS, explained the situation (ie. haven't gotten their extension letter yet), and got their stamp. The officers look up your case on their computer, see the status, and then go from there.

3) I booked my appointment 2 weeks before my extension letter expired, and that was fine.

1. Yes.
2. If it takes too long to get your NOA1 (the extension letter), make an INFOPASS appointment at your local district office and go and ask for the I-551 stamp to be put in your passport, this will cover you.

TSC hasn't been processing I-751s for the most part since June 30, 2007, when for a chunk of time people filing after that date were automatically transferred to CSC.

Since December 2007, people filing at TSC were transferred directly to VSC. There was a good portion of us (who had filed before June 30th) still sitting at TSC until the end of January 2008, when most, not all, of us were transferred to VSC.

As of two weeks ago or so, USCIS made it official that the only two centres processing I-751s are California and Vermont. Your petition will automatically be transferred to VSC.

You won't be asked for additional evidence at the biometrics appointment. You will fill out a paper, have your fingerprints taken, and that's it.

You may be interviewed, but that is very rare. Most people get approved without an interview.
