Aye, that is what I have heard and practised myself. I took the OP to mean the tickets were already booked in the married name and couldn't change them. I think (heavy emphasis on the word think) I have read that people here on VJ have gotten through with a difference in the last names, but 'tis very rare.

I am currently in Canada on a trip. When I checked in at the AA counter, they have a new automatic system. I had to swipe my passport, and then my expired GC for some reason. A "wait until airline personnel look at your paperwork" message came up. I was about to whip out my extension letter and marriage certificate to explain the name discrepancy, but she didn't thoroughly look at them. Going through security, however, is definitely a different matter as they definitely check the names on the passport and tickets.

I have travelled with my passport and airline tickets in my maiden name, my US ID/immigration paperwork in my married name, and a certified copy of my marriage certificate a total of five times now and I have yet to have a problem doing it this way. If you fly with your tickets in your married name (which I do not suggest, as the airlines and the security people may take issue with that), you will need to take a copy of your marriage certificate to show your change in name, not your marriage license.

If your card doesn't expire until August, and you're travelling in May, you will have no problems.

Lots (if not all) of people don't get their 10 year card before their 2 year card expires, that's why you receive an NOA1 that doubles as an extension letter. And many of us have had to get the I-551 stamp to extend the extension letter, since a year has passed since initially filing. For many of us, this part has not been a fast process.

I have travelled using my GC extension letter and didn't have a lick of trouble. In fact, the officer was visibly pleased that I was organized, familiar with the process and had all my paperwork in order. Guess I was lucky that day or something.

Being Canadian does not exempt us from scrutiny, nor does it mean that we get treated better or differently, even though we have a long history of good relations with the US. So I expect to get questioning when I go through the POE, and am pleasantly surprised when I don't.

My job in all this mess is to make sure I am educated about this process, and to take action when it is needed and warranted. I personally don't think a lawsuit will get the results I am looking for. I am looking into lobby groups dedicated to make change in this crazy process we are all in, because I think that is where my energy should be spent. Iansig, you feel that a lawsuit is in order, and that's up to you, it's your choice! Again, good luck and best wishes to you in that.

And was I cross and frustrated when I saw a group of us stuck at Texas while people transferred to California got their cards in quicktime? Heck yes I was. Am I frustrated on others' behalf (like our fellow VJe'rs in Nebraska) ?? Heck yes. But I'm not going to develop an ulcer over it! I refuse to let them have that kind of control over me!

This comes up a lot. smile.gif You may want to do a search in this forum of people's experiences with getting the I-551 stamp.

Make an INFOPASS and go to your district office with your card and extension letter ASAP, because you need the stamp regardless to extend the extension letter.

Focus on the overall picture, particularly financial evidence that 1) spans the entirety of your marriage and 2) shows that you have co-mingled your assets and liabilities. From what I have seen, 95% of all RFE's at this stage are related to insufficient financial evidence. I cannot deny that having a child together does "look good" for your case, but IMHO one should not assume that one will be approved solely because of the child and neglect to show "the rest of the picture".

From I-751 instructions:

"If you are filing this petition jointly with your spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires."


I have heard nothing from them yet so until they write to say re-file or it's accepted then we don't know. All I know is that their recorded message said that due to delays they wanted applications 6 months ahead.

I haven't come to this forum since I received my conditional green card 2 years ago.. Oh my God, this is insane! Getting my conditional was a crazy headache because USCIS kept saying for 1.5 yrs that they're waiting on me to reply to their RFE. Now, i have a question.. My conditional expires on the 8th. I sent EVERYTHING (I-751) out today EXPRESS MAIL (with signature) for next-day delivery.... What if the USCIS agent picks it up from the post office on the 9th, or what if the officer finally looks into my file a few days or weeks or years after the 8th of may?

I find this odd behaviour for someone that was delayed so much in getting PR. Why did you wait til last minute to submit? Not that it is too late, mind you.





It's not really odd behaviour, it's called slacking off. Bad move, really really bad move! Anyway, the reality of the immigration process is really starting to kick in now, very hard, and the same stressful emotions are back!


So i sent my documents yesterday, and today, it was almost delivered...Here's the message USPS site says: Status: Notice Left

"We attempted to deliver your item at 11:41 AM on May 7, 2008 in MESQUITE, TX 75185 and a notice was left. A second delivery attempt will be made. If unsuccessful, we will hold it for five business days and then it will be returned to the sender. Information, if available, is updated every evening. Please check again later."


I guess that was another bad move on our part. We never should have required the USCIS ppl to sign for it, bcz now i fear that they're going to feel lazy and not stand in line to pick up my letter, or perhaps they'll do it on purpose not to pick it up bcz they see it's EXPRESS mailed.



this is normal, you are not the only one to have gotten that message, they will pick it up and sign for it tomorrow. this is normal.

To be blunt, obviously what you sent them is not what they needed, or else you wouldn't have gotten an RFE.

For us to help you better, it would be helpful to be specific and tell us exactly what you sent, and what exactly they want. What you have told us so far is really general.

To the OP: I am in the camp that believes that an affidavit is a fair piece of evidence to include. I personally wouldn't worry that you only have one. Together with the rest of the evidence you have listed, it looks like a nice well-rounded package. smile.gif Best wishes to you as you submit it!

If someone from India needs a visa to travel to Canada, you will need a visa to travel to Canada, since you are travelling on an Indian passport and not one from the US.

If not, travelling to Canada with your passport from your home country will suffice.

You need your expired GC and the extension letter when you re-enter the US, and yes, the officers at the POE's in the airports are used to dealing with extension letters.
