K-1 Fiance(e) Visa Process & ProceduresWithdraw K1

Be aware that K-3 takes just as long as K-1 to process, so canceling the K-1 will set you back about a year, from what I read the Dominican Republic is one of the slowest embassies to process cases.

To cancel you will have to contact the embassy with the case number assigned by NVC, and request to withdraw the petition.

Yes, I am aware of the slow process in DR and that I will have to start everything from square 1. Thanks for the info. :)

Are ya REALLY sure you wanna do that? I am the biggest advocate of getting married if you are ready, but the wait is getting to be over 2 YEARS for an appointment.

From what everyone is saying,it all depends where you are getting the paper work done. Canada and a couple of the well wealthier countries arent as long of a wait. Canada, UK, Aus, Etc.. Good luck with your K-1 I hope everything turns out well for the both of you. Me and my fiance are getting everything done through K-1 as well.. I am from the United States and shes from Canada.

If you look real close, twincactus is dealing with the DR as well, so she is talking about DR specifically and not the K-1 process in general. DR is known for long wait times.

To the OP: best wishes to you in whatever decision you make, although I tend to side with those advising you to stay the K-1 course. :)

K-1 Fiance(e) Visa Process & ProceduresNOA2 -- does it say goes to NVC
It goes to NVC, who funnels it to the appropriate consulate.

K-1 Fiance(e) Visa Process & ProceduresTSC Texas service center

TSC doesn't process K-1 petitions. They recieve the K-1 petitions and then forward them to CSC (California Service Center). So check CSC's processing times. :)

Wow! That is crazy. Wonder Why they don't have me send to CSC directly. Sounds like a Gov thing

Because this has happened before, and then it reverted back to TSC, and then back to California. who knows, it may do it again.

K-1 Fiance(e) Visa Process & ProceduresConfusion on what to send/which & when after NOA2 to SO
Personally, we waited until we knew when my interview date was, and then Jerry sent me all the required documents and forms from his end, plus he copied them all for me so I didn't have to. :luv:

Actually in this case you would go to the State Dept website for the DS forms... but the ones on there are the most up to date...

Ah yes indeed zyggy, thanks for that reminder :)

Check the forms section on the USCIS website, they usually state which version (by date) of the forms in question are still valid. If your forms fall within the accepted dates, then it won't make one bit of difference at the interview.

K-1 Fiance(e) Visa Process & ProceduresThe hard part...
I worked a lot of overtime. :) And did a lot of stuff to distract me from thinking too much about the wait (hobbies, planning the wedding, packing/preparing for the move, etc etc).

(Best wishes for a short wait! :) )

K-1 Fiance(e) Visa Process & Proceduresone question plsss...
they say to wait about 2 weeks before contacting the NVC, it takes some time for the service centres to send approved petitions there.

K-1 Fiance(e) Visa Process & Proceduresquestion 18 on 1-129f
Some people answered in one or two sentences, some people used paragraphs, others --pages. Personally, I endorse a couple of succinct paragraphs indicating when/how/where you met, when you met in person, etc. with appropriate evidence to back up what you write. A Harlequin romance novel isn't necessary.

K-1 Fiance(e) Visa Process & ProceduresExactly how honest to be?
If you lie or creatively cover up what's going on, and they figure it out, you're in a heap more trouble. Not surehat to tell you.

K-1 Fiance(e) Visa Process & ProceduresNOA1 but no letter of receipt
also consider that there has been a national holiday in there, as well as crappy ice storm weather too. All adds up to delayed mail. I wouldn't sweat it too much, like others said, it's the NOA2 that's most importan, don't lose that sucker!

K-1 Fiance(e) Visa Process & ProceduresStressed out about this K-1 process

Hang in there. There may have been a delay with them sending it or with the mail since there were so many hoildays in that time frame.

that, and the ice storms in the region have wrecked havoc with deliveries of everything. Keep strong, peeps, you'll get things soon :)

K-1 Fiance(e) Visa Process & ProceduresAAAAArrrrrggghhhh

No, I know my petition was received on the 12th I sent it UPS.

It was received at NSC on the 12th... Takes a couple of days to get to CSC. So lets say the 15th. Then another 7/8 days for NOA1 in the mail... I would guess the 22nd or so...

my bet would be Feb 1st :)

K-1 Fiance(e) Visa Process & ProceduresHow many emails and Photos to be attached

Just on the subject of photos, I've been going out with my fiancee now for 3 years in march. The only proof I have of us meeting in the over the 2 years is photos during the summer and her 21st. Our first trip away together wasn't until the following summer which would only be a year a half ago. We've been abroad numerous times but all under the 2 year mark. I take it won't be worth submitting our passports with stamps? Are the photos going to be enough. I've e-mails but thats it. Kinda frustrating as I'm unsure and worried. I know we've met over 2 years ago and I've plenty of people who could swear to it but I've to convince the people reading my application!!

There are two questions that need to be answered when submitting the K-1 petition:

--have you met in person at least once in the last two years?
--can you prove it?

evaluate your documents and photos with that in mind. :)

K-1 Fiance(e) Visa Process & ProceduresHow many emails and Photos to be attached

As far as extra relationship evidence was concerned, I think we put in about 6 pictures, and a small selection of phone records. That's it.

We saved everything else for the interview.

What other documents do we need to keep gathering from now onwards for the interview process ? Any ideas would be helpful.

Thanks again.

I took everything that the checklist /forms asked for, as well as the following (dating from the beginning of our relationship up to the date of the visa interview):

--evidence of meeting in person during our relationship (4 meetings in total), such as tickets, photos, flight itineraries, etc etc
--evidence of engagement, such as ring receipt, "congratulations" cards and messages, etc
--evidence that we had met each other's families, and evidence that our parents had met each other (emails, photos, etc)
--phone records, evidence of gifts that Jerry had sent me, letters he had sent me, and a selection of emails

Wasn't asked to show a thing! After all that hard work of organizing! Oh well. :)

K-1 Fiance(e) Visa Process & ProceduresCSC, don’t you know how to mail a letter?

TELL ME ABOUT IT....I HAVE AN DEC 21ST NOA2 AND THE NVC STILL HAS NOT RECIEVED MY PETITION

4-6 weeks from CSC to the NVC is not unusual especially with the holidays. Just keep emailing/calling the NVC every week.

that, and the snow storms in Colorado and ice storms in the midwest have played havoc with the mail delivery times as well.

You can't be married before entering the USA, or you will have violated the terms of the fiance visa.

K-1 Fiance(e) Visa Process & ProceduresCeremonial wedding
They'll find out during the AOS process, when they ask for your proof of marriage.

I personally wouldn't risk it. However, I do humbly suggest having a civil wedding in the US, and when it is feasible, have the religious ceremony in Chile, when your fiance is allowed to travel/you have the finances to do so.

K-1 Fiance(e) Visa Process & ProceduresWhat does SO stand for?

ETA means 'edited to add.' It's a courtesy, in a forum, when you edit a post, to let people know what you changed, so they know you're not being dishonest or intentionally confusing.

oh right, quite forgot about that one, good catch :)

K-1 Fiance(e) Visa Process & ProceduresFiancee - technically when from USCIS perspective?
from the USCIS website:

What Is a “Fiancé(e)”?

A fiancé(e) is a person who is engaged or contracted to be married. The marriage must be legally possible according to laws of the state in the United States where the marriage will take place.

In general, the two people must have met in person within the past two years. The Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) grants some exceptions to this requirement. For example, it may be contrary in some traditions for a man and woman to meet before marriage.

Sometimes the USCIS considers a person a "fiancé(e)" even though a marriage contract has been concluded. In such cases, the American citizen petitioner and his/her spouse have not met, and they have not consummated the marriage.

K-1 Fiance(e) Visa Process & ProceduresPassport Photo Specifications
Seeing as the State department are the ones that are actually issuing the visas, and the size of the picture on the visa is 2x2, I'd go with 2x2. It was a pain in the butt for me as well to get them done, since Canadian size and dimension specifications are different, but I sucked it up and did it.

K-1 Fiance(e) Visa Process & ProceduresWhen can fiance visit his country?

so once he gets his greencard, he can leave the U.S.?

Yes, but as I and the others have stated here, he can apply for the Advanced Parole documents which provide him the opportunity to leave the US and come back while going through the process of applying/waiting for the green card.

K-1 Fiance(e) Visa Process & ProceduresWhen can fiance visit his country?

Hi, I am hoping our visa will be approved and my fiance will be here this year. I'm worried though, because his parents are both old and sick, so I was wondering, if he came here after the fiance visa is approved, could he return home if they got really sick or if one of them died? I would hate to have to re-do the entire visa process if he had to leave, but we would have no choice if anything happened. Please let me know.

Thanks,
Sara

If he leaves the US before your marriage, or after your marriage and before him receiving his AP papers, then yes, you will have to start over, because he will not be allowed back into the US.

K-1 Fiance(e) Visa Process & ProceduresFirst Come First Served
I would recommend checking out the first thread started by HUSKERKIEV, a former adjudicator at Nebraska Service Centre. He describes the process very well of how petitions are processed, and how the boxes of files, which are in order, can get out of order a bit. Personally, I found it very interesting.

K-1 Fiance(e) Visa Process & ProceduresAre there any REAL people working for USCIS?

Doll, you can still have the wedding in Aug/Sept if you are VERY flexible. Paul and I dont want to do the courthouse and then a ceremony so we are going to have a real wedding soon after he gets here. Look around at places and talk with all the vendors and explain your situation. I have found many are very understanding. We are going to do it on a Thursday, so no where is booked. I need to give them 2 weeks notice at the hall is all! Look for somewhere that is already nicely decorated so the florist wont have much to do on short notice. Thursday is great as well because you get lots of discounts (50% on my DJ!) So for us, Paul gets his visa, I call all the vendors with an actual date, he gets here and we get married! Just depends on what you want for the wedding but its another option. Just dont pay for any specific dates until he has the visa (or an interview date at the very least). Good luck and check out the timelines, great info for how long each step takes!!!

This is great advice, exactly what I personally would have written down as well. We did the exact same thing -- get all our ducks in a row (so to speak), so when we had more definite information all we did was call our people up and say ok, let's roll with this date. We ended up on a Sunday, which worked out well for us. Between that and doing a lot of things ourselves (reducing the amount of vendors we would have had to deal with), we had the wedding we wanted DESPITE immigration! ;) It can be done. :)

One of the things you're going to have to understand quick is that you won't get any type of visa in a month. I don't mean that to be rude, you just need to understand that this is not a fast process at all.
