K-1 Fiance(e) Visa Case Filing and Progress Reportsgetting harder everyday
QUOTE (ZeeNusah @ Apr 9 2008, 01:08 PM) <{POST_SNAPBACK}>
(5) I found something to do to take my mind off the process. I started reading more, going out for drives...anything to get me away from the computer. I started taking detours home from work so that by the time I got home it was dinner and then bed...no time to check on an approval.

This is great advice. The more you dwell on the process, the more you suffer. Dwell on the future, and not on the present. It's hard, but it will make you feel better in the long run.

You can't apply for your EAD before applying for AOS, you either apply for both together at the same time, or EAD after applying for AOS.

Yes you can... you would file under A(6) instead of C(9).

true, but seeing as a lot of people get that confused (a(6) is not the option for someone coming in on K-1, right?), I chose not to go down that road.

i'm curious... and maybe planning a little too far ahead... tongue.gif

if i'll be getting married in the first 2 weeks i'm in the US, how will this effect the SSN application process? is it simply a matter of taking my marriage certificate with all the other paperwork and my visa when i apply?

thanks biggrin.gif

I got married 6 days after entering the US. Went and applied for my SSN a month later. Got my card 8 days after that. And yes, you need to take your copy of the marriage certificate, along with your passport.

You can't apply for your EAD before applying for AOS, you either apply for both together at the same time, or EAD after applying for AOS.

K-1 Fiance(e) Visa Case Filing and Progress ReportsGetting married after K-1 approval...
If you are stressed out about wedding stuff, remember:

--you have 6 months to activate the visa
--you can do as others have suggested and do the civil wedding first, big frou-frou wedding later
--you can start planning now! smile.gif

What Jerry and I did was make all the decisions ahead of time and have everything set to go, so once we had a good idea of when we could have our wedding, we just set things in motion. Oh, and we did something then (which we could kind of get away with then) that I wouldn't reccommend doing now -- we set the wedding date before I had my visa in hand. whistling.gif And we scaled way back on what we wanted our wedding to be like -- instead of having tons of people and worrying about catering and all that kind of stuff, we focused on having a special intimate wedding at an amazing location with a few family and friends on that day, and we had a couple big parties for everyone else later. It was wonderful.

Based on my experience, these are my two biggest pieces of advice:

--go to your wedding vendors ahead of time and explain the situation you are in, and see how flexible they can be. Our wedding/reception site and the that da photographer/videography team were fantastic and were willing to work with us in case of delay and such, within limits. Because we were willing to be married on an "off day", this helped even more.

--cut out as many middle men (ie. wedding vendors) as you can, and do as much of the wedding yourself as you can. That way you have less people and deposits to worry about if something happens while your visa is processing.

Our wedding may not have been at the spot I always imagined it, but it turned out to be perfect and exactly what we wanted it to be. smile.gif

K-1 Fiance(e) Visa Case Filing and Progress ReportsWedding-planning blues
QUOTE (darbyoshea @ May 4 2008, 05:21 PM) <{POST_SNAPBACK}>
My fiance and I have decided to go the 2-ceremony route... him getting here ASAP and us having a courthouse affair, then three months later getting married in a church with family and all that. We can't have the big wedding earlier because of difficulty getting vacation time, etc. but I'm totally down about having the wedding be anti-climactic. Any tips on dealing with that? *le sigh*

The wedding is anti-climactic only if you choose to let it be anti-climactic, frankly. Make a conscious choice to see the big church affair as what it truly is -- a celebration of your love together, a celebration of starting a new life together as a married couple, surrounded by lots of people who love you and want to see you have nothing but the best! Oh, and you get to wear the fabulous dress! smile.gif

I worked a lot of overtime.

I focused on other things, like planning for my wedding, organizing my stuff to eventually be shipped to the US, spending time with my family, etc etc.

Distracting myself helped a lot in keeping me focusing on things out of my control!

I'd send a complete copy of his passport and not the passport itself, but that's just me.

I'd also beef up the proof that he actually saw you on his trips to the UK. All the passport stamps and boarding passes show is that he made trips to the UK.

Best of luck with the process!

Just be glad your not filing for a K3 or a CR-1 in VSC. Talk about limbo then. VSC has left the family filers in hell, while records are being set with K1 filers in VSC.

I think being already being married adds more stress to the situation. And certainly, there are a fair number of Dec., Jan. and Feb K-1 filers who are still waiting for NOA2's.

But I could not believe the numbers for VJ K-3 filers at VSC. Only 1 out of 37 February filers has received a NOA2 notice, and O notices for March filers.

Hopefully, that will all turn around soon. Keep the faith and bask in the warmth of having already met and married your SO.

Brian

Thank you for your kind words Brian, its so difficult just seeing Jan. filers of K1 who filed after me already have a visa in hand in May. VSC has left the K3 filers behind, and now rumors of VSC transferring K3 and CR-1 petitions to CSC for processing. That is scarry, possibilty of lost or incomplete petitions. And on 2nd note, yes, Im glad I have met and already married the man who I plan on spending the rest of my life with, just would be nice to be in same country and under same roof.
Take care and thank you.

They have been transferring I-751s all over the place (TSC to CSC, TSC to VSC, NSC to CSC) and I don't think anyone has gotten lost yet.

Removing Conditions on Residency General DiscussionWaiver for Lost Green Card

I am wondering if anyone has filed a Waiver for a Lost Green Card.

My son's GC has been lost in the mail for over a year now and he does not have the funds to pay for another card. Has anyone ever filed the Waiver and if so do you have an example letter?

We have contacted our Congress and USCIS will not take responibilty for sending his card to the wrong address. They are suggesting he send in the paperwork for the Waiver. (Oh how I am so sick of this #######). He cant not work with no GC, can not renew his Driver's License and it's really becoming a problem. I dont have the money or I would get it for him. I already paid for both when we Adjusted our Status. My card was lost for 8 months but I was lucky to find it at my old address. The people living there had opened it and I am sure they have my son's as well but say they dont.

Anyways, if anyone has any information they could share with me I would really appreciate it.

Thanks

I'm glad I found this topic because I am in the same situation. I am in Texas right now with an expired Nevada license. I tried to renew/reapply for a DL when I got here but they wouldn't not accept the NOA I received nor the biometrics letter, leaving me unable to drive. I was wondering, if I get an infopass appointment and I get the stamp, will they accept that (question to anyone who might know). Their list of accepted documents include "Resident Alien Card (I-551)" but I am not sure if they will honor a stamp on my foreign passport (after all, it's not a CARD). It would be really great if I can resolve this soon because Houston doesn't have the best public transport system. DMV frustrates me so much ranting33va.gif

Anyway, any info would be great!

Hi, me and my daughter just renewed our license at the Nevada DMV. It went like a breeze! My daughter didn't even have a formal NOA since she was under my I-751, they only sent her a plain paper letter saying that her green card is extended for a year and it wasn't even signed! Since you have a Nevada license, maybe it would be simpler to take a trip to Vegas and renew it there.

My son never received any letter. I just received the NOA for our joint petition.

I called the Vermont center and the man told me that only one petition goes out on a joint form. I am going to get his passport stamped when we go for bio's.

Thats just crazy.

All states should take the NOA or stamp.

If your card is to expire in May. How do they extend when you show them your card is to expire. I am going to have this problem as well.

My Green Card expires in May and so does my lisence. So if I go early to renew them they are only going to renew them until my card expires. Is that right?
