Hmmm. I'm not that knowledgeable and could be wrong, but, since he was in the US from the age of 10 till 26, that is more than enough time to become a naturalized US Citizen, so why was he deported again? Did they really revoke his citizenship on grounds of the crime he committed or did he just not become a naturalized citizen?


I believe that you have to be either 18 or 21 before you can apply for naturalisation. I'm not sure why he never did it before - I think it maybe never occured to him. I think his parents did theirs, and a lot of immigrant children assume that they also received naturalisation with their parents which isn't always the case. I have asked that much - I only know as much as I put above.

Hey guys!!

I'm writing this on behalf of a friend who needs some advice (I told her to sign up to VJ and post it, but she's asked me to do it for her).

She is American born and currently lives in Florida. Her (now) husband is from England, but his family moved to the US when he was 10, and he's now 26. Before they were together, when he turned 16 he was arrested and charged for DUI and possession of cannabis. Fast forward a few years - they both get together and have a son and then got engaged. Last year, I believe he applied for US citizenship and ended up being deported back to the UK in April after being detained for 2 months because of the crime he committed at the age of 16 - his fiancee and their son stayed in the US.

After he was deported, his fiancee came to England with their son for abour 4 months, and they ended up getting married before she returned back to the US with their son. Now he wants to move back to the US, where he was raised from age 10, to be with his wife and son, all of his family are in the US also - he just has one grandparent in the UK.

I believe they're currently trying to go through the process of the hardship waiver to have his deportation lifted, but they don't really know how reliable the outcome is, or what they need to be doing? She doesn't want to move to the UK because that means leaving all of her family behind too, and because economically it's so tough in the UK right now. Not to mention the unemployment rate is really high!

Does anyone have any advice I can pass on?

I'm not sure if this has been covered because I haven't read all the comments (I know, I'm really lazy lol!), but I noticed that people have only paid around £160 (depending on vaccinations). Is that including the x-ray? Because when I searched online with Knightsbridge it said you had to pay extra for the x-ray - around £362 in total!

United KingdomInterview dilemma :(

I'm so confused and upset, I just had to share it;
Packet 4 through the post this morning, 9th August! Over the moon since I have a wedding ceremony planned for August 22nd. I called and paid the fee, and the guy on the phone said it can take 7-10 working days to get the visa and passport back...

Well, 10 working days is August 23rd...
So I couldn't even travel to the US and have my ceremony, come back get the visa, and then get married officially after re-entering later, cause I won't have my passport! After spending 20 minutes on hold, the man on the phone told me I had to email and try and re-arrange the date for either before the 9th or after the 22nd.

Gutting, I thought this would finally be over. :(
I've sent the e-mail, so I guess I just have to wait and see now. :( :blink:

I would like some help and education here. 
I filed for a K-1 visa for my fiancée in Ghana on the 17th of January this year 2012 and I haven't heard from them. I called a month ago and I told they are now working on applications dated 16th January. 

I keep checking my status and it's still on  initial review. 
Can anyone help or advice me on what to do since it's taking long. Nearly 7mths now. Wow!!!

So judging from people's NOA2 dates from Vermont, it appears that they are almost a month behind the 5-month approval average! Unlike California who seems to be 2 or 3 months ahead of theirs...lol! My latest estimated approval date is almost a whole month later than the average 5-month timescale that Vermont have!

I think it gets harder to be patient for the NOA2 the closer to the estimated approval date you get! Lol!

I've had a US visa before - I had a B-1 visa when I lived in Texas for a year as a missionary, and that drove me crazy!! It was such a pain in the bum to get the visa!! I applied 4 times round and the visa they finally issued me with was the one I applied for the first time. Luckily I was never denied, but it kept getting postponed pending futher information, and the officer kept telling me that I needed a different visa each time I saw him!

Wow...my fiancee just got the NOA1 for our application - I can't believe how fast it came through!! They received it and opened it on Sunday afternoon! I didn't think that government bodies worked on a Sunday, because they sure don't in the UK! How long does it usually take them to process the I-129F so that we receive the NOA2?

Thanks guys!! I'm happy waiting to get married until the visa application has been completely processed and approved. She suggested it last night when she called me, because she thought it might help them speed up the process. I had a feeling it would void our current application, but I just wanted my thoughts confirming.

And that's okay, I have sufficient proof that I will return :) All my family is in the UK, and I have a job too at IKEA.

Hey guys!

I'm pretty new to this site, but I have some experience in non-immigrant visas to the US, but I'm currently going through the K-1 visa process so that I can go to the US and marry my fiance - and it's all new to me!

My fiancee has sent off the petition I-129F on my behalf (along with the G-325A from each of us, and all the other required info), and we're just awaiting receipt (and hopefully approval) of the form. I'm wondering, am I still allowed to travel (for 2 weeks) to the US to visit her while my petition is being assessed by the USCIS, or before I have my interview at the US Embassy in London? I want to go over and propose "properly" and give her the engagement ring - although she has no idea that I'm planning to "officially" propose yet.

Also, she wants to go to the court house and just get the marriage licence while I'm visiting, but I have a feeling that would have a negative effect on the visa application and we'd have to start the process all over again for a different visa. Am I right in thinking that, or would it possibly be a positive push for the visa application?

So I've been looking at peoples timelines and noticed many of them have received the visa within only 5 months!? Does this really happen often? Thought it would be longer.


I thought that too!! But I think it's just the time from the NOA1 to the NOA2 usually. Once the NOA2 has been issued, apparently it tends to move a lot faster then! I think from start to finish it seems to only take around 8 months give or take a few (and assuming there are no RFEs)

Yeah I've noticed that!! When I travelled from the US in to Canada, they stamped my passport! But not when I came across from Canada to the US! I just figured it was because i'm British! haha!

I can't say for sure, but I believe that you will just receive an RFE requesting more information. Unless there are a lot of errors in the application you sent off. I don't think they would deny the application based on that alone, in which case you shouldn't have to pay another $340 to start again. However if you do get an RFE then it will delay your application a little until whenever you are able to submit the information that they require.

If I'm wrong on this, please correct me! :)

In my G-325A Form, i answered NONE in other names used. however when i read the US Embassy (Philippines) website, it says the NBI clearance should be in the applicants birth certificate name and any aliases or NICKNAMES used.. also, in form DS156 item 9 asks for other first and middle names used. my birth certificate name is evangeline doe. my first name in all my records is evangeline. i have never used jane in any document, but my nickname, the name friends and family call me is jane and my email address is janedoe@xxx.com. should i add jane to my first names used in form DS156 then secure an NBI clearance with the name janedoe as my alias? if i do this, is there any negative effect in adding a first name in DS156 that i did not add in Form G325A? good day, everyone!


Hindi po - Use your legal name na lang...unless you have used the name "Jane Doe" on any other legal forms or changed ka with a legal change of name form, kasi "Jane Doe" isn't ang legal pangalan mo :)

I wouldn't put nicknames on those forms lol. They mean if you have changed your name before in the future (like me) so I listed my previous names


I legally changed my name too, so I also had to put my previous legal name and I submitted the change of name documents to the USCIS too with the I-129F peition that my fiancee sent in. I don't think they needed it with the petition, but I had her send it any way just in case!

It all depends. At the minute, Vermont seems to be falling behind a little on approvals. It all depends on the service center that is processing the application. I believe they are all processed in order of when they are received within each department within the service center that they reach. I've found people on here that sent in their I-129Fs almost a month after me, and have already received their NOA2!! Unfortunately, all we can do is wait and be patient :( There's nothing we can do to get them to hurry up

I made my fiance call USCIS today. They told her to mail in a letter explaining why the previous marriage was not declared on the I-129F, and copies of the paperwork for the current annulment process. They will then call her to verify the information that she mailed is correct, and rectify the application. They said that we called at the right time to make any changes that needed to be made, because if we had waited until receiving the NOA2 and then declared the annulment at the visa interview, then we would have major problems because the annulment wasn't finalised before the I-129F was filed. So they have mailed in the information that USCIS has requested, and it looks like they may just be treating it the same way they would an RFE. I guess we were very lucky with this! I'm not holding my breath until they send the NOA2 though, now the information they requested has been sent! If it doesn't work out, then we have decided that she will move to the UK instead, and then we'll work it out from there once we're married :)

She didn't know at the time of application that the annulment wasn't finalised yet - she thought her former spouse had sorted it out. It turns out that he hadn't and we didn't know until after the I-129F was submitted, so she was under the impression that she was free and legal to marry. Ahh I guess it's bad news then! Ok I'm gonna have to break the bad news to her then I think -_- but it's better than having to face it further down the line and have it hanging over us! I might just bring her to the UK and then start the process again as a married couple.

I haven't had the interview yet, I'm just trying to prepare myself whilst I'm waiting for the NOA2. And I know the annulment doesn't have to be declared on the I-129F (it only asks if single, married, divorced, or widowed anyway), but I wasn't sure if that also meant it didn't need to be declared at the visa interview either.

I have a quick question. My fiance has previously been married but is currently waiting for her annulment papers to come through, and so we didn't declare it on the I-129F (because legally you don't have to declare an annulment). I've noticed that a lot of people have been asked at the interview stage if they know whether their fiance has been previously married, and if so, why it ended. What should I say at this point? Do I have to tell them she was previously married, but the marriage was annulled? Or do I not mention it because legally it no longer has to be declared because the marriage became null and void? If I do mention it, would it delay the application because it wasn't previously declared on the I-129F?

Yep, £200 for the medical, $100 for the K1 visa, and standard delivery of the passport with visa is (according to the courier's website) £14. Standard delivery does not guarantee you when the passport will arrive on the day. To specify a certain time, it's £5 for before noon, £10 before 10am and £20 before 8am. We did the most expensive, and they were on the doorstep at 7.15am!


Thanks so much for that - it's less than I had thought. I just love this exchange rate (while I'm still on English money, that is!).

I know there will be about £200 for the medical, but what about interview fee, processing fee and issuance fee?

I am confused. I have sent Packet 3 to the US Embassy in London. From other timelines, I see that Packet 4 is usually received 2 to 3 weeks after Packet 3 has been sent. However, the "Embassy Information" page says the wait is between 10 and 12 WEEKS! Which is correct please? I am so worried because I have been waiting 3 weeks for Packet 4 and don't know whether I should contact the Embassy or not to find out what's going on.

Could other London Embassy people tell me how long they waited between sending Packet 3 and receiving Packet 4?

I will ring them again, but can't see that they will take any more notice of me than they did before. They just told me to email, which I did. I dare not email again, as you know what they're like if you email them more than once about the same topic.
