I called them today and they told me that Casablanca has requested all files to stay at NVC for now until they are not so busy. I asked the woman if that was normal and how long do they usually request for them to stay there and she said "I don't know...a month or two"......I am thinking she doesn't know....that is the first thing she said. anyways..you can always go to their site for more info..www.cbp.gov. or google search. chances are you can find a bunch of ppl on this very site who have experience the same thing.

maybe mine was a worst case scenario..who knows..but it was on my bday..the day i will remember as it was the day i was forced to be separated from my love until i see him again when i get my visa.

I think your fine and dont need a waiver. You just refile.
Read it slowly.

If you HAVE filed two or more.
That means in the past I believe.
You need to get a waiver. From the sound of things, this is your second visa petition. From what I understand, that means your third attempt at this needs a waiver.

No, dont just wait. Do something. It is past the deadline of 5 months and that means two things.
On USCIS website they have a, "what to do if outside the posted processing times section."

AND you need to have contacted a congress person or senators office to have them look into your case.


Two days after my senator called. I was approved.

Well first of all, if they are telling you that you overstayed. Then you probably did. Now we are going through the K1 process and my fiancee stayed a tab bit longer than she should have. Homeland security found her and told her to leave. When we applied for the k1 visa I asked my lawyer the same question as you. The simple answer was, my fiancee overstayed by 120 some odd days. The definition of an overstay is somewhere around 160. Find out from USCIS what dates they are considering your overstay. If its more than 160....then you are out of luck and will not be able to enter the US for a period of 10 years.

Sorry to be the bearer of bad news, but you NEED to know those dates ASAP.

Well......I'm young, I didn't want to get married yet. Plus homeland security came, as I said before, and made her leave.
When it came down to it, I told her that I needed some time to start my career and get settled. So, after she was gone for a bit,
I realized that she WAS the one I wanted. So I flew over, proposed, and we did the K1 thing.

I had no idea which one to do. I hadn't found visa journey until after we decided to go the K1 route.

We didnt know which process to do. We struggled on deciding. Based on my research, it seemed best, and the quickest route to do the K1 process. Plus, the DHS agent and the immigration agent both told us that in the end if the government allowed her to leave on her own accord it wouldn't matter. She could come back. But now, after reviewing all the evidence and the consulate forms asking if she has ever violated the terms of a visa, she has to check yes. The consulate in Casablanca will make up there mind even before the interview. We are freaking out here.

The clock starts ticking immediately after the grace period, however you say they "extended her legal stay" and if that is the case she had no overstay. 180 days overstay seems to be the "do not pass" line.

That said...Casa Blanca is a sitckler and loves to deny people. Good luck

Sounds like no. Depotation is a legal procedure involving a court and a deportation order, there is no question what is and what is not a "deportation" and this sound like it not.



So even if the consulate views it differently, then the overstay starts after the grace period. Thats even better for us cause that only means she overstayed by about 60 some odd days.

No....

See that's the thing, we have been in contact with the guy that originally arrested her ever since. He seems to think that we wont have a problem at all.
However, nothing was stamped in her passport, but she was given a piece of paper in a sealed envelope that she gave an immigration officer when she left.

The guy at DHS has been a godsend. We have talked with him ever since, and he always responds to us the next day with any questions.
We asked him about form DS 156 and there are two questions she has to answer yes on.

1. Have you been arrested.
2. Have you ever violated the terms of a visa.

The consulate in Casa scares the living daylights out of me, and it seems they make up their mind before the beneficiary even gets to speak.
So we are SOOOO nervous about them looking at those two questions and being like.....ooOOOPPPsssidaisy.

It sounds to me like she could be testing him. Just call everyday, email everyday and do not stop. Casa only has phone hours from 3 to 4 pm their time so keep that in mind when you call.
Even then, they rarely answer. I email them constantly and they reply very quickly. Then again I have had a senator contact them multiple times. Also, do as stated above, call the State Department and ask what is going on with your case.

It seems to me however, that they did not exactly deny him because they would give him a piece of paper stating so.
Hang in there, and I know its impossible, but just try to relax a little until you get some news.
Remember, this is their job. It is their job to be rough and flush out the frauds.
So just be persistent and I'm sure they will see that you evidence is looked at and you case is considered appropriately.
Until then, EMAIL EVERYDAY!!!

Congrats on your NOA2, things should move quickly now.

You should look at posting in your appropriate forum. Under the K1 visa processing, there should be a MARCH FILERS group that is for the Vermont Service Center.

Send an email? No? Not reliable enough? Have her go there? Well that doesn't work either. They don't let you in as a non-citizen. You see, there is a reason I contact everyone in the beginning.

I spent a couple of days before I got everyone involved calling every 5 minutes during their phone hours, which let me remind is only one. SO....the only real way to contact them,
is through email. If you do not start at the top with Casablanca they will just ignore you completely. So, all we tried to do was compromise between work and the consulate by starting a dialogue between us and them. It was just disappointing that's all.
