K-1 Fiance(e) Visa Process & ProceduresMedical exam and interview on the same weekend?
We're going through Montreal, and the money is a concern for us as well. So once we get our interview date we are going to book our medical three or four days before it. Hopefully we get it in time for the interview and if not, well I will have to get them to forward it to the consulate. It will delay us some if we don't get it in time. Hopefully all goes well.

QUOTE (Anna_Sofia @ Apr 15 2009, 09:36 PM) <{POST_SNAPBACK}>
Any final verdict? And what is vwp? I am going to have a summer job here, I'll be graduating in May, and then I work this summer until September. We just didn't want to be apart from eachother for the entire process because it would be so long. If it is up to the attitude of a POE(some kind of passport officer?) then I don't think i'll risk it. If it is legal and okay and there is a method to go about it I would like to know smile.gif

Thanks again everyone, it's really helpful to have input on these matters

I do believe Sweden in under the VWP (visa waiver program). Google Sweden Visa Waiver Program and you should get the info you need. You can read on here from numerous people that got through and some that didn't. If you tell the truth, answer their questions, bring proof of ties to your home country,it is still up to the officer at the POE whether to let you in or not. When I went through the first time, I was just asked reason for the trip, I replied on "on holidays and going to visit". I didn't lie, I was on holidays and I was going visiting. The second time I got asked a few more in depth questions, but still once I showed some "proof" he was satisfied and let me in. In Canada alot of the airports you have to clear US Customs before you even step foot off Canadian soil, which is a great benefit to having travelled all the way there and then get turned away. Good luck with whatever you decided.

I visited while we are in the process of our K-1 without problems. I just brought lots of evidence to show ties to my home country, such as a letter from my employer saying I was on two weeks vacation and is expected back, copy of my property deeds, bank loan for my car etc. I didn't have any difficulties. It's up to the officer at the POE whether to allow you in or not. Good luck!!

Maybe it is different because you are from Canada, a friendly neighbor, but my immigration attorney informed me that it is illegal to process 2 visas at the same time. She has clients that have been banned because they didn't listen to her. It is NOT worth the risk.

Well if a person is going to lie to try and get in then yes, they should be banned. Tell the truth, show ties, and hopefully the POE will allow entry.

QUOTE (Kathryn41 @ Feb 22 2009, 11:28 AM) <{POST_SNAPBACK}>
You should be fine visiting as long as you are prepared each and every time you cross the border to prove you still have strong ties to Canada. Put together an up to date package before each trip that contains things like a letter from your employment showing you are employed and expected back to work on such and such a date; copy of lease or mortgage or a letter from your landlord verifying you have ongoing agreements to rent such and such an address; copies of utility bills, insurance bills, car insurance and ownership papers; loan agreements, anything that shows you have financial and material interests that are best served by remaining in Canada. Include a copy of the I-129f petition and the K-1 application as well to show your intent is to do everything 'by the book'.

I travelled to the US while my K-1 was pending a number of times and was pulled into secondary inspection twice. In both cases they went through my file (and my purse, hehehehe) and then when they saw the K-1 application, closed up the file, handed it back to me and said I was fine.

You can travel as long as you are prepared to prove you have no immigrant intentions on that particular visit. It will still be up to the POE officer but it can be done. Good luck.

I did the same, had lots of proof to show them and didn't have any problems at all. good.gif

Your fiancee has not been issued a visa. The petition has simply been approved. Her visa will not be issued until after the interview. As long as she has proper documentation that will show strong ties to Canada then she should be able to cross the border to pick you up.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresNeed some advice: Canada to U.S. or vice versa
I agree with Huggles...as long as you honest about your intentions and nothing in your past that would cause problems then hopefully you won't have any problems in whichever country you decide on. Why not check into the job prospects for him in the area where you would be living in Canada. See what the wages compare like, and if its a career that he won't have too much difficulty finding employment in I think it would help you both to make the decision. I know I am not crazy about leaving Canada, but I am fortunate enough to have a honey who has agreed that we can move back to Canada if after a few years I can't find employment that I am happy with and/or just am not happy overall. The healthcare in Canada alone is enough reason to stay as far as I am concerned. An illness in the states can cripple you financially if your not covered. We are both close to our families so it would be difficult no matter which way we went. But for now, he makes more money then I do, he's more fiancially secure where he's at, I literally hate my job, really don't know a whole lot of people where I am, so we decided I would make the move.

And yes Huggles, I agree, you won't find too many people on here that have a whole lotta praise for immigration lawyers!

Good luck in whatever decision you make.

K-1 Fiance(e) Visa Process & ProceduresHow much does the whole K-1 Visa process cost?
Welcome to VJ! I don't think anyone on here can give you an exact total of what it would costs, as there are a lot of "little" things. For me and my honey, we just got our K1 Visa and to-date we have spent close to $2500. But there is alot that makes up that total from the initial filing fee, postage, fees for letter from the bank, hotel while awaiting interview, gas to get to the interview, meals while away, medical cost, visa fee, and on and on. Hopefully someone that is familiar with your benficiary's country can give you a better idea of what it cost them.

As far as attending the interview, again, will depend. Each has their own set of rules in regards to this. I only noticed by reading other posts.

Pictures, we only had two of us together.

Passport Photo's the benificary needs more then the petitioner, read the guides at the top. I can't remember off hand. The petitioner only needs them for the initial filing, but the benificary needs them for the initial, medical and interview. Again, this may vary due to the benificary's country.

If the petitioner makes enough money for the affid.of support and you don't need your family or friends then how they feel about your marriage really has no bearing on your petition. Its about the two of you. And if you do need a co-sponsor you'll just have to find one that is willing to help you two be together.

Hopefully someone else will come along and give you some more answers. Take care.

K-1 Fiance(e) Visa Process & ProceduresNeed advices for Canadian girl wanting to marry and live with my American boyfriend in USA!
I live in Nova Scotia, and my honey lives in Wisconsin. We went with the K-1 Visa with no regrets. We applied last September and had my visa in hand in April. I am still in Canada, moving in August. We have three months once I arrive that we need to be married in. The only downside being I can't work till after we are married. Actually he's ok with that, I am the one that's not. He thinks I will need the time to get settled in, decorate the house, meet people and all that stuff! There is alot of info on this website, I had to make a cup of tea and sat and read for hours. Most people are really helpful! Good luck which ever route you both decide to go.

Hello,

I am so very happy that my fiance and I found this website. I'm wondering if someone might have an answer to my question as I have found conflicting reports on the internet. My question is this... I live in Canada. Can I visit my fiance in the U.S. while the K1 visa is being processed? I have heard that I would be allowed into the U.S., but I would have issues returning back to Canada.

Thanks so much for any help that you can give me.

Hi there, I am from Nova Scotia, Canada and my honey is from Wisconsin. I visited him while in the process. You need to show ties to Canada. I had a copy of my property deeds, a letter from my employer saying I was on authorized leave and expected back, etc. I didn't have any major issues. Answer the questions they ask at the border, don't lie, but I didn't elobarate either. But remember in the end its up to the officer at the POE whether to let you in or not. Good luck.

K-1 Fiance(e) Visa Process & Proceduresunemployed fiance?
If he's quitting his job, if it were me, I would wait. You don't know how long its going to be before the move can take place. He could be months. If he quits closer to his move date he can file for his Canadian EI after he moves. I know from experience from a friend, who appeal and appealed and still didn't get her unemployment. She quit a couple months before. Tried to open up the claim up there, and they response was that it was two soon before the move. The whole process isn't cheap and he might want to hang on to the job a little longer. If cash isn't a problem well then he should be fine. A fellow VJer who was at the interview same day I was got questioned as to why she wasn't employed, but its the petitioner who has to show the ability to support. Your vehicle has to be imported into the US, he'll have to contact the manufacturer to get his letter that states it meets all safety and US emmission control standards for the year it was built. I got mine from GM and it cost me almost $80 bucks and about a week or so to come in the mail. I didn't realize that I didn't have to import it at the time of crossing, the border patrol officer said I could do it when I went to do the transfer and liscensing but since I already had everything I did it then. Best of luck.

K-1 Fiance(e) Visa Process & ProceduresApplying for K-1 Visa. What forms start to finish will I need?
QUOTE (lynnesigouin @ Oct 13 2009, 05:01 PM) <{POST_SNAPBACK}>
Hi, I am going to apply for the K-1 Fiancee Visa. I am trying to determin all of the forms and costs that will be required from start to finish. I checked the search field as well as the guides, however I have a feeling something is still missing? I have the following

I-129F Petition to be filled out & mailed in by my US citizen finacee. Cost for I-129F is $455.00
G-325A one form to be filled out by each my finacee and myself - No cost for G-325A form

Once the I-129F petition has been approved an appt is set up for me to attend the US Consular office for a meeting. I will bring the I-129F approved form along with the I-134 affidavit of Support form? Cost for I-134 ?? Is there one?

Do I need to fill out the DS-3025 for recent medical exam? Is there a cost for this? Or is there a cost to file this form?

How about the AOS. Once I enter the US and we marry, I will then apply to adjust my status correct? What form will I require and what is the cost? Do I need to fill out any forms for wanting to legally work? What form is required and what is the cost?

Sorry for the questions. I am hoping someone can assist me as this is a little confusing to me. I would like to print off all of the forms at one time so I am aware what is required. I can then sit down and fill them out one by one. Even if I get some filled out in advance, I would just prefer to be pre-pairded then waiting. Thanks in advance.\

Hi there, Well I know everyone is going to have a different figure but we have spent $3000 so far. Now please keep in mind that we tracked everything from postage, to gas to do the errands to get everything done, the initial filing, the medical, trip to Montreal, meals, visa fee, hotel, bank fee for the Aff. of Support financial info, and the travelling to get moved here. I still haven't moved my stuff yet though so we still have to factor that in. Once we are married I will need to do AOS for $1010.00. Oh and cost of passport photos too! Good luck on your journey.

K-1 Fiance(e) Visa Process & ProceduresK1 interview date
According to your timeline you just got your NOA2, I wouldn't panic about getting a November interview...your probably looking more towards January. If something amazing happens and you get a November interview, you can reschedule it if your not willing to give up your vacation. Mine was April and we thought we would have to reshedule due to work commitments and were told it would get moved to the next months interview dates. We work around it and took the April. Remember once you get your visa its valid for 6 months. I would not recommend to anyone to book anything as far as a wedding goes to you have your visa in hand. You just never know what could happen and you don't want to lose deposits and money that you've invested. But its a little late for you guys since you already did..I will keep my fingers crossed for you that things work out for you both. Take care and good luck!

I agree with everyone else. You need to address the first denial. Second application will only end up most likely being the same. They are going to see that you had already applied and then look at the denial. Make another trip over if you can, meet everyone, take lots of pictures. Its an expensive venture no doubt but I think it will help big time in the long run. I wish you both all the best.

K-1 Fiance(e) Visa Process & ProceduresWhat is the toatal cost from start to finish for alien to marry an american and live in america

My husband and I probably spent close to $5,000.00 for the entire process (including travel costs, etc.) up until now... Our next step is the ten-year green card I believe, so it shouldn't be too much more expensive after this... If you're able to, I would set aside at least $5,000.00 for the entire process, more if you're able. I am the USC and did not have a steady decent job when we were working through all the stages of immigration, so the financial aspect was the worst for us... It's an extremely stressful process to begin with, but when you're low on funds too, it's just ten times worse. It's worth it in the end though :-)

By the time we're done we are thinking close to $5000 as well. That's figuring in even the gas for running around, the running back and forth to the post office, the documents you have to track down, long form birth certificate, police clearance, etc. The filing fees for each thing $455 to file, $1010. for AOS the medical $300, the vacc trans. after you arrive for AOS, for us was a little over a hundred, airline tickets, hotel for a couple nights, meals during travel, trip 3 hrs away for biometrics. 14 hr drive for medical....each person is going to be different. But anyone filing for K1 just the fews for USCIS and medical without travel is close to $2000 gone. Everyday I wake up beside my sweetie is so worth it though.

From what I understand, at the time you applied for your K-1 Visa you must provide proof of having meet in the within the last two years. I have heard from other people who have gone through the process that this is a must. Hopefully someone with more experience will come along and offer their 2 cents worth. Good Luck!

This is not correct. You must have met in person within the two years preceding filing the I-129F petition. Applying for a visa is something you do after the petition is approved.

If you file a petition without evidence of seeing each other within the past two years, the petition will be denied and there will be no refund of the filing fee.

This OP's petition is approved, so that requirement was met at petition filing. Now the issue will be the bona fides. Not having seen each other for two years by the time of the interview violates no rules but it will make it more difficult to show a bona fide ongoing relationship.

That is what I meant, when they started the process of the K1 they needed to have meet in the two years previous to starting the process. Myself, like many others I know, say they are "applying for a K1 visa", and not getting all technical saying they are apply for an I-129f then when that gets approved they will apply for the visa. It goes hand in hand I think to most people and they just say K1 Visa.
