K-1 Fiance(e) Visa Process & Procedurescoming for the holidays
Make sure he brings some proof of ties to his country for the POE just in case. They can refuse him entry and you don't want that to happen. I took a letter from my employer saying "scheduled leave from work", copy of my mortgages, car payment etc. He may not need to show any but good to bring with him. GOOD LUCK and enjoy the holidays.

We filed first part of September and are awaiting our NOA2. We did it....just basically copied the letter and inserted our information. Keeping our fingers crossed its ok. I think that's the whole point of the sample page anyways. Not many ways to say ya, I want him/her in short form. Good luck!

K-1 Fiance(e) Visa Process & ProceduresHow do your parents/family take it?
I am hoping that by the time I actually make the move my family will be accepting of it. I know they tell me they just want me to be happy, but it doesn't stop the occasional dig....the "oh are you still going to make the biggest mistake of your life"....and "there are plenty of men in Canada". Its not that they don't like him, they just don't want me that far away. I was married before, short marriage and they are scared that it will happen again and they won't be there for me. I don't have the heart to say, "you weren't really there for me before". It was "you go married for better or for worse and you have to stick it out!" Not a chance in hell, ...we only get to go through life once, and its a short ride! I have been fortunate enough to meet a wonderful man who wants to share his life with me, who wants to be with me and I have no doubts this time around. I know eventually they will come around and see what I see in my honey. He's spending Christmas here so we will make the 3 1/2 hr drive to spend a few days with them, that will help. Good luck to all!

K-1 Fiance(e) Visa Process & ProceduresStill No Online Tracking After Almost 3 Months!!!
QUOTE (ThaitoUSA @ Nov 24 2008, 09:34 PM) <{POST_SNAPBACK}>
I am able to track and like Wis-Can, I never check. I figure my case won't be adjudicated until around Feb-March, so what would be the purpose of checking every day or every week between now and then? I'd rather spend that time chatting on here with good folks, planning for our wedding or doing something else productive. Since you have received confirmation several times that you are in fact entered into USCIS's system and your case has not been lost, there really is not much more to do but sit back, relax and wait. Or you can worry yourself sick over a site that seems unreliable at best.

It would be frustrating not to be able to see it, but then you read on here about people getting their NOA2 without a touch and the system still saying received and pending. I would take some comfort in knowing that at least when you've been able to contact them they CAN find you in their system and that's really the most important think. I stopped looking at the website for a while. I was driving myself crazy, getting mad at looking at the same date, day after day. GOOD LUCK with everything!

When I read this...I can't help but think its the fiancee that's writing it and not the fiance. Either way they asked a question and didn't asked to be judged. I think the age will definately be looked at closely but if they truly love each other hopefully they will have the opportunity to be together. GOOD LUCK!

Thanks

NOPE! USCIS is only concerned about the petitioners income. That doesn't come up until the embassy interview.

It means something but not the only something that counts. You must be free to marry to have a petition approved. If you file without such evidence, you'll be wasting the filing fee.

K-1 Fiance(e) Visa Process & ProceduresLawyer Recomendation?
We didn't go with a lawyer. Doing it on our own and making out fine. This website is a great help. I don't think I seen a posting on here from someone who had good luck with one! They certainly can't make the process go any faster for you. You still wait just as long whether you do the paperwork or they do. They don't get special treatment. As long as you do your homework, follow the guides........If we were doing it over again I would still do it on our own. Good luck!

Check your card out...you might be able to do the same. GOOD LUCK!

Hi everyone! Hope your holidays are going well. I posted this a while back, then it got moved to the Canadian forum right after I posted it and then I didn't get any responses. So I will try again.... My honey has to have recent paystubs.. well he works seasonal so his last paystubs will be from end of October, first of November. Then he doesn't start back till March. He is well above the minimum so that isn't a problem. Do we have his employer state he's fulltime seasonal in his letter and attach the latest ones from October, November that he has? Do you think we should show his unemployment stubs as well, or not a good idea? Any ideas on how to approach this? Thanks guys for any help you can give. whistling.gif

OH and we called NVC today, hoping they may have received our package, the lady told him to call back in 90 days! I'd say he got a cranky one. That's just their 'everyday' answer good.gif

If it were me, I'd approach this from a logical standpoint. State the nature of his employment/income, then provide as much information/documentation to support that.

Such as:

Employment letter -
If he can get one, definitely ask them to include a description of his role in the company i.e., how long he's worked for them - how often his seasonal work is, typical hours worked and if possible, what his rate of pay is.

Pay Stubs -
Include as many as possible - this will help to show his cycle of employment (plus his income).

Unemployment Stubs -
I don't think it would hurt to include this - goes to show his length of employment when he is employed since you can't get unemployment (in most states) unless you've been employed for a certain period of time.

Tax Records -
Last years (2007) Tax Return (and necessary supporting documents) and even 2008's if possible since we're only weeks away from being able to file; all go to support his income/employment history. (Tax transcripts - which can be ordered from the IRS eliminates the need for supporting documents such as W-2s etc.)

THANKS SO MUCH FOR THE REPLY! We appreciate it very much. good.gif

K-1 Fiance(e) Visa Process & Proceduresvisiting the US
QUOTE (stiggy @ Jan 4 2009, 07:14 PM) <{POST_SNAPBACK}>
In a few months, Ill be going to the US when my boyfriend gets back from oversea's for his home-coming. We will be in California for a week, packing up his stuff, so he can move to his family's home state which is a 30 hour drive. I told him that week while he's packing up, etc Im also wanting to visit 3 other friends that I want to see while there, and also go to our churche's temple there (we dont have one close to where I am).
I dont want them giving me a hard time at the POE if I tell them Im visiting my bf.
If they ask for the purpose of my trip - if I say to visit... then they ask who Im visiting, should I just say "visiting friends and going to my churches temple (mormon)?"... and if they ask "what friends" should I just state my friends, and my boyfriend?

Last time I entered the US to visit my boyfriend I Got haggled at the POE at the airport, for a 10 day trip and it wasnt too pleasant. But I also think that had something to do with me entering 3 weeks prior, for a week.. and they were probably wondering why I was visiting again on such short notice. And the fact that I also didnt have my return ticket with me, only my E-ticket confirmation #, along with the fact that I dont have a job (im a stay at home mom till my children start school).

I keep hearing how people say only answer with yes and no, and dont volunteer info.

I've never had a problem, when they ask purpose of visit, I just say visiting friends. I keep my answers to yes and no. Good luck.

A couple years back, my Fiancee opened a higher purchase credit line in her name so that a friend of hers could purchase a projection TV. Her friend has made all appropriate payments so far, and is down to owing less than $1000 NZ (big TV!)...

My question is: since this credit line is in my Fiancee's name, and is not entirely paid off, will this cause a rejection before or at the Interview? Her interview will most likely take place next month... so I'm wondering if we need to help her friend pay this TV off (not my favorite option!)

They do not check people's credits and wouldn't even know about this unless you yourself told them. So, you needn't be concerned at all.

I just want to add, and I realize it may be different for Canada, but that the Frankfurt consulate sent us a letter asking us to write that we still wanted the interview, even though THEY scheduled it after the 4 month time span. It was no big deal. In fact, we emailed the consulate and got a reply back right away saying thanks. That may be embassy-specific though.

Thanks, my honey wants to do the same "just in case". We may be lucky and get the interview within the four months span anyways. Just wanted to cover all the bases. I let him know the replies we got but he wants to be safe. He called NVC a couple days ago, got a cranky woman who said No, it wasn't there, and to call back in three months, I called today and got a really nice lady who said oh no its been here and gone, its on its way to Montreal. Hi Guys, I've asked a couple people, but thought I would post on here to see what everyone else thinks. I'm from Canada so I would be concerned with people who have gone through or going through the Montreal Consulate. I know your I-129F approval is good for four months and if you don't get completed you have to file an extension letter with the consulate. I noticed in the Canadian forum there are a number of filers who's interview is scheduled well beyond the four months. Is is automatically "OK" if that's when the consulate schedules your interview and you don't have to file that letter with them? Or, do they do that and leave it up to you to "know and submit the letter". Then my friend Tracey thought, maybe its because they get their appointment notice within the four months, even if the interview doesn't fall in the four months, but they were noticed in time. Any thoughts guys?? Thanks for the help.

If the consulate schedules an interview beyond the validity date of the notice, then they have taken care of the requirement to extend. It becomes a problem when there is no communication between the benneficiary/applicant and the consulate, causing the consulate to assume abandonement.

Thanks, I feel better now.

We discussed at great length "who" was going to move. In the end, in made more sense financially for me to make the move. He has a good job that he loves, mine is ok. He loves his hunting, and hunting to him would be limited here in Nova Scotia, Canada. And I guess more importantly, he's one of 8 siblings, who are all married with big families. The family is very close and do the holiday celebrations and such. I am very close to my parents, but there are two of them, much cheaper for travelling. I have two brothers that I see a few times a year. They might make the trip to Wisconsin, but I doubt it. His family is very welcoming of me so I am hoping that this will help with the transition. I know I'll no doubt have rough days. blush.gif

K-1 Fiance(e) Visa Process & ProceduresPlanning a wedding in 3 months?
It is hard to plan a wedding when you don't know a date. We decided that as much as a bigger wedding would be nice, the most important thing was that we were together so we're doing the Vegas thing! The cost of the whole immigration process kinda put a damper on things as well. Especially with the purchase of a new house. If you do have your heart set on a full wedding I would take advantage of the six months you have to use your visa, and then you have the 90 days to get married so that will give you a half decent amount of time to plan your dream wedding. Good luck with everything. I hope you have the wedding of your dreams!

Sorry to hear about your previous relationship. No one deserves that.

I'm sure you do know him well, and in all likelihood you'll get along great in person. I knew someone once for about seven months before meeting her in person, and she was quite different from what I expected. She had hidden some aspects of her personality from me.

I see marriage as a huge decision that should never be taken lightly, so please, meet each other, and spend some time together, before you take any more steps. You are lucky enough that you live relatively close to each other (compared to many of us on VJ), and either of you can fairly easily visit the other. Take advantage of that.

good.gif I agree. I am from Canada and my sweetie is from Wisconsin. We've none each other for over two years now, both of us have travelled back and forth several times, spending as much time together as well can. We talk on a daily basis. Our first meeting was almost 10 months after we meet, and being with someone in person is a whole lot different then an online relationship. Marriage is a hugh decision, which is why we are still 2 years of visiting to make sure this is right for us. I know we love each other but a couple weeks here and there, you really don't get enough time to see the real person. Its like a vacation....not reality. That's why we opted for the K-1 Visa. We knew it was going to probably take almost a year to complete so it gave us another year of visiting one another. My opinion to the OP, meet, several times if you can, spend quality time together and really get to know each other in person. You are lucky enough to be so close compared to most on here.

Good luck with whatever decision you make.

How do you come up with that when he says "go back to China, get married, and do this thing the other way....At some point, I'm concerned that the consulate in China will have two different petitions for the same couple."?

Looks to me like he plans on returning with his wife.

I am not one to pick apart the things that others say, but there is something disturbing about what you described your plans to be. I totally understand termination the first relationship because of fraud. But you are already anticipating petitioning someone you apparently know very little about, and you are going through an IMBRA agent. That tells me there is a problem with this marriage broker, who may be taking advantage of what seems to be a sense of urgency on your part to find Ms Right. I recommend taking a break from the action and reassess the situation. I think your rapid fire petition plan will create some real red flags for the USCIS or the consulate.

I agree. Wait. Take your time for several reasons. The most important of these reasons is to not be burned twice and make sure that it is meant to be. My wife and I knew we had something special after only a few days together but didn't contemplate marriage until well over a year down the line and many long talks (and large phone bills - before we got skype) and many visits.

Another good reason to wait is because it WILL look suspicious to USCIS. Ask yourself this, is she worth the wait. If the answer is no then don't do it.

K-1 Fiance(e) Visa Process & ProceduresMedical exam and interview on the same weekend?
We're going through Montreal, and the money is a concern for us as well. So once we get our interview date we are going to book our medical three or four days before it. Hopefully we get it in time for the interview and if not, well I will have to get them to forward it to the consulate. It will delay us some if we don't get it in time. Hopefully all goes well.
