Well, I just wanted to say that for 2 days, I couldn't check the status of my petition and I was starting to get irritated whistling.gif especially seeing people getting approved already.. hehehe.. I was just getting excited and happy for everyone.. devil.gif

Well, after getting stuck in traffic and a normal trip from Seattle to where I live only usually takes 35-40/mins.. it took me 2 n a half hours to get home today!!

Anyways, I just wanted to share my good news that I found when I got home and decided to check my status:

Current Status: Approval notice sent.

I just wanted to say, ppl, just hang in there and your turn will come.. my hands are a little shaky as I'm typing this and I think it's still sinking in!! kicking.gif kicking.gif I had sent my petition in @ the very end of July, so I was surprise to get this notice so soon as my adj date was suppose to be Dec. 15-26.. And I never got another touch besides the one that happened like 4-5 days after my NOA1 date.. Oh, and I'm #84 on IGOR's List.. but not nemore tongue.gif

Couldn't have asked for a better surprise the day before Thanksgiving.. and I'm really THANKFULL for the quick approval, GOOD LUCK TO EVERYONE AND HANG TIGHT!!! Just keep busy with work or whatever and it will go by fast!!! heart.gif yes.gif good.gif

Not sure if your bank makes copies of your check and puts it online for you to view.

I'm able to view my checks that are cashed online thru my bank, and when mine was cashed, I saw my case # stamped on the back and was able to create an account with USCIS and view my petition before I got my NOA1 hard copy in the mail, as you can see in my sig..

Agree, my fiance just got her passport last month, and didn't need to attend the CFO seminar. Here's a snip form the Philipppine gov web site (gov.ph)
PASSPORT REQUIREMENTS FOR FIRST TIME APPLICANTS

Personal Appearance is required.

Duly accomplished application form.

Birth Certificate (BC) in Security Paper (SECPA) issued by the National Statistics Office (NSO) or Certified True Copy (CTC) of BC issued by the Local Civil Registrar duly authenticated by NSO.

Three (3) colored photos of the applicant taken against a royal blue background. Applicant should be in decent attire with collar. Photo must be of good quality, and must have been taken within the last six (6) months. Photo size: 4.5 cm x 3.5 cm. Facial image size: Not less than 3 cm. DFA has the right to reject photos that do not comply with specifications and international standards.

Proof of identity / Supporting documents indicating full name, date and place of birth and citizenship

You took my response in the wrong way and I don't think I was snappy, not my intention...sometimes the way it was meant to be read, was not how the person reading it took it... good.gif

You didn't elaborate to why she felt concern about sending it thru the post-office in your first post and that just made me think maybe the postal service had issues that she knows about that would cause her concern, so I don't know how I came off as snappy by asking a legit question.

Anyways, if cost is a concern, you should just let her know you will send her money to send it to you if that's all it was. I know when my fiance needed to send me something really fast, I just sent her some money for postal expenses. I know getting all the stuff together can be confusing and frustrating at times, but once you get it all together and sent out, it will feel a little better and less stressfull once your journey starts...

On another note, try to not use profanity when responding to other peoples post, even if it upsets you cuz you might of took it the wrong way, it show your maturity level...

p.s. for our proof, it says to date the back of each picture and write the location aswell, however, I taped all the pictures on peices of paper and wrote the date and loc. on the paper. is this OK? or should I write it on the back aswell??

Just an FYI, this is on the Instructions sheet for 1-129F.
The filing fee for a Form I-129F is $455.00.

Use the following guidelines when you prepare your check or money order for the Form I-129F fee:

Make the check or money order payable to U.S. Department of Homeland Security, unless:
A. If you live in Guam and are filing your petition there, make it payable to Treasurer, Guam.
B. If you live in the U.S. Virgin Islands and are filing your petition there, make it payable to Commissioner
C. If you live outside the United States, Guam, or the U.S. Virgin Islands, contact the nearest U.S. consulate or embassy for instructions on the method of payment

I read some post where ppl did the pix the way you did and they didn't run into a problem with their petition. But, I would write it on the back as well, to play it safe...

If you're calling her phone direct, then you can just print up your monthly statement and use that. When you filled out the G325 form, did you put her cell # down as a means to contact her, if you did, then you can use that as proof that is her #. If you're using calling cards... hmm.. don't know about that as it seem your statement will only(not sure) show the access # you dialed before dialing her #.

In the Philippines, they do use carriers, it's just they are not on a calling plan like here in the US. I think I saw that you can sign up for calling plans, but I think most ppl prefer to just load their phone as they need it or when they get money. I have a phone I got from Phils with me here in the States and I have Globe and Smart SIMs installed(dual SIM phone).

To answer question 1, I wouldn't pay that much attention to USCIS dates. Everyone is going to be different as you can see by VJ members proving that. So, I never look @ there processing timeline, I just keep an eye out here to see when people post that they got ther NOA 2 and look @ their timeline to gauge how far off I am yes.gif

I can't really answer you question to #2, but I'm sure there will be someone that can. But you're going in the right direction by getitng all the stuff you can do ahead of time, it will make everything less stressful when you do get the packet for the next step as you've got a head start. good.gif

I guess it would vary per country to how much it cost, but for Phils.. you already know how much it cost to send the petition... go check out the US Embassy website in Manila ( http://manila.usemba.../wwwh3023.html) and they will have all the fees that has to be paid on that end, then you have to also look @ paying for the AOS after your married.

That should be your gross income as in 'before tax'.. as you will need to submit a statement from your employer(unless you're self employed) and your employer will show your gross income before tax, not after tax... (well, at least mine did it that way) so I would put down the same amount that they had on my statement from my employer....

Someone who sent theirs in should have a better answer, but I still think it's before tax, just my 2cents..

Just go over the instructions again and see if there is any other time limit on certain docs.

i enjoyed reading this...btw- i'm a female USC and my male fiance is from belarus...however, i still have to 'take it like a man' in order to maintain sanity. also to help clarify, my fiance and i met in person on a flight to the US from france. he spent the summer in the US and we visited for a week before he returned to BY. of course, still very rushed...and yes...the K1 route is the only way we can be together...and no, normal people do not marry this quickly. but, life is full of risks...and...as many of you have said- once this process is over, what's left is a lifetime together.

The only thing now that the US Embassy in Manila now sends is a notice to say you are able to schedule an interview. In March '08, you have to download the packet yourself. http://manila.usemba...v/wwwh3238.html

Check out that link and on the left, will be other links with all the information you will need. And most definatly, have them get a passport. They can't do the medical/interview without the passport.

Just read up on that link and you'll be good to go.

Hi everyone,

I'm in the process of putting together my K-1 package and I'm considering using my Certificate of Citizenship (I became a U.S. Citizen through my parents). I was in my teens at the time that the certificate was issued and it has my photo from that time. For better for worse, I've aged quite a bit since that time (:crying:) so the photo of myself on the certificate and my photos with my fiancee don't look the same.

Will this be an issue or when they look at the documents?

Nope, my picture on mine was back when I was 13/yrs old.. I'm in my 30's now.. no worries... like mentioned, if it has all the info that they need you should be good to go..

With President Arroyo's signing of the Dual Citizenship bill, Citizenship Retention and Re-acquisition Act of 2003 (Republic Act No. 9225), Filipinos the world over can once again re-acquire their Philippine citizenship.
This law helps the once Filipino Citizens get their citizenship back without losing their current citizenship to what ever country they are a citizen of now(i.e. U.S.A). I don't think this helps you if you're Filipino and never had Filipino citizenship.

Isn't an American, a citizen of the United State of America, regardless of where they came from? I was a natural born Filipino Citizen but became an American/US Citizen by naturalization, so I no longer can own a certain amount of land, do certain business, etc.. unless I get my dual-citizenship back.. I'm an American/US Citizen, but my nationality is Filipino... so, if your Filipino spouse becomes an American Citizen, then she also can't own property as you stated..

How do I prove that I am a natural-born Filipino?


A former natural-born citizen, who was born in the Philippines, shall submit the NSO-authenticated copy of his or her birth certificate.

A former natural-born citizen, who was born abroad, shall present a copy of the Report of Birth issued by the Philippine Embassy or Consulate and, in applicable cases, the original copy of the Birth Certificate by competent foreign authorities.



What is the procedure in applying and what documents are required in order to apply?


Applicant shall present a copy of his/her Birth Certificate issued or duly-authenticated by the National Statistics Office (NSO) in Manila.

(Note: Applicants can request for an authenticated birth certificate from the National Statistics Office on-line through the following website: www.ecensus.com.ph)

In case of no records found, applicant must present a Certificate of Non-Availability of Birth Record from the NSO and other secondary documentary proof of being a former natural-born Filipino citizen (e.g. old Philippine passport, baptismal certificate, marriage certificate of applicant’s parents)

Applicant accomplishes form entitled “Petition for Dual Citizenship and Issuance of Identification Certificate (IC) pursuant to RA 9225” and attaches three (3) 2”x2” photographs showing the front, left side and right side views of the applicant.


Applicant submits duly-accomplished petition to the Philippine Consulate / Embassy together with the photos, birth certificate and a valid ID.

(Note: Applicants who are married and who wish to use their married names must submit a copy of their marriage certificate).


Applicant pays a processing fee of US$ 50.00 and is assigned a schedule for his/her oath of allegiance before a consular officer. Applicant takes his/her oath.

What is the Oath of Allegiance?

The Oath of Allegiance is the final act that confers Philippine citizenship. It reads as follows:

"I,________________, solemnly swear that I will support and defend the Constitution of the Republic of the Philippines and obey the laws and local orders promulgated by the duly constituted authorities of the Philippines, and I hereby declare that I recognise and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto, and that I impose this obligation upon myself voluntarily without mental reservation or purpose of evasion."



Can the conferment of Philippine citizenship be revoked?


The conferment of Philippine citizenship under the IRR shall no longer be subject to the affirmation by the Secretary of Justice. However, Philippine citizenship may be revoked by competent authority upon a substantive finding of fraud, misrepresentation or concealment on the part of the applicant.



Can my foreign spouse also become a Filipino citizen under RA 9225?


No, the law does not apply to the foreign spouse. He/she has the following option if he/she wishes to reside permanently in the Philippines: (a) apply for naturalization; (cool.gif apply for a permanent resident visa.


Can my children (minor or aged 18 years old or over) also acquire Philippine citizenship under RA 9225?


According to Section 4 of RA 9225 (Derivative Citizenship), the unmarried child, whether legitimate, illegitimate or adopted, below eighteen (18) years of age, of those who re-acquire Philippine citizenship under this Act shall be deemed citizens of the Philippines.

A married child, although a minor, cannot therefore be included in the petition of his/her parent.


Children 18 years old and over do not qualify to acquire Philippine citizenship under RA 9225. They have the same options that are open to the foreign spouse.



What is the procedure for derivative acquisition of Philippine citizenship?


The petition under oath has the option to list the names and details of any minor, unmarried children. The applicant should include a copy of the Report of Birth and the original copy of Record of Birth for each minor child.

The Embassy will clarify from Bureau of Immigration the exact procedure in case of the minor children and whether the BI will issue to them a Certificate of Identification.



After I have re-acquired Philippine citizenship, can I apply for a Philippine passport?


Yes, and so can the minor children who are deemed to have acquired Philippine citizenship under RA 9225. You would need to comply with the requirements for first-time passport applicants.


What rights and privileges will dual citizens enjoy?


Those who retain or reacquire their Philippine Citizenship under RA 9225 shall enjoy full civil and political rights and be subject to all attendant liabilities and responsibilities under existing laws of the Philippines and the following conditions:


Those intending to exercise their right of suffrage must meet the requirements under Section 1, Article V of the Constitution, Republic Act No. 9189, otherwise known as “The Overseas Absentee Voting Act 0f 2003” and other existing laws.


Under the Act, the right to vote or be elected or appointed to any public office in the Philippines cannot be exercised by, or extended to, those who are candidates for or are occupying any public office in the country of which they are naturalized citizens and/or those who are in active service as commissioned or non-commissioned officers in the armed forces of the country which they are naturalized citizens.


Those seeking elective public office in the Philippines shall meet the qualifications for holding such public office as required by the Constitution and existing laws and, at the time of filing of the certificate of candidacy, make a personal and sworn renunciation of any and all foreign citizenship before any public officer authorized to administer an oath.


Those appointed to any public office shall subscribe and swear to an oath of allegiance to the Republic of the Philippines and its duly constituted authorities prior to their assumption of office; provided, that they renounce their oath of allegiance to the country where they took that oath.




Can I now acquire land and other properties or engage in business?


As provided for under the 1987 Philippine Constitution, a Filipino citizen is entitled to purchase land and other properties and engage in business. There is no limit in terms of area or size of land or real property he/she could acquire/purchase under his/her name. This right would now apply to former natural-born Filipinos who have re-acquired Philippine citizenship under RA 9225.




Can I now reside in the Philippines without having to apply for entry visa?


Former natural born Filipinos who have re-acquired Philippine citizenship may now reside in the Philippines continuously without having to apply for entry visa. If the foreign spouse and/or child wish to also reside permanently in the Philippines, they may opt to apply for naturalization as a Filipino citizen or apply for a permanent resident visa.

If he/she does not wish to reside permanent in the Philippines, he/she could visit the country as a Balikbayan (refers to a Filipino citizen who is out of the country continuously for at least one year). The foreign spouse or child may enter the country and stay for up to a year visa-free provided the spouse or child is accompanying or traveling with the Balikbayan when the Balikbayan goes home to the Philippines.



As a dual citizen, how long can I stay in the Philippines?


Having reacquired your citizenship, you can stay in the Philippines for as long as you want without having to pay an immigration fees. You can even choose to retire or permanently settle back in the Philippines. As a Filipino citizen, you are subject to duties and other obligations imposed on other ordinary Filipinos, such as paying the necessary community tax residence and other tax liabilities in accordance with the tax laws of the Philippines.



Will I now be required to pay income tax and other taxes? Am I exempt from paying the travel tax?


In accordance with existing laws, income earned in the Philippines is subject to the payment of tax. Filipinos who re-acquire citizenship and opt to reside and work in the Philippines will pay the income tax due at the end of each fiscal year. They are also subject to other obligations and liabilities, such as the community tax and residence tax.

Countries routinely forge bilateral agreements in order that their respective citizens who earn income overseas do not pay income tax twice.

Filipinos who have re-acquired citizenship, as long as they reside permanently overseas, also enjoy the travel tax exemption extended to Filipino citizens permanently residing in other countries, the OFWs and their dependents.



As a dual citizen, am I allowed to practice my profession in the Philippines (e.g. doctor) ?


Under the law, those intending to practice their profession in the Philippines shall apply with the proper authority for a license or permit to engage in such practice.

Well, depending on when they sent it, most likely USEM will not schedule you an interview until your petition actually gets there. It should only take 3-5 days to get there.

You don't need to pay the visa fee before making an appointment, but it would be a good idea to pay it when you can(it's good for a year). Just pay for the $18 PIN and you can schedule the interview for your SO if you know of a good date that will work out for her to go.

I used to use phone cards, but like you stated, too much hidden charges... I am currently using www.gorillamobile.com .. they charge $5.95 for a yearly fee(not monthly), and it's .9cents to Landline or .15cents to mobile. When you first sign up, you get I think a free $5 call to try their services. It's good cus you can print your monthly statement and it shows the your # and the # you call, so it's good for sending as proof of ongoing relationship..

I've got good receiption from them, and only time it was bad was when Phils was having their storms, cus even after I hung up and dialed direct(AT&T), it was the same quality..

I've been using gorilla mobile for over 5/months now and will stick with them over getting phone cards..

Yes you can use a separate sheet, just make sure to note which questions you're answering to.

For #12, I would put as close as you can remember, but if you can find out really fast, might as well put that in.

For #17, Elementary is not need, but your HS or any other education after that should be there. Again, if you can remember the date(maybe look on your diploma or certificates?) the better.

For some reason the bank will not accept filled out DS 157 forms and just stamp them. They will only give you one blank that is stamped on the back and a receipt!! headbonk.gif You have to fill it out and make a copy as 2 DS 157s are required.
In the past I've seen some peeps fill out online and get them stamped. NOT often tho. Maybe since USEM doesn't use BPI anymore the new one may do things different. BDO I think!

The DS-230 form is for Immigrant Visa and Alien Registration, you're applying for a K-1, which is a Non-Immigrant Visa.. have you downloaded the Packet from Manila Embassy yet? It states the forms you will need to bring with you for the interview: http://manila.usemba...ov/wwwfk1en.pdf

Although, it seems Eva has some special going on from my area to Phils that is the cheapest I could find so far.

I went to FedEx and did a sample shipment from my location(West Coast) and this is the delivery dates they gave me if I were to send it out tomorrow(Dec. 30th) and my SO is in Isabela region(yeah, up in the mountains..lol). And it seems the dates they show would support what ppl are saying about the holiday schedule there.

I went to USPS site as I have my account setup with them already and did the GXG 3-day Gauranteed and this is what it states, which is interesting cus they use FedEX Express once it gets to the international destination to deliver it:

As seeing that USPS uses FedEx anyways, not sure which one would be better. I did speak to the clerk @ the postoffice and he couln't seem to give me a date for thier service(he was also giving me a different price..$38 blink.gif from what I was seeing online) so not sure if he knew what he was doing blush.gif , but if it's 1-3/days and they use FedEx, then it should be the same.

yay!!! how did you get your interview date?did you call the embassy??i called them 2 days ago and i didn't get any luck...

Have your Fiance call, I(USC) called as soon as they opened, 8am. Paid my $18 for the PIN # and directly connected to the embassy afterwards, made the appointment for my SO and that's all it took.

If your SO makes it for you, make sure he has all the info, your birthday, address, e-mail address, Case #, etc..

Thanks for the advise. I don't use my Globe phone for making calls(I do get calls on it though), I just use it for recieving txt..
