Perhaps this will help:

1) 2 days after NOA2, starting calling NVC: 603-334-0700 press 1 then 5.
2) Once NVC has your case, they assign a new case #. Ask them what date they sent your file to the embassy & also for the NVC case #.
3) Once you know the date NVC sent off the file, track it at DHL's website: http://track.dhl-usa...?nav=TrackByRef For the reference code, enter EXP 10 JUL 2009A (adjust using dates just before the date NVC told you), with a shipping range of that day to a few days later (July 13 - July 14 worked for the example above). Look for shipments to your beneficiary's embassy.
4) To find out if the embassy processed the packet, call the Dept of State before 5pm: 202-663-1225 press 1 then 0
5) You can also call the DoS to find out your interview date once you believe the embassy has scheduled it.

Anyway, here's hoping that VSC gets their shiact together today and knocks out the rest of March! And if NVC could ship our petition to Seoul today, that'd be helpful too.

Speaking of ours, I got a self-congratulatory letter from my congressman today informing me of the NOA2. I hadn't been in touch with them since USCIS refused to transfer our file to CSC back in early July, and they had actually closed my file. In my desperation last week, I called and asked them to inquire again. It was later the same night that the email from CRIS came. I called the congressman's immigration caseworker back the next morning to tell her she didn't need to put in the inquiry. I seriously doubt they even had even made the inquiry yet, let alone had any effect on the NOA2. But whatever—let them have their little victory. rolleyes.gif

Seoul is pretty much the same way. The Packet 3 (or Packet 3.5, as they call it) email just contains a link to a website where you can download the necessary instructions and forms. They instruct you to complete and fax in DS-230 Part I right away, after which you can submit an interview request online. Then you just collect and hold the Packet 3.5 forms and documents and wait for the Packet 4 email, which is really just an interview confirmation.

If they have his email address, they'll probably send it directly to him. That being said, you can probably assume the same thing for Montreal.

No biggie either way; if it comes to me, I'll just forward it. yes.gif

As for that March 5 date that NCSC gives out, it's a load of hooey. Did you get that after escalating to a Tier II agent? As of last week (when I was calling obsessively), Tier I CSRs were telling people 5 months (as currently listed on the USCIS website), while Tier II agents were saying March 5th.

March 5th may be the oldest application they haven't done anything on... but to say they're "currently processing applications filed on March 5th" is utter nonsense. Take a look at Igor's List for Vermont.. The bulk of the approvals so far this week (8 of 13) have been May filers. I won't go into detail on the theory as to why this is the case, I'll just state a simple fact: it sucks that they're leaving March (and now April) filers hanging while they artificially pad their stats by cherry-picking cases.

Anyway, you are well outside the current processing time of 5 months as listed on the USCIS website. I would suggest calling and politely insisting that they initiate a service referral request. Make sure you take down the referral number, as well as the name and ID number of the agent with whom you speak. This might also be a good time to get your congressman or senator involved.

Here's the latest (since I'm sure you're all just dying to know)...

I called NVC tonight, just as I did last night and will probably do every night until our petition is sent on to Seoul. laughing.gif

It arrived there late in the day on Monday, 8/31—I say that because it hadn't arrived in the afternoon when I first called, but they had it when I called around 10:30 that night.

As of tonight, it's still there crying.gif but they asked for Elisha's email address, which is a good sign. Seoul sends out Packet 3 by email, and as there's no place on the I-129F petition to provide the beneficiary's email address, they didn't have it yet. I also got her consulate case number. good.gif

Still no NOA2 hardcopy, but that's not entirely unexpected.

Did I say that? If I did, I misspoke... Seoul is a very quick embassy; Elisha says she may have an appointment as little as 3 days after requesting one. The medical is likewise quick: no appointment necessary, in and out in 40 minutes, and results available by end of day.

I heartily agree with the part about late approval, though!

No, in fact as a member of FINRA my fingerprints are on file and my record gets checked regularly.


I wonder if that can cause issues with the background check similar to those encountered by US citizen petitioners who hold security clearances? Perhaps there's a "flag" on your FBI file that would cause FINRA to be alerted if you got in trouble, and that flag requires the USCIS background check to be cleared manually rather than simply returning "No Record."

I have no idea if this is actually the case, mind you; I'm just thinking out loud.

I would advise against this.

First of all, many congressmen and senators have an explicit "Congressional courtesy" policy of refusing to get involved in a case that another legislator is already working on.

Second, multiple inquiries from different congressional/senatorial offices could actually slow down your case. They have to chase down each inquiry separately, so if the first inquiry gets your file taken off the shelf and onto an adjudicator's desk, second and third inquiries will just slow down the adjudicator.

There's merit to both of those theories, plus a ton of other factors that could come into play—the congressman's or senator's seniority, his committee memberships... probably most important is how experienced his immigration caseworker is and what contacts he/she has inside of USCIS. My congressman's caseworker, for instance, was very kind and understanding but didn't strike me as all that effective. All her contacts were through USCIS's central POC for congressional inquiries (kind of like NCSC for Congress) and, consequently, all she ever heard back from them was USCIS boilerplate. On the other hand, I've read of other congressmen/senators who have personal contacts within the service centers that they've built up over the course of years. I would imagine that this sort of contact would be far more effective.

Welcome to the weekend, March family!

Needless to say, I'm elated to have finally gotten my NOA2 and to see so many other Marchers approved to round out the week. At the same time, it's bittersweet because there's still 50 of us who can't celebrate yet. I'm hoping and praying for all y'all to get that email from CRIS soon!

Anyway, what's everybody up to? I'm in the office this morning - ugh! The project I'm currently working on is on a very compressed timetable, so we've got a status conference call (ugh!) at 11. Then I figure I'll get some printing and copying done to prepare the interview package for Elisha. Thanks to a kind VJer whose SO went through the process in Seoul earlier this year, we have copies of Packet 3 and Packet 4, so we're ahead of the game. Monday, I figure I'll mail it all off to her and start calling NVC. smile.gif

Not doing that great, to tell you the truth. Five months and no NOA, not even a touch since April 1—it's really getting to me.

I was really hoping to fly to Korea October 1 to spend Seollal (the Korean harvest festival, roughly analogous to Thanksgiving) with Elisha and her family, then bring her home around the 9th or 10th. With each passing day, the possibility of that happening fades. We've got all the Packet 3.5 forms filled out and documents gathered. Medicals and interview dates in Seoul are very quick—but we can't do anything without that blasted NOA2, and these twits at USCIS are blowing through April while our petition gathers dust somewhere.

I sooooooooooooooooooooooooo can relate... for me it was getting the children here so they could start school when everyone else did, when that didnt happen it was a pretty bad few days... then it get better... and now it is worse again wink.gif

How long does it take to get an interview at your Embassy? it is 2 months for warsaw.. but they said they would do everything they could to expedite an interview in a few weeks time... maybe your embassy would or could do something similar? September and October are apparently slow months at the Seoul embassy—Elisha says she could have an interview in as little as 3 days. She hasn't had the medical yet—she needs her SEO case number from NVC first—but again, it's a walk-in affair, takes less than an hour, and results are available the same day. The only thing we're waiting on is NOA2.

Not doing that great, to tell you the truth. Five months and no NOA, not even a touch since April 1—it's really getting to me.

I was really hoping to fly to Korea October 1 to spend Seollal (the Korean harvest festival, roughly analogous to Thanksgiving) with Elisha and her family, then bring her home around the 9th or 10th. With each passing day, the possibility of that happening fades. We've got all the Packet 3.5 forms filled out and documents gathered. Medicals and interview dates in Seoul are very quick—but we can't do anything without that blasted NOA2, and these twits at USCIS are blowing through April while our petition gathers dust somewhere.

Sorry to be such a drag, but I am so angry I can barely even speak. I am SO SICK of USCIS and their ridiculous ineptitude. APRIL 28?!?!! #### that!

good question... i doubt one has more pull than the other.... but to be safe, lets do both! smile.gif

Well, senators theoretically have more power because there's fewer of them... but unless you live in a tiny (or very sparsely populated) state, they have way more constituents than a representative so it might be harder to get prompt action on your case.

I've read on several senators' and congresscritters' sites that you should stick with one at a time; out of "congressional courtesy," many decline to intervene if you've already engaged another one on your case.

I guess I might stick with the congressman because they're already familiar with my case and already have my privacy release on file, etc.

I just got off the phone with NCSC.

After going through the Tier I CSR's twenty questions, I gave her my receipt number and she rattled off the worthless info from CRIS. I thanked her, told her that my status in CRIS hadn't been updated since April 1, and politely asked to be connected to an IO. She went through the pro forma dissuasion attempt, noting that it's currently one day shy of 5 months. I thanked her again and reiterated my request to be transferred to an IO, with which she complied.

When the IO answered (in an unidentifiable, slightly difficult to understand accent), she asked for more information on me - name, address, DOB, etc. She looked me up in her system and said the case was still showing as pending. I asked if she could tell me if the file was actually on the floor or sitting on a shelf somewhere, and she said it was assigned to an adjudicator. She brought up the nonsense about March 5, to which I responded that most of the recent approvals have been April filers. She said "your approval could come any time, please give us one or two more weeks." I thanked her for her help, noting that it couldn't be easy taking complaints from upset people all day.

They're not getting one or two weeks. The letter to my congressman's immigration caseworker (who is already familiar with my case from my fruitless attempt to get transferred to CSC) gets faxed around 4 pm tomorrow, with a follow-up call first thing Friday morning. I'm making it clear that I want a detailed status report on the case (either it's awaiting a background check or it's just sitting on a shelf or in someone's pile); if there's no outstanding information, I expect the petition to be pulled and worked immediately.
