Linda, sorry for speaking legalese!

What I mean is, you filed your I-129F on March X, 2009.

In order to have a chance to successfully appeal your denial, you need to provide evidence that you and Thom met in person within two years prior to filing your petition—in other words, between March X, 2007 and March X, 2009.

If you have strong evidence that can demonstrate such a meeting, you might want to submit an appeal. If you didn't meet in person within that time period, or you don't have strong evidence to demonstrate it, don't waste your time—file a new I-129F or get married in Mexico and file the I-130.

It looks like you might be right, Richard... if they submit all their supporting evidence as well as a good cover letter as an explanatory brief, 103.3 says that the official who denied the petition (presumably the guy who signed the denial letter) can treat it as a motion to reopen for the purposes of granting favorable action within 45 days. So, if their evidence is sufficient and well-presented, the appeal might work and be faster than a new I-129F.

I would strongly caution them to make sure that the evidence pertains to the 2 years immediately preceding the original submission of the I-129F. Any meetings in person after the filing of the petition are useless for the purpose of an appeal. So if they have strong evidence (primary and secondary as explained in the K-1 guides) of meeting before, then I might suggest going with the appeal. But if they don't have this evidence, the appeal will be a waste of time and money.

I replied in the other thread, and I am likewise not an attorney and am simply offering my opinion, but I came to the exact opposite conclusion.

They cannot file a motion to reconsider. If you read the instructions on the I-290B, it states that motions and appeals are filed on the same form, but the notice of denial specifies what options are available for appeal and/or reconsideration. In her case, the denial notice only mentions the option of appealing.

Next, as I understand it, in order to successfully appeal, you have to show that the USCIS decision was in error—either an error of law or error of fact. There was no such error in this case. Linda stated that they inadvertently failed to submit evidence of having met in person in the last two years. The laws and regulations cited in the letter clearly state that USCIS may at its discretion deny a petition submitted without initial evidence, and that the burden of proof rests on the petitioner to establish eligibility for a benefit. No error was made—USCIS was within the law to deny the petition, and factually the petition was deficient. Now, if they had submitted evidence and USCIS had lost it, an appeal would be in order. But not in this case, in my opinion.

The denial letter does not state that the petitioner or beneficiary is INELIGIBLE. It merely states that the petition failed to establish eligibility. Rather than arguing that it did and trying to prove USCIS wrong (essentially what an appeal entails), better to save money (definitely) and time (likely) by filing a new, properly supported I-129F.

Once again, just my opinion, but I think my reasoning is sound here.

Linda, as I posted in the other thread, what might be most helpful is if you were to post the FULL TEXT of the denial letter your fiance received (minus the personal/private details, of course). Only by knowing the exact language USCIS used, and the exact options they gave you, can someone give you good and accurate advice.

For example, an appeal and a motion to reconsider or reopen are different things. One would have to look at the denial letter and at what specifically was missing from your initial petition to determine which one (appeal or motion) would be appropriate under the circumstances.

Also, did your fiance make a copy of the entire package he submitted initially? That's the surest way to know what you sent them and, by extension, to determine what's missing.

Your best option might be to fill it out together on his computer using www.teamviewer.com as michey and odessa suggested. That way you can see everything on his screen and even type for him, but then he can click continue and print it out there once you're satisfied that everything is entered correctly.

When you fill out the DS-156 online and click Continue, it generates a printable PDF of the entire form with a unique barcode. In addition to printing, you should also be able to save it. That PDF can't be changed, however. Any changes have to be made on the evisaforms web form, because any change would require the site to generate a new bar code.

What you should be able to do is fill it out completely, hit continue, and save the PDF to email to your SO to be printed and signed. If you need his input to fill it out, I suggest typing in as much as you know on the website and just printing the page itself—not hitting continue to create the PDF. Or work on it together using screen-sharing software like the one suggested earlier in the thread or something like gotomypc.com or gotomeeting.com (which both have free trials, I think).

In my case, I'm just filling out and printing all the forms (including the DS-156), then sending them to my SO along with the affidavit of support, reaffirmation of intent to marry, and evidence of our ongoing relationship. We've been chatting back and forth all along to get the forms all filled in.

If you had one, believe me, you'd know it! They dig up your whole life, question your neighbors, current and former coworkers, pull your credit files... Anyway, unless you have or had a job that was somehow related to defense or national security, you'd have no reason to hold a security clearance.

You could fill it out for him, print 2 copies, and send them to him for his signature. It's formatted for US letter-size paper anyway, which might not be easy for him to get his hands on (they use A4 in Europe, which is close but slightly narrower and longer).

OR you can fill it out and print the web page (i.e., don't click "Continue," just use your browser's print function) and send that to him so he can use it to fill out the web form to generate the actual DS-156 with bar code.

Sorry for all the unnecessary confusion.

First of all, the current versions of all visa forms can be obtained from the Department of State website at http://travel.state....forms_1342.html

From there, you must follow the link to http://evisaforms.state.gov to fill out the DS-156. You must fill out the form on the web page—when you click Continue, the web application will generate a prefilled PDF version of the form including a unique bar code containing all the information on the form. You can then print and/or save the PDF generated by the web application.

The other forms (DS-156K and DS-230) can be downloaded and filled out on your own computer. The problem with the Department of State versions, as you discovered, is that they don't allow you to save the entries. I downloaded each of these forms and enabled saving. These forms—current versions, exactly the same as the DoS site except that saving is enabled—are available at the following URLs:

Different consulates have different requirements for Packet 3, so you'll need to check the individual consulate's website for the correct and up-to-date information that applies to you.

I didn't upload the DS-156 at all. It must be filled out at the link above, as the web form generates a printout with a unique barcode when submitted.

I uploaded the DS-156K, which is the Nonimmigant Fiance Visa Application. The version I posted is the most recent version as downloaded directly from the Department of State. Per the DS-156K instructions, K-1 visa applicants must complete the DS-156 AND the DS-156K: "This form, together with Form DS-156, Nonimmigrant Visa Application, completed in duplicate, constitutes the complete application for a "K" Fiancé(e) Nonimmigrant Visa authorized under Section 222© of the Immigration and Nationality Act."

I also uploaded the DS-230 Immigrant Visa Application, which some consulates require as part of the Packet 3 information. Once again, the version uploaded is the current version from the Department of State website.

That's okay though... just means a whole bunch today! August 6th on the Catholic liturgical calendar is the Feast of the Transfiguration, so I'm confident that lots of March I-129Fs will be transfigured into NOA2s today! good.gif

I opened it in Adobe Acrobat Professional (not just the free Reader), enabled Adobe Reader usage rights, then resaved the document. Then I had to delete Part II because the entire doc was too big for the attachment system - ugh! I can send you the whole thing as one doc - PM me with your email address if you like. If you're having the same trouble with the other forms, I can do the same thing with them as well.

In order to see "touches" to your file, you need to set up an account on the USCIS website. Go to the USCIS home page http://www.uscis.gov, then click "Case Status Online" in the left column. Create a customer account, then add your receipt number (for a VSC case, this will start with EAC followed by a series of numbers). You can try here... http://bogota.usemba...rant_visas.html they are also on VJ under example forms I think. I have read that Bogota is a difficult Embassy... so start doing some research... to make sure you have everything you need..

Actually, although the K-1 is technically a nonimmigrant visa, most consulates handle them through the immigrant visa section. It appears that Bogota is the same way: http://bogota.usemba...pt-package.html. The K Visa Packet 3 instructions are available on that page, as well as all other required forms.

Well, I just got off the phone with my congressman's District Director regarding my request to transfer our I-129F petition to CSC. They did forward the request to USCIS, but?surprise, surprise?they shot it down. Oh well. I was pretty much expecting this, but nothing ventured, nothing gained.

On the plus side, things at VSC seem to be moving again, so hopefully it'll soon be a moot point!
