It's hard to say for sure until the official notice comes in the mail. But are the words "termination letter" directly from the email or your own words? Did the words "Notice of Intent to Revoke" appear in the email?

The OP had their petition sent back to USCIS by the consulate after the initial interview. They've been notified that a Notice of Intent to Deny (NOID) is in the mail, though AFAIK they haven't received the hard copy yet.

You were required to notify USCIS of your change of address because you filed an I-864 Affidavit of Support for your husband at the time of AOS.

For the OP, whose I-129F has already been approved but fiance has not yet received a K-1, the system will not accept an online change of address.

If you don't believe me, try it. Go to the USCIS change of address page, click "Yes, this change of address is for a U.S. Citizen." Then click "No, I do not have any Pending Applications or Petitions." You'll get the following message:

If your fiance's case is now at the London embassy, you do not have a petition pending at USCIS?it's already been approved. You don't need to notify them of your change of address.

If you've moved prior to AOS, you'll simply use the new address on the AOS paperwork.

well it never hurts. I doubt you need it for Australia. Also sending all this with the petition does not FORCE anyone to look at anything but they cannot dent they never saw anything later when USCIS reviews their denial. It is one of those things that if you need it, you are already in heap big problems. It is a recovery tool more than anything, seems like. Maybe it helps with some consulates up front. I just do not see Australia or any of the "1st world" low fraud consulates being that way and have never heard of such a thing. Check the consulate reviews.

Agreed. The consulates in developed countries generally don't look at approved K-1s with a presumption of fraud. Certain high-risk, high-fraud consulates do. When dealing with those consulates, many people advise front-loading with everything but the kitchen sink so as to pre-empt any possible reason they might pull out of their hat to throw you into a 221(g) process or deny you outright.

Aside from the "####### consulates," front-loading is probably only necessary if you have major red flags that you need to overcome.

I got my paper NOA2 today!! But I have a question about it, I'm wondering if I'm missing some info? This website: http://travel.state....types_1309.html Says that I'm supposed to have a priority date on my NOA2 paper, but that section on mine is blank. The NOA2 says that "The above petition has been approved, and forwarded to the listed consulate" though it doesn't list a particular consulate anywhere on it (even though I know its Sydney).

It also says its "Valid from 01/25/2012 to 05/25/2012" does this mean it has to be approved completely before then? Is this normal? I've obviously never been to this stage in this process before lol Thanks for any help!

(And yes I have read the guides and did some google searching on the subject but I can't seem to either find or really 'get' the answers to my questions so any straight answers would be most appreciated!)

Ok, I'm the petitioner, and I've read the guides and the flowchart but some of it I still have questions about what to do now. I have a decent idea of what to do but I need to fill in the blanks!

First off:

"*Two weeks after you receive the NOA2 you can contact the NVC to see if they have received your approved I-129F. You can contact them at 603 334-0700. " This is where I call to get my case number, correct? Do I need to call them or will the case number be on some paper they send me? I heard from someone that you actually have to apply for an interview date, so they don't automatically assign you one? Is this the time that you request an interview date or is this after you send back packet 3 with the police reports and medical?

"*This will be sent out within a week (typically less) from when the embassy processes the received petition. This package will include a checklist of items and paperwork that must be collected. Some will be sent back asap, and others will be sent back later or brought to the interview." This is packet 3 correct? Will I get anything in the mail or is it all him from here on out? I know I need to send another letter of intent, my letter from work, my paystubs etc. Is it necessary that I send my tax returns even with my paystubs? How many years back do I need and how do I get them if I don't have them anymore?


That's basically all my questions for now, I look forward to some answers that will make this more clear, thank you :3

So I'm reading the instructions for this form, and it says:

"Evidence should consist of any of the documents listed below that apply to your situation."

Then it lists bank statements for the past year and all that, statements from my employer stating my salary and employment status, then it says IF I am self employed, copy of last income tax return. Does this mean I don't need that since I'm not self employed?

Thank you. I have another question. On this site: http://www.***remove...rtificates.html It says that if you live somewhere in australia for less than 6 months you don't need a police report from that locality, but if you have lived elsewhere in Australia for more than 6months then you will need a police report from that locality. He lived in Adelaide for more than 6 months prior to living in the US with me, and will have lived in Melbourne now for 6 months in mid March. No matter what he needs a police report from Adelaide, but if packet 3 gets sent back before mid march, will he need a police report from Melbourne? Will they ask for it at the interview when most likely he will have been there for at least 6 months? I'm not sure whether he should get both just to be safe.

Also do you have to be in Adelaide to get the police report or can it be sent? Thanks!

He returned to Australia after living in America for a year in Sept 2011. Also, it says something about requiring a police report for any place outside Australia if he live there longer than 12 months. He was in America for a few days shy of 12 months, would he still need one to be safe or do you think it will be ok?

The Aussie one is good for a year, but if you were still in Australia you would need an appt for getting your fingerprints taken...I'm not sure what the rules are when you aren't living there anymore :( Check with Chile's rules, and see what it says if you lived overseas and how long ago, you may not have to get it? (Not sure but my fiance lived here for a year and didn't need to get a police report for here :3) Good luck!

Australia is a low fraud country. Age gaps (with the woman older) aren't super common but they're not against cultural norms so it's no wonder it wasn't denied. I know you were just using it as an example but other high fraud consulates would be a better example. I can't say I've seen too many denials (actually I can't recall any but there may be some I don't know about) out of Australia who are members here on VJ.


I'm one of em :) I'm 4 years older than my fiance, not a huge age gap but my sisters call me a cradle robber anyway :rofl:

I want to send the packet off on friday. However, i have a question on how it should be put together, should i staple? should i use a big clip? should i put it in a brown envelope. How should i package my packet? i know it is pretty basic I just want to make sure it is presented to the USCIS in a fashion that is acceptable to them. I followed the guide on what to put in, filled out the documents, I just dont now how to wrap it up.

No I saw that, and I had a family member who is a lawyer look at my paper work. I just thought there were locations for every state not just Texas. In the letter of intent it wants me to put the filing office, would that also be Texas?

Hey All, so Its been 6 months since I sent off my petition and So i am hoping that it will be close to the time that we will get a response. Already my Fiance took an 8 hour train down to Moscow to get her medical exam.

I am filling out my I-134, but I already know I dont make enough money for the support, but my dad said he will co sign. and he makes more than enough for it. How do we go about co-signing, do we both fill out a form, does he only fill out a form? thanks for taking the time to help!

Hey All,

 

So we received from the USCIS our NOA2, and I have been working on the support document. It has 25 pages long, including my I-134, and a Cosigned I-134 from my dad is who cosigning. I have also attached ( I didnt a cover letter for it, looks just like the example cover letter for the 129F. 

 

But it has both fo our I-134's, It has Statements from the bank stamped and signed by the Bank officer. (for both my father and I) letters from our employerers, and both of our birth certificate. My question is, should I also attach both of our W2s and Pay stubs?

My father is Cosigning my Affidavit of Support, And we both have done the I-134A plus statments from work, and Bank officer as well as our W-2s and Photo Copies of our Birth Certificate. And the file I am sending my Fiance is 27 Pages long.

 

 

Is that normal? did i do too much?

I feel so blessed that this website exists! because of all of you no RFEs at all :) One question about the NOA2 however. It says pretty much the same thing as what the USCIS said online about my petition...That it is approved. That is wonderful, but It also keeps saying Consulate instead of Embassy....I was under the impression she(My Fiance) would have her interview at the Embassy in Moscow not the consulate in Saint petersburg. Is it just poor word choice or does that mean she will have her interview at the consulate?
